{"formats":[{"name":"JSON","format":"json","url":"\/downloads\/2025\/code-json\/2.2-1617.json"},{"name":"Plain Text","format":"text","url":"\/downloads\/2025\/code-text\/2.2-1617.txt"},{"name":"XML","format":"xml","url":"\/downloads\/2025\/code-xml\/2.2-1617.xml"},{"name":"HTML","format":"html","url":"\/downloads\/2025\/code-html\/2.2-1617.html"}],"law_id":58329,"edition_id":1,"section_id":58329,"structure_id":15320,"section_number":"2.2-1617","catch_line":"One-stop small business permitting program","history":"2013, cc. 155, 206, 482; 2014, c. 758; 2018, c. 218; 2020, c. 750.","full_text":"A\n\nAs used in this article, unless the context requires a different meaning:\n\t\t\t&#8220;Business Permitting Center&#8221; or &#8220;Center&#8221; means the business registration and permitting center established by this section and located in and under the administrative control of the Department.\n\t\t\t&#8220;Comprehensive application&#8221; means a document incorporating pertinent data from existing applications for permits covered under this section.\n\t\t\t&#8220;Comprehensive permit&#8221; means the single document designed for public display issued by the Business Permitting Center that certifies state agency permit approval and that incorporates the endorsements for individual permits included in the comprehensive permitting program.\n\t\t\t&#8220;Comprehensive permitting program&#8221; or &#8220;Program&#8221; means the mechanism by which comprehensive permits are issued and renewed, permit and regulatory information is disseminated, and account data is exchanged by state agencies.\n\t\t\t&#8220;Permit&#8221; means the whole or part of any state agency permit, license, certificate, approval, registration, charter, or any form or permission required by law, to engage in activity associated with or involving the establishment of a small business in the Commonwealth.\n\t\t\t&#8220;Permit information packet&#8221; means a collection of information about permitting requirements and application procedures custom assembled for each request.\n\t\t\t&#8220;Regulatory&#8221; means all permitting and other governmental or statutory requirements establishing a small business or professional activities associated with establishing a small business.\n\t\t\t&#8220;Regulatory agency&#8221; means any state agency, board, commission, or division that regulates one or more professions, occupations, industries, businesses, or activities.\n\t\t\t&#8220;Renewal application&#8221; means a document used to collect pertinent data for renewal of permits covered under this section.\n\t\t\t&#8220;Small business&#8221; means an independently owned and operated business that, together with affiliates, has 250 or fewer employees or average annual gross receipts of $10 million or less averaged over the previous three years.\n\t\t\t&#8220;Veteran&#8221; means an individual who has served in the active military, naval, or air service and who was discharged or released therefrom under conditions other than dishonorable.B\n\nThere is created within the Department the comprehensive permitting program (the Program). The Program is established to serve as a single access point to aid entrepreneurs in filling out the various permit applications associated with establishing a small business in Virginia. The Program in no way supersedes or supplants any regulatory authority granted to any state agency with permits covered by this section. As part of the Program, the Department shall coordinate with the regulatory agency, and the regulatory agency shall determine, consistent with applicable law, what types of permits are appropriate for inclusion in the Program as well as the rules governing the submission of and payment for those permits. The website of the Department shall provide access to information regarding the Program. The Department shall have the power and duty to:1\n\nCreate a comprehensive application that will allow an entrepreneur, or an agent thereof, seeking to establish a small business, to create accounts that will allow them to acquire the appropriate permits required in the Commonwealth. The comprehensive application shall:\n\t\t\t\ta. Allow the business owner to choose a business type and to provide common information, such as name, address, and telephone number, on the front page, eliminating the need to repeatedly provide common information on each permit application;\n\t\t\t\tb. Allow the business owner to preview and answer questions related to the operation of the business;\n\t\t\t\tc. Provide business owners with a customized to-do agency checklist, which checklist shall provide the permit applications pertinent to each business type and provide the rules, regulations, and general laws applicable to each business type as well as local licensing information;\n\t\t\t\td. Allow the business owner to submit permit applications by electronic means as authorized by &#xA7; 59.1-496 and to affix thereto his electronic signature as defined in &#xA7; 59.1-480;\n\t\t\t\te. Allow the business owner to check on the status of applications online and to receive information from the permitting agencies electronically; and\n\t\t\t\tf. Allow a business owner to submit electronic payment of application or permitting fees for applications that have been accepted by the permitting agency.2\n\nDevelop and administer a computerized system program capable of storing, retrieving, and exchanging permit information while protecting the confidentiality of information submitted to the Department to the extent allowable by law. Information submitted to the Department shall be subject to the