I, cc. 14, 499, 520; 2022, cc. 554, 609, 722, 767; 2024, cc. 445, 504, 593; 2025, c. 336.","full_text":"A\n\nThe Department shall adopt regulations that:1\n\nRequire, as a condition of receiving a charitable gaming permit or authorization to conduct electronic gaming, that the applicant use a predetermined percentage of its receipts for those lawful religious, charitable, community, or educational purposes for which the organization is specifically chartered or organized, including (i) those expenses relating to the acquisition, construction, maintenance, or repair of any interest in real property or (ii) expenses related to the rental of real property by an organization as described by subdivision 5, 6, or 7 of the definition of &#8220;social organization&#8221; in &#xA7; 18.2-340.16 where such real property is involved in the operation of the organization and used for lawful religious, charitable, community, or educational purposes, as follows:\n\t\t\t\ta. With respect to charitable gaming, other than electronic gaming, a predetermined percentage of its gross receipts.\n\t\t\t\tb. With respect to electronic gaming, a predetermined percentage of its electronic gaming adjusted gross receipts.2\n\nSpecify the conditions under which a complete list of the organization&#8217;s members who participate in the management, operation, or conduct of charitable gaming may be required in order for the Department to ascertain the percentage of Virginia residents in accordance with subdivision A 3 of &#xA7; 18.2-340.24.\n\t\t\t\tMembership lists furnished to the Department in accordance with this subdivision shall not be a matter of public record and shall be exempt from disclosure under the provisions of the Freedom of Information Act (&#xA7; 2.2-3700 et seq.).3\n\nPrescribe fees for processing applications for charitable gaming permits and authorizing social organizations to conduct electronic gaming. Such fees may reflect the nature and extent of the charitable gaming activity proposed to be conducted.4\n\nEstablish requirements for the audit of all reports required in accordance with &#xA7;&#xA7; 18.2-340.30 and 18.2-340.30:2.5\n\nDefine electronic and mechanical equipment used in the conduct of charitable gaming. Department regulations shall include capacity for such equipment to provide full automatic daubing as numbers are called. For the purposes of this subdivision, electronic or mechanical equipment for instant bingo, pull tabs, or seal cards shall include such equipment that displays facsimiles of instant bingo, pull tabs, or seal cards and are used solely for the purpose of dispensing or opening such paper or electronic cards, or both; but shall not include (i) devices operated by dropping one or more coins or tokens into a slot and pulling a handle or pushing a button or touchpoint on a touchscreen to activate one to three or more reels marked into horizontal segments by varying symbols, where the predetermined prize amount depends on how and how many of the symbols line up when the rotating reels come to rest, or (ii) other similar devices that display flashing lights or illuminations, or bells, whistles, or other sounds, solely intended to entice players to play. Such regulations shall not prohibit (a) devices that display spinning, rotating, or rolling reels or animations or flashing lights; (b) devices that accept vouchers; (c) the purchase and play of an electronic pull tab with a single press or touch of a button; or (d) the use of multiple video monitors or touchscreens on an electronic gaming device.6\n\nPrescribe the conditions under which a qualified organization may (i) provide food and nonalcoholic beverages to its members who participate in the management, operation, or conduct of bingo; (ii) permit members who participate in the management, operation, or conduct of bingo to play bingo; and (iii) subject to the provisions of subdivision 12 of &#xA7; 18.2-340.33, permit nonmembers to participate in the conduct of bingo so long as the nonmembers are under the direct supervision of a bona fide member of the organization during the bingo game.7\n\nPrescribe the conditions under which a qualified organization may sell raffle tickets for a raffle drawing that will be held outside the Commonwealth pursuant to subsection B of &#xA7; 18.2-340.26.8\n\nPrescribe the conditions under which persons who are bona fide members of a qualified organization or a child, above the age of 13 years, of a bona fide member of such organization may participate in the conduct or operation of bingo games.9\n\nPrescribe the conditions under which a person below the age of 18 years may play bingo, provided that such person is accompanied by his parent or legal guardian.10\n\nRequire all qualified organizations that are subject to Department regulations to post in a conspicuous place in every place where charitable gaming is conducted a sign that bears a toll-free telephone number for the National Problem Gambling Helpline.11\n\nRequire all qualified organizations that are subject to Department regulations to post in a conspicuous place in every place where charitable gaming is conducted a sign that bears the toll-free telephone number and website for the illegal gaming tip line established and administered by the Office of the Gaming Enforcement Coordinator in the Department of State Police pursuant to &#xA7; 52-54 for members of the public to report concerns about, or suspected instances of, illegal gaming activities.12\n\nPrescribe the conditions under which a qualified organization may sell network bingo cards in accordance