The Board shall develop and adopt personnel rules, policies, and procedures to give its employees grievance rights, ensure that employment decisions shall be based upon the merit and fitness of applicants, and prohibit discrimination on the basis of race, religion, color, sex, sexual orientation, gender identity, or national origin.B\n\nAny employee of the Virginia Commercial Space Flight Authority who is a member of any plan providing health insurance coverage pursuant to Chapter 28 (&#xA7; 2.2-2800 et seq.) shall continue to be a member of such health insurance plan under the same terms and conditions. Notwithstanding subsection A of &#xA7; 2.2-2818, the costs of providing health insurance coverage to such employees who elect to continue to be members of the state employees&#8217; health insurance plan shall be paid by the Authority. Alternatively, an employee may elect to become a member of any health insurance plan established by the Authority. The Authority is authorized to (i) establish a health insurance plan for the benefit of its employees and (ii) enter into agreements with the Department of Human Resource Management providing for the coverage of its employees under the state employees&#8217; health insurance plan, provided that such agreements require the Authority to pay the costs of providing health insurance coverage under such plan.C\n\nAny retired employee of the Virginia Commercial Space Flight Authority shall be eligible to receive the health insurance credit set forth in &#xA7; 51.1-1400, provided the retired employee meets the eligibility criteria set forth in that section.D\n\nThe Authority is hereby authorized to establish one or more retirement plans for the benefit of its employees (the Authority retirement plan). For purposes of such plans, the provisions of \u00a7 51.1-126.4 shall apply, mutatis mutandis. Any Authority employee who is a member of the Virginia Retirement System or other retirement plan as authorized by Article 4 (\u00a7 51.1-125 et seq.) of Chapter 1 of Title 51.1 (the statutory optional retirement plan) at the time the Authority retirement plan becomes effective shall continue to be a member of the Virginia Retirement System or the statutory optional retirement plan under the same terms and conditions, unless such employee elects to become a member of the Authority retirement plan. For purposes of this subsection, the &#8220;Virginia Retirement System&#8221; shall include any hybrid retirement program established under Title 51.1.\n\t\t\tThe following rules shall apply:1\n\nThe Authority shall collect and pay all employee and employer contributions to the Virginia Retirement System or the statutory optional retirement plan for retirement and group life insurance in accordance with the provisions of Chapter 1 (&#xA7; 51.1-124.1 et seq.) of Title 51.1 for any employee who elects to remain a member of the Virginia Retirement System or a statutory optional retirement plan.2\n\nEmployees who elect to become members of the Authority retirement plan shall be given full credit for their creditable service as defined in &#xA7; 51.1-124.3 and vesting and benefit accrual under the Authority retirement plan. The Authority shall reimburse the Virginia Retirement System for the cost of actuarial services necessary to determine the present value of the accrued basic benefit of employees who transfer to an Authority retirement plan.4\n\nThe Authority may provide that employees of the Authority who are eligible to participate in any deferred compensation plan sponsored by the Authority shall be enrolled automatically in such plan, unless such employee elects, in a manner prescribed by the Board of the Authority, not to participate. The <span class=\"dictionary\">Authority<\/span> is authorized to (i) establish a health insurance plan for the benefit of its employees and (ii) enter into agreements with the Department of Human Resource Management providing for the coverage of its employees under the <span class=\"dictionary\">state<\/span> employees&#8217; health insurance plan, provided that such agreements require the <span class=\"dictionary\">Authority<\/span> to pay the costs of providing health insurance coverage under such plan. <a id=\"paragraph-259058\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2203.3\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Any retired employee of the Virginia Commercial Space Flight <span class=\"dictionary\">Authority<\/span> shall be eligible to receive the health insurance credit set forth in &#xA7; <a class=\"law\" title=\"Health insurance credits for retired state employees\" href=\"\/51.1-1400\/\">51.1-1400<\/a>, provided the retired employee meets the eligibility criteria set forth in that section. <a id=\"paragraph-259059\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2203.3\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> The <span class=\"dictionary\">Authority<\/span> is hereby authorized to establish one or more retirement plans for the benefit of its employees (the <span class=\"dictionary\">Authority<\/span> retirement plan). For