The clerk of the county shall cause a notice of such election to be published in a newspaper published in or having a general circulation in the county, once a week for three consecutive weeks, and shall post a copy of such notice at the door of the courthouse of the county.B\n\nThe regular election officers of the county at the time designated in the order authorizing the vote shall open the polls at the various voting places in the county and conduct the election in such manner as is provided by law for other elections, insofar as the same is applicable. The election shall be by ballot, and the ballots shall be prepared by the electoral board and distributed to the various election precincts as in other elections. If it appears by the report of the commissioners of election that a majority of the qualified <span class=\"dictionary\">voters<\/span> of the <span class=\"dictionary\">county<\/span> voting approve the adoption of the <span class=\"dictionary\">county<\/span>&#8217;s <span class=\"dictionary\">board of supervisors<\/span> being elected from magisterial districts and the chairman being elected from the <span class=\"dictionary\">county<\/span> at large, the <span class=\"dictionary\">circuit<\/span> <span class=\"dictionary\">court<\/span> of the <span class=\"dictionary\">county<\/span>, or the <span class=\"dictionary\">judge<\/span> thereof in vacation, shall enter of record such <span class=\"dictionary\">fact<\/span>. <a id=\"paragraph-276321\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/15.2-1212\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> At the next succeeding election, following approval of the plan provided for herein, at which the <span class=\"dictionary\">county<\/span>&#8217;s <span class=\"dictionary\">board of supervisors<\/span> are to be elected, the form of organization of such <span class=\"dictionary\">county<\/span>&#8217;s <span class=\"dictionary\">board of supervisors<\/span> shall be in accordance with the form provided for herein. <a id=\"paragraph-276322\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/15.2-1212\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> All <span class=\"dictionary\">county<\/span> and district officers of such <span class=\"dictionary\">county<\/span>, unless otherwise sooner removed, shall continue to hold office until their successors are elected and have qualified. <a id=\"paragraph-276323\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/15.2-1212\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> A <span class=\"dictionary\">referendum<\/span> as described in this section to revert to the former method of electing the chairman and supervisors may be conducted upon a resolution of the <span class=\"dictionary\">board of supervisors<\/span> as provided in this section. In lieu of such resolution by the <span class=\"dictionary\">board of supervisors<\/span>, a <span class=\"dictionary\">referendum<\/span> as described in this section may be conducted upon a <span class=\"dictionary\">petition<\/span> filed with the <span class=\"dictionary\">circuit<\/span> <span class=\"dictionary\">court<\/span> of the <span class=\"dictionary\">county<\/span>, or the <span class=\"dictionary\">judge<\/span> thereof in vacation, and signed by 10 percent of the qualified <span class=\"dictionary\">voters<\/span> of such <span class=\"dictionary\">county<\/span> requesting such <span class=\"dictionary\">referendum<\/span>, and the <span class=\"dictionary\">court<\/span> or the <span class=\"dictionary\">judge<\/span> shall proceed as in the case of a resolution by the <span class=\"dictionary\">board of supervisors<\/span>. <a id=\"paragraph-276324\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/15.2-1212\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nFREDERICK COUNTY; RESOLUTION OF BOARD OF SUPERVISORS; REFERENDUM; ELECTION (\u00a7\n15.2-1212)\n\nA. Upon resolution passed by the board of supervisors of Frederick County and\nfiled with the circuit court asking for a referendum on the question of\nFrederick County being governed by a board of supervisors, one or more elected\nfrom each magisterial district and a chairman elected from the county at large,\nthe court shall by order entered of record, require the regular election\nofficials at the November 1974 regular election to open a poll and take the\nsense of the qualified voters of the county on the question submitted as herein\nprovided. The clerk of the county shall cause a notice of such election to be\npublished in a newspaper published in or having a general circulation in the\ncounty, once a week for three consecutive weeks, and shall post a copy of such\nnotice at the door of the courthouse of the county.\n\nB. The regular election officers of the county at the time designated in the\norder authorizing the vote shall open the polls at the various voting places in\nthe county and conduct the election in such manner as is provided by law for\nother elections, insofar as the same is applicable. The election shall be by\nballot, and the ballots shall be prepared by the electoral board and distributed\nto the various election precincts as in other elections. The ballots used shall\nbe printed to read as follows:\n\t\t\t&#8220;Do you approve the adoption of the county&#8217;s board of supervisors\nbeing elected by magisterial districts and the chairman elected from the county\nat large?\n\t\t\t[ ] Yes\n\t\t\t[ ] No&#8221;\n\t\t\tThe squares to be printed in such ballots shall not be less than one-quarter\nnor more than one-half inch in size.\n\t\t\tAny person voting at such election shall place a () or a cross (X) or (+)\nmark or a line (-) in the square before the appropriate word indicating how he\ndesires to vote on the question submitted.\n\t\t\tThe ballots shall be counted, returns made and canvassed as in other\nelections, and the results certified by the commissioners of election to the\ncircuit court, and the circuit court, or the judge thereof in vacation, shall\nenter of record the results of the election.
