The contents of the report required pursuant to this subsection shall be utilized by the local school division solely to implement the provisions of subsection B of § 22.1-296.2 and § 22.1-315.B\n\nThe report required pursuant to subsection A shall be transmitted to the division safety official (i) via certified mail, return receipt requested, to the mailing address identified by the division superintendent pursuant to subsection F of § 22.1-279.8 or (ii) via email to the email address identified by the division superintendent pursuant to subsection F of § 22.1-279.8. This law was first created in 1991. The record of its establishment is cataloged in chapter 2 of that year\u2019s edition of \u201cActs of Assembly,\u201d the annual state publication listing all changes made to the Code of Virginia in that year. Unfortunately, the 1991 \u201cActs\u201d aren\u2019t available online. It has been modified 10 times. Those modifications are cataloged by \u201cThe Acts of Assembly,\u201d a state publication, by year and chapter. Those modifications that can be read on the General Assembly\u2019s website will be linked accordingly. A.<\/span> Every state official or agency and every sheriff, police officer, or other local law<\/span>-enforcement officer or conservator of the peace having the power to arrest<\/span> for a felony<\/span>, upon arresting a person who is known or discovered by the arresting official to be a full-time, part-time, permanent, or temporary teacher or any other employee in any local school division in the Commonwealth for a felony<\/span> or a Class 1 misdemeanor<\/span> or an equivalent offense<\/span> in another state, shall file a report of such arrest<\/span> with the division safety official designated pursuant to subsection F of § 22.1-279.8<\/a> in the school division in which such person is employed as soon as practicable but no later than 48 hours after such arrest<\/span>. The contents of the report required pursuant to this subsection shall be utilized by the local school division solely to implement the provisions of subsection B of § 22.1-296.2<\/a> and § 22.1-315<\/a>. <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

B.<\/span> The report required pursuant to subsection A shall be transmitted to the division safety official (i) via certified mail, return receipt requested, to the mailing address identified by the division superintendent pursuant to subsection F of § 22.1-279.8<\/a> or (ii) via email to the email address identified by the division superintendent pursuant to subsection F of § 22.1-279.8<\/a>. Any certified mail return receipt shall be retained in the case file<\/span>. <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

C.<\/span> (Expires July 1, 2027) In the event that the law<\/span>-enforcement agency has existing access to Virginia Employment Commission records, each arresting official shall request in writing that the Virginia Employment Commission provide the name of the current employer of each person arrested for an offense<\/span> set forth in § 9.1-902<\/a> for purposes of determining whether a report is required pursuant to subsection A. <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

D.<\/span> Every state official or agency and every sheriff, police officer, or other local law<\/span>-enforcement officer or conservator of the peace having the power to arrest<\/span> for a felony<\/span> shall file a report, as soon as practicable, with the division superintendent of the school division in which the student is enrolled upon arresting a person who is known or discovered by the arresting official to be a student age 18 or older in any local school division in the Commonwealth for: <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

1.<\/span> A firearm offense<\/span> pursuant to Article 4 (§ 18.2-279<\/a> et seq.), 5 (§ 18.2-288<\/a> et seq.), 6 (§ 18.2-299<\/a> et seq.), 6.1 (§ 18.2-307.1<\/a> et seq.), or 7 (§ 18.2-308.1<\/a> et seq.) of Chapter 7 of Title 18.2; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

2.<\/span> Homicide<\/span>, pursuant to Article 1 (§ 18.2-30<\/a> et seq.) of Chapter 4 of Title 18.2; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

3.<\/span> Felonious assault<\/span> and bodily wounding, pursuant to Article 4 (§ 18.2-51<\/a> et seq.) of Chapter 4 of Title 18.2; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

4.<\/span> Criminal sexual assault<\/span>, pursuant to Article 7 (§ 18.2-61<\/a> et seq.) of Chapter 4 of Title 18.2; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

8.<\/span> Burglary<\/span> and related offenses<\/span>, pursuant to §§ 18.2-89<\/a> through 18.2-93<\/a>; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t
