This law was first created in 1987. The record of its establishment is cataloged in chapter 234 of that year\u2019s edition of \u201cActs of Assembly,\u201d the annual state publication listing all changes made to the Code of Virginia in that year. Unfortunately, the 1987 \u201cActs\u201d aren\u2019t available online. It has been modified 3 times. Those modifications are cataloged by \u201cThe Acts of Assembly,\u201d a state publication, by year and chapter. Beneficial use products are produced by facilities\nthat include beneficiation facilities and recycling centers.\n\t\t“Beneficiation facility” means a facility that uses methods\nincluding sorting by color, removal of contaminants, crushing, grinding,\nscreening, grading, and monitoring of size and quality to produce clean, crushed\nglass cullet that satisfies the specifications of the end user of the cullet,\nincluding a manufacturer of glass containers or fiberglass.\n\t\t“Disposable package” or “container” means all packages\nor containers intended or used to contain solids, liquids or materials and so\ndesignated.\n\t\t“Expanded polystyrene food service container” means a rigid\nsingle-use container made primarily of expanded polystyrene and used in the\nrestaurant and food service industry for serving or transporting prepared,\nready-to-consume food or beverages. “Expanded polystyrene food service\ncontainer” includes plates, cups, bowls, trays, and hinged containers but\ndoes not include packaging for unprepared foods or packaging, including a\ncooler, used in the shipment of food.\n\t\t“Food vendor” means an establishment that provides prepared food\nfor public consumption on or off its premises and includes a store, shop, sales\noutlet, restaurant, grocery store, supermarket, delicatessen, or catering truck\nor vehicle; any other person who provides prepared food; and any individual,\norganization, group, or state or local government entity that regularly provides\nfood as a part of its services.\n\t\t“Fund” means the Litter Control and Recycling Fund.\n\t\t“Litter” means all waste material disposable packages or\ncontainers but not including the wastes of the primary processes of mining,\nlogging, sawmilling, farming, or manufacturing.\n\t\t“Litter bag” means a bag, sack, or durable material which is large\nenough to serve as a receptacle for litter inside a vehicle or watercraft which\nis similar in size and capacity to a state approved litter bag.\n\t\t“Litter receptacle” means containers acceptable to the Department\nfor the depositing of litter.\n\t\t“Person” means any natural person, corporation, association, firm,\nreceiver, guardian, trustee, executor, administrator, fiduciary, or\nrepresentative or group of individuals or entities of any kind.\n\t\t“Prepared food” means a food or beverage prepared for consumption\non or off a food vendor’s premises, using any cooking or food preparation\ntechnique. “Prepared food” does not include raw or uncooked meat,\nfish, or eggs provided without further food preparation.\n\t\t“Public place” means any area that is used or held out for use by\nthe public, whether owned or operated by public or private interests.\n\t\t“Recycling” means the process of separating a given waste material\nfrom the waste stream and processing it so that it may be used again as a raw\nmaterial for a product which may or may not be similar to the original product.\n\t\t“Recycling center” means a facility that (i) accepts recyclable\nmaterials that have already been separated at the source from municipal solid\nwaste generated by either residential or commercial producers; (ii) processes\nsource segregated recyclable materials, including mixed-paper fiber materials,\nmetal and plastic postconsumer containers, and glass containers; and (iii)\nprocesses and sells recyclable materials according to end-user specifications.\n“Recycling center” does not include a facility for construction and\ndemolition debris processing, sorting of municipal solid waste, incineration,\nsorting or processing of industrial waste, composting, or used tire processing.\n\t\t“Sold within the Commonwealth” or “sales of the business\nwithin the Commonwealth” means all sales of retailers engaged in business\nwithin the Commonwealth and in the case of manufacturers and wholesalers, sales\nof products for use and consumption within the Commonwealth.\n\t\t“Vehicle” includes every device capable of being moved upon a\npublic highway and in, upon, or by which any person or property may be\ntransported upon a public highway, except devices moved by human power or used\nexclusively upon stationary rails or tracks.\n\t\t“Watercraft” means any boat, ship, vessel, barge, or other\nfloating craft.\n\nHISTORY: 1987, c. 234, \u00a7 10-277.1; 1988, c. 891; 1995, c. 417; 2018, c. 615;\n2021, Sp.
