I, c. 453; 2023, cc. 624, 625.","full_text":"A\n\nThe Board shall implement a Virginia Workforce System that shall undertake the following actions to implement and foster workforce development and training and better align education and workforce programs to meet current and projected skills requirements of an increasingly technological, global workforce:1\n\nProvide policy advice to the Governor on workforce and workforce development issues in order to create a business-driven system that yields increasing rates of attainment of workforce credentials in demand by business and increasing rates of jobs creation and attainment;2\n\nProvide policy direction to local workforce development boards;3\n\nAssist the Governor in the development, implementation, and modification of any combined state plan developed pursuant to the WIOA;4\n\nIdentify current and emerging statewide workforce needs of the business community;5\n\nForecast and identify training requirements for the new workforce;6\n\nRecommend strategies to match trained workers with available jobs to include strategies for increasing business engagement in education and workforce development;7\n\nEvaluate the extent to which the state&#8217;s workforce development programs emphasize education and training opportunities that align with employers&#8217; workforce needs and labor market statistics and report the findings of this analysis to the Governor every two years;8\n\nAdvise and oversee the development of a strategic workforce dashboard and tools that will inform the Governor, policy makers, system stakeholders, and the public on issues such as state and regional labor market conditions, the relationship between the supply and demand for workers, workforce program outcomes, and projected employment growth or decline. The Department of Workforce Development and Advancement, along with other workforce partners, shall provide data to populate the tools and dashboard;9\n\nDetermine and publish a list of jobs, trades, and professions for which high demand for qualified workers exists or is projected by the Department of Workforce Development and Advancement. The Department of Workforce Development and Advancement shall support the Virginia Board of Workforce Development in making such determination. Such information shall be published biennially and disseminated to employers; education and training entities, including associate-degree-granting and baccalaureate public institutions of higher education; government agencies, including the Department of Education and public libraries; and other users in the public and private sectors;10\n\nDevelop pay-for-performance contract strategy incentives for rapid reemployment services consistent with the WIOA as an alternative model to traditional programs;11\n\nConduct a review of budgets, which shall be submitted annually to the Board by each agency conducting federal and state funded career and technical and adult education and workforce development programs, that identify the agency&#8217;s sources and expenditures of administrative, workforce education and training, and support services for workforce development programs;12\n\nReview and recommend industry credentials that align with high demand occupations, which credentials shall include a credential that determines career readiness;13\n\nDefine the Board&#8217;s role in certifying WIOA training providers, including those not subject to the authority expressed in Article 3 (&#xA7; 23.1-213 et seq.) of Chapter 2 of Title 23.1;14\n\nProvide an annual report to the Governor concerning its actions and determinations under subdivisions 1 through 13;15\n\nCreate quality standards, guidelines, and directives applicable to local workforce development boards and the operation of one-stops, as necessary and appropriate to carry out the purposes of this article;16\n\nConduct or cause to be conducted, on a biennial basis, an independent evaluation of the operational and program objectives of the Department of Workforce Development and Advancement and submit a report to the Governor and the General Assembly summarizing such evaluation; and17\n\nPerform any act or function in accordance with the purposes of this article.B\n\nThe Board may establish such committees as it deems necessaryC\n\nThe Board, the Secretary of Labor, and the Governor&#8217;s other Cabinet Secretaries shall assist the Governor in complying with the provisions of the WIOA and ensuring the coordination and effectiveness of all federal and state funded career and technical and adult education and workforce development programs and providers within Virginia&#8217;s Workforce System.D\n\nThe Board shall assist the Governor in the following areas with respect to workforce development: development of any combined state plan developed pursuant to the WIOA; development and continuous improvement of a statewide workforce development system that ensures career readiness and coordinates and aligns career and technical education, adult education, and federal and state workforce programs; development of linkages to ensure coordination and nonduplication among programs and activities; designation of local areas; development of local discretionary allocation formulas; development and continuous improvement of comprehensive state performance measures including, without limitation, performance measures reflecting the degree to which one-stop centers provide comprehensive services with all mandatory partners and the degree to which local workforce development boards have obtained funding from sources other than the WIOA; preparation of the annual report to the U.S. Secretary of Labor; development of a statewide employment statistics system; and development of a statewide system of one-stop centers that provide comprehensive workforce services to employers, employees, and job seekers.