provisions of the Virginia Freedom of Information Act (&#xA7; 2.2-3700 et seq.) as the same would apply were the information submitted directly to the Department or to any permitting agency.3\n\nIssue and renew comprehensive permits in an efficient manner.4\n\nIdentify the types of permits appropriate for inclusion in the Program. The Department shall coordinate with the regulatory agency, and the regulatory agency shall determine, consistent with applicable law, what types of permits are appropriate for inclusion in the Program.5\n\nIncorporate permits into the Program.6\n\nDo all acts necessary or convenient to carry out the purposes of this chapter.C\n\nRegulatory agencies shall, by November 30 of each year, provide the Department with information outlining any changes to the agency&#8217;s policies and regulations. The Business Permitting Center shall compile information regarding the regulatory programs associated with each of the permits obtainable under the Program. This information shall include, at a minimum, a listing of the statutes and administrative rules requiring the permits and pertaining to the regulatory programs that are directly related to the permit. The Center shall provide information governed by this section to any person requesting it. Materials used by the Center to describe the services provided by the Center shall indicate that this information is available upon request.D\n\nEach state agency shall cooperate and provide reasonable assistance to the Department in the implementation of this section.E\n\nThe State Corporation Commission and the Department of Small Business and Supplier Diversity shall by January 1, 2020, establish one or more processes by which data or information relevant to the Program can be collected and exchanged electronically.F\n\nAny person requiring permits that have been incorporated into the Program may submit a comprehensive application to the Department requesting the issuance of the permits. The comprehensive application form shall contain in consolidated form information necessary for the issuance of the permits.G\n\nThe applicant, if not a veteran, shall include with the application the handling fee established by the Department. An applicant who is a veteran shall be exempt from payment of the handling fee prescribed by this subsection. The amount of the handling fee assessed against the applicant shall be set by the Department at a level necessary to cover the costs of administering the comprehensive permitting program.H\n\nThe authority for approving the issuance and renewal of any requested permit that requires investigation, inspection, testing, or other judgmental review by the regulatory agency otherwise legally authorized to issue the permit shall remain with that agency. The Center may issue those permits for which proper fee payment and a completed application form have been received and for which no approval action is required by the regulatory agency.I\n\nUpon receipt of the application, and proper fee payment for any permit for which issuance is subject to regulatory agency action under subsection H, the Department shall immediately notify the State Corporation Commission or the regulatory agency with authority to approve the permit issuance or renewal requested by the applicant. The State Corporation Commission or the regulatory agency shall advise the Department within a reasonable time after receiving the notice of one of the following:1\n\nThat the State Corporation Commission or the regulatory agency approves the issuance of the requested permit and will advise the applicant of any specific conditions required for issuing the permit;2\n\nThat the State Corporation Commission or the regulatory agency denies the issuance of the permit and gives the applicant reasons for the denial;3\n\nThat the application is pending; or4\n\nThat the application is incomplete and further information from or action by the applicant is necessary.J\n\nThe Department shall issue a comprehensive permit endorsed for all the approved permits to the applicant and advise the applicant of the status of other requested permits. The applicant shall be responsible for contesting any decision regarding conditions imposed or permits denied through the normal process established by statute or by the State Corporation Commission or the regulatory agency with the authority for approving the issuance of the permit.K\n\nRegulatory agencies shall be provided information from the comprehensive application for their permitting and regulatory functions.L\n\nThe Department shall be responsible for directing the applicant to make all payments for applicable fees established by the regulatory agency directly to the proper agency.M\n\nThere is hereby created in the state treasury a special nonreverting fund to be known as the Comprehensive Permitting Fund, hereafter referred to as &#8220;the Fund.