This suspension period shall be in addition to the suspension period provided under &#xA7; 46.2-391.2.B\n\nIf a person (i) is tried on a process alleging a second offense of violating &#xA7; 18.2-266 or subsection A of &#xA7; 46.2-341.24, or any substantially similar local ordinance, or law of any other jurisdiction, within ten years of a first offense for which the person was convicted, or found guilty in the case of a juvenile, under &#xA7; 18.2-266 or subsection A of &#xA7; 46.2-341.24 or any valid local ordinance or any law of any other jurisdiction substantially similar to &#xA7; 18.2-266 or subsection A of &#xA7; 46.2-341.24 and (ii) is convicted thereof, such conviction shall of itself operate to deprive the person so convicted of the privilege to drive or operate any motor vehicle, engine or train in the Commonwealth for a period of three years from the date of the judgment of conviction and such person shall have his license revoked as provided in subsection A of &#xA7; 46.2-391. The court trying such case shall order the surrender of the person&#8217;s driver&#8217;s license, to be disposed of in accordance with &#xA7; 46.2-398, and shall notify such person that his license has been revoked for a period of three years and that the penalty for violating that revocation is as set out in &#xA7; 46.2-391. This suspension period shall be in addition to the suspension period provided under &#xA7; 46.2-391.2. Any period of license suspension or revocation imposed pursuant to this section, in any case, shall run consecutively with any period of suspension for failure to permit a blood or breath sample to be taken as required by &#xA7;&#xA7; 18.2-268.1 through 18.2-268.12 or &#xA7;&#xA7; 46.2-341.26:1 through 46.2-341.26:11 or any period of suspension for a previous violation of &#xA7; 18.2-266, 18.2-266.1, or 46.2-341.24.C\n\nIf a person (i) is tried on a process alleging (a) a felony conviction of &#xA7; 18.2-266 or (b) a third or subsequent offense of violating &#xA7; 18.2-266 or subsection A of &#xA7; 46.2-341.24, or any substantially similar local ordinance, or law of any other jurisdiction, within 10 years of two other offenses for which the person was convicted, or found not innocent in the case of a juvenile, under &#xA7; 18.2-266 or subsection A of &#xA7; 46.2-341.24 or any valid local ordinance or any law of any other jurisdiction substantially similar to &#xA7; 18.2-266 or subsection A of &#xA7; 46.2-341.24 and (ii) is convicted thereof, such conviction shall of itself operate to deprive the person so convicted of the privilege to drive or operate any motor vehicle, engine or train in the Commonwealth and such person shall not be eligible for participation in a program pursuant to &#xA7; 18.2-271.1 and shall, upon such conviction, have his license revoked as provided in subsection B of &#xA7; 46.2-391. <a class=\"law\" title=\"Probation, education, and rehabilitation of person charged or convicted; person convicted under law of another state or federal law\" href=\"\/18.2-271.1\/\">18.2-271.1<\/a>, the <span class=\"dictionary\">judgment<\/span> of <span class=\"dictionary\">conviction<\/span> if for a first <span class=\"dictionary\">offense<\/span> under &#xA7; <a class=\"law\" title=\"Driving motor vehicle, engine, etc., while intoxicated, etc\" href=\"\/18.2-266\/\">18.2-266<\/a> or for a similar <span class=\"dictionary\">offense<\/span> under any county, city, or town <span class=\"dictionary\">ordinance<\/span>, or for a first <span class=\"dictionary\">offense<\/span> under subsection A of &#xA7; <a class=\"law\" title=\"Driving a commercial motor vehicle while intoxicated, etc\" href=\"\/46.2-341.24\/\">46.2-341.24<\/a>, shall of itself operate to deprive the person so convicted of the <span class=\"dictionary\">privilege<\/span> to drive or operate any <span class=\"dictionary\">motor vehicle<\/span>, engine or train in the Commonwealth for a period of one year from the date of such <span class=\"dictionary\">judgment<\/span>. This suspension period shall be in addition to the suspension period provided under &#xA7; <a class=\"law\" title=\"Administrative suspension of license or privilege to operate a motor vehicle\" href=\"\/46.2-391.2\/\">46.2-391.2<\/a>. <a id=\"paragraph-290224\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-271\/#A\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> If