\n\t\t\tThe Board shall share information regarding its meetings and activities with the public.E\n\nEach local workforce development board shall develop and submit to the Governor and the Board an annual workforce demand plan for its workforce development board area based on a survey of local and regional businesses that reflects the local employers&#8217; needs and requirements and the availability of trained workers to meet those needs and requirements. Local boards shall also designate or certify one-stop operators; identify eligible providers of youth activities; develop a budget; conduct local oversight of one-stop operators and training providers in partnership with its local chief elected official; negotiate local performance measures, including incentives for good performance and penalties for inadequate performance; assist in developing statewide employment statistics; coordinate workforce development activities with economic development strategies and the annual demand plan, and develop linkages among them; develop and enter into memoranda of understanding with one-stop partners and implement the terms of such memoranda; promote participation by the private sector; actively seek sources of financing in addition to WIOA funds; report performance statistics to the Board; and certify local training providers in accordance with criteria provided by the Board. Further, a local training provider certified by any workforce development board has reciprocal certification for all workforce development boards.F\n\nEach workforce development board shall develop and execute a strategic plan designed to combine public and private resources to support sector strategies, career pathways, and career readiness skills development. Such initiatives shall include or address (i) a regional vision for workforce development; (ii) protocols for planning workforce strategies that anticipate industry needs; (iii) the needs of incumbent and underemployed workers in the region; (iv) the development of partners and guidelines for various forms of on-the-job training, such as registered apprenticeships; (v) the setting of standards and metrics for operational delivery; (vi) alignment of monetary and other resources, including private funds and in-kind contributions, to support the workforce development system; and (vii) the generation of new sources of funding to support workforce development in the region.G\n\nLocal workforce development boards are encouraged to implement pay-for-performance contract strategy incentives for rapid reemployment services consistent within the WIOA as an alternative model to traditional programs. Such incentives shall focus on (i) partnerships that lead to placements of eligible job seekers in unsubsidized employment and (ii) placement in unsubsidized employment for hard-to-serve job seekers. At the discretion of the local workforce development board, funds to the extent permissible under &#xA7;&#xA7; 128(b) and 133(b) of the WIOA may be allocated for pay-for-performance partnerships.H\n\nEach chief local elected official shall consult with the Governor regarding designation of local workforce development areas; appoint members to the local board in accordance with state criteria; serve as the local grant recipient unless another entity is designated in the local plan; negotiate local performance measures with the Governor; ensure that all mandated partners are active participants in the local workforce development board and one-stop center; and collaborate with the local workforce development board on local plans and program oversight.I\n\nEach local workforce development board shall develop and enter into a memorandum of understanding concerning the operation of the one-stop delivery system in the local area with each entity that carries out any of the following programs or activities:1\n\nPrograms authorized under Title I of the WIOA;2\n\nPrograms authorized under the Wagner-Peyser Act (29 U.S.C. &#xA7; 49 et seq.);3\n\nAdult education and literacy activities authorized under Title II of the WIOA;4\n\nPrograms authorized under Title I of the Rehabilitation Act of 1973 (29 U.S.C. &#xA7; 720 et seq.);5\n\nPostsecondary career and technical education activities authorized under the Carl D. Perkins Vocational and Applied Technology Education Act (20 U.S.C. &#xA7; 2301 et seq.);6\n\nActivities authorized under Chapter 2 of Title II of the Trade Act of 1974 (19 U.S.C. &#xA7; 2271 et seq.);7\n\nActivities pertaining to employment and training programs for veterans authorized under 38 U.S.C. &#xA7; 4100 et seq.;8\n\nPrograms authorized under Title 60.2, in accordance with applicable federal law;9\n\nWorkforce development activities or work requirements of the Temporary Assistance to Needy Families (TANF) program known in Virginia as the Virginia Initiative for Education and Work (VIEW) established pursuant to &#xA7; 63.2-608;10\n\nWorkforce development activities or work programs authorized under the Food Stamp Act of 1977 (7 U.S.C. &#xA7; 2011 et seq.);11\n\nOther programs or activities as required by the WIOA; and12\n\nPrograms authorized under Title I of the WIOA.J\n\nThe quorum for a meeting of a local workforce development board shall consist of a majority of both the private sector and public sector members. workforce needs and labor market statistics and report the <span