Such term does not include simple calculators, automated typewriters, facsimile machines, or any other specialized computing devices that are preprogrammed to perform a narrow range of functions with minimal end-user or operator intervention and are dedicated to a specific task.\n\t\t&#8220;Computer data&#8221; means any representation of information, knowledge, facts, concepts, or instructions which is being prepared or has been prepared and is intended to be processed, is being processed, or has been processed in a computer or computer network. &#8220;Computer data&#8221; may be in any form, whether readable only by a computer or only by a human or by either, including, but not limited to, computer printouts, magnetic storage media, punched cards, or stored internally in the memory of the computer.\n\t\t&#8220;Computer network&#8221; means two or more computers connected by a network.\n\t\t&#8220;Computer operation&#8221; means arithmetic, logical, monitoring, storage or retrieval functions and any combination thereof, and includes, but is not limited to, communication with, storage of data to, or retrieval of data from any device or human hand manipulation of electronic or magnetic impulses. A &#8220;<span class=\"dictionary\">computer operation<\/span>&#8221; for a particular computer may also be any function for which that computer was generally designed.\n\t\t&#8220;<span class=\"dictionary\">Computer program<\/span>&#8221; means an ordered set of data representing coded instructions or statements that, when executed by a computer, causes the computer to perform one or more <span class=\"dictionary\">computer operations<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Computer services<\/span>&#8221; means computer time or services, including data processing services, Internet services, electronic mail services, electronic message services, or information or data stored in connection therewith.\n\t\t&#8220;<span class=\"dictionary\">Computer software<\/span>&#8221; means a set of <span class=\"dictionary\">computer programs<\/span>, procedures and associated documentation concerned with <span class=\"dictionary\">computer data<\/span> or with the operation of a computer, <span class=\"dictionary\">computer program<\/span>, or <span class=\"dictionary\">computer network<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Electronic mail service provider<\/span>&#8221; (EMSP) means any <span class=\"dictionary\">person<\/span> who (i) is an intermediary in sending or receiving electronic mail and (ii) provides to end-users of electronic mail services the ability to send or receive electronic mail.\n\t\t&#8220;Financial instrument&#8221; includes, but is not limited to, any check, draft, warrant, money <span class=\"dictionary\">order<\/span>, note, certificate of deposit, letter of credit, bill of exchange, credit or debit card, transaction authorization mechanism, marketable security, or any computerized representation thereof.\n\t\t&#8220;Network&#8221; means any combination of digital transmission facilities and packet switches, routers, and similar equipment interconnected to enable the exchange of <span class=\"dictionary\">computer data<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Owner<\/span>&#8221; means an <span class=\"dictionary\">owner<\/span> or lessee of a computer or a <span class=\"dictionary\">computer network<\/span> or an <span class=\"dictionary\">owner<\/span>, lessee, or licensee of <span class=\"dictionary\">computer data<\/span>, <span class=\"dictionary\">computer programs<\/span> or <span class=\"dictionary\">computer software<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Person<\/span>&#8221; shall include any individual, partnership, association, corporation or joint venture.\n\t\t&#8220;Property&#8221; shall include:<\/p><\/section>\n\t\t\t\t\t\t<section id=\"1\"><p><span class=\"prefix-number\">1.<\/span> Real property; <a id=\"paragraph-201487\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-152.2\/#1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"2\"><p><span class=\"prefix-number\">2.<\/span> <span class=\"dictionary\">Computers<\/span> and <span class=\"dictionary\">computer networks<\/span>; <a id=\"paragraph-201488\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-152.2\/#2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"3\"><p><span class=\"prefix-number\">3.<\/span> Financial instruments, <span class=\"dictionary\">computer data<\/span>, <span class=\"dictionary\">computer programs<\/span>, <span class=\"dictionary\">computer software<\/span> and all other personal property regardless of whether they are:\n\t\t\ta. Tangible or intangible;\n\t\t\tb. In a format readable by humans or by a computer;\n\t\t\tc. In transit between <span class=\"dictionary\">computers<\/span> or within a <span class=\"dictionary\">computer network<\/span> or between any devices which comprise a computer; or\n\t\t\td. Located on any paper or in any device on which it is stored by a computer or by a human; and <a id=\"paragraph-201489\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-152.2\/#3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"4\"><p><span class=\"prefix-number\">4.<\/span> <span class=\"dictionary\">Computer services<\/span>.\n\t\t\t&#8220;<span class=\"dictionary\">Spam<\/span>&#8221; means unsolicited <span class=\"dictionary\">commercial electronic mail<\/span>. <span class=\"dictionary\">Spam<\/span> shall not include <span class=\"dictionary\">commercial electronic mail<\/span> transmitted to a recipient with whom the sender has an existing business or personal relationship.\n\t\t\tA <span class=\"dictionary\">person<\/span> &#8220;uses&#8221; a computer or <span class=\"dictionary\">computer network<\/span> when he attempts to cause or causes a computer or <span class=\"dictionary\">computer network<\/span> to perform or to stop performing <span class=\"dictionary\">computer operations<\/span>.\n\t\t\tA <span class=\"dictionary\">person<\/span> is &#8220;without authority&#8221; when he knows or reasonably should know that he has no right, agreement, or permission or acts in a manner knowingly exceeding such right, agreement, or permission. <a id=\"paragraph-201490\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-152.2\/#4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nDEFINITIONS; COMPUTER CRIMES (\u00a7 18.2-152.2)\n\nFor purposes of this article:\n\t\t&#8220;Commercial electronic mail&#8221; means electronic mail, the primary\npurpose of which is the advertisement or promotion of a commercial product or\nservice.\n\t\t&#8220;Computer&#8221; means a device that accepts information in digital or\nsimilar form and manipulates it for a result based on a sequence of\ninstructions.