a person (i) is tried on a process alleging a second <span class=\"dictionary\">offense<\/span> of violating &#xA7; <a class=\"law\" title=\"Driving motor vehicle, engine, etc., while intoxicated, etc\" href=\"\/18.2-266\/\">18.2-266<\/a> or subsection A of &#xA7; <a class=\"law\" title=\"Driving a commercial motor vehicle while intoxicated, etc\" href=\"\/46.2-341.24\/\">46.2-341.24<\/a>, or any substantially similar local <span class=\"dictionary\">ordinance<\/span>, or <span class=\"dictionary\">law<\/span> of any other <span class=\"dictionary\">jurisdiction<\/span>, within ten years of a first <span class=\"dictionary\">offense<\/span> for which the person was convicted, or found guilty in the case of a juvenile, under &#xA7; <a class=\"law\" title=\"Driving motor vehicle, engine, etc., while intoxicated, etc\" href=\"\/18.2-266\/\">18.2-266<\/a> or subsection A of &#xA7; <a class=\"law\" title=\"Driving a commercial motor vehicle while intoxicated, etc\" href=\"\/46.2-341.24\/\">46.2-341.24<\/a> or any valid local <span class=\"dictionary\">ordinance<\/span> or any <span class=\"dictionary\">law<\/span> of any other <span class=\"dictionary\">jurisdiction<\/span> substantially similar to &#xA7; <a class=\"law\" title=\"Driving motor vehicle, engine, etc., while intoxicated, etc\" href=\"\/18.2-266\/\">18.2-266<\/a> or subsection A of &#xA7; <a class=\"law\" title=\"Driving a commercial motor vehicle while intoxicated, etc\" href=\"\/46.2-341.24\/\">46.2-341.24<\/a> and (ii) is convicted thereof, such <span class=\"dictionary\">conviction<\/span> shall of itself operate to deprive the person so convicted of the <span class=\"dictionary\">privilege<\/span> to drive or operate any <span class=\"dictionary\">motor vehicle<\/span>, engine or train in the Commonwealth for a period of three years from the date of the <span class=\"dictionary\">judgment<\/span> of <span class=\"dictionary\">conviction<\/span> and such person shall have his license revoked as provided in subsection A of &#xA7; <a class=\"law\" title=\"Revocation of license for multiple convictions of driving while intoxicated; exception; petition for restoration of privilege\" href=\"\/46.2-391\/\">46.2-391<\/a>. The <span class=\"dictionary\">court<\/span> trying such case shall <span class=\"dictionary\">order<\/span> the surrender of the person&#8217;s driver&#8217;s license, to be disposed of in accordance with &#xA7; <a class=\"law\" title=\"(Effective July 1, 2026) Disposition of surrendered licenses on revocation or suspension\" href=\"\/46.2-398\/\">46.2-398<\/a>, and shall notify such person that his license has been revoked for a period of three years and that the <span class=\"dictionary\">penalty<\/span> for violating that <span class=\"dictionary\">revocation<\/span> is as set out in &#xA7; <a class=\"law\" title=\"Revocation of license for multiple convictions of driving while intoxicated; exception; petition for restoration of privilege\" href=\"\/46.2-391\/\">46.2-391<\/a>. This suspension period shall be in addition to the suspension period provided under &#xA7; <a class=\"law\" title=\"Administrative suspension of license or privilege to operate a motor vehicle\" href=\"\/46.2-391.2\/\">46.2-391.2<\/a>. Any period of license suspension or <span class=\"dictionary\">revocation<\/span> imposed pursuant to this section, in any case, shall run consecutively with any period of suspension for failure to permit a blood or breath sample to be taken as required by &#xA7;&#xA7; <a class=\"law\" title=\"Chemical testing to determine alcohol or drug content of blood; definitions\" href=\"\/18.2-268.1\/\">18.2-268.1<\/a> through <a class=\"law\" title=\"Ordinances\" href=\"\/18.2-268.12\/\">18.2-268.12<\/a> or &#xA7;&#xA7; <a class=\"law\" title=\"Use of chemical tests to determine alcohol or drug content of blood of commercial driver; definitions\" href=\"\/46.2-341.26_1\/\">46.2-341.26:1<\/a> through <a class=\"law\" title=\"Substantial compliance\" href=\"\/46.2-341.26_11\/\">46.2-341.26:11<\/a> or any period of suspension for a previous violation of &#xA7; <a class=\"law\" title=\"Driving motor vehicle, engine, etc., while intoxicated, etc\" href=\"\/18.2-266\/\">18.2-266<\/a>, <a class=\"law\" title=\"Persons under age 21 driving after illegally consuming alcohol; penalty\" href=\"\/18.2-266.1\/\">18.2-266.1<\/a>, or <a class=\"law\" title=\"Driving