The Commonwealth Data Trust includes data from state, regional, and local governments, from public institutions of higher education, and from any other sources deemed necessary and appropriate.\n\t\t\t&#8220;Council&#8221; means the Data Governance Council.\n\t\t\t&#8220;Group&#8221; means the Data Stewards Group.\n\t\t\t&#8220;Office&#8221; means the Office of Data Governance and Analytics as created pursuant to &#xA7; 2.2-2034.1.\n\t\t\t&#8220;Open data&#8221; means data that is collected by an agency that is not prohibited from being made available to the public by applicable laws or regulations or other restrictions, requirements, or rights associated with such data.B\n\nThere is created in the Office of the Secretary of Administration the position of Chief Data Officer of the Commonwealth to lead the Office of Data Governance and Analytics. The CDO shall exercise and perform the duties conferred or imposed upon him by law and perform such other duties as may be required by the Governor and the Secretary of Administration. The CDO shall not be considered the custodian of any public records in or derived from the Commonwealth Data Trust. The CDO shall:1\n\nEstablish business rules, guidelines, and best practices for the use of data, including open data, in the Commonwealth. Such rules, guidelines, and best practices shall address, at a minimum, (i) the sharing of data between state, regional, and local public entities and public institutions of higher education, and, when appropriate, private entities; (ii) data storage; (iii) data security; (iv) privacy; (v) compliance with federal law; (vi) the de-identification of data for research purposes; and (vii) the appropriate access to and presentation of open data and datasets to the public;2\n\nAssist state, regional, and local public entities, public institutions of higher education, and employees thereof, with the application of the Government Data Collection and Dissemination Practices Act (&#xA7; 2.2-3800 et. seq.) and understanding the applicability of federal laws governing privacy and access to data to the data sharing practices of the Commonwealth;3\n\nAssist the Chief Information Officer of the Commonwealth with matters related to the creation, storage, and dissemination of data upon request;4\n\nEncourage and coordinate efforts of state, regional, and local public entities and public institutions of higher education to access and share data, including open data, across all levels of government in an effort to improve the efficiency and efficacy of services, improve outcomes, and promote data-driven policy making, decision making, research, and analysis;5\n\nOversee the implementation of a website dedicated to (i) hosting open data from state, regional, and local public entities and public institutions of higher education and (ii) providing links to any other additional open data websites in the Commonwealth;6\n\nEnter into contracts for the purpose of carrying out the provisions of this section;7\n\nObtain from the Virginia Information Technologies Agency office space and human resources, procurement, fiscal, and other administrative support and resources necessary to support the operations of the Office and to carry out the provisions of this section; and8\n\nReport on the activities of the Office and the Commonwealth Data Trust annually by December 1 to the Governor and the General Assembly.C\n\nThe Commonwealth Data Trust shall be governed by a multi-level governance structure as follows:1\n\nThe Executive Data Board shall consist of the directors or chief executives, or their designees, of executive branch agencies engaged in data sharing and analytics projects with the Commonwealth Data Trust. The CDO shall chair the Board. Members of the Board shall (i) translate the Commonwealth&#8217;s data-driven policy goals and objectives into performance targets at their respective agencies; (ii) allocate appropriate resources at their respective agencies to support data governance, sharing, and analytics initiatives; and (iii) provide any reports to the Office regarding their respective agencies&#8217; data analytics work and implementation of recommendations.2\n\nThe Data Governance Council shall consist of employees of the agencies represented on the Board, selected by the Board members from their respective agencies. The CDO, or his designee, shall chair the Council. The Council shall (i) liaise between state agency operations and the CDO; (ii) advise the CDO on data technology, policy, and governance structure; (iii) administer data governance policies, standards, and best practices, as set by the Board; (iv) oversee data sharing and analytics projects; (v) review open data assets prior to publication; (vi) provide to the Board any reports on the Council&#8217;s recommendations and work as required by the Board; (vii) develop necessary privacy and