Sess. I, c. 188; 2025, c. 261.","full_text":"A\n\nThe Commission shall adopt an initial set of discretionary felony sentencing guidelines which shall become effective on January 1, 1995. The initial recommended sentencing range for each felony offense shall be determined first, by computing the actual time-served distribution for similarly situated offenders, in terms of their conviction offense and prior criminal history, released from incarceration during the base period of calendar years 1988 through 1992, increased by 13.4 percent, and second, by eliminating from this range the upper and lower quartiles. The midpoint of each initial recommended sentencing range shall be the median time served for the middle two quartiles and subject to the following additional enhancements:1\n\nThe midpoint of the initial recommended sentencing range for first degree murder, second degree murder, rape in violation of &#xA7; 18.2-61, forcible sodomy, object sexual penetration, and aggravated sexual battery shall be further increased by (i) 125 percent in cases in which the defendant has no previous conviction of a violent felony offense; (ii) 300 percent in cases in which the defendant has previously been convicted of a violent felony offense punishable by a maximum punishment of less than 40 years; or (iii) 500 percent in cases in which the defendant has previously been convicted of a violent felony offense punishable by a maximum punishment of 40 years or more, except that the recommended sentence for a defendant convicted of first degree murder who has previously been convicted of a violent felony offense punishable by a maximum term of imprisonment of 40 years or more shall be imprisonment for life;2\n\nThe midpoint of the initial recommended sentencing range for voluntary manslaughter, robbery, aggravated malicious wounding, malicious wounding, and any burglary of a dwelling house or statutory burglary of a dwelling house or any burglary committed while armed with a deadly weapon or any statutory burglary committed while armed with a deadly weapon shall be further increased by (i) 100 percent in cases in which the defendant has no previous conviction of a violent felony offense, (ii) 300 percent in cases in which the defendant has previously been convicted of a violent felony offense punishable by a maximum term of imprisonment of less than 40 years, or (iii) 500 percent in cases in which the defendant has previously been convicted of a violent felony offense punishable by a maximum term of imprisonment of 40 years or more;3\n\nThe midpoint of the initial recommended sentencing range for manufacturing, selling, giving, or distributing, or possessing with the intent to manufacture, sell, give, or distribute a Schedule I or II controlled substance, shall be increased by (i) 200 percent in cases in which the defendant has previously been convicted of a violent felony offense punishable by a maximum punishment of less than 40 years or (ii) 400 percent in cases in which the defendant has previously been convicted of a violent felony offense punishable by a maximum term of imprisonment of 40 years or more; and4\n\nThe midpoint of the initial recommended sentencing range for felony offenses not specified in subdivision 1, 2, or 3 shall be increased by 100 percent in cases in which the defendant has previously been convicted of a violent felony offense punishable by a maximum punishment of less than 40 years and by 300 percent in cases in which the defendant has previously been convicted of a violent felony offense punishable by a maximum term of imprisonment of 40 years or more.B\n\nFor purposes of this chapter, previous convictions shall include prior adult convictions and juvenile convictions and adjudications of delinquency based on an offense which would have been at the time of conviction a felony if committed by an adult under the laws of any state, the District of Columbia, or the United States or its territories.C\n\nFor purposes of this chapter, violent felony offenses shall include any felony violation of &#xA7; 16.1-253.2; solicitation to commit murder under &#xA7; 18.2-29; any violation of &#xA7; 18.2-31, 18.2-32, 18.2-32.1, 18.2-32.2, 18.2-33, or 18.2-35; any violation of subsection B of &#xA7; 18.2-36.1; any violation of &#xA7; 18.2-40 or 18.2-41; any violation of clause (c)(i) or (ii) of subsection B of &#xA7; 18.2-46.3; any violation of &#xA7; 18.2-46.5, 18.2-46.6, or 18.2-46.7; any Class 5 felony violation of &#xA7; 18.2-47; any felony violation of &#xA7; 18.2-48, 18.2-48.1, or 18.2-49; any violation of &#xA7; 18.2-51, 18.2-51.1, 18.2-51.2, 18.2-51.3, 18.2-51.4, 18.2-51.6, 18.2-52, 18.2-52.1, 18.2-53, 18.2-53.1, 18.2-54.1, 18.2-54.2, or 18.2-55; any violation of subsection B of &#xA7; 18.2-57; any felony violation of &#xA7; 18.2-57.2; any violation of &#xA7; 18.2-58 or 18.2-58.1; any felony violation