class=\"dictionary\">findings<\/span> of this analysis to the Governor every two years; <a id=\"paragraph-277612\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#A7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> Advise and oversee the development of a strategic workforce dashboard and tools that will inform the Governor, policy makers, system stakeholders, and the public on <span class=\"dictionary\">issues<\/span> such as state and regional labor market conditions, the relationship between the supply and demand for workers, workforce program outcomes, and projected employment growth or decline. The Department of Workforce Development and Advancement, along with other workforce partners, shall provide data to populate the tools and dashboard; <a id=\"paragraph-277613\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#A8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> Determine and publish a list of jobs, trades, and professions for which high demand for qualified workers exists or is projected by the Department of Workforce Development and Advancement. The Department of Workforce Development and Advancement shall support the Virginia Board of Workforce Development in making such determination. Such information shall be published biennially and disseminated to employers; education and training entities, including associate-degree-granting and baccalaureate public institutions of higher education; government agencies, including the Department of Education and public libraries; and other users in the public and private sectors; <a id=\"paragraph-277614\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#A9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> Develop pay-for-performance <span class=\"dictionary\">contract<\/span> strategy incentives for rapid reemployment services consistent with the <span class=\"dictionary\">WIOA<\/span> as an alternative model to traditional programs; <a id=\"paragraph-277615\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#A10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A11\" class=\"indent-1\"><p><span class=\"prefix-number\">11.<\/span> Conduct a review of budgets, which shall be submitted annually to the Board by each agency conducting federal and state funded career and technical and adult education and workforce development programs, that identify the agency&#8217;s sources and expenditures of administrative, workforce education and training, and support services for workforce development programs; <a id=\"paragraph-277616\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#A11\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A12\" class=\"indent-1\"><p><span class=\"prefix-number\">12.<\/span> Review and recommend industry credentials that align with high demand occupations, which credentials shall include a credential that determines career readiness; <a id=\"paragraph-277617\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#A12\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A13\" class=\"indent-1\"><p><span class=\"prefix-number\">13.<\/span> Define the Board&#8217;s role in certifying <span class=\"dictionary\">WIOA<\/span> training providers, including those not subject to the authority expressed in Article 3 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/23.1-213\/\">23.1-213<\/a> et seq.) of Chapter 2 of Title 23.1; <a id=\"paragraph-277618\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#A13\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A14\" class=\"indent-1\"><p><span class=\"prefix-number\">14.<\/span> Provide an annual report to the Governor concerning its actions and determinations under subdivisions 1 through 13; <a id=\"paragraph-277620\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#A15\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A16\" class=\"indent-1\"><p><span class=\"prefix-number\">16.<\/span> Conduct or cause to be conducted, on a biennial basis, an independent evaluation of the operational and program objectives of the Department of Workforce Development and Advancement and submit a report to the Governor and the General Assembly summarizing such evaluation; and <a id=\"paragraph-277621\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#A16\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A17\" class=\"indent-1\"><p><span class=\"prefix-number\">17.<\/span> Perform any act or function in accordance with the purposes of this article. <a id=\"paragraph-277622\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#A17\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> The Board may establish such committees as it deems necessary <a id=\"paragraph-277623\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> The Board, the Secretary of Labor, and the Governor&#8217;s other Cabinet Secretaries shall assist the Governor in complying with the provisions of the <span class=\"dictionary\">WIOA<\/span> and ensuring the coordination and effectiveness of all federal and state funded career and technical and adult education and workforce development programs and providers within Virginia&#8217;s Workforce System. <a id=\"paragraph-277624\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> The Board shall assist the Governor in the following areas with respect to workforce development: development of any combined state plan developed pursuant to the <span class=\"dictionary\">WIOA<\/span>; development and continuous improvement of a statewide workforce development system that ensures career readiness and coordinates and aligns career and technical education, adult education, and