Such regulations shall be developed in consultation with the state agencies with procurement responsibility and promulgated by those agencies in accordance with applicable law;7\n\nReceive and coordinate, with the appropriate state agency, the investigation of complaints that a business certified pursuant to this chapter has failed to comply with its subcontracting plan under subsection D of &#xA7; 2.2-4310. If the Department determines that a business certified pursuant to this chapter has failed to comply with the subcontracting plan, the business shall provide a written explanation; and8\n\nFacilitate relationships between established businesses and start-up women-owned and minority-owned businesses by creating and administering a mentorship program under the provisions of &#xA7; 2.2-1605.1.B\n\nIn addition, the Department shall serve as the liaison between the Commonwealth&#8217;s existing businesses and state government in order to promote the development of Virginia&#8217;s economy. To that end, the Department shall:1\n\nEncourage the training or retraining of individuals for specific employment opportunities at new or expanding business facilities in the Commonwealth;2\n\nDevelop and implement programs to assist small businesses in the Commonwealth in order to promote their growth and the creation and retention of jobs for Virginians;3\n\nEstablish an industry program that is the principal point of communication between basic employers in the Commonwealth and the state government that will address issues of significance to business;4\n\nMake available to existing businesses, in conjunction and cooperation with localities, chambers of commerce, and other public and private groups, basic information and pertinent factors of interest and concern to such businesses;5\n\nDevelop statistical reports on job creation and the general economic conditions in the Commonwealth; and6\n\nAnnually review and provide feedback on SWaM plans. The review shall focus on strategies state agencies can use to improve SWaM spending, increase procurement of goods and services from SWaM businesses, and meet procurement goals outlined in SWaM plans. The Department shall encourage state agencies to integrate such strategies with all current and future procurements. The Department shall suggest strategies that may be more effective or changes to strategies that have not been effective. Upon request of a state agency, the Department shall meet with the state agency one-on-one to discuss its SWaM goals and strategies and advise it on effective strategies. Such regulations shall be developed in consultation with the state agencies with procurement responsibility and promulgated by those agencies in accordance with applicable <span class=\"dictionary\">law<\/span>; <a id=\"paragraph-281522\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1605\/#A6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Receive and coordinate, with the appropriate <span class=\"dictionary\">state agency<\/span>, the investigation of complaints that a business certified pursuant to this chapter has failed to comply with its subcontracting plan under subsection D of &#xA7; <a class=\"law\" title=\"Discrimination prohibited; participation of small, women-owned, minority-owned, military family-owned, and service disabled veteran-owned businesses and employment services organizations\" href=\"\/2.2-4310\/\">2.2-4310<\/a>. If the <span class=\"dictionary\">Department<\/span> determines that a business certified pursuant to this chapter has failed to comply with the subcontracting plan, the business shall provide a written explanation; and <a id=\"paragraph-281523\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1605\/#A7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> Facilitate relationships between established businesses and start-up women-owned and minority-owned businesses by creating and administering a mentorship program under the provisions of &#xA7; <a class=\"law\" title=\"Mentorship program\" href=\"\/2.2-1605.1\/\">2.2-1605.1<\/a>. <a id=\"paragraph-281524\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1605\/#A8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> In addition, the <span class=\"dictionary\">Department<\/span> shall serve as the liaison between the Commonwealth&#8217;s existing businesses and state government in <span class=\"dictionary\">order<\/span> to promote the development of Virginia&#8217;s economy. To that end, the <span class=\"dictionary\">Department<\/span> shall: <a id=\"paragraph-281525\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1605\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Encourage the training or retraining of individuals for specific employment opportunities at new or expanding business facilities in the Commonwealth; <a id=\"paragraph-281526\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1605\/#B1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Develop and implement programs to assist small businesses in the Commonwealth in <span class=\"dictionary\">order<\/span> to promote their growth and the creation and retention of jobs for Virginians; <a id=\"paragraph-281527\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1605\/#B2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Establish an industry program that is the principal point of communication between basic employers in the Commonwealth and the state government that will address <span class=\"dictionary\">issues<\/span> of significance to business; <a id=\"paragraph-281528\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1605\/#B3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Make available to existing businesses, in conjunction and cooperation with localities, <span class=\"dictionary\">chambers<\/span> of commerce, and other public and private groups, basic information and pertinent factors of interest and concern to such businesses; <a id=\"paragraph-281529\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1605\/#B4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Develop statistical reports on job creation and the general economic conditions in the Commonwealth; and <a id=\"paragraph-281530\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1605\/#B5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Annually review and provide feedback on <span class=\"dictionary\">SWaM plans<\/span>. The review shall focus on strategies state agencies can use to improve SWaM spending, increase procurement of goods and services from SWaM businesses, and meet procurement goals outlined in <span class=\"dictionary\">SWaM plans<\/span>. The <span class=\"dictionary\">Department<\/span> shall encourage state agencies to integrate such strategies with all current and future procurements. The <span class=\"dictionary\">Department<\/span> shall suggest strategies that may be more effective or changes to strategies that have not been effective. Upon request of a <span class=\"dictionary\">state agency<\/span>, the <span class=\"dictionary\">Department<\/span> shall meet with the <span class=\"dictionary\">state agency<\/span> one-on-one to discuss its SWaM goals and strategies and advise it on effective strategies. The <span class=\"dictionary\">Department<\/span> shall research and compile information that state agencies can use to increase SWaM spending and shall develop and publish guidance on how state agencies can implement these strategies. <a id=\"paragraph-281531\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1605\/#B6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> All agencies of the Commonwealth shall assist the <span class=\"dictionary\">Department<\/span> upon request and furnish such information and assistance as the <span class=\"dictionary\">Department<\/span> may require in the discharge of its duties. <a id=\"paragraph-281532\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1605\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nPOWERS AND DUTIES OF DEPARTMENT (\u00a7 2.2-1605)\n\nA. The Department shall have the following powers and duties:\n\n   1. Coordinate as consistent with prevailing law the plans, programs, and\n   operations of the state government that affect or may contribute to the\n   establishment, preservation, and strengthening of small, women-owned, and\n   minority-owned businesses;\n\n   2. Promote the mobilization of activities and resources of state and local\n   governments, businesses and trade associations, baccalaureate institutions of\n   higher education, foundations, professional organizations, and volunteer and\n   other groups towards the growth of small businesses and businesses owned by\n   women and minorities, and facilitate the coordination of the efforts of these\n   groups with those of state departments and agencies;\n\n   3. Establish a center for the development, collection, summarization, and\n   dissemination of information that will be helpful to persons and organizations\n   throughout the nation in undertaking or promoting procurement from small,\n   women-owned, and minority-owned businesses;\n\n   4. Consistent with prevailing law and availability of funds, and according to\n   the Director&#8217;s discretion, provide technical and management assistance\n   to small, women-owned, and minority-owned businesses and defray all or part of\n   the costs of pilot or demonstration projects that are designed to overcome the\n   special problems of small, women-owned, and minority-owned businesses;\n\n   5. Advise the Small Business Financing Authority on the management and\n   administration of the Small, Women-owned, and Minority-owned Business Loan\n   Fund created pursuant to &#xA7; 2.2-2311.1;\n\n   6. Implement any remediation or enhancement measure for small, women-owned, or\n   minority-owned businesses as may be authorized by the Governor pursuant to\n   subsection C of &#xA7; 2.2-4310 and develop regulations, consistent with\n   prevailing law, for program implementation.