of &#xA7; 18.2-60.1, 18.2-60.3, or 18.2-60.4; any violation of &#xA7; 18.2-61, 18.2-64.1, 18.2-67.1, 18.2-67.2, former &#xA7; 18.2-67.2:1, 18.2-67.3, 18.2-67.5, or 18.2-67.5:1 involving a third conviction of either sexual battery in violation of &#xA7; 18.2-67.4 or attempted sexual battery in violation of subsection C of &#xA7; 18.2-67.5; any Class 4 felony violation of &#xA7; 18.2-63; any violation of subsection A of &#xA7; 18.2-67.4:1; any violation of subsection A of &#xA7; 18.2-77; any Class 3 felony violation of &#xA7; 18.2-79; any Class 3 felony violation of &#xA7; 18.2-80; any violation of &#xA7; 18.2-85, 18.2-89, 18.2-90, 18.2-91, 18.2-92, or 18.2-93; any felony violation of &#xA7; 18.2-152.7; any Class 4 felony violation of &#xA7; 18.2-153; any Class 4 felony violation of &#xA7; 18.2-154; any Class 4 felony violation of &#xA7; 18.2-155; any felony violation of &#xA7; 18.2-162; <a class=\"law\" title=\"Rape\" href=\"\/18.2-61\/\">18.2-61<\/a>, forcible sodomy, <span class=\"dictionary\">object<\/span> sexual penetration, and aggravated sexual <span class=\"dictionary\">battery<\/span> shall be further increased by (i) 125 percent in cases in which the <span class=\"dictionary\">defendant<\/span> has no previous <span class=\"dictionary\">conviction<\/span> of a violent <span class=\"dictionary\">felony<\/span> <span class=\"dictionary\">offense<\/span>; (ii) 300 percent in cases in which the <span class=\"dictionary\">defendant<\/span> has previously been convicted of a violent <span class=\"dictionary\">felony<\/span> <span class=\"dictionary\">offense<\/span> punishable by a maximum punishment of less than 40 years; or (iii) 500 percent in cases in which the <span class=\"dictionary\">defendant<\/span> has previously been convicted of a violent <span class=\"dictionary\">felony<\/span> <span class=\"dictionary\">offense<\/span> punishable by a maximum punishment of 40 years or more, except that the recommended sentence for a <span class=\"dictionary\">defendant<\/span> convicted of first degree <span class=\"dictionary\">murder<\/span> who has previously been convicted of a violent <span class=\"dictionary\">felony<\/span> <span class=\"dictionary\">offense<\/span> punishable by a maximum term of imprisonment of 40 years or more shall be imprisonment for life; <a id=\"paragraph-287285\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/17.1-805\/#A1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> The midpoint of the initial recommended sentencing range for voluntary <span class=\"dictionary\">manslaughter<\/span>, <span class=\"dictionary\">robbery<\/span>, aggravated <span class=\"dictionary\">malicious<\/span> wounding, <span class=\"dictionary\">malicious<\/span> wounding, and any <span class=\"dictionary\">burglary<\/span> of a dwelling house or statutory <span class=\"dictionary\">burglary<\/span> of a dwelling house or any <span class=\"dictionary\">burglary<\/span> committed while armed with a deadly weapon or any statutory <span class=\"dictionary\">burglary<\/span> committed while armed with a deadly weapon shall be further increased by (i) 100 percent in cases in which the <span class=\"dictionary\">defendant<\/span> has no previous <span class=\"dictionary\">conviction<\/span> of a violent <span class=\"dictionary\">felony<\/span> <span class=\"dictionary\">offense<\/span>, (ii) 300 percent in cases in which the <span class=\"dictionary\">defendant<\/span> has previously been convicted of a violent <span class=\"dictionary\">felony<\/span> <span class=\"dictionary\">offense<\/span> punishable by a maximum term of imprisonment of less than 40 years, or (iii) 500 percent in cases in which the <span class=\"dictionary\">defendant<\/span> has previously been convicted of a violent <span class=\"dictionary\">felony<\/span> <span class=\"dictionary\">offense<\/span> punishable by a maximum term of imprisonment of 40 years or more; <a id=\"paragraph-287286\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/17.1-805\/#A2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> The midpoint of the initial recommended sentencing range for manufacturing, selling, giving, or distributing, or possessing with the <span class=\"dictionary\">intent<\/span> to manufacture, sell, give, or distribute a Schedule I or II controlled substance, shall be increased by (i) 200 percent in cases in which the <span class=\"dictionary\">defendant<\/span> has previously been convicted of a violent <span class=\"dictionary\">felony<\/span> <span class=\"dictionary\">offense<\/span> punishable by a maximum punishment of less than 40 years or (ii) 400 percent in cases in which the <span class=\"dictionary\">defendant<\/span> has previously been convicted of a violent <span class=\"dictionary\">felony<\/span> <span class=\"dictionary\">offense<\/span> punishable by a maximum term of imprisonment of 40 years