federal and state workforce programs; development of linkages to ensure coordination and nonduplication among programs and activities; designation of local areas; development of local discretionary allocation formulas; development and continuous improvement of comprehensive state performance measures including, without limitation, performance measures reflecting the degree to which <span class=\"dictionary\">one-stop centers<\/span> provide comprehensive services with all mandatory partners and the degree to which <span class=\"dictionary\">local workforce development boards<\/span> have obtained funding from sources other than the <span class=\"dictionary\">WIOA<\/span>; preparation of the annual report to the U.S. Secretary of Labor; development of a statewide employment statistics system; and development of a statewide system of <span class=\"dictionary\">one-stop centers<\/span> that provide comprehensive workforce services to employers, employees, and job seekers.\n\t\t\tThe Board shall share information regarding its meetings and activities with the public. <a id=\"paragraph-277625\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> Each <span class=\"dictionary\">local workforce development board<\/span> shall develop and submit to the Governor and the Board an annual workforce demand plan for its workforce development board area based on a survey of local and regional businesses that reflects the local employers&#8217; needs and requirements and the availability of trained workers to meet those needs and requirements. Local boards shall also designate or certify <span class=\"dictionary\">one-stop operators<\/span>; identify eligible providers of youth activities; develop a budget; conduct local oversight of <span class=\"dictionary\">one-stop operators<\/span> and training providers in partnership with its local chief elected official; negotiate local performance measures, including incentives for good performance and penalties for inadequate performance; assist in developing statewide employment statistics; coordinate workforce development activities with economic development strategies and the annual demand plan, and develop linkages among them; develop and enter into memoranda of understanding with one-stop partners and implement the terms of such memoranda; promote participation by the private sector; actively seek sources of financing in addition to <span class=\"dictionary\">WIOA<\/span> funds; report performance statistics to the Board; and certify local training providers in accordance with criteria provided by the Board. Further, a local training provider certified by any workforce development board has reciprocal certification for all workforce development boards. <a id=\"paragraph-277626\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> Each workforce development board shall develop and execute a strategic plan designed to combine public and private resources to support sector strategies, career pathways, and career readiness skills development. Such initiatives shall include or address (i) a regional vision for workforce development; (ii) protocols for planning workforce strategies that anticipate industry needs; (iii) the needs of incumbent and underemployed workers in the region; (iv) the development of partners and guidelines for various forms of on-the-job training, such as registered apprenticeships; (v) the setting of standards and metrics for operational delivery; (vi) alignment of monetary and other resources, including private funds and in-kind contributions, to support the workforce development system; and (vii) the generation of new sources of funding to support workforce development in the region. <a id=\"paragraph-277627\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> <span class=\"dictionary\">Local workforce development boards<\/span> are encouraged to implement pay-for-performance <span class=\"dictionary\">contract<\/span> strategy incentives for rapid reemployment services consistent within the <span class=\"dictionary\">WIOA<\/span> as an alternative model to traditional programs. Such incentives shall focus on (i) partnerships that lead to placements of eligible job seekers in unsubsidized employment and (ii) placement in unsubsidized employment for hard-to-serve job seekers. At the discretion of the <span class=\"dictionary\">local workforce development board<\/span>, funds to the extent permissible under &#xA7;&#xA7; 128(b) and 133(b) of the <span class=\"dictionary\">WIOA<\/span> may be allocated for pay-for-performance partnerships. <a id=\"paragraph-277628\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"H\"><p><span class=\"prefix-number\">H.<\/span> Each chief local elected official shall consult with the Governor regarding designation of local workforce development areas; appoint members to the local board in accordance with state criteria; serve as the local grant recipient unless another entity is designated in the local plan; negotiate local performance measures with the Governor; ensure that all mandated partners are active participants in the <span class=\"dictionary\">local workforce development board<\/span> and <span class=\"dictionary\">one-stop center<\/span>; and collaborate with the <span class=\"dictionary\">local workforce development board<\/span> on local plans and program oversight. <a id=\"paragraph-277629\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#H\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I\"><p><span class=\"prefix-number\">I.