&#8221; The Fund shall be established on the books of the Comptroller. The Fund shall consist of all moneys collected from the handling fee established by the Department pursuant to subsection G and such other funds as may be appropriated by the General Assembly. Interest earned on moneys in the Fund shall remain in the Fund and be credited to it. Any moneys remaining in the Fund, including interest thereon, at the end of each fiscal year shall not revert to the general fund but shall remain in the Fund. Moneys in the Fund shall be used solely to administer the Program. Expenditures and disbursements from the Fund shall be made by the State Treasurer on warrants issued by the Comptroller upon written request signed by the Director of the Department.N\n\nUnless otherwise directed by the regulatory agency, the Department shall not issue or renew a comprehensive permit to any person under any of the following circumstances:1\n\nThe person does not have a valid tax registration, if required;2\n\nThe person is a corporation, limited liability company, business trust, limited partnership, or registered limited liability partnership that (i) is delinquent in the payment of fees or penalties collected by the State Corporation Commission pursuant to the business entity statutes it administers, (ii) does not exist, or (iii) is not authorized to transact business in the Commonwealth pursuant to one of the business entity statutes administered by the State Corporation Commission; or3\n\nThe person has not submitted the sum of all fees and deposits required for the requested individual permit endorsements, any outstanding comprehensive permit delinquency fee, or other fees and penalties to be collected through the comprehensive permitting program.O\n\nThe Department shall develop and provide guidance to businesses with newly approved permits regarding responsibilities and requirements for maintaining such business. Such guidance shall include information regarding sales tax and unemployment tax requirements, workers&#8217; compensation insurance requirements, and postings required by the Virginia Department of Labor and Industry and the U.S. Department of Labor. Those modifications are as follows: in 2014, chapter <a href=\"https:\/\/legacylis.virginia.gov\/cgi-bin\/legp604.exe?141+ful+CHAP0758\">758<\/a>; in 2018, chapter <a href=\"https:\/\/legacylis.virginia.gov\/cgi-bin\/legp604.exe?181+ful+CHAP0218\">218<\/a>; in 2020, chapter <a href=\"https:\/\/legacylis.virginia.gov\/cgi-bin\/legp604.exe?201+ful+CHAP0750\">750<\/a>.<\/p>","references":false,"refers_to":[{"id":64046,"section_number":"2.2-1606","catch_line":"Powers of Director","order_by":null,"url":"\/2.2-1606\/"},{"id":55569,"section_number":"2.2-3700","catch_line":"Short title; policy","order_by":null,"url":"\/2.2-3700\/"},{"id":69066,"section_number":"59.1-480","catch_line":"Definitions","order_by":null,"url":"\/59.1-480\/"},{"id":81914,"section_number":"59.1-496","catch_line":"Acceptance and distribution of electronic records by public bodies; electronic filing of information permitted","order_by":null,"url":"\/59.1-496\/"}],"permalink":{"id":173131,"object_type":"law","relational_id":58329,"identifier":"2.2-1617","token":"2.2\/I\/C\/16.1\/3\/2.2-1617","url":"\/2.2-1617\/","edition_id":1,"permalink":0,"preferred":1},"url":"\/2.2-1617\/","token":"2.2\/I\/C\/16.1\/3\/2.2-1617","dublin_core":{"Title":"One-stop small business permitting program","Type":"Text","Format":"text\/html","Identifier":"\u00a7 2.2-1617","Relation":"Code of Virginia"},"html":"\n\t\t\t\t\t\t<section id=\"A\"><p><span class=\"prefix-number\">A.<\/span> As used in this article, unless the context requires a different meaning:\n\t\t\t&#8220;<span class=\"dictionary\">Business Permitting Center<\/span>&#8221; or &#8220;Center&#8221; means the business registration and permitting center established by this section and located in and under the administrative control of the <span class=\"dictionary\">Department<\/span>.\n\t\t\t&#8220;<span class=\"dictionary\">Comprehensive application<\/span>&#8221; means a document incorporating pertinent data from existing applications for permits covered under this section.\n\t\t\t&#8220;<span class=\"dictionary\">Comprehensive permit<\/span>&#8221; means the single document designed for public display issued by the <span class=\"dictionary\">Business Permitting Center<\/span> that certifies <span class=\"dictionary\">state agency<\/span> permit approval and that incorporates the endorsements for individual permits included in the <span class=\"dictionary\">comprehensive permitting program<\/span>.\n\t\t\t&#8220;<span class=\"dictionary\">Comprehensive permitting program<\/span>&#8221; or &#8220;Program&#8221; means the mechanism by which <span class=\"dictionary\">comprehensive permits<\/span> are issued and renewed, permit and regulatory information is disseminated, and account data is exchanged by state agencies.\n\t\t\t&#8220;Permit&#8221; means the whole or part of any <span class=\"dictionary\">state agency<\/span> permit, license, certificate, approval, registration, charter, or any form or permission required by <span class=\"dictionary\">law<\/span>, to engage in activity associated with or involving the establishment of a <span class=\"dictionary\">small business<\/span> in the Commonwealth.\n\t\t\t&#8220;<span class=\"dictionary\">Permit information packet<\/span>&#8221; means a collection of information about permitting requirements and application procedures custom assembled for each request.\n\t\t\t&#8220;Regulatory&#8221; means all permitting and other governmental or statutory requirements establishing a <span class=\"dictionary\">small business<\/span> or professional activities associated with establishing a <span class=\"dictionary\">small business<\/span>.\n\t\t\t&#8220;<span class=\"dictionary\">Regulatory agency<\/span>&#8221; means any <span class=\"dictionary\">state agency<\/span>, board, commission, or division that regulates one or more professions, occupations, industries, businesses, or activities.\n\t\t\t&#8220;<span class=\"dictionary\">Renewal application<\/span>&#8221; means a document used to collect pertinent data for renewal of permits covered under this section.\n\t\t\t&#8220;<span class=\"dictionary\">Small business<\/span>&#8221; means an independently owned and operated business that, together with affiliates, has 250 or fewer employees or average annual gross receipts of $10 million or less averaged over the previous three years.