<a class=\"law\" title=\"Definitions\" href=\"\/46.2-100\/\">46.2-100<\/a>, in the Commonwealth, or any engine or train in the Commonwealth, during the time for which he was deprived of the right to do so (i) upon <span class=\"dictionary\">conviction<\/span> of a violation of &#xA7; <a class=\"law\" title=\"Refusal of tests; penalties; procedures\" href=\"\/18.2-268.3\/\">18.2-268.3<\/a> or <a class=\"law\" title=\"Refusal of tests; issuance of out-of-service orders; disqualification\" href=\"\/46.2-341.26_3\/\">46.2-341.26:3<\/a> or of an <span class=\"dictionary\">offense<\/span> set forth in subsection E of &#xA7; <a class=\"law\" title=\"Penalty for driving while intoxicated; subsequent offense; prior conviction\" href=\"\/18.2-270\/\">18.2-270<\/a>, (ii) by &#xA7; <a class=\"law\" title=\"Forfeiture of driver&#039;s license for driving while intoxicated\" href=\"\/18.2-271\/\">18.2-271<\/a> or <a class=\"law\" title=\"Administrative suspension of license or privilege to operate a motor vehicle\" href=\"\/46.2-391.2\/\">46.2-391.2<\/a>, (iii) after his license has been revoked pursuant to &#xA7; <a class=\"law\" title=\"Required revocation for one year upon conviction or finding of guilty of certain offenses; exceptions\" href=\"\/46.2-389\/\">46.2-389<\/a> or <a class=\"law\" title=\"Revocation of license for multiple convictions of driving while intoxicated; exception; petition for restoration of privilege\" href=\"\/46.2-391\/\">46.2-391<\/a>, or (iv) in violation of the terms of a restricted license issued pursuant to subsection E of &#xA7; <a class=\"law\" title=\"Probation, education, and rehabilitation of person charged or convicted; person convicted under law of another state or federal law\" href=\"\/18.2-271.1\/\">18.2-271.1<\/a>, subsection C of &#xA7; <a class=\"law\" title=\"Ignition interlock systems; penalty\" href=\"\/18.2-270.1\/\">18.2-270.1<\/a>, or subsection E of &#xA7; <a class=\"law\" title=\"Ignition interlock systems; penalty\" href=\"\/18.2-270.1\/\">18.2-270.1<\/a>, as it shall become effective on July 1, 2021, is guilty of a Class 1 <span class=\"dictionary\">misdemeanor<\/span> except as otherwise provided in &#xA7; <a class=\"law\" title=\"Revocation of license for multiple convictions of driving while intoxicated; exception; petition for restoration of privilege\" href=\"\/46.2-391\/\">46.2-391<\/a>, and is subject to administrative <span class=\"dictionary\">revocation<\/span> of his driver&#8217;s license pursuant to &#xA7;&#xA7; <a class=\"law\" title=\"Required revocation for one year upon conviction or finding of guilty of certain offenses; exceptions\" href=\"\/46.2-389\/\">46.2-389<\/a> and <a class=\"law\" title=\"Revocation of license for multiple convictions of driving while intoxicated; exception; petition for restoration of privilege\" href=\"\/46.2-391\/\">46.2-391<\/a>. Any person convicted of three violations of this section committed within a 10-year period is guilty of a Class 6 <span class=\"dictionary\">felony<\/span>.\n\t\t\tNothing in this section or &#xA7; <a class=\"law\" title=\"Driving motor vehicle, engine, etc., while intoxicated, etc\" href=\"\/18.2-266\/\">18.2-266<\/a>, <a class=\"law\" title=\"Penalty for driving while intoxicated; subsequent offense; prior conviction\" href=\"\/18.2-270\/\">18.2-270<\/a>, or <a class=\"law\" title=\"Forfeiture of driver&#039;s license for driving while intoxicated\" href=\"\/18.2-271\/\">18.2-271<\/a> shall be construed as conflicting with or repealing any <span class=\"dictionary\">ordinance<\/span> or resolution of any county, city, or town that restricts still further the right of such persons to drive or operate any such vehicle or conveyance. <a