<\/span> Each <span class=\"dictionary\">local workforce development board<\/span> shall develop and enter into a <span class=\"dictionary\">memorandum<\/span> of understanding concerning the operation of the one-stop delivery system in the local area with each entity that carries out any of the following programs or activities: <a id=\"paragraph-277630\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#I\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Programs authorized under Title I of the <span class=\"dictionary\">WIOA<\/span>; <a id=\"paragraph-277631\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#I1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Programs authorized under the Wagner-Peyser Act (29 U.S.C. &#xA7; 49 et seq.); <a id=\"paragraph-277632\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#I2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Adult education and literacy activities authorized under Title II of the <span class=\"dictionary\">WIOA<\/span>; <a id=\"paragraph-277633\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#I3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Programs authorized under Title I of the Rehabilitation Act of 1973 (29 U.S.C. &#xA7; 720 et seq.); <a id=\"paragraph-277634\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#I4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Postsecondary career and technical education activities authorized under the Carl D. Perkins Vocational and Applied Technology Education Act (20 U.S.C. &#xA7; 2301 et seq.); <a id=\"paragraph-277635\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#I5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Activities authorized under Chapter 2 of Title II of the Trade Act of 1974 (19 U.S.C. &#xA7; 2271 et seq.); <a id=\"paragraph-277636\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#I6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Activities pertaining to employment and training programs for veterans authorized under 38 U.S.C. &#xA7; 4100 et seq.; <a id=\"paragraph-277637\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#I7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> Programs authorized under Title 60.2, in accordance with applicable federal <span class=\"dictionary\">law<\/span>; <a id=\"paragraph-277638\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#I8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> Workforce development activities or work requirements of the Temporary Assistance to Needy Families (TANF) program known in Virginia as the Virginia Initiative for Education and Work (VIEW) established pursuant to &#xA7; <a class=\"law\" title=\"Virginia Initiative for Education and Work (VIEW)\" href=\"\/63.2-608\/\">63.2-608<\/a>; <a id=\"paragraph-277639\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#I9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> Workforce development activities or work programs authorized under the Food Stamp Act of 1977 (7 U.S.C. &#xA7; 2011 et seq.); <a id=\"paragraph-277640\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#I10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I11\" class=\"indent-1\"><p><span class=\"prefix-number\">11.<\/span> Other programs or activities as required by the <span class=\"dictionary\">WIOA<\/span>; and <a id=\"paragraph-277641\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#I11\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I12\" class=\"indent-1\"><p><span class=\"prefix-number\">12.<\/span> Programs authorized under Title I of the <span class=\"dictionary\">WIOA<\/span>. <a id=\"paragraph-277642\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#I12\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"J\"><p><span class=\"prefix-number\">J.<\/span> The quorum for a meeting of a <span class=\"dictionary\">local workforce development board<\/span> shall consist of a majority of both the private sector and public sector members. Each <span class=\"dictionary\">local workforce development board<\/span> shall share information regarding its meetings and activities with the public. <a id=\"paragraph-277643\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#J\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"K\"><p><span class=\"prefix-number\">K.<\/span> For the purposes of implementing the <span class=\"dictionary\">WIOA<\/span>, income from service in the Virginia National Guard shall not disqualify unemployed service members from <span class=\"dictionary\">WIOA<\/span>-related services. <a id=\"paragraph-277644\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#K\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"L\"><p><span class=\"prefix-number\">L.<\/span> The Secretary of Labor shall be responsible for the coordination of the Virginia Workforce System and the implementation of the <span class=\"dictionary\">WIOA<\/span>. <a id=\"paragraph-277645\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-2472\/#L\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nPOWERS AND DUTIES OF THE BOARD; VIRGINIA WORKFORCE SYSTEM CREATED (\u00a7 2.2-2472)\n\nA. The Board shall implement a Virginia Workforce System that shall undertake\nthe following actions to implement and foster workforce development and training\nand better align education and workforce programs to meet current and projected\nskills requirements of an increasingly technological, global workforce:\n\n   1. Provide policy advice to the Governor on workforce and workforce\n   development issues in order to create a business-driven system that yields\n   increasing rates of attainment of workforce credentials in demand by business\n   and increasing rates of jobs