However, no investigation of an elected official of the Commonwealth to determine whether a criminal violation has occurred, is occurring, or is about to occur under the provisions of &#xA7; 52-8.1 shall be initiated, undertaken, or continued except upon the request of the Governor, the Attorney General, or a grand jury;6\n\nPrepare a detailed report of each investigation stating whether fraud, waste, abuse, or corruption has been detected. If fraud, waste, abuse, or corruption is detected, the report shall (i) identify the person committing the wrongful act or omission, (ii) describe the wrongful act or omission, and (iii) describe any corrective measures taken by the state agency or nonstate agency in which the wrongful act or omission was committed to prevent recurrences of similar actions;7\n\nProvide timely notification to the appropriate attorney for the Commonwealth and law-enforcement agencies whenever the State Inspector General has reasonable grounds to believe there has been a violation of state criminal law;8\n\nAdminister the Fraud and Abuse Whistle Blower Reward Fund created pursuant to &#xA7; 2.2-3014;9\n\nOversee the Fraud, Waste and Abuse Hotline;10\n\nConduct performance reviews of state agencies to assess the efficiency, effectiveness, or economy of programs and to ascertain, among other things, that sums appropriated have been or are being expended for the purposes for which the appropriation was made and prepare a report for each performance review detailing any findings or recommendations for improving the efficiency, effectiveness, or economy of state agencies, including recommending changes in the law to the Governor and the General Assembly that are necessary to address such findings;11\n\nCoordinate and require standards for those internal audit programs in existence as of July 1, 2012, and for other internal audit programs in state agencies and nonstate agencies as needed in order to ensure that the Commonwealth&#8217;s assets are subject to appropriate internal management controls;12\n\nAs deemed necessary, assess the condition of the accounting, financial, and administrative controls of state agencies and nonstate agencies and make recommendations to protect the Commonwealth&#8217;s assets;13\n\nAssist agency internal auditing programs with technical auditing issues and coordinate and provide training to the Commonwealth&#8217;s internal auditors;14\n\nAssist citizens in understanding their rights and the processes available to them to express concerns regarding the activities of a state agency or nonstate agency or any officer or employee of the foregoing;15\n\nMaintain data on inquiries received, the types of assistance requested, any actions taken, and the disposition of each such matter;16\n\nUpon request, assist citizens in using the procedures and processes available to express concerns regarding the activities of a state or nonstate agency or any officer or employee of the foregoing;17\n\nEnsure that citizens have access to the services provided by the State Inspector General and that citizens receive timely responses to their inquiries from the State Inspector General or his representatives; and18\n\nDo all acts necessary or convenient to carry out the purposes of this chapter.B\n\nIf the State Inspector General receives a complaint from whatever source that alleges fraud, waste, abuse, or corruption by a public institution of higher education that is (i) a covered institution as defined by the Restructured Higher Education Financial and Administrative Operations Act (&#xA7; 23.1-1000 et seq.) and (ii) classified as a Level 3 institution by the State Council of Higher Education for Virginia, or any of its officers or employees, the State Inspector General shall, but for reasonable and articulable causes, refer the complaint to the internal audit department of the public institution of higher education for investigation. However, if the complaint concerns the president of the institution or its internal audit department, or if the State Inspector General otherwise concludes that his office should investigate the complaint to ensure a comprehensive and fully independent investigation, the investigation shall be conducted by the State Inspector General. The State Inspector General may provide assistance for investigations as may be requested by the public institution of higher education.\n\t\t\tThe public institution of higher education shall provide periodic updates on the status of investigations, whether they originated internally or were referred by the State Inspector General, and report annually to the State Inspector General on the results of all such investigations.C\n\nThe State Inspector General shall establish procedures governing the intake and investigation of complaints alleging allegations of fraud, waste, abuse, or corruption by a state agency or nonstate agency or by any officer or employee of a state agency or nonstate agency. Such procedures shall:1\n\nProvide that the State Inspector General, or his designee, shall review each decision to dismiss an allegation reported to the State Fraud, Waste, and Abuse Hotline at the initial intake stage without further investigation.2\n\nRequire that (i) investigators of the Office of the State Inspector General directly investigate allegations of serious administrative violations and (ii) other agency internal audit divisions may investigate allegations meeting certain criteria specified by the State Inspector General, only if the internal audit division has demonstrated the ability to conduct investigations in an independent, effective, and timely manner. However, no investigation of an elected official of the Commonwealth to determine whether a criminal violation has occurred, is occurring, or is about to occur under the provisions of &#xA7; <a class=\"law\" title=\"Powers and duties of Bureau of Criminal Investigation\" href=\"\/52-8.1\/\">52-8.1<\/a> shall be initiated, undertaken, or continued except upon the request of the Governor, the <span class=\"dictionary\">Attorney General<\/span>, or a <span class=\"dictionary\">grand jury<\/span>; <a id=\"paragraph-254763\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-309\/#A5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Prepare a detailed report of each investigation stating whether <span class=\"dictionary\">fraud<\/span>, waste, abuse, or corruption has been detected. If <span class=\"dictionary\">fraud<\/span>, waste, abuse, or corruption is detected, the report shall (i) identify the person committing the wrongful act or omission, (ii) describe the wrongful act or omission, and (iii) describe any corrective measures taken by the <span class=\"dictionary\">state agency<\/span> or <span class=\"dictionary\">nonstate agency<\/span> in which the wrongful act or omission was committed to prevent recurrences of similar actions; <a id=\"paragraph-254767\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-309\/#A9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> Conduct performance reviews of state agencies to assess the efficiency, effectiveness, or economy of programs and to ascertain, among other things, that sums appropriated have been or are being expended for the purposes for which the appropriation was made and prepare a report for each performance review detailing any <span class=\"dictionary\">findings<\/span> or recommendations for improving the efficiency, effectiveness, or economy of state agencies, including recommending changes in the <span class=\"dictionary\">law<\/span> to the Governor and the General Assembly that are necessary to address such <span class=\"dictionary\">findings<\/span>; <a id=\"paragraph-254771\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-309\/#A13\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A14\" class=\"indent-1\"><p><span class=\"prefix-number\">14.