id=\"paragraph-253537\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-272\/#A\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> Regardless of compliance with any other restrictions on his <span class=\"dictionary\">privilege<\/span> to drive or operate a <span class=\"dictionary\">motor vehicle<\/span>, it shall be a violation of this section for any person whose <span class=\"dictionary\">privilege<\/span> to drive or operate a <span class=\"dictionary\">motor vehicle<\/span> has been restricted, suspended or revoked because of a violation of &#xA7; <a class=\"law\" title=\"Certain conduct punishable as involuntary manslaughter\" href=\"\/18.2-36.1\/\">18.2-36.1<\/a>, <a class=\"law\" title=\"Maiming, etc., of another resulting from driving while intoxicated\" href=\"\/18.2-51.4\/\">18.2-51.4<\/a>, <a class=\"law\" title=\"Driving motor vehicle, engine, etc., while intoxicated, etc\" href=\"\/18.2-266\/\">18.2-266<\/a>, <a class=\"law\" title=\"Refusal of tests; penalties; procedures\" href=\"\/18.2-268.3\/\">18.2-268.3<\/a>, <a class=\"law\" title=\"Driving a commercial motor vehicle while intoxicated, etc\" href=\"\/46.2-341.24\/\">46.2-341.24<\/a>, or <a class=\"law\" title=\"Refusal of tests; issuance of out-of-service orders; disqualification\" href=\"\/46.2-341.26_3\/\">46.2-341.26:3<\/a> or a similar <span class=\"dictionary\">ordinance<\/span> or <span class=\"dictionary\">law<\/span> of another state or the United States to drive or operate a <span class=\"dictionary\">motor vehicle<\/span>  on any highway, as defined in &#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/46.2-100\/\">46.2-100<\/a>, in the Commonwealth while he has a blood alcohol content of 0.02 percent or more.\n\t\t\tAny person suspected of a violation of this subsection shall be entitled to a preliminary breath test in accordance with the provisions of &#xA7; <a class=\"law\" title=\"Preliminary analysis of breath to determine alcoholic content of blood\" href=\"\/18.2-267\/\">18.2-267<\/a>, shall be deemed to have given his implied consent to have samples of his blood, breath or both taken for analysis pursuant to the provisions of &#xA7; <a class=\"law\" title=\"Implied consent to post-arrest testing to determine drug or alcohol content of blood\" href=\"\/18.2-268.2\/\">18.2-268.2<\/a>, and, when charged with a violation of this subsection, shall be subject to the provisions of &#xA7;&#xA7; <a class=\"law\" title=\"Chemical testing to determine alcohol or drug content of blood; definitions\" href=\"\/18.2-268.1\/\">18.2-268.1<\/a> through <a class=\"law\" title=\"Ordinances\" href=\"\/18.2-268.12\/\">18.2-268.12<\/a>. <a id=\"paragraph-253538\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-272\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Any person who drives or operates a <span class=\"dictionary\">motor vehicle<\/span> on any highway, as defined in &#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/46.2-100\/\">46.2-100<\/a>, in the Commonwealth without a certified ignition interlock system as required by &#xA7; <a class=\"law\" title=\"Administrative enforcement of ignition interlock requirements\" href=\"\/46.2-391.01\/\">46.2-391.01<\/a> is guilty of a Class 1 <span class=\"dictionary\">misdemeanor<\/span> and is subject to administrative <span class=\"dictionary\">revocation<\/span> of his driver&#8217;s license pursuant to &#xA7;&#xA7; <a class=\"law\" title=\"Required revocation for one year upon conviction or finding of guilty of certain offenses; exceptions\" href=\"\/46.2-389\/\">46.2-389<\/a> and <a class=\"law\" title=\"Revocation of license for multiple convictions of driving while intoxicated; exception; petition for restoration of