The purpose of the program is to, in a cost-effective manner, refer such transitioning service members, veterans, members of the Virginia National Guard, Virginia residents in the Armed Forces Reserves, and their family members to mental health, physical rehabilitation, and other services as needed to help them achieve individually identified goals and to periodically monitor their progress toward achieving those goals.B\n\nThe program shall, subject to the availability of public and private funds appropriated for such purposes, (i) build awareness of veterans&#8217; service needs and the availability of the program through marketing, outreach, training for first responders, service providers, and others; (ii) collaborate with relevant agencies of the Commonwealth, localities, and service providers; (iii) develop and implement a consistent method of determining how many veterans in the Commonwealth are in need of mental health, physical rehabilitation, or other services currently or may be in need of such services in the future; (iv) work with veterans to develop a coordinated resources plan that identifies appropriate service providers to meet the veteran&#8217;s service needs; (v) refer veterans to appropriate and available providers on the basis of needs identified in the coordinated resources plan; and (vi) monitor progress toward individually identified goals in accordance with the coordinated resource plan.\n\t\t\tCoordinated resources plans shall be developed and veterans shall be referred to necessary services in a timely manner. The program shall prioritize veterans served on the basis of the immediacy and severity of service needs and the likelihood that those needs are attributable to the veteran&#8217;s military service or combat experience.C\n\nThe program shall cooperate with localities that may establish special treatment procedures for veterans and active military service members such as authorized by \u00a7\u00a7 9.1-173 and 9.1-174. To facilitate local involvement and flexibility in responding to the problem of crime in local communities and to effectively treat, counsel, rehabilitate, and supervise veterans and active military service members who are offenders or defendants in the criminal justice system and who need access to proper treatment for mental illness, including major depression, alcohol or drug abuse, post traumatic stress disorder, traumatic brain injury or a combination of these, any city, county, or combination thereof may develop, establish, and maintain policies, procedures, and treatment services for all such offenders who are convicted and sentenced for misdemeanors or felonies that are not felony acts of violence, as defined in \u00a7 19.2-297.1. Such policies, procedures, and treatment services shall be designed to provide:1\n\nCoordination of treatment and counseling services available to the criminal justice system case processing;2\n\nEnhanced public safety through offender supervision, counseling, and treatment;3\n\nPrompt identification and placement of eligible participants;4\n\nAccess to a continuum of treatment, rehabilitation, and counseling services in collaboration with such care providers as are willing and able to provide the services needed;5\n\nWhere appropriate, verified participant abstinence through frequent alcohol and other drug testing;6\n\nPrompt response to participants&#8217; noncompliance with program requirements;7\n\nOngoing monitoring and evaluation of program effectiveness and efficiency;8\n\nOngoing education and training in support of program effectiveness and efficiency;9\n\nOngoing collaboration among public agencies, community-based organizations and the U.S. Department of Veterans Affairs health care networks, the Veterans Benefits Administration, volunteer veteran mentors, and veterans and military family support organizations; and10\n\nThe creation of a veterans and military service members&#8217; advisory council to provide input on the operations of such programs. The program shall prioritize <span class=\"dictionary\">veterans<\/span> served on the basis of the immediacy and severity of service needs and the likelihood that those needs are attributable to the <span class=\"dictionary\">veteran<\/span>&#8217;s military service or combat experience. <a id=\"paragraph-248494\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2001.1\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> The program shall cooperate with localities that may establish special treatment procedures for <span class=\"dictionary\">veterans<\/span> and active military service members such as authorized by \u00a7\u00a7&nbsp;<a class=\"law\" title=\"Purpose\" href=\"\/9.1-173\/\">9.1-173<\/a> and <a class=\"law\" title=\"Establishment of a community-based probation services agency\" href=\"\/9.1-174\/\">9.1-174<\/a>. To facilitate local involvement and flexibility in responding to the problem of <span class=\"dictionary\">crime<\/span> in local communities and to effectively treat, <span class=\"dictionary\">counsel<\/span>, rehabilitate, and supervise <span class=\"dictionary\">veterans<\/span> and active military service members who are offenders or <span class=\"dictionary\">defendants<\/span> in the criminal justice system and who need access to proper treatment for mental illness, including major depression, alcohol or drug abuse, post traumatic stress disorder, traumatic brain injury or a combination of these, any city, county, or combination thereof may develop, establish, and maintain policies, procedures, and treatment services for all such offenders who are convicted and sentenced for <span class=\"dictionary\">misdemeanors<\/span> or felonies that are not <span class=\"dictionary\">felony<\/span> acts of violence, as defined in \u00a7&nbsp;<a class=\"law\" title=\"Sentence of person twice previously convicted of certain violent felonies\" href=\"\/19.2-297.1\/\">19.2-297.1<\/a>. Such policies, procedures, and treatment services shall be designed to provide: <a id=\"paragraph-248495\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2001.1\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Coordination of treatment and counseling services available to the criminal justice system case processing; <a id=\"paragraph-248496\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2001.1\/#C1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Enhanced public safety through offender supervision, counseling, and treatment; <a id=\"paragraph-248497\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2001.1\/#C2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Prompt identification and placement of eligible participants; <a id=\"paragraph-248498\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2001.1\/#C3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Access to a continuum of treatment, rehabilitation, and counseling services in collaboration with such care providers as are willing and able to provide the services needed; <a id=\"paragraph-248499\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2001.1\/#C4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Where appropriate, verified participant abstinence