with &#xA7; 18.2-340.28:1 and establish a percentage of proceeds derived from network bingo sales to be allocated to (i) prize pools, (ii) the organization conducting the network bingo, and (iii) the network bingo provider. The regulations shall also establish procedures for the retainage and ultimate distribution of any unclaimed prize.13\n\nPrescribe the conditions under which a qualified organization may manage, operate, or contract with operators of, or conduct Texas Hold&#8217;em poker tournaments.14\n\nPrescribe the conditions under which a qualified organization may lease the premises of a permitted social organization for the purpose of conducting bingo, network bingo, instant bingo, pull tabs, seal cards, and electronic gaming permitted under this article and establish requirements for proper financial reporting of all disbursements, gross receipts, and electronic gaming adjusted gross receipts and payment of all fees required under this article.B\n\nThe Commissioner may, by regulation, approve variations to the card formats for bingo games, provided that such variations result in bingo games that are conducted in a manner consistent with the provisions of this article. in &#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/18.2-340.16\/\">18.2-340.16<\/a> where such real property is involved in the <span class=\"dictionary\">operation<\/span> of the organization and used for lawful religious, charitable, community, or educational purposes, as follows:\n\t\t\t\ta. With respect to charitable gaming, other than electronic gaming, a predetermined percentage of its gross receipts.\n\t\t\t\tb. Such fees may reflect the nature and extent of the charitable gaming activity proposed to be conducted. <a id=\"paragraph-308099\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.19\/#A3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Establish requirements for the audit of all reports required in accordance with &#xA7;&#xA7; <a class=\"law\" title=\"Reports of gross receipts, electronic gaming adjusted gross receipts, and disbursements required; form of reports; failure to file\" href=\"\/18.2-340.30\/\">18.2-340.30<\/a> and <a class=\"law\" title=\"Reports of electronic gaming adjusted gross receipts by electronic gaming manufacturer required; form of reports; failure to file\" href=\"\/18.2-340.30_2\/\">18.2-340.30:2<\/a>. <a id=\"paragraph-308100\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.19\/#A4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Define electronic and mechanical equipment used in the <span class=\"dictionary\">conduct<\/span> of charitable gaming. <span class=\"dictionary\">Department<\/span> regulations shall include capacity for such equipment to provide full automatic daubing as numbers are called. For the purposes of this subdivision, electronic or mechanical equipment for instant <span class=\"dictionary\">bingo<\/span>, pull tabs, or <span class=\"dictionary\">seal cards<\/span> shall include such equipment that displays facsimiles of instant <span class=\"dictionary\">bingo<\/span>, pull tabs, or <span class=\"dictionary\">seal cards<\/span> and are used solely for the purpose of dispensing or opening such paper or electronic cards, or both; but shall not include (i) devices operated by dropping one or more coins or tokens into a slot and pulling a handle or pushing a button or touchpoint on a touchscreen to activate one to three or more reels marked into horizontal segments by varying symbols, where the predetermined prize amount depends on how and how many of the symbols line up when the rotating reels come to rest, or (ii) other similar devices that display flashing lights or illuminations, or bells, whistles, or other sounds, solely intended to entice players to play. Such regulations shall not prohibit (a) devices that display spinning, rotating, or rolling reels or animations or flashing lights; (b) devices that accept vouchers; (c) the purchase and play of an electronic pull tab with a single press or touch of a button; or (d) the use of multiple video monitors or touchscreens on an electronic gaming device. <a id=\"paragraph-308101\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.19\/#A5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Prescribe the conditions under which a <span class=\"dictionary\">qualified organization<\/span> may (i) provide food and nonalcoholic beverages to its members who participate in the <span class=\"dictionary\">management<\/span>, <span class=\"dictionary\">operation<\/span>, or <span class=\"dictionary\">conduct<\/span> of <span class=\"dictionary\">bingo<\/span>; (ii) permit members who participate in the <span class=\"dictionary\">management<\/span>, <span class=\"dictionary\">operation<\/span>, or <span class=\"dictionary\">conduct<\/span> of <span class=\"dictionary\">bingo<\/span> to play <span class=\"dictionary\">bingo<\/span>; and (iii) subject to the provisions of subdivision 12 of &#xA7; <a class=\"law\" title=\"Prohibited practices\" href=\"\/18.2-340.33\/\">18.2-340.33<\/a>, permit nonmembers to participate in the <span class=\"dictionary\">conduct<\/span> of <span class=\"dictionary\">bingo<\/span> so long as the nonmembers are under the direct supervision of a <span class=\"dictionary\">bona fide member<\/span> of the organization during the <span class=\"dictionary\">bingo<\/span> game. <a id=\"paragraph-308102\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.19\/#A6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Prescribe the conditions under which a <span class=\"dictionary\">qualified