Such powers and duties shall include the following:\n\n1\n\nThe Department is vested with jurisdiction and supervision over all charitable gaming authorized under the provisions of this article and including all persons that conduct or provide goods, services, or premises used in the conduct of charitable gaming. It may employ such persons as are necessary to ensure that charitable gaming is conducted in conformity with the provisions of this article and Department regulations. The Department shall designate such agents and employees as it deems necessary and appropriate who shall be sworn to enforce the provisions of this article and the criminal laws of the Commonwealth and who shall be law-enforcement officers as defined in &#xA7; 9.1-101.2\n\nThe Department, its agents and employees and any law-enforcement officers charged with the enforcement of charitable gaming laws shall have free access to the offices, facilities, or any other place of business of any organization, including any premises devoted in whole or in part to the conduct of charitable gaming. These individuals may enter such places or premises for the purpose of carrying out any duty imposed by this article, securing records required to be maintained by an organization, investigating complaints, or conducting audits.3\n\nThe Department may compel the production of any books, documents, records, or memoranda of any organization, electronic gaming manufacturer, or supplier involved in the conduct of charitable gaming for the purpose of satisfying itself that this article and its regulations are strictly complied with. Such powers and duties shall include the following:<\/p><\/section>\n\t\t\t\t\t\t<section id=\"1\"><p><span class=\"prefix-number\">1.<\/span> The <span class=\"dictionary\">Department<\/span> is vested with <span class=\"dictionary\">jurisdiction<\/span> and supervision over all <span class=\"dictionary\">charitable gaming<\/span> authorized under the provisions of this article and including all persons that <span class=\"dictionary\">conduct<\/span> or provide goods, services, or premises used in the <span class=\"dictionary\">conduct<\/span> of <span class=\"dictionary\">charitable gaming<\/span>. It may employ such persons as are necessary to ensure that <span class=\"dictionary\">charitable gaming<\/span> is conducted in conformity with the provisions of this article and <span class=\"dictionary\">Department<\/span> regulations. The <span class=\"dictionary\">Department<\/span> shall designate such agents and employees as it deems necessary and appropriate who shall be sworn to enforce the provisions of this article and the criminal <span class=\"dictionary\">laws<\/span> of the Commonwealth and who shall be <span class=\"dictionary\">law<\/span>-enforcement officers as defined in &#xA7; <a class=\"law\" title=\"(Effective July 1, 2026) Definitions\" href=\"\/9.1-101\/\">9.1-101<\/a>. <a id=\"paragraph-269416\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.18\/#1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"2\"><p><span class=\"prefix-number\">2.<\/span> The <span class=\"dictionary\">Department<\/span>, its agents and employees and any <span class=\"dictionary\">law<\/span>-enforcement officers charged with the enforcement of <span class=\"dictionary\">charitable gaming<\/span> <span class=\"dictionary\">laws<\/span> shall have free access to the offices, facilities, or any other place of business of any <span class=\"dictionary\">organization<\/span>, including any premises devoted in whole or in part to the <span class=\"dictionary\">conduct<\/span> of <span class=\"dictionary\">charitable gaming<\/span>. These individuals may enter such places or premises for the purpose of carrying out any duty imposed by this article, securing records required to be maintained by an <span class=\"dictionary\">organization<\/span>, investigating complaints, or conducting audits. <a id=\"paragraph-269417\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.18\/#2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"3\"><p><span class=\"prefix-number\">3.<\/span> The <span class=\"dictionary\">Department<\/span> may compel the production of any books, documents, records, or memoranda of any <span class=\"dictionary\">organization<\/span>, <span class=\"dictionary\">electronic gaming manufacturer<\/span>, or <span class=\"dictionary\">supplier<\/span> involved in the <span class=\"dictionary\">conduct<\/span> of <span class=\"dictionary\">charitable gaming<\/span> for the purpose of satisfying itself that this article and its regulations are strictly complied with. In addition, the <span class=\"dictionary\">Department<\/span> may require the production of an annual balance sheet and operating statement of any person granted a <span class=\"dictionary\">permit<\/span> pursuant to the provisions of this article and may require the production of any <span class=\"dictionary\">contract<\/span> to which such person is or may be a <span class=\"dictionary\">party<\/span>. <a id=\"paragraph-269418\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.18\/#3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"4\"><p><span class=\"prefix-number\">4.