ethical standards and policies for Commonwealth Data Trust resources; (viii) monitor the sharing of Commonwealth Data Trust member-contributed data resources; (ix) review and approve new Commonwealth Data Trust-managed data resources; and (x) conduct any other business the CDO deems necessary for Commonwealth Data Trust governance.3\n\nThe Data Stewards Group shall consist of employees from executive branch agencies with technical experience in data management or data analytics. Executive branch agencies shall be encouraged to designate at least one agency data steward to serve on the Group and may designate multiple data stewards as appropriate based upon organizational or data system responsibilities. The Group shall (i) provide the Board and Council with technical subject matter expertise in support of data policies, standards, and best practices; (ii) implement data sharing and analytics projects promoting data accessibility, sharing, and reuse, thereby reducing redundancy across the Commonwealth; (iii) coordinate and resolve technical stewardship issues for standardized data; (iv) ensure data quality processes and standards are implemented consistently by agencies in the Commonwealth; (v) provide communication and education to data users on the appropriate use, sharing, and protection of the Commonwealth&#8217;s data assets; (vi) promote the collection and sharing of metadata by registering data assets in the Virginia Data Catalog; (vii) liaise with agency project managers and information technology investment staff to ensure adherence to Commonwealth data standards and data sharing requirements; and (viii) support informed, data-driven decision making through compliance with Commonwealth data policies, standards, and best practices.D\n\nIn carrying out the provisions of this section, the Office shall coordinate and collaborate with, to the fullest extent authorized by federal law and notwithstanding any state law to the contrary, all agencies set forth in subsection A of &#xA7; 2.2-212 and subsection A of &#xA7; 2.2-221; any other state, regional, and local public bodies, including community services boards; local law-enforcement agencies; any health and human services-related entity of a political subdivision that receives state funds; public institutions of higher education; and, when appropriate, private entities.E\n\nThe Office shall be considered an agent of any state agency in the executive branch of government that shares information or data with the Office, and shall be an authorized recipient of information under any statutory or administrative law governing the information or data. The <span class=\"dictionary\">CDO<\/span> shall exercise and perform the duties conferred or imposed upon him by <span class=\"dictionary\">law<\/span> and perform such other duties as may be required by the Governor and the Secretary of Administration. The <span class=\"dictionary\">CDO<\/span> shall not be considered the custodian of any public records in or derived from the <span class=\"dictionary\">Commonwealth Data Trust<\/span>. (ii) data storage; (iii) data security; (iv) privacy; (v) compliance with federal <span class=\"dictionary\">law<\/span>; (vi) the de-identification of data for research purposes; and (vii) the appropriate access to and presentation of <span class=\"dictionary\">open data<\/span> and datasets to the public; <a id=\"paragraph-206753\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-203.2_4\/#B1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Assist state, regional, and local public entities, public institutions of higher education, and employees thereof, with the application of the Government Data Collection and Dissemination Practices Act (&#xA7; <a class=\"law\" title=\"Short title; findings; principles of information practice\" href=\"\/2.2-3800\/\">2.2-3800<\/a> et. seq.) and understanding the applicability of federal <span class=\"dictionary\">laws<\/span> governing privacy and access to data to the data sharing practices of the Commonwealth; <a id=\"paragraph-206754\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-203.2_4\/#B2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Assist the Chief Information Officer of the Commonwealth with matters related to the creation, storage, and dissemination of data upon request; <a id=\"paragraph-206755\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-203.2_4\/#B3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Encourage and coordinate efforts of state, regional, and local public entities and public institutions of higher education to access and share data, including <span class=\"dictionary\">open data<\/span>, across all levels of government in an effort to improve the efficiency and efficacy of services, improve outcomes, and promote data-driven policy making, decision making, research, and analysis; <a