\n\t\t\t&#8220;<span class=\"dictionary\">Veteran<\/span>&#8221; means an individual who has served in the active military, naval, or air service and who was discharged or released therefrom under conditions other than dishonorable. <a id=\"paragraph-213625\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#A\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> There is created within the <span class=\"dictionary\">Department<\/span> the <span class=\"dictionary\">comprehensive permitting program<\/span> (the Program). The Program is established to serve as a single access point to aid entrepreneurs in filling out the various permit applications associated with establishing a <span class=\"dictionary\">small business<\/span> in Virginia. The Program in no way supersedes or supplants any regulatory authority granted to any <span class=\"dictionary\">state agency<\/span> with permits covered by this section. As part of the Program, the <span class=\"dictionary\">Department<\/span> shall coordinate with the <span class=\"dictionary\">regulatory agency<\/span>, and the <span class=\"dictionary\">regulatory agency<\/span> shall determine, consistent with applicable <span class=\"dictionary\">law<\/span>, what types of permits are appropriate for inclusion in the Program as well as the rules governing the submission of and payment for those permits. The website of the <span class=\"dictionary\">Department<\/span> shall provide access to information regarding the Program. The <span class=\"dictionary\">Department<\/span> shall have the power and duty to: <a id=\"paragraph-213626\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Create a <span class=\"dictionary\">comprehensive application<\/span> that will allow an entrepreneur, or an agent thereof, seeking to establish a <span class=\"dictionary\">small business<\/span>, to create accounts that will allow them to acquire the appropriate permits required in the Commonwealth. The <span class=\"dictionary\">comprehensive application<\/span> shall:\n\t\t\t\ta. Allow the business owner to choose a business type and to provide common information, such as name, address, and telephone number, on the front page, eliminating the need to repeatedly provide common information on each permit application;\n\t\t\t\tb. Allow the business owner to preview and answer questions related to the operation of the business;\n\t\t\t\tc. Provide business owners with a customized to-do agency checklist, which checklist shall provide the permit applications pertinent to each business type and provide the rules, regulations, and general <span class=\"dictionary\">laws<\/span> applicable to each business type as well as local licensing information;\n\t\t\t\td. Allow the business owner to submit permit applications by electronic means as authorized by &#xA7; <a class=\"law\" title=\"Acceptance and distribution of electronic records by public bodies; electronic filing of information permitted\" href=\"\/59.1-496\/\">59.1-496<\/a> and to affix thereto his electronic signature as defined in &#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/59.1-480\/\">59.1-480<\/a>;\n\t\t\t\te. Allow the business owner to check on the status of applications online and to receive information from the permitting agencies electronically; and\n\t\t\t\tf. Allow a business owner to submit electronic payment of application or permitting fees for applications that have been accepted by the permitting agency. <a id=\"paragraph-213627\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#B1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Develop and administer a computerized system program capable of storing, retrieving, and exchanging permit information while protecting the confidentiality of information submitted to the <span class=\"dictionary\">Department<\/span> to the extent allowable by <span class=\"dictionary\">law<\/span>. Information submitted to the <span class=\"dictionary\">Department<\/span> shall be subject to the provisions of the Virginia Freedom of Information Act (&#xA7; <a class=\"law\" title=\"Short title; policy\" href=\"\/2.2-3700\/\">2.2-3700<\/a> et seq.) as the same would apply were the information submitted directly to the <span class=\"dictionary\">Department<\/span> or to any permitting agency. <a id=\"paragraph-213628\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#B2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> <span class=\"dictionary\">Issue<\/span> and renew <span class=\"dictionary\">comprehensive permits<\/span> in an efficient manner. <a id=\"paragraph-213629\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#B3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Identify the types of permits appropriate for inclusion in the Program. The <span class=\"dictionary\">Department<\/span> shall coordinate with the <span class=\"dictionary\">regulatory agency<\/span>, and the <span class=\"dictionary\">regulatory agency<\/span> shall determine, consistent with applicable <span class=\"dictionary\">law<\/span>, what types of permits are appropriate for inclusion in the Program. <a id=\"paragraph-213630\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#B4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Incorporate permits into the Program. <a id=\"paragraph-213631\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#B5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Do all acts necessary or convenient to carry out the purposes of this chapter. <a