a commercial motor vehicle while intoxicated, etc\" href=\"\/46.2-341.24\/\">46.2-341.24<\/a>. <a id=\"paragraph-290225\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-271\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> If a person (i) is tried on a process alleging (a) a <span class=\"dictionary\">felony<\/span> <span class=\"dictionary\">conviction<\/span> of &#xA7; <a class=\"law\" title=\"Driving motor vehicle, engine, etc., while intoxicated, etc\" href=\"\/18.2-266\/\">18.2-266<\/a> or (b) a third or subsequent <span class=\"dictionary\">offense<\/span> of violating &#xA7; <a class=\"law\" title=\"Driving motor vehicle, engine, etc., while intoxicated, etc\" href=\"\/18.2-266\/\">18.2-266<\/a> or subsection A of &#xA7; <a class=\"law\" title=\"Driving a commercial motor vehicle while intoxicated, etc\" href=\"\/46.2-341.24\/\">46.2-341.24<\/a>, or any substantially similar local <span class=\"dictionary\">ordinance<\/span>, or <span class=\"dictionary\">law<\/span> of any other <span class=\"dictionary\">jurisdiction<\/span>, within 10 years of two other <span class=\"dictionary\">offenses<\/span> for which the person was convicted, or found not innocent in the case of a juvenile, under &#xA7; <a class=\"law\" title=\"Driving motor vehicle, engine, etc., while intoxicated, etc\" href=\"\/18.2-266\/\">18.2-266<\/a> or subsection A of &#xA7; <a class=\"law\" title=\"Driving a commercial motor vehicle while intoxicated, etc\" href=\"\/46.2-341.24\/\">46.2-341.24<\/a> or any valid local <span class=\"dictionary\">ordinance<\/span> or any <span class=\"dictionary\">law<\/span> of any other <span class=\"dictionary\">jurisdiction<\/span> substantially similar to &#xA7; <a class=\"law\" title=\"Driving motor vehicle, engine, etc., while intoxicated, etc\" href=\"\/18.2-266\/\">18.2-266<\/a> or subsection A of &#xA7; <a class=\"law\" title=\"Driving a commercial motor vehicle while intoxicated, etc\" href=\"\/46.2-341.24\/\">46.2-341.24<\/a> and (ii) is convicted thereof, such <span class=\"dictionary\">conviction<\/span> shall of itself operate to deprive the person so convicted of the <span class=\"dictionary\">privilege<\/span> to drive or operate any <span class=\"dictionary\">motor vehicle<\/span>, engine or train in the Commonwealth and such person shall not be eligible for participation in a program pursuant to &#xA7; <a class=\"law\" title=\"Probation, education, and rehabilitation of person charged or convicted; person convicted under law of another state or federal law\" href=\"\/18.2-271.1\/\">18.2-271.1<\/a> and shall, upon such <span class=\"dictionary\">conviction<\/span>, have his license revoked as provided in subsection B of &#xA7; <a class=\"law\" title=\"Revocation of license for multiple convictions of driving while intoxicated; exception; petition for restoration of privilege\" href=\"\/46.2-391\/\">46.2-391<\/a>. The <span class=\"dictionary\">court<\/span> trying such case shall <span class=\"dictionary\">order<\/span> the surrender of the person&#8217;s driver&#8217;s license, to be disposed of in accordance with &#xA7; <a class=\"law\" title=\"(Effective July 1, 2026) Disposition of surrendered licenses on revocation or suspension\" href=\"\/46.2-398\/\">46.2-398<\/a>, and shall notify such person that his license has been revoked indefinitely and that the <span class=\"dictionary\">penalty<\/span> for violating that <span class=\"dictionary\">revocation<\/span> is as set out in &#xA7; <a class=\"law\" title=\"Revocation of license for multiple convictions of driving while intoxicated; exception; petition for restoration of privilege\" href=\"\/46.2-391\/\">46.2-391<\/a>. <a id=\"paragraph-290226\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-271\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Notwithstanding any other provision of this section, the period of license <span class=\"dictionary\">revocation<\/span> or suspension shall not begin to expire until the person convicted has surrendered his license to the <span class=\"dictionary\">court<\/span> or to the Department of <span class=\"dictionary\">Motor Vehicles<\/span>. <a id=\"paragraph-290227\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-271\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> The provisions of this section shall not apply to, and shall have no effect upon, any disqualification