or more; and <a id=\"paragraph-287287\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/17.1-805\/#A3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> The midpoint of the initial recommended sentencing range for <span class=\"dictionary\">felony<\/span> <span class=\"dictionary\">offenses<\/span> not specified in subdivision 1, 2, or 3 shall be increased by 100 percent in cases in which the <span class=\"dictionary\">defendant<\/span> has previously been convicted of a violent <span class=\"dictionary\">felony<\/span> <span class=\"dictionary\">offense<\/span> punishable by a maximum punishment of less than 40 years and by 300 percent in cases in which the <span class=\"dictionary\">defendant<\/span> has previously been convicted of a violent <span class=\"dictionary\">felony<\/span> <span class=\"dictionary\">offense<\/span> punishable by a maximum term of imprisonment of 40 years or more. <a id=\"paragraph-287288\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/17.1-805\/#A4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> For purposes of this chapter, previous <span class=\"dictionary\">convictions<\/span> shall include prior adult <span class=\"dictionary\">convictions<\/span> and juvenile <span class=\"dictionary\">convictions<\/span> and adjudications of delinquency based on an <span class=\"dictionary\">offense<\/span> which would have been at the time of <span class=\"dictionary\">conviction<\/span> a <span class=\"dictionary\">felony<\/span> if committed by an adult under the <span class=\"dictionary\">laws<\/span> of any state, the District of Columbia, or the United States or its territories. <a id=\"paragraph-287289\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/17.1-805\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> For purposes of this chapter, violent <span class=\"dictionary\">felony<\/span> <span class=\"dictionary\">offenses<\/span> shall include any <span class=\"dictionary\">felony<\/span> violation of &#xA7; <a class=\"law\" title=\"Violation of provisions of protective orders; penalties\" href=\"\/16.1-253.2\/\">16.1-253.2<\/a>; solicitation to commit <span class=\"dictionary\">murder<\/span> under &#xA7; <a class=\"law\" title=\"Criminal solicitation; penalty\" href=\"\/18.2-29\/\">18.2-29<\/a>; any violation of &#xA7; <a class=\"law\" title=\"Aggravated murder defined; punishment\" href=\"\/18.2-31\/\">18.2-31<\/a>, <a class=\"law\" title=\"First and second degree murder defined; punishment\" href=\"\/18.2-32\/\">18.2-32<\/a>, <a class=\"law\" title=\"Murder of a pregnant woman; penalty\" href=\"\/18.2-32.1\/\">18.2-32.1<\/a>, <a class=\"law\" title=\"Killing a fetus; penalty\" href=\"\/18.2-32.2\/\">18.2-32.2<\/a>, <a class=\"law\" title=\"Felony homicide defined; punishment\" href=\"\/18.2-33\/\">18.2-33<\/a>, or <a class=\"law\" title=\"How voluntary manslaughter punished\" href=\"\/18.2-35\/\">18.2-35<\/a>; any violation of subsection B of &#xA7; <a class=\"law\" title=\"Certain conduct punishable as involuntary manslaughter\" href=\"\/18.2-36.1\/\">18.2-36.1<\/a>; any violation of &#xA7; <a class=\"law\" title=\"Lynching deemed murder\" href=\"\/18.2-40\/\">18.2-40<\/a> or <a class=\"law\" title=\"Shooting, stabbing, etc., with intent to maim, kill, etc., by mob\" href=\"\/18.2-41\/\">18.2-41<\/a>; any violation of clause (c)(i) or (ii) of subsection B of &#xA7; <a class=\"law\" title=\"Recruitment of persons for criminal street gang; penalty\" href=\"\/18.2-46.3\/\">18.2-46.3<\/a>; any violation of &#xA7; <a class=\"law\" title=\"Committing, conspiring and aiding and abetting acts of terrorism prohibited; penalty\" href=\"\/18.2-46.5\/\">18.2-46.5<\/a>, <a class=\"law\" title=\"Possession, manufacture, distribution, etc., of weapon of terrorism or hoax device prohibited; penalty\" href=\"\/18.2-46.6\/\">18.2-46.6<\/a>, or <a class=\"law\" title=\"Act of bioterrorism against agricultural crops or animals; penalty\" href=\"\/18.2-46.7\/\">18.2-46.7<\/a>; any Class 5 <span class=\"dictionary\">felony<\/span> violation of &#xA7; <a class=\"law\" title=\"Abduction and kidnapping defined; forced labor; punishment\" href=\"\/18.2-47\/\">18.2-47<\/a>; any <span class=\"dictionary\">felony<\/span> violation of &#xA7; <a class=\"law\" title=\"Abduction with intent to extort money or for immoral purpose\" href=\"\/18.2-48\/\">18.2-48<\/a>, <a class=\"law\" title=\"Abduction by prisoners or committed persons; penalty\" href=\"\/18.2-48.1\/\">18.2-48.1<\/a>, or <a class=\"law\" title=\"Threatening, attempting, or assisting in such abduction; penalty\" href=\"\/18.2-49\/\">18.2-49<\/a>; any violation of &#xA7; <a class=\"law\" title=\"Shooting, stabbing, etc., with intent to maim, kill, etc\" href=\"\/18.2-51\/\">18.2-51<\/a>, <a class=\"law\" title=\"Malicious bodily injury to law-enforcement officers, firefighters, search and rescue personnel, or