id=\"paragraph-206756\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-203.2_4\/#B4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Oversee the implementation of a website dedicated to (i) hosting <span class=\"dictionary\">open data<\/span> from state, regional, and local public entities and public institutions of higher education and (ii) providing links to any other additional <span class=\"dictionary\">open data<\/span> websites in the Commonwealth; <a id=\"paragraph-206757\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-203.2_4\/#B5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Enter into <span class=\"dictionary\">contracts<\/span> for the purpose of carrying out the provisions of this section; <a id=\"paragraph-206758\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-203.2_4\/#B6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Obtain from the Virginia Information Technologies Agency <span class=\"dictionary\">office<\/span> space and human resources, procurement, fiscal, and other administrative support and resources necessary to support the operations of the <span class=\"dictionary\">Office<\/span> and to carry out the provisions of this section; and <a id=\"paragraph-206759\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-203.2_4\/#B7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> Report on the activities of the <span class=\"dictionary\">Office<\/span> and the <span class=\"dictionary\">Commonwealth Data Trust<\/span> annually by December 1 to the Governor and the General Assembly. <a id=\"paragraph-206760\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-203.2_4\/#B8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> The <span class=\"dictionary\">Commonwealth Data Trust<\/span> shall be governed by a multi-level governance structure as follows: <a id=\"paragraph-206761\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-203.2_4\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> The Executive Data <span class=\"dictionary\">Board<\/span> shall consist of the directors or chief executives, or their designees, of executive branch agencies engaged in data sharing and analytics projects with the <span class=\"dictionary\">Commonwealth Data Trust<\/span>. The <span class=\"dictionary\">CDO<\/span> shall chair the <span class=\"dictionary\">Board<\/span>. Members of the <span class=\"dictionary\">Board<\/span> shall (i) translate the Commonwealth&#8217;s data-driven policy goals and objectives into performance targets at their respective agencies; (ii) allocate appropriate resources at their respective agencies to support data governance, sharing, and analytics initiatives; and (iii) provide any reports to the <span class=\"dictionary\">Office<\/span> regarding their respective agencies&#8217; data analytics work and implementation of recommendations. <a id=\"paragraph-206762\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-203.2_4\/#C1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> The Data Governance <span class=\"dictionary\">Council<\/span> shall consist of employees of the agencies represented on the <span class=\"dictionary\">Board<\/span>, selected by the <span class=\"dictionary\">Board<\/span> members from their respective agencies. The <span class=\"dictionary\">CDO<\/span>, or his designee, shall chair the <span class=\"dictionary\">Council<\/span>. The <span class=\"dictionary\">Council<\/span> shall (i) liaise between <span class=\"dictionary\">state agency<\/span> operations and the <span class=\"dictionary\">CDO<\/span>; (ii) advise the <span class=\"dictionary\">CDO<\/span> on data technology, policy, and governance structure; (iii) administer data governance policies, standards, and best practices, as set by the <span class=\"dictionary\">Board<\/span>; (iv) oversee data sharing and analytics projects; (v) review <span class=\"dictionary\">open data<\/span> <span class=\"dictionary\">assets<\/span> prior to publication; (vi) provide to the <span class=\"dictionary\">Board<\/span> any reports on the <span class=\"dictionary\">Council<\/span>&#8217;s recommendations and work as required by the <span class=\"dictionary\">Board<\/span>; (vii) develop necessary privacy and ethical standards and policies for <span class=\"dictionary\">Commonwealth Data Trust<\/span> resources; (viii) monitor the sharing of <span class=\"dictionary\">Commonwealth Data Trust<\/span> member-contributed data resources; (ix) review and approve new <span class=\"dictionary\">Commonwealth Data Trust<\/span>-managed data resources; and (x) conduct any other business the <span class=\"dictionary\">CDO<\/span> deems necessary for <span class=\"dictionary\">Commonwealth Data Trust<\/span> governance. <a id=\"paragraph-206763\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-203.2_4\/#C2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> The Data Stewards <span