purposes of such plans, the provisions of \u00a7&nbsp;<a class=\"law\" title=\"Employees of the Virginia Port Authority\" href=\"\/51.1-126.4\/\">51.1-126.4<\/a> shall apply, <span class=\"dictionary\">mutatis mutandis<\/span>. Any <span class=\"dictionary\">Authority<\/span> employee who is a member of the <span class=\"dictionary\">Virginia Retirement System<\/span> or other retirement plan as authorized by Article 4 (\u00a7&nbsp;<a class=\"law\" title=\"Persons composing membership; persons holding more than one position\" href=\"\/51.1-125\/\">51.1-125<\/a> et seq.) of Chapter 1 of Title 51.1 (the statutory optional retirement plan) at the time the <span class=\"dictionary\">Authority<\/span> retirement plan becomes effective shall continue to be a member of the <span class=\"dictionary\">Virginia Retirement System<\/span> or the statutory optional retirement plan under the same terms and conditions, unless such employee elects to become a member of the <span class=\"dictionary\">Authority<\/span> retirement plan. For purposes of this subsection, the &#8220;<span class=\"dictionary\">Virginia Retirement System<\/span>&#8221; shall include any hybrid retirement program established under Title 51.1.\n\t\t\tThe following rules shall apply: <a id=\"paragraph-259060\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2203.3\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> The <span class=\"dictionary\">Authority<\/span> shall collect and pay all employee and employer contributions to the <span class=\"dictionary\">Virginia Retirement System<\/span> or the statutory optional retirement plan for retirement and group life insurance in accordance with the provisions of Chapter 1 (&#xA7; <a class=\"law\" title=\"Virginia Retirement System established\" href=\"\/51.1-124.1\/\">51.1-124.1<\/a> et seq.) of Title 51.1 for any employee who elects to remain a member of the <span class=\"dictionary\">Virginia Retirement System<\/span> or a statutory optional retirement plan. <a id=\"paragraph-259061\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2203.3\/#D1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Employees who elect to become members of the <span class=\"dictionary\">Authority<\/span> retirement plan shall be given full credit for their creditable service as defined in &#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/51.1-124.3\/\">51.1-124.3<\/a> and vesting and benefit accrual under the <span class=\"dictionary\">Authority<\/span> retirement plan. For any such employee, employment with the <span class=\"dictionary\">Authority<\/span> shall be treated as employment with any nonparticipating employer for purposes of the <span class=\"dictionary\">Virginia Retirement System<\/span> or any statutory optional retirement plan. <a id=\"paragraph-259062\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2203.3\/#D2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> For employees who elect to become members of the <span class=\"dictionary\">Authority<\/span> retirement plan, the <span class=\"dictionary\">Virginia Retirement System<\/span> or the statutory optional retirement plan, as applicable, shall transfer to the <span class=\"dictionary\">Authority<\/span> retirement plan <span class=\"dictionary\">assets<\/span> equal to the actuarially determined present value of the accrued <span class=\"dictionary\">basic benefits<\/span> for such employees as of the transfer date. For purposes hereof, &#8220;<span class=\"dictionary\">basic benefits<\/span>&#8221; means the benefits accrued under the <span class=\"dictionary\">Virginia Retirement System<\/span> or under the statutory optional retirement plan based on creditable service and average final compensation as defined in &#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/51.1-124.3\/\">51.1-124.3<\/a>. The actuarial present value shall be determined by using the same actuarial factors and assumptions used in determining the funding needs of the <span class=\"dictionary\">Virginia Retirement System<\/span> or the statutory optional retirement plan so that the transfer of <span class=\"dictionary\">assets<\/span> to the <span class=\"dictionary\">Authority<\/span> retirement plan will have no effect on the funded status and financial stability of the <span class=\"dictionary\">Virginia Retirement System<\/span> or the statutory optional retirement plan. The <span class=\"dictionary\">Authority<\/span> shall reimburse the <span class=\"dictionary\">Virginia Retirement System<\/span> for the cost of actuarial services necessary to determine the present value of the accrued basic benefit of employees who transfer to an <span class=\"dictionary\">Authority<\/span> retirement plan. <a id=\"paragraph-259063\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2203.3\/#D3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> The <span class=\"dictionary\">Authority<\/span> may provide that employees of the <span class=\"dictionary\">Authority<\/span> who are eligible to participate in any deferred compensation plan sponsored by the <span