emergency medical services personnel; penalty; lesser-included offense\" href=\"\/18.2-51.1\/\">18.2-51.1<\/a>, <a class=\"law\" title=\"Aggravated malicious wounding; penalty\" href=\"\/18.2-51.2\/\">18.2-51.2<\/a>, <a class=\"law\" title=\"Prohibition against reckless endangerment of others by throwing objects from places higher than one story; penalty\" href=\"\/18.2-51.3\/\">18.2-51.3<\/a>, <a class=\"law\" title=\"Maiming, etc., of another resulting from driving while intoxicated\" href=\"\/18.2-51.4\/\">18.2-51.4<\/a>, <a class=\"law\" title=\"Strangulation or suffocation of another; penalty\" href=\"\/18.2-51.6\/\">18.2-51.6<\/a>, <a class=\"law\" title=\"Malicious bodily injury by means of any caustic substance or agent or use of any explosive or fire\" href=\"\/18.2-52\/\">18.2-52<\/a>, <a class=\"law\" title=\"Possession of infectious biological substances or radiological agents; penalties\" href=\"\/18.2-52.1\/\">18.2-52.1<\/a>, <a class=\"law\" title=\"Shooting, etc., in committing or attempting a felony\" href=\"\/18.2-53\/\">18.2-53<\/a>, <a class=\"law\" title=\"Use or display of firearm in committing felony\" href=\"\/18.2-53.1\/\">18.2-53.1<\/a>, <a class=\"law\" title=\"Attempts to poison\" href=\"\/18.2-54.1\/\">18.2-54.1<\/a>, <a class=\"law\" title=\"Adulteration of food, drink, drugs, cosmetics, etc.; penalty\" href=\"\/18.2-54.2\/\">18.2-54.2<\/a>, or <a class=\"law\" title=\"Bodily injuries caused by prisoners, state juvenile probationers and state and local adult probationers or adult parolees\" href=\"\/18.2-55\/\">18.2-55<\/a>; any violation of subsection B of &#xA7; <a class=\"law\" title=\"Assault and battery; penalty\" href=\"\/18.2-57\/\">18.2-57<\/a>; any <span class=\"dictionary\">felony<\/span> violation of &#xA7; <a class=\"law\" title=\"Assault and battery against a family or household member; penalty\" href=\"\/18.2-57.2\/\">18.2-57.2<\/a>; any violation of &#xA7; <a class=\"law\" title=\"Robbery; penalties\" href=\"\/18.2-58\/\">18.2-58<\/a> or <a class=\"law\" title=\"Carjacking; penalty\" href=\"\/18.2-58.1\/\">18.2-58.1<\/a>; any <span class=\"dictionary\">felony<\/span> violation of &#xA7; <a class=\"law\" title=\"Threatening the Governor or his immediate family\" href=\"\/18.2-60.1\/\">18.2-60.1<\/a>, <a class=\"law\" title=\"Stalking; penalty\" href=\"\/18.2-60.3\/\">18.2-60.3<\/a>, or <a class=\"law\" title=\"Violation of protective orders; penalty\" href=\"\/18.2-60.4\/\">18.2-60.4<\/a>; any violation of &#xA7; <a class=\"law\" title=\"Rape\" href=\"\/18.2-61\/\">18.2-61<\/a>, <a class=\"law\" title=\"Carnal knowledge of certain minors\" href=\"\/18.2-64.1\/\">18.2-64.1<\/a>, <a class=\"law\" title=\"Forcible sodomy\" href=\"\/18.2-67.1\/\">18.2-67.1<\/a>, <a class=\"law\" title=\"Object sexual penetration; penalty\" href=\"\/18.2-67.2\/\">18.2-67.2<\/a>, former &#xA7; <a class=\"law\" title=\"Repealed\" href=\"\/18.2-67.2_1\/\">18.2-67.2:1<\/a>, <a class=\"law\" title=\"Aggravated sexual battery; penalty\" href=\"\/18.2-67.3\/\">18.2-67.3<\/a>, <a class=\"law\" title=\"Attempted rape, forcible sodomy, object sexual penetration, aggravated sexual battery, and sexual battery\" href=\"\/18.2-67.5\/\">18.2-67.5<\/a>, or <a class=\"law\" title=\"Punishment upon conviction of third misdemeanor offense\" href=\"\/18.2-67.5_1\/\">18.2-67.5:1<\/a> involving a third <span class=\"dictionary\">conviction<\/span> of either sexual <span class=\"dictionary\">battery<\/span> in violation of &#xA7; <a class=\"law\" title=\"Sexual battery\" href=\"\/18.2-67.4\/\">18.2-67.4<\/a> or attempted sexual <span class=\"dictionary\">battery<\/span> in violation of subsection C of &#xA7; <a class=\"law\" title=\"Attempted rape, forcible sodomy, object sexual penetration, aggravated sexual battery, and sexual battery\" href=\"\/18.2-67.5\/\">18.2-67.5<\/a>; any Class 4 <span class=\"dictionary\">felony<\/span> violation of &#xA7; <a class=\"law\" title=\"Carnal knowledge of child between thirteen and fifteen years of age\" href=\"\/18.2-63\/\">18.2-63<\/a>; any violation of subsection A of &#xA7; <a class=\"law\" title=\"Infected sexual battery; penalty\" href=\"\/18.2-67.4_1\/\">18.2-67.4:1<\/a>; any violation of subsection A of &#xA7; <a class=\"law\" title=\"Burning or destroying dwelling house, etc\" href=\"\/18.2-77\/\">18.2-77<\/a>; any Class 3 <span class=\"dictionary\">felony<\/span> violation of &#xA7; <a class=\"law\" title=\"Burning or destroying meeting house, etc\" href=\"\/18.2-79\/\">18.2-79<\/a>; any Class 3 <span class=\"dictionary\">felony<\/span> violation of &#xA7; <a class=\"law\" title=\"Burning or destroying any other building or structure\" href=\"\/18.2-80\/\">18.2-80<\/a>; any violation of &#xA7; <a class=\"law\" title=\"Manufacture, possession, use, etc., of fire bombs or explosive materials or devices; penalties\" href=\"\/18.2-85\/\">18.2-85<\/a>, <a