I, c. 520; 2022, cc. 554, 609, 722, 767; 2023, cc. 592, 593, 594, 787.","full_text":"A\n\nNo organization that reasonably expects, on the basis of prior charitable gaming annual results or any other quantifiable method, to realize gross receipts of $40,000 or less in any 12-month period from raffles conducted in accordance with the provisions of this article shall be required to (i) notify the Department of its intention to conduct raffles or (ii) comply with Department regulations governing raffles.B\n\nAny organization that reasonably expects, on the basis of prior charitable gaming annual results or any other quantifiable method, to realize gross receipts of $40,000 or less from all charitable gaming other than raffles on a total of no more than seven days per calendar year shall be required to register with the Department pursuant to the provisions of &#xA7; 18.2-340.24:1.C\n\nIf any organization&#8217;s actual gross receipts from raffles for the 12-month period exceed $40,000 as described in subsection A or actual gross receipts from all charitable gaming other than raffles conducted on a total of no more than seven days per calendar year exceed $40,000 as described in subsection B, the Department shall require the organization to obtain a permit pursuant to the provisions of &#xA7; 18.2-340.25 and file by a specified date the report required by &#xA7; 18.2-340.30.D\n\nAny (i) organization described in subdivision 18 of the definition of &#8220;organization&#8221; in &#xA7; 18.2-340.16 or (ii) volunteer fire department or volunteer emergency medical services agency or auxiliary unit thereof that has been recognized in accordance with &#xA7; 15.2-955 by an ordinance or resolution of the political subdivision where the volunteer fire department or volunteer emergency medical services agency is located as being part of the safety program of such political subdivision shall be exempt from the payment of application fees required by &#xA7; 18.2-340.25 and the payment of audit fees required by &#xA7; 18.2-340.31. Any such organization, department, agency, or unit that conducts electronic gaming shall be subject to such application fees and audit fees for its electronic gaming activities; however, in accordance with the provisions of &#xA7; 18.2-340.31, any audit fees may be paid by either the organization or the electronic gaming manufacturer whose electronic gaming devices are present on the premises of the organization, department, agency, or unit. application fee; form of application","order_by":null,"url":"\/18.2-340.25\/"},{"id":81497,"section_number":"18.2-340.31","catch_line":"Audit of reports; exemption; audit and administration fee; additional assessment of gross receipts and electronic gaming adjusted gross receipts","order_by":null,"url":"\/18.2-340.31\/"}],"permalink":{"id":167533,"object_type":"law","relational_id":84287,"identifier":"18.2-340.23","token":"18.2\/8\/1.1%3A1\/18.2-340.23","url":"\/18.2-340.23\/","edition_id":1,"permalink":0,"preferred":1},"url":"\/18.2-340.23\/","token":"18.2\/8\/1.1%3A1\/18.2-340.23","dublin_core":{"Title":"Organizations exempt from certain fees and reports","Type":"Text","Format":"text\/html","Identifier":"\u00a7 18.2-340.23","Relation":"Code of Virginia"},"html":"\n\t\t\t\t\t\t<section id=\"A\"><p><span class=\"prefix-number\">A.<\/span> No <span class=\"dictionary\">organization<\/span> that reasonably expects, on the basis of prior <span class=\"dictionary\">charitable gaming<\/span> annual results or any other quantifiable method, to realize <span class=\"dictionary\">gross receipts<\/span> of $40,000 or less in any 12-month period from <span class=\"dictionary\">raffles<\/span> conducted in accordance with the provisions of this article shall be required to (i) notify the <span class=\"dictionary\">Department<\/span> of its intention to <span class=\"dictionary\">conduct<\/span> <span class=\"dictionary\">raffles<\/span> or (ii) comply with <span class=\"dictionary\">Department<\/span> regulations governing <span class=\"dictionary\">raffles<\/span>. <a id=\"paragraph-302154\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.23\/#A\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> Any <span class=\"dictionary\">organization<\/span> that reasonably expects, on the basis of prior <span class=\"dictionary\">charitable gaming<\/span> annual results or any other quantifiable method, to realize <span class=\"dictionary\">gross receipts<\/span> of $40,000 or less from all <span class=\"dictionary\">charitable gaming<\/span> other than <span class=\"dictionary\">raffles<\/span> on a total of no more than seven days per calendar year shall be required to register with the <span class=\"dictionary\">Department<\/span> pursuant to the provisions of &#xA7; <a class=\"law\" title=\"Registration requirements; certain organizations\" href=\"\/18.2-340.24_1\/\">18.2-340.24:1<\/a>. <a id=\"paragraph-302155\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.23\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> If any <span class=\"dictionary\">organization<\/span>&#8217;s actual <span class=\"dictionary\">gross receipts<\/span> from <span class=\"dictionary\">raffles<\/span> for the 12-month period exceed $40,000 as described in subsection A or actual <span class=\"dictionary\">gross receipts<\/span> from all <span class=\"dictionary\">charitable gaming<\/span> other than <span class=\"dictionary\">raffles<\/span> conducted on a total of no more than seven days per calendar year exceed $40,000 as described in subsection B, the <span class=\"dictionary\">Department<\/span> shall require the <span class=\"dictionary\">organization<\/span> to obtain a <span class=\"dictionary\">permit<\/span> pursuant to the provisions of &#xA7; <a class=\"law\" title=\"Permit required; application fee; form of application\" href=\"\/18.2-340.25\/\">18.2-340.25<\/a> and file by a specified date the report required by &#xA7; <a class=\"law\" title=\"Reports of gross receipts, electronic gaming adjusted gross receipts, and disbursements required; form of reports; failure to file\" href=\"\/18.2-340.30\/\">18.2-340.30<\/a>. <a id=\"paragraph-302156\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.23\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Any (i) <span