No setback, lot area, hours of operation or noise requirements may be more restrictive than similar provisions for other agricultural structures or activities. <a id=\"paragraph-229734\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/15.2-2288.01\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nLOCALITIES SHALL NOT REQUIRE A SPECIAL USE PERMIT FOR CERTAIN SMALL-SCALE\nCONVERSION OF BIOMASS TO ALTERNATIVE FUEL (\u00a7 15.2-2288.01)\n\nA. As used in this section, unless the context requires a different meaning:\n\t\t\t&#8220;Biomass&#8221; means agricultural-related materials including\nvineyard, grain or crop residues; straws; aquatic plants; and crops and trees\nplanted for energy production.\n\t\t\t&#8220;Small-scale conversion of biomass&#8221; means the conversion of any\nrenewable biomass into heat, power, or biofuels.\n\nB. A zoning ordinance shall not require that a special exception or special use\npermit be obtained for the small-scale conversion of biomass if: (i) at least 50\npercent of the feedstock is produced either on site or by the owner of the\nconversion equipment; (ii) any structure used for the processing of the\nfeedstock into energy occupies less than 4,000 square feet, not including the\nspace required for storage of feedstock; and (iii) the owner of the farm\nnotifies the administrative head of the locality in which the processing occurs.\nLocalities may adopt reasonable requirements for setback, minimum lot area, and\nrestrictions on the hours of operation and maximum noise levels applicable to\nthe small-scale conversion of biomass.
