Upon <span class=\"dictionary\">conviction<\/span>, the sentence of such person shall include a mandatory minimum term of imprisonment of two years.\n\t\tIf any person unlawfully, but not maliciously, with the <span class=\"dictionary\">intent<\/span> aforesaid, causes bodily injury to another by any means, knowing or having reason to know such other person is a <span class=\"dictionary\">law-enforcement officer<\/span>, firefighter, as defined in \u00a7&nbsp;<a class=\"law\" title=\"Coverage of firefighters and law-enforcement officers in off-duty capacity\" href=\"\/65.2-102\/\">65.2-102<\/a>, <span class=\"dictionary\">search and rescue personnel<\/span>, or emergency medical services personnel, engaged in the performance of his public duties as a <span class=\"dictionary\">law-enforcement officer<\/span>, firefighter, <span class=\"dictionary\">search and rescue personnel<\/span>, or emergency medical services personnel as defined in \u00a7&nbsp;<a class=\"law\" title=\"Definitions\" href=\"\/32.1-111.1\/\">32.1-111.1<\/a>, he is guilty of a Class 6 <span class=\"dictionary\">felony<\/span>, and upon <span class=\"dictionary\">conviction<\/span>, the sentence of such person shall include a mandatory minimum term of imprisonment of one year.\n\t\tNothing in this section shall be construed to affect the right of any person charged with a violation of this section from asserting and presenting <span class=\"dictionary\">evidence<\/span> in support of any defenses to the charge that may be available under <span class=\"dictionary\">common law<\/span>.\n\t\tAs used in this section, &#8220;<span class=\"dictionary\">law-enforcement officer<\/span>&#8221; means any full-time or part-time employee of a police department or sheriff&#8217;s office that is part of or administered by the Commonwealth or any political subdivision thereof, who is responsible for the prevention or detection of <span class=\"dictionary\">crime<\/span> and the enforcement of the penal, traffic, or highway <span class=\"dictionary\">laws<\/span> of the Commonwealth; any conservation officer of the Department of Conservation and Recreation commissioned pursuant to \u00a7&nbsp;<a class=\"law\" title=\"Appointment of conservation officers; qualifications; oath\" href=\"\/10.1-115\/\">10.1-115<\/a>; any conservation police officer appointed pursuant to \u00a7&nbsp;<a class=\"law\" title=\"Appointment of conservation police officers\" href=\"\/29.1-200\/\">29.1-200<\/a>; and auxiliary police officers appointed or provided for pursuant to \u00a7\u00a7&nbsp;<a class=\"law\" title=\"Establishment, etc., authorized; powers, authority and immunities generally\" href=\"\/15.2-1731\/\">15.2-1731<\/a> and <a class=\"law\" title=\"Appointment of auxiliary police officers; revocation of appointment; uniform; organization; rules and regulations\" href=\"\/15.2-1733\/\">15.2-1733<\/a> and auxiliary deputy sheriffs appointed pursuant to \u00a7&nbsp;<a class=\"law\" title=\"Appointment of deputies; their powers; how removed\" href=\"\/15.2-1603\/\">15.2-1603<\/a>.\n\t\tAs used in this section, &#8220;<span class=\"dictionary\">search and rescue personnel<\/span>&#8221; means any employee or member of a search and rescue organization that is authorized by a resolution or <span class=\"dictionary\">ordinance<\/span> duly adopted by the governing body of any county, city, or town of the Commonwealth or any member of a search and rescue organization operating under a <span class=\"dictionary\">memorandum<\/span> of understanding with the Virginia Department of Emergency Management.\n\t\tThe provisions of \u00a7&nbsp;<a class=\"law\" title=\"Shooting, stabbing, etc., with intent to maim, kill, etc\" href=\"\/18.2-51\/\">18.2-51<\/a> shall be deemed to provide a lesser-included <span class=\"dictionary\">offense<\/span> hereof.<\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nMALICIOUS BODILY INJURY TO LAW-ENFORCEMENT OFFICERS, FIREFIGHTERS, SEARCH AND\nRESCUE PERSONNEL, OR EMERGENCY MEDICAL SERVICES PERSONNEL; PENALTY;\nLESSER-INCLUDED OFFENSE (\u00a7 18.2-51.1)\n\nIf any person maliciously causes bodily injury to another by any means including\nthe means set out in \u00a7 18.2-52, with intent to maim, disfigure, disable or\nkill, and knowing or having reason to know that such other person is a\nlaw-enforcement officer, as defined hereinafter, firefighter, as defined in \u00a7\n65.2-102, search and rescue personnel as defined hereinafter, or emergency\nmedical services personnel, as defined in \u00a7 32.1-111.1 engaged in the\nperformance of his public duties as a law-enforcement officer, firefighter,\nsearch and rescue personnel, or emergency medical services personnel, such\nperson is guilty of a felony punishable by imprisonment for a period of not less\nthan five years nor more than 30 years and, subject to subdivision (g) of \u00a7\n18.2-10, a fine of not more than $100,000.