creation and attainment;\n\n   2. Provide policy direction to local workforce development boards;\n\n   3. Assist the Governor in the development, implementation, and modification of\n   any combined state plan developed pursuant to the WIOA;\n\n   4. Identify current and emerging statewide workforce needs of the business\n   community;\n\n   5. Forecast and identify training requirements for the new workforce;\n\n   6. Recommend strategies to match trained workers with available jobs to\n   include strategies for increasing business engagement in education and\n   workforce development;\n\n   7. Evaluate the extent to which the state&#8217;s workforce development\n   programs emphasize education and training opportunities that align with\n   employers&#8217; workforce needs and labor market statistics and report the\n   findings of this analysis to the Governor every two years;\n\n   8. Advise and oversee the development of a strategic workforce dashboard and\n   tools that will inform the Governor, policy makers, system stakeholders, and\n   the public on issues such as state and regional labor market conditions, the\n   relationship between the supply and demand for workers, workforce program\n   outcomes, and projected employment growth or decline. The Department of\n   Workforce Development and Advancement, along with other workforce partners,\n   shall provide data to populate the tools and dashboard;\n\n   9. Determine and publish a list of jobs, trades, and professions for which\n   high demand for qualified workers exists or is projected by the Department of\n   Workforce Development and Advancement. The Department of Workforce Development\n   and Advancement shall support the Virginia Board of Workforce Development in\n   making such determination. Such information shall be published biennially and\n   disseminated to employers; education and training entities, including\n   associate-degree-granting and baccalaureate public institutions of higher\n   education; government agencies, including the Department of Education and\n   public libraries; and other users in the public and private sectors;\n\n   10. Develop pay-for-performance contract strategy incentives for rapid\n   reemployment services consistent with the WIOA as an alternative model to\n   traditional programs;\n\n   11. Conduct a review of budgets, which shall be submitted annually to the\n   Board by each agency conducting federal and state funded career and technical\n   and adult education and workforce development programs, that identify the\n   agency&#8217;s sources and expenditures of administrative, workforce education\n   and training, and support services for workforce development programs;\n\n   12. Review and recommend industry credentials that align with high demand\n   occupations, which credentials shall include a credential that determines\n   career readiness;\n\n   13. Define the Board&#8217;s role in certifying WIOA training providers,\n   including those not subject to the authority expressed in Article 3 (&#xA7;\n   23.1-213 et seq.) of Chapter 2 of Title 23.1;\n\n   14. Provide an annual report to the Governor concerning its actions and\n   determinations under subdivisions 1 through 13;\n\n   15. Create quality standards, guidelines, and directives applicable to local\n   workforce development boards and the operation of one-stops, as necessary and\n   appropriate to carry out the purposes of this article;\n\n   16. Conduct or cause to be conducted, on a biennial basis, an independent\n   evaluation of the operational and program objectives of the Department of\n   Workforce Development and Advancement and submit a report to the Governor and\n   the General Assembly summarizing such evaluation; and\n\n   17. Perform any act or function in accordance with the purposes of this\n   article.\n\nB. The Board may establish such committees as it deems necessary\n\nC. The Board, the Secretary of Labor, and the Governor&#8217;s other Cabinet\nSecretaries shall assist the Governor in complying with the provisions of the\nWIOA and ensuring the coordination and effectiveness of all federal and state\nfunded career and technical and adult education and workforce development\nprograms and providers within Virginia&#8217;s Workforce System.\n\nD. The Board shall assist the Governor in the following areas with respect to\nworkforce development: development of any combined state plan developed pursuant\nto the WIOA; development and continuous improvement of a statewide workforce\ndevelopment system that ensures career readiness and coordinates and aligns\ncareer and technical education, adult education, and federal and state workforce\nprograms; development of linkages to ensure coordination and nonduplication\namong programs and activities; designation of local areas; development of local\ndiscretionary allocation formulas; development and continuous improvement of\ncomprehensive state performance measures including, without limitation,\nperformance measures reflecting the degree to which one-stop centers provide\ncomprehensive services with all mandatory partners and the degree to which local\nworkforce development boards have obtained funding from sources other than the\nWIOA; preparation of the annual report to the U.S. Secretary of Labor;\ndevelopment of a statewide employment statistics system; and development of a\nstatewide system of one-stop centers that provide comprehensive workforce\nservices to employers, employees, and job seekers.\n\t\t\tThe Board shall share information regarding its meetings and activities with\nthe public.\n\nE.