organization<\/span> may sell <span class=\"dictionary\">raffle<\/span> tickets for a <span class=\"dictionary\">raffle<\/span> drawing that will be held outside the Commonwealth pursuant to subsection B of &#xA7; <a class=\"law\" title=\"Sale of raffle tickets; drawings\" href=\"\/18.2-340.26\/\">18.2-340.26<\/a>. <a id=\"paragraph-308103\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.19\/#A7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> Prescribe the conditions under which persons who are <span class=\"dictionary\">bona fide members<\/span> of a <span class=\"dictionary\">qualified organization<\/span> or a child, above the age of 13 years, of a <span class=\"dictionary\">bona fide member<\/span> of such organization may participate in the <span class=\"dictionary\">conduct<\/span> or <span class=\"dictionary\">operation<\/span> of <span class=\"dictionary\">bingo<\/span> games. <a id=\"paragraph-308104\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.19\/#A8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> Prescribe the conditions under which a person below the age of 18 years may play <span class=\"dictionary\">bingo<\/span>, provided that such person is accompanied by his parent or legal guardian. <a id=\"paragraph-308105\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.19\/#A9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> Require all <span class=\"dictionary\">qualified organizations<\/span> that are subject to <span class=\"dictionary\">Department<\/span> regulations to post in a conspicuous place in every place where charitable gaming is conducted a sign that bears a toll-free telephone number for the National Problem Gambling Helpline. <a id=\"paragraph-308106\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.19\/#A10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A11\" class=\"indent-1\"><p><span class=\"prefix-number\">11.<\/span> Require all <span class=\"dictionary\">qualified organizations<\/span> that are subject to <span class=\"dictionary\">Department<\/span> regulations to post in a conspicuous place in every place where charitable gaming is conducted a sign that bears the toll-free telephone number and website for the illegal gaming tip line established and administered by the Office of the Gaming Enforcement Coordinator in the <span class=\"dictionary\">Department<\/span> of State Police pursuant to &#xA7; <a class=\"law\" title=\"Office of the Gaming Enforcement Coordinator established; purpose; duties\" href=\"\/52-54\/\">52-54<\/a> for members of the public to report concerns about, or suspected instances of, illegal gaming activities. <a id=\"paragraph-308107\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.19\/#A11\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A12\" class=\"indent-1\"><p><span class=\"prefix-number\">12.<\/span> Prescribe the conditions under which a <span class=\"dictionary\">qualified organization<\/span> may sell network bingo cards in accordance with &#xA7; <a class=\"law\" title=\"Conduct of network bingo\" href=\"\/18.2-340.28_1\/\">18.2-340.28:1<\/a> and establish a percentage of proceeds derived from network bingo sales to be allocated to (i) prize pools, (ii) the organization conducting the network bingo, and (iii) the <span class=\"dictionary\">network bingo provider<\/span>. The regulations shall also establish procedures for the retainage and ultimate distribution of any unclaimed prize. <a id=\"paragraph-308108\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.19\/#A12\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A13\" class=\"indent-1\"><p><span class=\"prefix-number\">13.<\/span> Prescribe the conditions under which a <span class=\"dictionary\">qualified organization<\/span> may manage, operate, or <span class=\"dictionary\">contract<\/span> with operators of, or <span class=\"dictionary\">conduct<\/span> Texas Hold&#8217;em poker <span class=\"dictionary\">tournaments<\/span>. <a id=\"paragraph-308109\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.19\/#A13\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A14\" class=\"indent-1\"><p><span class=\"prefix-number\">14.<\/span> Prescribe the conditions under which a <span class=\"dictionary\">qualified organization<\/span> may lease the premises of a permitted <span class=\"dictionary\">social organization<\/span> for the purpose of conducting bingo, network bingo, instant bingo, pull tabs, <span class=\"dictionary\">seal cards<\/span>, and electronic gaming permitted under this article and establish requirements for proper financial reporting of all disbursements, gross receipts, and <span class=\"dictionary\">electronic gaming adjusted gross receipts<\/span> and payment of all fees required under this article. <a id=\"paragraph-308110\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.19\/#A14\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> The <span class=\"dictionary\">Commissioner<\/span> may, by regulation, approve variations to the card formats for bingo games, provided that such variations result in bingo games that are conducted in a manner consistent with the provisions of this article. <span class=\"dictionary\">Department<\/span>-approved variations may include bingo games commonly referred to as player selection games and 90-number bingo. <a id=\"paragraph-308111\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.19\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nREGULATIONS OF THE DEPARTMENT (\u00a7 18.2-340.19)\n\nA. Specify the conditions under which a complete list of the\n   organization&#8217;s members who participate in the management, operation, or\n   conduct of charitable gaming may be required in order for the Department to\n   ascertain the percentage of Virginia residents in accordance with subdivision\n   A 3 of &#xA7; 18.2-340.24.