id=\"paragraph-213632\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#B6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Regulatory agencies shall, by November 30 of each year, provide the <span class=\"dictionary\">Department<\/span> with information outlining any changes to the agency&#8217;s policies and regulations. The <span class=\"dictionary\">Business Permitting Center<\/span> shall compile information regarding the regulatory <span class=\"dictionary\">programs<\/span> associated with each of the permits obtainable under the Program. This information shall include, at a minimum, a listing of the <span class=\"dictionary\">statutes<\/span> and administrative rules requiring the permits and pertaining to the regulatory <span class=\"dictionary\">programs<\/span> that are directly related to the permit. The Center shall provide information governed by this section to any person requesting it. <span class=\"dictionary\">Materials<\/span> used by the Center to describe the services provided by the Center shall indicate that this information is available upon request. <a id=\"paragraph-213633\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Each <span class=\"dictionary\">state agency<\/span> shall cooperate and provide reasonable assistance to the <span class=\"dictionary\">Department<\/span> in the implementation of this section. <a id=\"paragraph-213634\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> The State Corporation Commission and the <span class=\"dictionary\">Department<\/span> of <span class=\"dictionary\">Small Business<\/span> and Supplier Diversity shall by January 1, 2020, establish one or more processes by which data or information relevant to the Program can be collected and exchanged electronically. <a id=\"paragraph-213635\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> Any person requiring permits that have been incorporated into the Program may submit a <span class=\"dictionary\">comprehensive application<\/span> to the <span class=\"dictionary\">Department<\/span> requesting the issuance of the permits. The <span class=\"dictionary\">comprehensive application<\/span> form shall contain in consolidated form information necessary for the issuance of the permits. <a id=\"paragraph-213636\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> The applicant, if not a <span class=\"dictionary\">veteran<\/span>, shall include with the application the handling fee established by the <span class=\"dictionary\">Department<\/span>. An applicant who is a <span class=\"dictionary\">veteran<\/span> shall be exempt from payment of the handling fee prescribed by this subsection. The amount of the handling fee assessed against the applicant shall be set by the <span class=\"dictionary\">Department<\/span> at a level necessary to cover the costs of administering the <span class=\"dictionary\">comprehensive permitting program<\/span>. <a id=\"paragraph-213637\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"H\"><p><span class=\"prefix-number\">H.<\/span> The authority for approving the issuance and renewal of any requested permit that requires investigation, inspection, testing, or other judgmental review by the <span class=\"dictionary\">regulatory agency<\/span> otherwise legally authorized to <span class=\"dictionary\">issue<\/span> the permit shall remain with that agency. The Center may <span class=\"dictionary\">issue<\/span> those permits for which proper fee payment and a completed application form have been received and for which no approval action is required by the <span class=\"dictionary\">regulatory agency<\/span>. <a id=\"paragraph-213638\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#H\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I\"><p><span class=\"prefix-number\">I.<\/span> Upon receipt of the application, and proper fee payment for any permit for which issuance is subject to <span class=\"dictionary\">regulatory agency<\/span> action under subsection H, the <span class=\"dictionary\">Department<\/span> shall immediately notify the State Corporation Commission or the <span class=\"dictionary\">regulatory agency<\/span> with authority to approve the permit issuance or renewal requested by the applicant. The State Corporation Commission or the <span class=\"dictionary\">regulatory agency<\/span> shall advise the <span class=\"dictionary\">Department<\/span> within a reasonable time after receiving the notice of one of the following: <a id=\"paragraph-213639\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#I\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> That the State Corporation Commission or the <span class=\"dictionary\">regulatory agency<\/span> approves the issuance of the requested permit and will advise the applicant of any specific conditions required for issuing the permit; <a id=\"paragraph-213640\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#I1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> That the State Corporation Commission or the <span class=\"dictionary\">regulatory agency<\/span> denies the issuance of the permit and gives the applicant reasons for the denial; <a id=\"paragraph-213641\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#I2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> That the application is pending; or <a id=\"paragraph-213642\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#I3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> That the application is incomplete and further information from or action by the applicant is necessary. <a id=\"paragraph-213643\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#I4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"J\"><p><span class=\"prefix-number\">J.