through frequent alcohol and other drug testing; <a id=\"paragraph-248500\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2001.1\/#C5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Prompt response to participants&#8217; noncompliance with program requirements; <a id=\"paragraph-248501\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2001.1\/#C6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Ongoing monitoring and evaluation of program effectiveness and efficiency; <a id=\"paragraph-248502\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2001.1\/#C7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> Ongoing education and training in support of program effectiveness and efficiency; <a id=\"paragraph-248503\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2001.1\/#C8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> Ongoing collaboration among public agencies, community-based organizations and the U.S. <span class=\"dictionary\">Department<\/span> of <span class=\"dictionary\">Veterans<\/span> Affairs health care networks, the <span class=\"dictionary\">Veterans<\/span> Benefits Administration, volunteer <span class=\"dictionary\">veteran<\/span> mentors, and <span class=\"dictionary\">veterans<\/span> and military family support organizations; and <a id=\"paragraph-248504\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2001.1\/#C9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> The creation of a <span class=\"dictionary\">veterans<\/span> and military service members&#8217; advisory council to provide input on the operations of such programs. The council shall include individuals responsible for the criminal justice procedures program along with <span class=\"dictionary\">veterans<\/span> and, if available, active military service members. <a id=\"paragraph-248505\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2001.1\/#C10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> The <span class=\"dictionary\">Commissioner<\/span> shall include the results of the program in the annual report submitted to the Secretary of <span class=\"dictionary\">Veterans<\/span> and Defense Affairs, the Governor, and the General Assembly pursuant to &#xA7; <a class=\"law\" title=\"Additional powers and duties of Commissioner\" href=\"\/2.2-2004\/\">2.2-2004<\/a>. The report shall include the number of transitioning service members, <span class=\"dictionary\">veterans<\/span>, members of the Virginia National Guard, Virginia residents in the Armed Forces Reserves, and their family members affected by covered military members&#8217; service and deployments for whom coordinated resources plans are developed and who are referred for services; information about services provided to transitioning service members, <span class=\"dictionary\">veterans<\/span>, members of the Virginia National Guard, Virginia residents in the Armed Forces Reserves, and their family members, including information about the types of services provided and the quality of those services; and the number of transitioning service members, <span class=\"dictionary\">veterans<\/span>, members of the Virginia National Guard, Virginia residents in the Armed Forces Reserves, and their family members identified by the program as in need of services but not referred for services. <a id=\"paragraph-248506\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2001.1\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nPROGRAM FOR MENTAL HEALTH AND REHABILITATIVE SERVICES (\u00a7 2.2-2001.1)\n\nA. The Department, in cooperation with the Department of Behavioral Health and\nDevelopmental Services and the Department for Aging and Rehabilitative Services,\nshall establish a program to monitor and coordinate mental health and\nrehabilitative services support for military service members transitioning from\nmilitary to civilian life, veterans, members of the Virginia National Guard,\nVirginia residents in the Armed Forces Reserves, and their family members. The\npurpose of the program is to, in a cost-effective manner, refer such\ntransitioning service members, veterans, members of the Virginia National Guard,\nVirginia residents in the Armed Forces Reserves, and their family members to\nmental health, physical rehabilitation, and other services as needed to help\nthem achieve individually identified goals and to periodically monitor their\nprogress toward achieving those goals.\n\nB. The program shall, subject to the availability of public and private funds\nappropriated for such purposes, (i) build awareness of veterans&#8217; service\nneeds and the availability of the program through marketing, outreach, training\nfor first responders, service providers, and others; (ii) collaborate with\nrelevant agencies of the Commonwealth, localities, and service providers; (iii)\ndevelop and implement a consistent method of determining how many veterans in\nthe Commonwealth are in need of mental health, physical rehabilitation, or other\nservices currently or may be in need of such services in the future; (iv) work\nwith veterans to develop a coordinated resources plan that identifies\nappropriate service providers to meet the veteran&#8217;s service needs; (v)\nrefer veterans to appropriate and available providers on the basis of needs\nidentified in the coordinated resources plan; and (vi) monitor progress toward\nindividually identified goals in accordance with the coordinated resource plan.\n\t\t\tCoordinated resources plans shall be developed and veterans shall be referred\nto necessary services in a timely manner. To facilitate local involvement and\nflexibility in responding to the problem of crime in local communities and to\neffectively treat, counsel, rehabilitate, and supervise veterans and active\nmilitary service members who are offenders or defendants in the criminal justice\nsystem and who need access to proper treatment for mental illness, including\nmajor depression, alcohol or drug abuse, post traumatic stress disorder,\ntraumatic brain injury or a combination of these, any city, county, or\ncombination thereof may develop, establish, and maintain policies, procedures,\nand treatment services for all such offenders who are convicted and sentenced\nfor misdemeanors or felonies that are not felony acts of violence, as defined in\n\u00a7 19.2-297.1. Such policies, procedures, and treatment services shall be\ndesigned to provide:\n\n   1. Coordination of treatment and counseling services available to the criminal\n   justice system case processing;\n\n   2. Enhanced public safety through offender supervision, counseling, and\n   treatment;\n\n   3. Prompt identification and placement of eligible participants;\n\n   4. Access to a continuum of treatment, rehabilitation, and counseling services\n   in collaboration with such care providers as are willing and able to provide\n   the services needed;\n\n   5. Where appropriate, verified participant abstinence through frequent alcohol\n   and other drug testing;\n\n   6. Prompt response to participants&#8217; noncompliance with program\n   requirements;\n\n   7. Ongoing monitoring and evaluation of program effectiveness and efficiency;\n\n   8.