<\/span> The <span class=\"dictionary\">Department<\/span> may <span class=\"dictionary\">issue<\/span> <span class=\"dictionary\">subpoenas<\/span> for the attendance of witnesses before it, administer <span class=\"dictionary\">oaths<\/span>, and compel production of records or other documents and <span class=\"dictionary\">testimony<\/span> of such witnesses whenever, in the <span class=\"dictionary\">judgment<\/span> of the <span class=\"dictionary\">Department<\/span>, it is necessary to do so for the effectual discharge of its duties. <a id=\"paragraph-269419\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.18\/#4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"5\"><p><span class=\"prefix-number\">5.<\/span> The <span class=\"dictionary\">Department<\/span> may compel any person conducting <span class=\"dictionary\">charitable gaming<\/span> to file with the <span class=\"dictionary\">Department<\/span> such documents, information, or data as shall appear to the <span class=\"dictionary\">Department<\/span> to be necessary for the performance of its duties. <a id=\"paragraph-269420\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.18\/#5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"6\"><p><span class=\"prefix-number\">6.<\/span> The <span class=\"dictionary\">Department<\/span> may enter into arrangements with any governmental agency of this or any other state or any locality in the Commonwealth or any agency of the federal government for the purposes of exchanging information or performing any other act to better ensure the proper <span class=\"dictionary\">conduct<\/span> of <span class=\"dictionary\">charitable gaming<\/span>. <a id=\"paragraph-269421\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.18\/#6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"7\"><p><span class=\"prefix-number\">7.<\/span> The <span class=\"dictionary\">Department<\/span> may <span class=\"dictionary\">issue<\/span> a <span class=\"dictionary\">charitable gaming permit<\/span> while the permittee&#8217;s tax-exempt status is pending approval by the Internal Revenue Service. <a id=\"paragraph-269422\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.18\/#7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"8\"><p><span class=\"prefix-number\">8.<\/span> The <span class=\"dictionary\">Department<\/span> shall report annually to the Governor and the General Assembly, which report shall include a financial statement of the <span class=\"dictionary\">operation<\/span> of the <span class=\"dictionary\">Department<\/span> and any recommendations for legislation applicable to charitable gaming in the Commonwealth. <a id=\"paragraph-269423\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.18\/#8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"9\"><p><span class=\"prefix-number\">9.<\/span> The <span class=\"dictionary\">Department<\/span>, its agents, and employees may <span class=\"dictionary\">conduct<\/span> such audits, in addition to those required by &#xA7; <a class=\"law\" title=\"Audit of reports; exemption; audit and administration fee; additional assessment of gross receipts and electronic gaming adjusted gross receipts\" href=\"\/18.2-340.31\/\">18.2-340.31<\/a>, as they deem necessary and desirable. <a id=\"paragraph-269424\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.18\/#9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"10\"><p><span class=\"prefix-number\">10.<\/span> The <span class=\"dictionary\">Department<\/span> may limit the number of <span class=\"dictionary\">organizations<\/span> for which a person may manage, operate, or <span class=\"dictionary\">conduct<\/span> <span class=\"dictionary\">charitable games<\/span>. <a id=\"paragraph-269425\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.18\/#10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"11\"><p><span class=\"prefix-number\">11.<\/span> The <span class=\"dictionary\">Department<\/span> may promulgate regulations that require any <span class=\"dictionary\">landlord<\/span> that leases to a <span class=\"dictionary\">qualified organization<\/span> any premises devoted in whole or in part to the <span class=\"dictionary\">conduct<\/span> of <span class=\"dictionary\">bingo<\/span> games or any other charitable gaming to register with the <span class=\"dictionary\">Department<\/span>. <a id=\"paragraph-269426\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.18\/#11\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"12\"><p><span class=\"prefix-number\">12.<\/span> The <span class=\"dictionary\">Department<\/span> may report any alleged criminal violation of this article to the appropriate attorney for the Commonwealth for appropriate action. <a id=\"paragraph-269427\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.18\/#12\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"13\"><p><span class=\"prefix-number\">13.<\/span> Beginning July 1, 2024, and at least once every five years thereafter, the <span class=\"dictionary\">Department<\/span> shall convene a stakeholder work group to review the limitations on prize amounts and provide any recommendations to the General Assembly by November 30 of the year in which the stakeholder work group is convened. <a id=\"paragraph-269428\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.18\/#13\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nPOWERS AND DUTIES OF THE DEPARTMENT (\u00a7 18.2-340.18)\n\nThe Department shall have all powers and duties necessary to carry out the\nprovisions of this article and to exercise the control of charitable gaming as\nset forth in \u00a7 18.2-340.15.