class=\"law\" title=\"Burglary; how punished\" href=\"\/18.2-89\/\">18.2-89<\/a>, <a class=\"law\" title=\"Entering dwelling house, etc., with intent to commit murder, rape, robbery or arson; penalty\" href=\"\/18.2-90\/\">18.2-90<\/a>, <a class=\"law\" title=\"Entering dwelling house, etc., with intent to commit larceny, assault and battery or other felony\" href=\"\/18.2-91\/\">18.2-91<\/a>, <a class=\"law\" title=\"Breaking and entering dwelling house with intent to commit other misdemeanor\" href=\"\/18.2-92\/\">18.2-92<\/a>, or <a class=\"law\" title=\"Entering bank, armed, with intent to commit larceny\" href=\"\/18.2-93\/\">18.2-93<\/a>; any <span class=\"dictionary\">felony<\/span> violation of &#xA7; <a class=\"law\" title=\"Personal trespass by computer; penalty\" href=\"\/18.2-152.7\/\">18.2-152.7<\/a>; any Class 4 <span class=\"dictionary\">felony<\/span> violation of &#xA7; <a class=\"law\" title=\"Obstructing or injuring canal, railroad, power line, etc\" href=\"\/18.2-153\/\">18.2-153<\/a>; any Class 4 <span class=\"dictionary\">felony<\/span> violation of &#xA7; <a class=\"law\" title=\"Shooting at or throwing missiles, etc., at train, car, vessel, etc.; penalty\" href=\"\/18.2-154\/\">18.2-154<\/a>; any Class 4 <span class=\"dictionary\">felony<\/span> violation of &#xA7; <a class=\"law\" title=\"Injuring, etc., signal used by railroad\" href=\"\/18.2-155\/\">18.2-155<\/a>; any <span class=\"dictionary\">felony<\/span> violation of &#xA7; <a class=\"law\" title=\"Damage or trespass to public services or utilities\" href=\"\/18.2-162\/\">18.2-162<\/a>; any violation of &#xA7; <a class=\"law\" title=\"Discharging firearms or missiles within or at building or dwelling house; penalty\" href=\"\/18.2-279\/\">18.2-279<\/a> involving an occupied dwelling; any <span class=\"dictionary\">felony<\/span> violation of subsection A or B of &#xA7; <a class=\"law\" title=\"Willfully discharging firearms in public places\" href=\"\/18.2-280\/\">18.2-280<\/a>; any violation of &#xA7; <a class=\"law\" title=\"Setting spring gun or other deadly weapon\" href=\"\/18.2-281\/\">18.2-281<\/a>; any <span class=\"dictionary\">felony<\/span> violation of subsection A of &#xA7; <a class=\"law\" title=\"Pointing, holding, or brandishing firearm, air or gas operated weapon or object similar in appearance; penalty\" href=\"\/18.2-282\/\">18.2-282<\/a>; any <span class=\"dictionary\">felony<\/span> violation of &#xA7; <a class=\"law\" title=\"Brandishing a machete or other bladed weapon with intent to intimidate; penalty\" href=\"\/18.2-282.1\/\">18.2-282.1<\/a>; any violation of &#xA7; <a class=\"law\" title=\"Shooting from vehicles so as to endanger persons; penalty\" href=\"\/18.2-286.1\/\">18.2-286.1<\/a>, <a class=\"law\" title=\"Wearing of body armor while committing a crime; penalty\" href=\"\/18.2-287.2\/\">18.2-287.2<\/a>, <a class=\"law\" title=\"Use of machine gun for crime of violence\" href=\"\/18.2-289\/\">18.2-289<\/a>, or <a class=\"law\" title=\"Use of machine gun for aggressive purpose\" href=\"\/18.2-290\/\">18.2-290<\/a>; any violation of subsection A of &#xA7; <a class=\"law\" title=\"Possession or use of &quot;sawed-off&quot; shotgun or rifle\" href=\"\/18.2-300\/\">18.2-300<\/a>; any <span class=\"dictionary\">felony<\/span> violation of subsection C of &#xA7; <a class=\"law\" title=\"Possession of firearm, stun weapon, or other weapon on school property prohibited; penalty\" href=\"\/18.2-308.1\/\">18.2-308.1<\/a> or &#xA7; <a class=\"law\" title=\"Possession or transportation of firearms, firearms ammunition, stun weapons, explosives or concealed weapons by convicted felons; penalties; petition for restoration order; when issued\" href=\"\/18.2-308.2\/\">18.2-308.2<\/a>; any violation of &#xA7; <a class=\"law\" title=\"Prohibiting the selling, etc., of firearms to certain persons; penalties\" href=\"\/18.2-308.2_1\/\">18.2-308.2:1<\/a> or subsection M or N of &#xA7; <a class=\"law\" title=\"Criminal history record information check required for the transfer of certain firearms\" href=\"\/18.2-308.2_2\/\">18.2-308.2:2<\/a>; any violation of &#xA7; <a class=\"law\" title=\"Use or attempted use of restricted ammunition in commission or attempted commission of crimes prohibited; penalty\" href=\"\/18.2-308.3\/\">18.2-308.3<\/a> or <a class=\"law\" title=\"Illegal use of tear gas, phosgene and other gases\" href=\"\/18.2-312\/\">18.2-312<\/a>; any former <span class=\"dictionary\">felony<\/span> violation of &#xA7; <a class=\"law\" title=\"Prostitution; commercial sexual conduct; penalties\" href=\"\/18.2-346\/\">18.2-346<\/a>; any <span class=\"dictionary\">felony<\/span> violation of &#xA7; <a class=\"law\" title=\"Prostitution; solicitation; commercial exploitation of a minor; penalties\" href=\"\/18.2-346.01\/\">18.2-346.01<\/a>, <a class=\"law\" title=\"Aiding prostitution or illicit sexual