from operating a commercial <span class=\"dictionary\">motor vehicle<\/span> imposed under the provisions of the Commercial Driver&#8217;s License Act (&#xA7; <a class=\"law\" title=\"Title\" href=\"\/46.2-341.1\/\">46.2-341.1<\/a> et seq.). <a id=\"paragraph-290228\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-271\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nFORFEITURE OF DRIVER&#8217;S LICENSE FOR DRIVING WHILE INTOXICATED (\u00a7 18.2-271)\n\nA. Except as provided in &#xA7; 18.2-271.1, the judgment of conviction if for a\nfirst offense under &#xA7; 18.2-266 or for a similar offense under any county,\ncity, or town ordinance, or for a first offense under subsection A of &#xA7;\n46.2-341.24, shall of itself operate to deprive the person so convicted of the\nprivilege to drive or operate any motor vehicle, engine or train in the\nCommonwealth for a period of one year from the date of such judgment. This\nsuspension period shall be in addition to the suspension period provided under\n&#xA7; 46.2-391.2.\n\nB. If a person (i) is tried on a process alleging a second offense of violating\n&#xA7; 18.2-266 or subsection A of &#xA7; 46.2-341.24, or any substantially\nsimilar local ordinance, or law of any other jurisdiction, within ten years of a\nfirst offense for which the person was convicted, or found guilty in the case of\na juvenile, under &#xA7; 18.2-266 or subsection A of &#xA7; 46.2-341.24 or any\nvalid local ordinance or any law of any other jurisdiction substantially similar\nto &#xA7; 18.2-266 or subsection A of &#xA7; 46.2-341.24 and (ii) is convicted\nthereof, such conviction shall of itself operate to deprive the person so\nconvicted of the privilege to drive or operate any motor vehicle, engine or\ntrain in the Commonwealth for a period of three years from the date of the\njudgment of conviction and such person shall have his license revoked as\nprovided in subsection A of &#xA7; 46.2-391. The court trying such case shall\norder the surrender of the person&#8217;s driver&#8217;s license, to be disposed\nof in accordance with &#xA7; 46.2-398, and shall notify such person that his\nlicense has been revoked for a period of three years and that the penalty for\nviolating that revocation is as set out in &#xA7; 46.2-391. This suspension\nperiod shall be in addition to the suspension period provided under &#xA7;\n46.2-391.2. Any period of license suspension or revocation imposed pursuant to\nthis section, in any case, shall run consecutively with any period of suspension\nfor failure to permit a blood or breath sample to be taken as required by\n&#xA7;&#xA7; 18.2-268.1 through 18.2-268.12 or &#xA7;&#xA7; 46.2-341.26:1\nthrough 46.2-341.26:11 or any period of suspension for a previous violation of\n&#xA7; 18.2-266, 18.2-266.1, or 46.2-341.24.\n\nC. If a person (i) is tried on a process alleging (a) a felony conviction of\n&#xA7; 18.2-266 or (b) a third or subsequent offense of violating &#xA7;\n18.2-266 or subsection A of &#xA7; 46.2-341.24, or any substantially similar\nlocal ordinance, or law of any other jurisdiction, within 10 years of two other\noffenses for which the person was convicted, or found not innocent in the case\nof a juvenile, under &#xA7; 18.2-266 or subsection A of &#xA7; 46.2-341.24 or\nany valid local ordinance or any law of any other jurisdiction substantially\nsimilar to &#xA7; 18.2-266 or subsection A of &#xA7; 46.2-341.24 and (ii) is\nconvicted thereof, such conviction shall of itself operate to deprive the person\nso convicted of the privilege to drive or operate any motor vehicle, engine or\ntrain in the Commonwealth and such person shall not be eligible for\nparticipation in a program pursuant to &#xA7; 18.2-271.1 and shall, upon such\nconviction, have his license revoked as provided in subsection B of &#xA7;\n46.2-391. The court trying such case shall order the surrender of the\nperson&#8217;s driver&#8217;s license, to be disposed of in accordance with\n&#xA7; 46.2-398, and shall notify such person that his license has been revoked\nindefinitely and that the penalty for violating that revocation is as set out in\n&#xA7; 46.2-391.\n\nD. Notwithstanding any other provision of this section, the period of license\nrevocation or suspension shall not begin to expire until the person convicted\nhas surrendered his license to the court or to the Department of Motor Vehicles.\n\nE.