<\/span> The <span class=\"dictionary\">Department<\/span> shall <span class=\"dictionary\">issue<\/span> a <span class=\"dictionary\">comprehensive permit<\/span> endorsed for all the approved permits to the applicant and advise the applicant of the status of other requested permits. The applicant shall be responsible for contesting any decision regarding conditions imposed or permits denied through the normal process established by <span class=\"dictionary\">statute<\/span> or by the State Corporation Commission or the <span class=\"dictionary\">regulatory agency<\/span> with the authority for approving the issuance of the permit. <a id=\"paragraph-213644\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#J\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"K\"><p><span class=\"prefix-number\">K.<\/span> Regulatory agencies shall be provided information from the <span class=\"dictionary\">comprehensive application<\/span> for their permitting and regulatory functions. <a id=\"paragraph-213645\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#K\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"L\"><p><span class=\"prefix-number\">L.<\/span> The <span class=\"dictionary\">Department<\/span> shall be responsible for directing the applicant to make all payments for applicable fees established by the <span class=\"dictionary\">regulatory agency<\/span> directly to the proper agency. <a id=\"paragraph-213646\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#L\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"M\"><p><span class=\"prefix-number\">M.<\/span> There is hereby created in the state treasury a special nonreverting fund to be known as the Comprehensive Permitting Fund, hereafter referred to as &#8220;the Fund.&#8221; The Fund shall be established on the books of the Comptroller. The Fund shall consist of all moneys collected from the handling fee established by the <span class=\"dictionary\">Department<\/span> pursuant to subsection G and such other funds as may be appropriated by the General Assembly. Interest earned on moneys in the Fund shall remain in the Fund and be credited to it. Any moneys remaining in the Fund, including interest thereon, at the end of each fiscal year shall not revert to the general fund but shall remain in the Fund. Moneys in the Fund shall be used solely to administer the Program. Expenditures and disbursements from the Fund shall be made by the State Treasurer on warrants issued by the Comptroller upon written request signed by the Director of the <span class=\"dictionary\">Department<\/span>. <a id=\"paragraph-213647\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#M\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"N\"><p><span class=\"prefix-number\">N.<\/span> Unless otherwise directed by the <span class=\"dictionary\">regulatory agency<\/span>, the <span class=\"dictionary\">Department<\/span> shall not <span class=\"dictionary\">issue<\/span> or renew a <span class=\"dictionary\">comprehensive permit<\/span> to any person under any of the following circumstances: <a id=\"paragraph-213648\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#N\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"N1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> The person does not have a valid tax registration, if required; <a id=\"paragraph-213649\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#N1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"N2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> The person is a corporation, limited liability company, business trust, limited partnership, or registered limited liability partnership that (i) is delinquent in the payment of fees or penalties collected by the State Corporation Commission pursuant to the business entity <span class=\"dictionary\">statutes<\/span> it administers, (ii) does not exist, or (iii) is not authorized to transact business in the Commonwealth pursuant to one of the business entity <span class=\"dictionary\">statutes<\/span> administered by the State Corporation Commission; or <a id=\"paragraph-213650\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#N2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"N3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> The person has not submitted the sum of all fees and deposits required for the requested individual permit endorsements, any outstanding <span class=\"dictionary\">comprehensive permit<\/span> delinquency fee, or other fees and penalties to be collected through the <span class=\"dictionary\">comprehensive permitting program<\/span>. <a id=\"paragraph-213651\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#N3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"O\"><p><span class=\"prefix-number\">O.<\/span> The <span class=\"dictionary\">Department<\/span> shall develop and provide guidance to businesses with newly approved permits regarding responsibilities and requirements for maintaining such business. Such guidance shall include information regarding sales tax and unemployment tax requirements, workers&#8217; compensation insurance requirements, and postings required by the Virginia <span class=\"dictionary\">Department<\/span> of Labor and Industry and the U.S. <span class=\"dictionary\">Department<\/span> of Labor. Any guidance provided for in this subsection may be provided electronically. <a id=\"paragraph-213652\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#O\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"P\"><p><span class=\"prefix-number\">P.