class=\"dictionary\">Authority<\/span> shall be enrolled automatically in such plan, unless such employee elects, in a manner prescribed by the <span class=\"dictionary\">Board<\/span> of the <span class=\"dictionary\">Authority<\/span>, not to participate. The amount of the deferral under the automatic enrollment and the group of employees to which the automatic enrollment shall apply shall be set by the <span class=\"dictionary\">Board<\/span>, provided, however, that such employees are provided the opportunity to increase or decrease the amount of the deferral in accordance with the Internal Revenue Code of 1986, as amended. <a id=\"paragraph-259064\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2203.3\/#D4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> The <span class=\"dictionary\">Authority<\/span> is hereby authorized to establish a plan providing short-term disability and long-term disability benefits for its employees. <a id=\"paragraph-259065\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2203.3\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nEMPLOYEES; EMPLOYMENT; PERSONNEL RULES (\u00a7 2.2-2203.3)\n\nA. Employees of the Authority shall be employed on such terms and conditions as\nestablished by the Board. The Board shall develop and adopt personnel rules,\npolicies, and procedures to give its employees grievance rights, ensure that\nemployment decisions shall be based upon the merit and fitness of applicants,\nand prohibit discrimination on the basis of race, religion, color, sex, sexual\norientation, gender identity, or national origin.\n\nB. Any employee of the Virginia Commercial Space Flight Authority who is a\nmember of any plan providing health insurance coverage pursuant to Chapter 28\n(&#xA7; 2.2-2800 et seq.) shall continue to be a member of such health insurance\nplan under the same terms and conditions. Notwithstanding subsection A of &#xA7;\n2.2-2818, the costs of providing health insurance coverage to such employees who\nelect to continue to be members of the state employees&#8217; health insurance\nplan shall be paid by the Authority. Alternatively, an employee may elect to\nbecome a member of any health insurance plan established by the Authority. The\nAuthority is authorized to (i) establish a health insurance plan for the benefit\nof its employees and (ii) enter into agreements with the Department of Human\nResource Management providing for the coverage of its employees under the state\nemployees&#8217; health insurance plan, provided that such agreements require\nthe Authority to pay the costs of providing health insurance coverage under such\nplan.\n\nC. Any retired employee of the Virginia Commercial Space Flight Authority shall\nbe eligible to receive the health insurance credit set forth in &#xA7;\n51.1-1400, provided the retired employee meets the eligibility criteria set\nforth in that section.\n\nD. The Authority is hereby authorized to establish one or more retirement plans\nfor the benefit of its employees (the Authority retirement plan). For purposes\nof such plans, the provisions of \u00a7 51.1-126.4 shall apply, mutatis mutandis.\nAny Authority employee who is a member of the Virginia Retirement System or\nother retirement plan as authorized by Article 4 (\u00a7 51.1-125 et seq.) of\nChapter 1 of Title 51.1 (the statutory optional retirement plan) at the time the\nAuthority retirement plan becomes effective shall continue to be a member of the\nVirginia Retirement System or the statutory optional retirement plan under the\nsame terms and conditions, unless such employee elects to become a member of the\nAuthority retirement plan. For purposes of this subsection, the &#8220;Virginia\nRetirement System&#8221; shall include any hybrid retirement program established\nunder Title 51.1.\n\t\t\tThe following rules shall apply:\n\n   1. For purposes hereof, &#8220;basic\n   benefits&#8221; means the benefits accrued under the Virginia Retirement\n   System or under the statutory optional retirement plan based on creditable\n   service and average final compensation as defined in &#xA7; 51.1-124.3. The\n   actuarial present value shall be determined by using the same actuarial\n   factors and assumptions used in determining the funding needs of the Virginia\n   Retirement System or the statutory optional retirement plan so that the\n   transfer of assets to the Authority retirement plan will have no effect on the\n   funded status and financial stability of the Virginia Retirement System or the\n   statutory optional retirement plan. The Authority shall reimburse the Virginia\n   Retirement System for the cost of actuarial services necessary to determine\n   the present value of the accrued basic benefit of employees who transfer to an\n   Authority retirement plan.\n\n   4. The Authority may provide that employees of the Authority who are eligible\n   to participate in any deferred compensation plan sponsored by the Authority\n   shall be enrolled automatically in such plan, unless such employee elects, in\n   a manner prescribed by the Board of the Authority, not to participate.
