Any locality may, by ordinance, provide that:\n\n   1. No landowner shall allow running bamboo to grow without proper upkeep and\n   appropriate containment measures, including barriers or trenching; and\n\n   2. No landowner shall allow running bamboo to spread from his property to any\n   public right-of-way or adjoining property not owned by the landowner.\n\nC. A violation of a running bamboo ordinance authorized by this section shall be\nsubject to a civil penalty, not to exceed $50 for the first violation or\nviolations arising from the same set of operative facts. The civil penalty for\nsubsequent violations not arising from the same set of operative facts within 12\nmonths of the first violation shall not exceed $200. Each business day during\nwhich the same violation is found to have existed shall constitute a separate\noffense. In no event shall a series of specified violations arising from the\nsame set of operative facts result in civil penalties that exceed a total of\n$3,000 in a 12-month period.\n\nD. No violation of a running bamboo ordinance arising from the same set of\noperative facts shall be subject to a civil penalty under both (i) an ordinance\nadopted pursuant to this section and (ii) an ordinance adopted pursuant to\n&#xA7; 15.2-901.\n\nHISTORY: 2017, cc. 213, 392.","edition":{"id":1,"name":"2025","slug":"2025","date_created":"2026-06-21 22:39:22","date_modified":"2026-06-21 22:39:22","current":1,"order_by":1,"last_import":null}}