intercourse, etc.; penalty\" href=\"\/18.2-348\/\">18.2-348<\/a>, or <a class=\"law\" title=\"Using vehicles to promote prostitution or unlawful sexual intercourse; penalty\" href=\"\/18.2-349\/\">18.2-349<\/a>; any violation of &#xA7; <a class=\"law\" title=\"Taking, detaining, etc., person for prostitution, etc., or consenting thereto; human trafficking\" href=\"\/18.2-355\/\">18.2-355<\/a>, <a class=\"law\" title=\"Receiving money for procuring person; penalties\" href=\"\/18.2-356\/\">18.2-356<\/a>, <a class=\"law\" title=\"Receiving money from earnings of male or female prostitute; penalties\" href=\"\/18.2-357\/\">18.2-357<\/a>, or <a class=\"law\" title=\"Commercial sex trafficking; penalties\" href=\"\/18.2-357.1\/\">18.2-357.1<\/a>; any violation of former &#xA7; <a class=\"law\" title=\"Repealed\" href=\"\/18.2-358\/\">18.2-358<\/a>; any violation of subsection B of &#xA7; <a class=\"law\" title=\"Crimes against nature; penalty\" href=\"\/18.2-361\/\">18.2-361<\/a>; any violation of subsection B of &#xA7; <a class=\"law\" title=\"Sexual intercourse by persons forbidden to marry; incest; penalties\" href=\"\/18.2-366\/\">18.2-366<\/a>; any violation of &#xA7; <a class=\"law\" title=\"Placing or leaving spouse for prostitution; penalty\" href=\"\/18.2-368\/\">18.2-368<\/a>, <a class=\"law\" title=\"Taking indecent liberties with children; penalties\" href=\"\/18.2-370\/\">18.2-370<\/a>, or <a class=\"law\" title=\"Taking indecent liberties with child by person in custodial or supervisory relationship; penalties\" href=\"\/18.2-370.1\/\">18.2-370.1<\/a>; any violation of subsection A of &#xA7; <a class=\"law\" title=\"Abuse and neglect of children; penalties; abandoned infant\" href=\"\/18.2-371.1\/\">18.2-371.1<\/a>; any <span class=\"dictionary\">felony<\/span> violation of &#xA7; <a class=\"law\" title=\"Abuse and neglect of vulnerable adults; penalties\" href=\"\/18.2-369\/\">18.2-369<\/a> resulting in serious bodily injury or disease; any violation of &#xA7; <a class=\"law\" title=\"Production, publication, sale, financing, etc., of child pornography; presumption as to age\" href=\"\/18.2-374.1\/\">18.2-374.1<\/a>; any <span class=\"dictionary\">felony<\/span> violation of &#xA7; <a class=\"law\" title=\"Possession, reproduction, distribution, solicitation, and facilitation of child pornography; penalty\" href=\"\/18.2-374.1_1\/\">18.2-374.1:1<\/a>; any <span class=\"dictionary\">felony<\/span> violation of &#xA7; <a class=\"law\" title=\"Use of communications systems to facilitate certain offenses involving children; penalties\" href=\"\/18.2-374.3\/\">18.2-374.3<\/a> or <a class=\"law\" title=\"Display of child pornography or grooming video or materials to a child unlawful; penalty\" href=\"\/18.2-374.4\/\">18.2-374.4<\/a>; any second or subsequent <span class=\"dictionary\">offense<\/span> under &#xA7;&#xA7; <a class=\"law\" title=\"Employing or permitting minor to assist in offense under article\" href=\"\/18.2-379\/\">18.2-379<\/a> and <a class=\"law\" title=\"Punishment for subsequent offenses; additional penalty for owner\" href=\"\/18.2-381\/\">18.2-381<\/a>; any <span class=\"dictionary\">felony<\/span> violation of &#xA7; <a class=\"law\" title=\"What constitutes a riot; punishment\" href=\"\/18.2-405\/\">18.2-405<\/a> or <a class=\"law\" title=\"What constitutes an unlawful assembly; punishment\" href=\"\/18.2-406\/\">18.2-406<\/a>; any violation of &#xA7; <a class=\"law\" title=\"Conspiracy; incitement, etc., to riot\" href=\"\/18.2-408\/\">18.2-408<\/a>, <a class=\"law\" title=\"Commission of certain offenses in county, city or town declared by Governor to be in state of riot or insurrection\" href=\"\/18.2-413\/\">18.2-413<\/a>, <a class=\"law\" title=\"Injury to property or persons by persons unlawfully or riotously assembled\" href=\"\/18.2-414\/\">18.2-414<\/a>, <a class=\"law\" title=\"Burning cross on property of another or public place with intent to intimidate; penalty; prima facie evidence of intent\" href=\"\/18.2-423\/\">18.2-423<\/a>, <a class=\"law\" title=\"Burning object on property of another or a highway or other public place with intent to intimidate; penalty\" href=\"\/18.2-423.01\/\">18.2-423.01<\/a>, <a class=\"law\" title=\"Placing Nazi symbol or emblem on certain property with intent to intimidate; penalty; prima facie evidence of intent\" href=\"\/18.2-423.1\/\">18.2-423.1<\/a>, <a class=\"law\" title=\"Displaying noose on property of another or a highway or other public place with intent to intimidate; penalty\" href=\"\/18.2-423.2\/\">18.2-423.2<\/a>, or <a class=\"law\" title=\"Paramilitary activity prohibited; penalty\" href=\"\/18.2-433.2\/\">18.2-433.2<\/a>; any <span class=\"dictionary\">felony<\/span> violation of &#xA7; <a class=\"law\" title=\"Obstructing justice; resisting arrest; fleeing from a law-enforcement officer; penalties\" href=\"\/18.2-460\/\">18.2-460<\/a>, <a