<\/span> The <span class=\"dictionary\">Department<\/span> may adopt regulations in accordance with &#xA7; <a class=\"law\" title=\"Powers of Director\" href=\"\/2.2-1606\/\">2.2-1606<\/a> as may be necessary to carry out the purposes of this section. <a id=\"paragraph-213653\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-1617\/#P\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nONE-STOP SMALL BUSINESS PERMITTING PROGRAM (\u00a7 2.2-1617)\n\nA. As used in this article, unless the context requires a different meaning:\n\t\t\t&#8220;Business Permitting Center&#8221; or &#8220;Center&#8221; means the\nbusiness registration and permitting center established by this section and\nlocated in and under the administrative control of the Department.\n\t\t\t&#8220;Comprehensive application&#8221; means a document incorporating\npertinent data from existing applications for permits covered under this\nsection.\n\t\t\t&#8220;Comprehensive permit&#8221; means the single document designed for\npublic display issued by the Business Permitting Center that certifies state\nagency permit approval and that incorporates the endorsements for individual\npermits included in the comprehensive permitting program.\n\t\t\t&#8220;Comprehensive permitting program&#8221; or &#8220;Program&#8221; means\nthe mechanism by which comprehensive permits are issued and renewed, permit and\nregulatory information is disseminated, and account data is exchanged by state\nagencies.\n\t\t\t&#8220;Permit&#8221; means the whole or part of any state agency permit,\nlicense, certificate, approval, registration, charter, or any form or permission\nrequired by law, to engage in activity associated with or involving the\nestablishment of a small business in the Commonwealth.\n\t\t\t&#8220;Permit information packet&#8221; means a collection of information\nabout permitting requirements and application procedures custom assembled for\neach request.\n\t\t\t&#8220;Regulatory&#8221; means all permitting and other governmental or\nstatutory requirements establishing a small business or professional activities\nassociated with establishing a small business.\n\t\t\t&#8220;Regulatory agency&#8221; means any state agency, board, commission, or\ndivision that regulates one or more professions, occupations, industries,\nbusinesses, or activities.\n\t\t\t&#8220;Renewal application&#8221; means a document used to collect pertinent\ndata for renewal of permits covered under this section.\n\t\t\t&#8220;Small business&#8221; means an independently owned and operated\nbusiness that, together with affiliates, has 250 or fewer employees or average\nannual gross receipts of $10 million or less averaged over the previous three\nyears.\n\t\t\t&#8220;Veteran&#8221; means an individual who has served in the active\nmilitary, naval, or air service and who was discharged or released therefrom\nunder conditions other than dishonorable.\n\nB. There is created within the Department the comprehensive permitting program\n(the Program). The Program is established to serve as a single access point to\naid entrepreneurs in filling out the various permit applications associated with\nestablishing a small business in Virginia. The Program in no way supersedes or\nsupplants any regulatory authority granted to any state agency with permits\ncovered by this section. As part of the Program, the Department shall coordinate\nwith the regulatory agency, and the regulatory agency shall determine,\nconsistent with applicable law, what types of permits are appropriate for\ninclusion in the Program as well as the rules governing the submission of and\npayment for those permits. The website of the Department shall provide access to\ninformation regarding the Program. The Department shall have the power and duty\nto:\n\n   1. Create a comprehensive application that will allow an entrepreneur, or an\n   agent thereof, seeking to establish a small business, to create accounts that\n   will allow them to acquire the appropriate permits required in the\n   Commonwealth. The comprehensive application shall:\n   \t\t\t\ta. Allow the business owner to choose a business type and to provide\n   common information, such as name, address, and telephone number, on the front\n   page, eliminating the need to repeatedly provide common information on each\n   permit application;\n   \t\t\t\tb. Allow the business owner to preview and answer questions related to the\n   operation of the business;\n   \t\t\t\tc. Provide business owners with a customized to-do agency checklist, which\n   checklist shall provide the permit applications pertinent to each business\n   type and provide the rules, regulations, and general laws applicable to each\n   business type as well as local licensing information;\n   \t\t\t\td. Allow the business owner to submit permit applications by electronic\n   means as authorized by &#xA7; 59.1-496 and to affix thereto his electronic\n   signature as defined in &#xA7; 59.1-480;\n   \t\t\t\te. Allow the business owner to check on the status of applications online\n   and to receive information from the permitting agencies electronically; and\n   \t\t\t\tf. Allow a business owner to submit electronic payment of application or\n   permitting fees for applications that have been accepted by the permitting\n   agency.\n\n   2. Develop and administer a computerized system program capable of storing,\n   retrieving, and exchanging permit information while protecting the\n   confidentiality of information submitted to the Department to the extent\n   allowable by law. Information submitted to the Department shall be subject to\n   the provisions of the Virginia Freedom of Information Act (&#xA7; 2.2-3700 et\n   seq.) as the same would apply were the information submitted directly to the\n   Department or to any permitting agency.