The plan shall set forth the proposed reorganization and the provisions of law or the rules, regulations or standards that prohibit or restrict the implementation of such proposed reorganization.B\n\nThe Governor shall prepare, and provide to those counties and cities which request them, guidelines for the preparation and submission to him of reorganization plans by a city or county. The Governor may consider only those reorganization plans adopted by resolution of the governing body of the city or county applying for approval to reorganize its human services agencies.C\n\nThe several state boards and commissions which are empowered to promulgate rules, regulations and guidelines affecting the organization or administration of local human service agencies are hereby authorized to modify their respective rules, regulations and guidelines at the direction of the Governor in furtherance of any reorganization plan approved by him.D\n\nIf a provision or provisions of law prohibit or restrict the implementation of all or part of such reorganization plan the Governor shall transmit such plan or such parts of such plan affected by such laws to each House of the General Assembly at least 45 days prior to the commencement of a regular or special session of the General Assembly. The plan shall set forth the proposed reorganization and the provisions of <span class=\"dictionary\">law<\/span> or the rules, regulations or standards that prohibit or restrict the implementation of such proposed reorganization. <a id=\"paragraph-263724\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/15.2-964\/#A\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> The Governor shall prepare, and provide to those counties and cities which request them, guidelines for the preparation and submission to him of reorganization plans by a <span class=\"dictionary\">city<\/span> or <span class=\"dictionary\">county<\/span>. The Governor may consider only those reorganization plans adopted by resolution of the <span class=\"dictionary\">governing body<\/span> of the <span class=\"dictionary\">city<\/span> or <span class=\"dictionary\">county<\/span> applying for approval to reorganize its human services agencies. <a id=\"paragraph-263725\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/15.2-964\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> The several state boards and commissions which are empowered to promulgate rules, regulations and guidelines affecting the organization or administration of local human service agencies are hereby authorized to modify their respective rules, regulations and guidelines at the direction of the Governor in furtherance of any reorganization plan approved by him. <a id=\"paragraph-263726\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/15.2-964\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> If a provision or provisions of <span class=\"dictionary\">law<\/span> prohibit or restrict the implementation of all or part of such reorganization plan the Governor shall transmit such plan or such parts of such plan affected by such <span class=\"dictionary\">laws<\/span> to each House of the General Assembly at least 45 days prior to the commencement of a regular or special session of the General Assembly. Such plan or portions of such plan so transmitted by the Governor under this section shall not become effective unless it is introduced by bill and enacted into <span class=\"dictionary\">law<\/span>. <a id=\"paragraph-263727\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/15.2-964\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> The plan or such portions of the plan transmitted by the Governor to the General Assembly shall set forth: (i) the provision or provisions of <span class=\"dictionary\">law<\/span> that prohibit or restrict the implementation of such plan or parts of such plan; (ii) the changes in governmental structure or administrative procedure system of the human resources agencies affected; and (iii) the anticipated effects of such changes upon the efficiency and effectiveness of the agencies affected. <a id=\"paragraph-263728\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/15.2-964\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> Any reorganization authorized under the provision of this section shall be implemented within appropriations or other funds which may be made available to the <span class=\"dictionary\">city<\/span> or <span class=\"dictionary\">county<\/span> requesting such reorganization approval. <a id=\"paragraph-263729\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/15.2-964\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> Nothing in this section shall be interpreted to permit a <span class=\"dictionary\">city<\/span> or <span class=\"dictionary\">county<\/span> to eliminate the provision of any service required by <span class=\"dictionary\">law<\/span> or to reduce the level of service below any level required by <span class=\"dictionary\">law<\/span>. <a id=\"paragraph-263730\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/15.2-964\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"H\"><p><span class=\"prefix-number\">H.<\/span> The localities shall be required to maintain financial and statistical records in accordance with the guidelines issued by the Governor so as to allow responsible state agencies to review records and determine costs for programs for which the agency is responsible. <a id=\"paragraph-263731\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/15.2-964\/#H\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I\"><p><span class=\"prefix-number\">I.<\/span> For the purposes of this section the term &#8220;<span class=\"dictionary\">human resource agencies<\/span>&#8221; means agencies that deliver social, employment, health, mental health and developmental, rehabilitation, nursing, or information and referral services and such other related services. <a id=\"paragraph-263732\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/15.2-964\/#I\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nORGANIZATION OF LOCAL HUMAN SERVICES ACTIVITIES; AUTHORIZATION OF REORGANIZATION\nBY GOVERNOR (\u00a7 15.2-964)\n\nA.