class=\"law\" title=\"Delivery of drugs, firearms, explosives, etc., to prisoners or committed persons\" href=\"\/18.2-474.1\/\">18.2-474.1<\/a>, or <a class=\"law\" title=\"Escapes from juvenile facility; penalty\" href=\"\/18.2-477.1\/\">18.2-477.1<\/a>; any violation of &#xA7; <a class=\"law\" title=\"Prisoner escaping from jail; how punished\" href=\"\/18.2-477\/\">18.2-477<\/a>, <a class=\"law\" title=\"Escape from jail or custody by force or violence without setting fire to jail; penalty\" href=\"\/18.2-478\/\">18.2-478<\/a>, <a class=\"law\" title=\"Escape, etc., by setting fire to jail\" href=\"\/18.2-480\/\">18.2-480<\/a>, <a class=\"law\" title=\"Treason defined; how proved and punished\" href=\"\/18.2-481\/\">18.2-481<\/a>, or <a class=\"law\" title=\"Conspiring to incite one race to insurrection against another race\" href=\"\/18.2-485\/\">18.2-485<\/a>; any violation of &#xA7; <a class=\"law\" title=\"Escape of persons committed; penalty\" href=\"\/37.2-917\/\">37.2-917<\/a>; any violation of &#xA7; <a class=\"law\" title=\"Confidentiality and immunity from service of process; penalties\" href=\"\/52-48\/\">52-48<\/a>; any violation of &#xA7; <a class=\"law\" title=\"Felonies by prisoners; penalties\" href=\"\/53.1-203\/\">53.1-203<\/a>; any conspiracy or attempt to commit any <span class=\"dictionary\">offense<\/span> specified in this subsection, or any substantially similar <span class=\"dictionary\">offense<\/span> under the <span class=\"dictionary\">laws<\/span> of any state, the District of Columbia, or the United States or its territories. <a id=\"paragraph-287290\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/17.1-805\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nADOPTION OF INITIAL DISCRETIONARY SENTENCING GUIDELINE MIDPOINTS (\u00a7 17.1-805)\n\nA. The Commission shall adopt an initial set of discretionary felony sentencing\nguidelines which shall become effective on January 1, 1995. The initial\nrecommended sentencing range for each felony offense shall be determined first,\nby computing the actual time-served distribution for similarly situated\noffenders, in terms of their conviction offense and prior criminal history,\nreleased from incarceration during the base period of calendar years 1988\nthrough 1992, increased by 13.4 percent, and second, by eliminating from this\nrange the upper and lower quartiles. The midpoint of each initial recommended\nsentencing range shall be the median time served for the middle two quartiles\nand subject to the following additional enhancements:\n\n   1. The midpoint of the initial recommended sentencing range for first degree\n   murder, second degree murder, rape in violation of &#xA7; 18.2-61, forcible\n   sodomy, object sexual penetration, and aggravated sexual battery shall be\n   further increased by (i) 125 percent in cases in which the defendant has no\n   previous conviction of a violent felony offense; (ii) 300 percent in cases in\n   which the defendant has previously been convicted of a violent felony offense\n   punishable by a maximum punishment of less than 40 years; or (iii) 500 percent\n   in cases in which the defendant has previously been convicted of a violent\n   felony offense punishable by a maximum punishment of 40 years or more, except\n   that the recommended sentence for a defendant convicted of first degree murder\n   who has previously been convicted of a violent felony offense punishable by a\n   maximum term of imprisonment of 40 years or more shall be imprisonment for\n   life;\n\n   2. The midpoint of the initial recommended sentencing range for voluntary\n   manslaughter, robbery, aggravated malicious wounding, malicious wounding, and\n   any burglary of a dwelling house or statutory burglary of a dwelling house or\n   any burglary committed while armed with a deadly weapon or any statutory\n   burglary committed while armed with a deadly weapon shall be further increased\n   by (i) 100 percent in cases in which the defendant has no previous conviction\n   of a violent felony offense, (ii) 300 percent in cases in which the defendant\n   has previously been convicted of a violent felony offense punishable by a\n   maximum term of imprisonment of less than 40 years, or (iii) 500 percent in\n   cases in which the defendant has previously been convicted of a violent felony\n   offense punishable by a maximum term of imprisonment of 40 years or more;\n\n   3. The midpoint of the initial recommended sentencing range for manufacturing,\n   selling, giving, or distributing, or possessing with the intent to\n   manufacture, sell, give, or distribute a Schedule I or II controlled\n   substance, shall be increased by (i) 200 percent in cases in which the\n   defendant has previously been convicted of a violent felony offense punishable\n   by a maximum punishment of less than 40 years or (ii) 400 percent in cases in\n   which the defendant has previously been convicted of a violent felony offense\n   punishable by a maximum term of imprisonment of 40 years or more; and\n\n   4. The midpoint of the initial recommended sentencing range for felony\n   offenses not specified in subdivision 1, 2, or 3 shall be increased by 100\n   percent in cases in which the defendant has previously been convicted of a\n   violent felony offense punishable by a maximum punishment of less than 40\n   years and by 300 percent in cases in which the defendant has previously been\n   convicted of a violent felony offense punishable by a maximum term of\n   imprisonment of 40 years or more.