\n\n   3. Issue and renew comprehensive permits in an efficient manner.\n\n   4. Identify the types of permits appropriate for inclusion in the Program. The\n   Department shall coordinate with the regulatory agency, and the regulatory\n   agency shall determine, consistent with applicable law, what types of permits\n   are appropriate for inclusion in the Program.\n\n   5. Incorporate permits into the Program.\n\n   6. Do all acts necessary or convenient to carry out the purposes of this\n   chapter.\n\nC. Regulatory agencies shall, by November 30 of each year, provide the\nDepartment with information outlining any changes to the agency&#8217;s policies\nand regulations. The Business Permitting Center shall compile information\nregarding the regulatory programs associated with each of the permits obtainable\nunder the Program. This information shall include, at a minimum, a listing of\nthe statutes and administrative rules requiring the permits and pertaining to\nthe regulatory programs that are directly related to the permit. The Center\nshall provide information governed by this section to any person requesting it.\nMaterials used by the Center to describe the services provided by the Center\nshall indicate that this information is available upon request.\n\nD. Each state agency shall cooperate and provide reasonable assistance to the\nDepartment in the implementation of this section.\n\nE. The State Corporation Commission and the Department of Small Business and\nSupplier Diversity shall by January 1, 2020, establish one or more processes by\nwhich data or information relevant to the Program can be collected and exchanged\nelectronically.\n\nF. Any person requiring permits that have been incorporated into the Program may\nsubmit a comprehensive application to the Department requesting the issuance of\nthe permits. The comprehensive application form shall contain in consolidated\nform information necessary for the issuance of the permits.\n\nG. The applicant, if not a veteran, shall include with the application the\nhandling fee established by the Department. An applicant who is a veteran shall\nbe exempt from payment of the handling fee prescribed by this subsection. The\namount of the handling fee assessed against the applicant shall be set by the\nDepartment at a level necessary to cover the costs of administering the\ncomprehensive permitting program.\n\nH. The authority for approving the issuance and renewal of any requested permit\nthat requires investigation, inspection, testing, or other judgmental review by\nthe regulatory agency otherwise legally authorized to issue the permit shall\nremain with that agency. The Center may issue those permits for which proper fee\npayment and a completed application form have been received and for which no\napproval action is required by the regulatory agency.\n\nI. Upon receipt of the application, and proper fee payment for any permit for\nwhich issuance is subject to regulatory agency action under subsection H, the\nDepartment shall immediately notify the State Corporation Commission or the\nregulatory agency with authority to approve the permit issuance or renewal\nrequested by the applicant. The State Corporation Commission or the regulatory\nagency shall advise the Department within a reasonable time after receiving the\nnotice of one of the following:\n\n   1. That the State Corporation Commission or the regulatory agency approves the\n   issuance of the requested permit and will advise the applicant of any specific\n   conditions required for issuing the permit;\n\n   2. That the State Corporation Commission or the regulatory agency denies the\n   issuance of the permit and gives the applicant reasons for the denial;\n\n   3. That the application is pending; or\n\n   4. That the application is incomplete and further information from or action\n   by the applicant is necessary.\n\nJ. The Department shall issue a comprehensive permit endorsed for all the\napproved permits to the applicant and advise the applicant of the status of\nother requested permits. The applicant shall be responsible for contesting any\ndecision regarding conditions imposed or permits denied through the normal\nprocess established by statute or by the State Corporation Commission or the\nregulatory agency with the authority for approving the issuance of the permit.\n\nK. Regulatory agencies shall be provided information from the comprehensive\napplication for their permitting and regulatory functions.\n\nL. The Department shall be responsible for directing the applicant to make all\npayments for applicable fees established by the regulatory agency directly to\nthe proper agency.\n\nM. There is hereby created in the state treasury a special nonreverting fund to\nbe known as the Comprehensive Permitting Fund, hereafter referred to as\n&#8220;the Fund.&#8221; The Fund shall be established on the books of the\nComptroller. The Fund shall consist of all moneys collected from the handling\nfee established by the Department pursuant to subsection G and such other funds\nas may be appropriated by the General Assembly. Interest earned on moneys in the\nFund shall remain in the Fund and be credited to it. Any moneys remaining in the\nFund, including interest thereon, at the end of each fiscal year shall not\nrevert to the general fund but shall remain in the Fund. Moneys in the Fund\nshall be used solely to administer the Program.