\n   \t\t\t\tMembership lists furnished to the Department in accordance with this\n   subdivision shall not be a matter of public record and shall be exempt from\n   disclosure under the provisions of the Freedom of Information Act (&#xA7;\n   2.2-3700 et seq.).\n\n   3. Prescribe fees for processing applications for charitable gaming permits\n   and authorizing social organizations to conduct electronic gaming. Such fees\n   may reflect the nature and extent of the charitable gaming activity proposed\n   to be conducted.\n\n   4. Establish requirements for the audit of all reports required in accordance\n   with &#xA7;&#xA7; 18.2-340.30 and 18.2-340.30:2.\n\n   5. Define electronic and mechanical equipment used in the conduct of\n   charitable gaming. Department regulations shall include capacity for such\n   equipment to provide full automatic daubing as numbers are called. For the\n   purposes of this subdivision, electronic or mechanical equipment for instant\n   bingo, pull tabs, or seal cards shall include such equipment that displays\n   facsimiles of instant bingo, pull tabs, or seal cards and are used solely for\n   the purpose of dispensing or opening such paper or electronic cards, or both;\n   but shall not include (i) devices operated by dropping one or more coins or\n   tokens into a slot and pulling a handle or pushing a button or touchpoint on a\n   touchscreen to activate one to three or more reels marked into horizontal\n   segments by varying symbols, where the predetermined prize amount depends on\n   how and how many of the symbols line up when the rotating reels come to rest,\n   or (ii) other similar devices that display flashing lights or illuminations,\n   or bells, whistles, or other sounds, solely intended to entice players to\n   play. Such regulations shall not prohibit (a) devices that display spinning,\n   rotating, or rolling reels or animations or flashing lights; (b) devices that\n   accept vouchers; (c) the purchase and play of an electronic pull tab with a\n   single press or touch of a button; or (d) the use of multiple video monitors\n   or touchscreens on an electronic gaming device.\n\n   6. Prescribe the conditions under which a qualified organization may (i)\n   provide food and nonalcoholic beverages to its members who participate in the\n   management, operation, or conduct of bingo; (ii) permit members who\n   participate in the management, operation, or conduct of bingo to play bingo;\n   and (iii) subject to the provisions of subdivision 12 of &#xA7; 18.2-340.33,\n   permit nonmembers to participate in the conduct of bingo so long as the\n   nonmembers are under the direct supervision of a bona fide member of the\n   organization during the bingo game.\n\n   7. Prescribe the conditions under which a qualified organization may sell\n   raffle tickets for a raffle drawing that will be held outside the Commonwealth\n   pursuant to subsection B of &#xA7; 18.2-340.26.\n\n   8. Prescribe the conditions under which persons who are bona fide members of a\n   qualified organization or a child, above the age of 13 years, of a bona fide\n   member of such organization may participate in the conduct or operation of\n   bingo games.\n\n   9. Prescribe the conditions under which a person below the age of 18 years may\n   play bingo, provided that such person is accompanied by his parent or legal\n   guardian.\n\n   10. Require all qualified organizations that are subject to Department\n   regulations to post in a conspicuous place in every place where charitable\n   gaming is conducted a sign that bears a toll-free telephone number for the\n   National Problem Gambling Helpline.\n\n   11. Require all qualified organizations that are subject to Department\n   regulations to post in a conspicuous place in every place where charitable\n   gaming is conducted a sign that bears the toll-free telephone number and\n   website for the illegal gaming tip line established and administered by the\n   Office of the Gaming Enforcement Coordinator in the Department of State Police\n   pursuant to &#xA7; 52-54 for members of the public to report concerns about,\n   or suspected instances of, illegal gaming activities.\n\n   12. Prescribe the conditions under which a qualified organization may sell\n   network bingo cards in accordance with &#xA7; 18.2-340.28:1 and establish a\n   percentage of proceeds derived from network bingo sales to be allocated to (i)\n   prize pools, (ii) the organization conducting the network bingo, and (iii) the\n   network bingo provider. The regulations shall also establish procedures for\n   the retainage and ultimate distribution of any unclaimed prize.\n\n   13. Prescribe the conditions under which a qualified organization may manage,\n   operate, or contract with operators of, or conduct Texas Hold&#8217;em poker\n   tournaments.\n\n   14. Prescribe the conditions under which a qualified organization may lease\n   the premises of a permitted social organization for the purpose of conducting\n   bingo, network bingo, instant bingo, pull tabs, seal cards, and electronic\n   gaming permitted under this article and establish requirements for proper\n   financial reporting of all disbursements, gross receipts, and electronic\n   gaming adjusted gross receipts and payment of all fees required under this\n   article.\n\nB.