\n\nB. For purposes of this chapter, previous convictions shall include prior adult\nconvictions and juvenile convictions and adjudications of delinquency based on\nan offense which would have been at the time of conviction a felony if committed\nby an adult under the laws of any state, the District of Columbia, or the United\nStates or its territories.\n\nC. For purposes of this chapter, violent felony offenses shall include any\nfelony violation of &#xA7; 16.1-253.2; solicitation to commit murder under\n&#xA7; 18.2-29; any violation of &#xA7; 18.2-31, 18.2-32, 18.2-32.1, 18.2-32.2,\n18.2-33, or 18.2-35; any violation of subsection B of &#xA7; 18.2-36.1; any\nviolation of &#xA7; 18.2-40 or 18.2-41; any violation of clause (c)(i) or (ii)\nof subsection B of &#xA7; 18.2-46.3; any violation of &#xA7; 18.2-46.5,\n18.2-46.6, or 18.2-46.7; any Class 5 felony violation of &#xA7; 18.2-47; any\nfelony violation of &#xA7; 18.2-48, 18.2-48.1, or 18.2-49; any violation of\n&#xA7; 18.2-51, 18.2-51.1, 18.2-51.2, 18.2-51.3, 18.2-51.4, 18.2-51.6, 18.2-52,\n18.2-52.1, 18.2-53, 18.2-53.1, 18.2-54.1, 18.2-54.2, or 18.2-55; any violation\nof subsection B of &#xA7; 18.2-57; any felony violation of &#xA7; 18.2-57.2; any\nviolation of &#xA7; 18.2-58 or 18.2-58.1; any felony violation of &#xA7;\n18.2-60.1, 18.2-60.3, or 18.2-60.4; any violation of &#xA7; 18.2-61, 18.2-64.1,\n18.2-67.1, 18.2-67.2, former &#xA7; 18.2-67.2:1, 18.2-67.3, 18.2-67.5, or\n18.2-67.5:1 involving a third conviction of either sexual battery in violation\nof &#xA7; 18.2-67.4 or attempted sexual battery in violation of subsection C of\n&#xA7; 18.2-67.5; any Class 4 felony violation of &#xA7; 18.2-63; any violation\nof subsection A of &#xA7; 18.2-67.4:1; any violation of subsection A of &#xA7;\n18.2-77; any Class 3 felony violation of &#xA7; 18.2-79; any Class 3 felony\nviolation of &#xA7; 18.2-80; any violation of &#xA7; 18.2-85, 18.2-89, 18.2-90,\n18.2-91, 18.2-92, or 18.2-93; any felony violation of &#xA7; 18.2-152.7; any\nClass 4 felony violation of &#xA7; 18.2-153; any Class 4 felony violation of\n&#xA7; 18.2-154; any Class 4 felony violation of &#xA7; 18.2-155; any felony\nviolation of &#xA7; 18.2-162; any violation of &#xA7; 18.2-279 involving an\noccupied dwelling; any felony violation of subsection A or B of &#xA7; 18.2-280;\nany violation of &#xA7; 18.2-281; any felony violation of subsection A of &#xA7;\n18.2-282; any felony violation of &#xA7; 18.2-282.1; any violation of &#xA7;\n18.2-286.1, 18.2-287.2, 18.2-289, or 18.2-290; any violation of subsection A of\n&#xA7; 18.2-300; any felony violation of subsection C of &#xA7; 18.2-308.1 or\n&#xA7; 18.2-308.2; any violation of &#xA7; 18.2-308.2:1 or subsection M or N of\n&#xA7; 18.2-308.2:2; any violation of &#xA7; 18.2-308.3 or 18.2-312; any former\nfelony violation of &#xA7; 18.2-346; any felony violation of &#xA7; 18.2-346.01,\n18.2-348, or 18.2-349; any violation of &#xA7; 18.2-355, 18.2-356, 18.2-357, or\n18.2-357.1; any violation of former &#xA7; 18.2-358; any violation of subsection\nB of &#xA7; 18.2-361; any violation of subsection B of &#xA7; 18.2-366; any\nviolation of &#xA7; 18.2-368, 18.2-370, or 18.2-370.1; any violation of\nsubsection A of &#xA7; 18.2-371.1; any felony violation of &#xA7; 18.2-369\nresulting in serious bodily injury or disease; any violation of &#xA7;\n18.2-374.1; any felony violation of &#xA7; 18.2-374.1:1; any felony violation of\n&#xA7; 18.2-374.3 or 18.2-374.4; any second or subsequent offense under\n&#xA7;&#xA7; 18.2-379 and 18.2-381; any felony violation of &#xA7; 18.2-405 or\n18.2-406; any violation of &#xA7; 18.2-408, 18.2-413, 18.2-414, 18.2-423,\n18.2-423.01, 18.2-423.1, 18.2-423.2, or 18.2-433.2; any felony violation of\n&#xA7; 18.2-460, 18.2-474.1, or 18.2-477.1; any violation of &#xA7; 18.2-477,\n18.2-478, 18.2-480, 18.2-481, or 18.2-485; any violation of &#xA7; 37.2-917; any\nviolation of &#xA7; 52-48; any violation of &#xA7; 53.1-203; any conspiracy or\nattempt to commit any offense specified in this subsection, or any substantially\nsimilar offense under the laws of any state, the District of Columbia, or the\nUnited States or its territories.\n\nHISTORY: 1994, Sp.