class=\"dictionary\">organization<\/span> described in subdivision 18 of the definition of &#8220;<span class=\"dictionary\">organization<\/span>&#8221; in &#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/18.2-340.16\/\">18.2-340.16<\/a> or (ii) volunteer fire <span class=\"dictionary\">department<\/span> or volunteer emergency medical services agency or auxiliary unit thereof that has been recognized in accordance with &#xA7; <a class=\"law\" title=\"Approval by local governing body for the establishment of volunteer emergency medical services agencies and firefighting organizations\" href=\"\/15.2-955\/\">15.2-955<\/a> by an <span class=\"dictionary\">ordinance<\/span> or resolution of the political subdivision where the volunteer fire <span class=\"dictionary\">department<\/span> or volunteer emergency medical services agency is located as being part of the safety program of such political subdivision shall be exempt from the payment of application fees required by &#xA7; <a class=\"law\" title=\"Permit required; application fee; form of application\" href=\"\/18.2-340.25\/\">18.2-340.25<\/a> and the payment of audit fees required by &#xA7; <a class=\"law\" title=\"Audit of reports; exemption; audit and administration fee; additional assessment of gross receipts and electronic gaming adjusted gross receipts\" href=\"\/18.2-340.31\/\">18.2-340.31<\/a>. Any such <span class=\"dictionary\">organization<\/span>, <span class=\"dictionary\">department<\/span>, agency, or unit that <span class=\"dictionary\">conducts<\/span> electronic gaming shall be subject to such application fees and audit fees for its electronic gaming activities; however, in accordance with the provisions of &#xA7; <a class=\"law\" title=\"Audit of reports; exemption; audit and administration fee; additional assessment of gross receipts and electronic gaming adjusted gross receipts\" href=\"\/18.2-340.31\/\">18.2-340.31<\/a>, any audit fees may be paid by either the <span class=\"dictionary\">organization<\/span> or the <span class=\"dictionary\">electronic gaming manufacturer<\/span> whose electronic gaming devices are present on the premises of the <span class=\"dictionary\">organization<\/span>, <span class=\"dictionary\">department<\/span>, agency, or unit. Nothing in this subsection shall be construed as exempting any <span class=\"dictionary\">organizations<\/span> described in subdivision 18 of the definition of &#8220;<span class=\"dictionary\">organization<\/span>&#8221; in &#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/18.2-340.16\/\">18.2-340.16<\/a>, volunteer fire <span class=\"dictionary\">departments<\/span>, or volunteer emergency medical services agencies from any other provisions of this article or other <span class=\"dictionary\">Department<\/span> regulations. <a id=\"paragraph-302157\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.23\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> Nothing in this section shall prevent the <span class=\"dictionary\">Department<\/span> from conducting any investigation or audit it deems appropriate to ensure an <span class=\"dictionary\">organization<\/span>&#8217;s compliance with the provisions of this article and, to the extent applicable, <span class=\"dictionary\">Department<\/span> regulations. <a id=\"paragraph-302158\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/18.2-340.23\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nORGANIZATIONS EXEMPT FROM CERTAIN FEES AND REPORTS (\u00a7 18.2-340.23)\n\nA. No organization that reasonably expects, on the basis of prior charitable\ngaming annual results or any other quantifiable method, to realize gross\nreceipts of $40,000 or less in any 12-month period from raffles conducted in\naccordance with the provisions of this article shall be required to (i) notify\nthe Department of its intention to conduct raffles or (ii) comply with\nDepartment regulations governing raffles.\n\nB. Any organization that reasonably expects, on the basis of prior charitable\ngaming annual results or any other quantifiable method, to realize gross\nreceipts of $40,000 or less from all charitable gaming other than raffles on a\ntotal of no more than seven days per calendar year shall be required to register\nwith the Department pursuant to the provisions of &#xA7; 18.2-340.24:1.\n\nC. If any organization&#8217;s actual gross receipts from raffles for the\n12-month period exceed $40,000 as described in subsection A or actual gross\nreceipts from all charitable gaming other than raffles conducted on a total of\nno more than seven days per calendar year exceed $40,000 as described in\nsubsection B, the Department shall require the organization to obtain a permit\npursuant to the provisions of &#xA7; 18.2-340.25 and file by a specified date\nthe report required by &#xA7; 18.2-340.30.\n\nD. Any (i) organization described in subdivision 18 of the definition of\n&#8220;organization&#8221; in &#xA7; 18.2-340.16 or (ii) volunteer fire\ndepartment or volunteer emergency medical services agency or auxiliary unit\nthereof that has been recognized in accordance with &#xA7; 15.2-955 by an\nordinance or resolution of the political subdivision where the volunteer fire\ndepartment or volunteer emergency medical services agency is located as being\npart of the safety program of such political subdivision shall be exempt from\nthe payment of application fees required by &#xA7; 18.2-340.25 and the payment\nof audit fees required by &#xA7; 18.2-340.31. Any such organization, department,\nagency, or unit that conducts electronic gaming shall be subject to such\napplication fees and audit fees for its electronic gaming activities; however,\nin accordance with the provisions of &#xA7; 18.2-340.31, any audit fees may be\npaid by either the organization or the electronic gaming manufacturer whose\nelectronic gaming devices are present on the premises of the organization,\ndepartment, agency, or unit. Nothing in this subsection shall be construed as\nexempting any organizations described in subdivision 18 of the definition of\n&#8220;organization&#8221; in &#xA7; 18.2-340.16, volunteer fire departments, or\nvolunteer emergency medical services agencies from any other provisions of this\narticle or other Department regulations.\n\nE.