privilege\" href=\"\/46.2-391\/\">46.2-391<\/a>. <a id=\"paragraph-253539\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-272\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Any person who drives or operates a <span class=\"dictionary\">motor vehicle<\/span> who has tampered with, or in any way attempted to circumvent the operation of, a remote alcohol monitoring device that an offender is ordered to use under &#xA7; <a class=\"law\" title=\"Ignition interlock systems; penalty\" href=\"\/18.2-270.1\/\">18.2-270.1<\/a> is not guilty of a violation of this section but is guilty of a violation of subsection H of &#xA7; <a class=\"law\" title=\"Ignition interlock systems; penalty\" href=\"\/18.2-270.1\/\">18.2-270.1<\/a>. <a id=\"paragraph-253540\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-272\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nDRIVING AFTER FORFEITURE OF LICENSE (\u00a7 18.2-272)\n\nA. Any person who drives or operates any motor vehicle  on any highway, as\ndefined in &#xA7; 46.2-100, in the Commonwealth, or any engine or train in the\nCommonwealth, during the time for which he was deprived of the right to do so\n(i) upon conviction of a violation of &#xA7; 18.2-268.3 or 46.2-341.26:3 or of\nan offense set forth in subsection E of &#xA7; 18.2-270, (ii) by &#xA7; 18.2-271\nor 46.2-391.2, (iii) after his license has been revoked pursuant to &#xA7;\n46.2-389 or 46.2-391, or (iv) in violation of the terms of a restricted license\nissued pursuant to subsection E of &#xA7; 18.2-271.1, subsection C of &#xA7;\n18.2-270.1, or subsection E of &#xA7; 18.2-270.1, as it shall become effective\non July 1, 2021, is guilty of a Class 1 misdemeanor except as otherwise provided\nin &#xA7; 46.2-391, and is subject to administrative revocation of his\ndriver&#8217;s license pursuant to &#xA7;&#xA7; 46.2-389 and 46.2-391. Any\nperson convicted of three violations of this section committed within a 10-year\nperiod is guilty of a Class 6 felony.\n\t\t\tNothing in this section or &#xA7; 18.2-266, 18.2-270, or 18.2-271 shall be\nconstrued as conflicting with or repealing any ordinance or resolution of any\ncounty, city, or town that restricts still further the right of such persons to\ndrive or operate any such vehicle or conveyance.\n\nB. Regardless of compliance with any other restrictions on his privilege to\ndrive or operate a motor vehicle, it shall be a violation of this section for\nany person whose privilege to drive or operate a motor vehicle has been\nrestricted, suspended or revoked because of a violation of &#xA7; 18.2-36.1,\n18.2-51.4, 18.2-266, 18.2-268.3, 46.2-341.24, or 46.2-341.26:3 or a similar\nordinance or law of another state or the United States to drive or operate a\nmotor vehicle  on any highway, as defined in &#xA7; 46.2-100, in the\nCommonwealth while he has a blood alcohol content of 0.02 percent or more.\n\t\t\tAny person suspected of a violation of this subsection shall be entitled to a\npreliminary breath test in accordance with the provisions of &#xA7; 18.2-267,\nshall be deemed to have given his implied consent to have samples of his blood,\nbreath or both taken for analysis pursuant to the provisions of &#xA7;\n18.2-268.2, and, when charged with a violation of this subsection, shall be\nsubject to the provisions of &#xA7;&#xA7; 18.2-268.1 through 18.2-268.12.\n\nC. Any person who drives or operates a motor vehicle on any highway, as defined\nin &#xA7; 46.2-100, in the Commonwealth without a certified ignition interlock\nsystem as required by &#xA7; 46.2-391.01 is guilty of a Class 1 misdemeanor and\nis subject to administrative revocation of his driver&#8217;s license pursuant\nto &#xA7;&#xA7; 46.2-389 and 46.2-391.\n\nD.