class=\"dictionary\">Group<\/span> shall consist of employees from executive branch agencies with technical experience in data management or data analytics. Executive branch agencies shall be encouraged to designate at least one agency data steward to serve on the <span class=\"dictionary\">Group<\/span> and may designate multiple data stewards as appropriate based upon organizational or data system responsibilities. The <span class=\"dictionary\">Group<\/span> shall (i) provide the <span class=\"dictionary\">Board<\/span> and <span class=\"dictionary\">Council<\/span> with technical subject matter expertise in support of data policies, standards, and best practices; (ii) implement data sharing and analytics projects promoting data accessibility, sharing, and reuse, thereby reducing redundancy across the Commonwealth; (iii) coordinate and resolve technical stewardship <span class=\"dictionary\">issues<\/span> for standardized data; (iv) ensure data quality processes and standards are implemented consistently by agencies in the Commonwealth; (v) provide communication and education to data users on the appropriate use, sharing, and protection of the Commonwealth&#8217;s data <span class=\"dictionary\">assets<\/span>; (vi) promote the collection and sharing of metadata by registering data <span class=\"dictionary\">assets<\/span> in the Virginia Data Catalog; (vii) liaise with agency project managers and information technology investment staff to ensure adherence to Commonwealth data standards and data sharing requirements; and (viii) support informed, data-driven decision making through compliance with Commonwealth data policies, standards, and best practices. <a id=\"paragraph-206764\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-203.2_4\/#C3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> In carrying out the provisions of this section, the <span class=\"dictionary\">Office<\/span> shall coordinate and collaborate with, to the fullest extent authorized by federal <span class=\"dictionary\">law<\/span> and notwithstanding any state <span class=\"dictionary\">law<\/span> to the contrary, all agencies set forth in subsection A of &#xA7; <a class=\"law\" title=\"Position established; agencies for which responsible; additional powers\" href=\"\/2.2-212\/\">2.2-212<\/a> and subsection A of &#xA7; <a class=\"law\" title=\"Position established; agencies for which responsible; additional powers and duties\" href=\"\/2.2-221\/\">2.2-221<\/a>; any other state, regional, and local public bodies, including <span class=\"dictionary\">community services<\/span> <span class=\"dictionary\">boards<\/span>; local <span class=\"dictionary\">law<\/span>-enforcement agencies; any health and human services-related entity of a political subdivision that receives state funds; public institutions of higher education; and, when appropriate, private entities. <a id=\"paragraph-206765\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-203.2_4\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> The <span class=\"dictionary\">Office<\/span> shall be considered an agent of any <span class=\"dictionary\">state agency<\/span> in the executive branch of government that shares information or data with the <span class=\"dictionary\">Office<\/span>, and shall be an authorized recipient of information under any statutory or administrative <span class=\"dictionary\">law<\/span> governing the information or data. In carrying out the provisions of this section, the Office shall coordinate\nand collaborate with, to the fullest extent authorized by federal law and\nnotwithstanding any state law to the contrary, all agencies set forth in\nsubsection A of &#xA7; 2.2-212 and subsection A of &#xA7; 2.2-221; any other\nstate, regional, and local public bodies, including community services boards;\nlocal law-enforcement agencies; any health and human services-related entity of\na political subdivision that receives state funds; public institutions of higher\neducation; and, when appropriate, private entities.\n\nE. The Office shall be considered an agent of any state agency in the executive\nbranch of government that shares information or data with the Office, and shall\nbe an authorized recipient of information under any statutory or administrative\nlaw governing the information or data. Interagency data shared pursuant to this\nsection shall not constitute a disclosure or release of information or data\nunder any statutory or administrative law governing the information or data.\n\nF. The Office shall be responsible for overseeing and supporting any workforce\ndevelopment data systems authorized under the Secretary of Labor to ensure the\ninteroperability of the systems, to facilitate data sharing, to identify\ninnovative technology solutions, and to support processes that create\ndata-informed decisions.\n\nHISTORY: 2018, c. 679; 2021, Sp.