<\/span> Assist citizens in understanding their rights and the processes available to them to express concerns regarding the activities of a <span class=\"dictionary\">state agency<\/span> or <span class=\"dictionary\">nonstate agency<\/span> or any <span class=\"dictionary\">officer<\/span> or <span class=\"dictionary\">employee<\/span> of the foregoing; <a id=\"paragraph-254772\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-309\/#A14\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A15\" class=\"indent-1\"><p><span class=\"prefix-number\">15.<\/span> Maintain data on inquiries received, the types of assistance requested, any actions taken, and the <span class=\"dictionary\">disposition<\/span> of each such matter; <a id=\"paragraph-254773\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-309\/#A15\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A16\" class=\"indent-1\"><p><span class=\"prefix-number\">16.<\/span> Upon request, assist citizens in using the procedures and processes available to express concerns regarding the activities of a state or <span class=\"dictionary\">nonstate agency<\/span> or any <span class=\"dictionary\">officer<\/span> or <span class=\"dictionary\">employee<\/span> of the foregoing; <a id=\"paragraph-254774\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-309\/#A16\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A17\" class=\"indent-1\"><p><span class=\"prefix-number\">17.<\/span> Ensure that citizens have access to the services provided by the State Inspector General and that citizens receive timely responses to their inquiries from the State Inspector General or his representatives; and <a id=\"paragraph-254775\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-309\/#A17\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A18\" class=\"indent-1\"><p><span class=\"prefix-number\">18.<\/span> Do all acts necessary or convenient to carry out the purposes of this chapter. <a id=\"paragraph-254776\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-309\/#A18\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> If the State Inspector General receives a complaint from whatever source that alleges <span class=\"dictionary\">fraud<\/span>, waste, abuse, or corruption by a public institution of higher education that is (i) a covered institution as defined by the Restructured Higher Education Financial and Administrative Operations Act (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/23.1-1000\/\">23.1-1000<\/a> et seq.) and (ii) classified as a Level 3 institution by the State Council of Higher Education for Virginia, or any of its <span class=\"dictionary\">officers<\/span> or <span class=\"dictionary\">employees<\/span>, the State Inspector General shall, but for reasonable and articulable causes, refer the complaint to the internal audit department of the public institution of higher education for investigation. However, if the complaint concerns the president of the institution or its internal audit department, or if the State Inspector General otherwise concludes that his <span class=\"dictionary\">office<\/span> should investigate the complaint to ensure a comprehensive and fully independent investigation, the investigation shall be conducted by the State Inspector General. The State Inspector General may provide assistance for investigations as may be requested by the public institution of higher education.\n\t\t\tThe public institution of higher education shall provide periodic updates on the status of investigations, whether they originated internally or were referred by the State Inspector General, and report annually to the State Inspector General on the results of all such investigations. <a id=\"paragraph-254777\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-309\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> The State Inspector General shall establish procedures governing the intake and investigation of complaints alleging <span class=\"dictionary\">allegations<\/span> of <span class=\"dictionary\">fraud<\/span>, waste, abuse, or corruption by a <span class=\"dictionary\">state agency<\/span> or <span class=\"dictionary\">nonstate agency<\/span> or by any <span class=\"dictionary\">officer<\/span> or <span class=\"dictionary\">employee<\/span> of a <span class=\"dictionary\">state agency<\/span> or <span class=\"dictionary\">nonstate agency<\/span>. Such procedures shall: <a id=\"paragraph-254778\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-309\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Provide that the State Inspector General, or his designee, shall review each decision to dismiss an <span class=\"dictionary\">allegation<\/span> reported to the State <span class=\"dictionary\">Fraud<\/span>, Waste, and Abuse Hotline at the initial intake stage without further investigation. <a id=\"paragraph-254779\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-309\/#C1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Require that (i) investigators of the <span class=\"dictionary\">Office<\/span> of the State Inspector General directly investigate <span class=\"dictionary\">allegations<\/span> of serious administrative violations and (ii) other agency internal audit divisions may investigate <span class=\"dictionary\">allegations<\/span> meeting certain criteria specified by the State Inspector General, only if the internal audit division has demonstrated the ability to conduct investigations in an independent, effective, and timely manner. Criteria may include <span class=\"dictionary\">allegations<\/span> below a specified dollar threshold. <a id=\"paragraph-254780\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-309\/#C2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Require oversight by the <span class=\"dictionary\">Office<\/span> of the State Inspector General of all investigations referred to other agencies to ensure quality, timeliness, and independence. <a id=\"paragraph-254781\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-309\/#C3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Develop a process for the regular review of the status of recommendations made by the <span class=\"dictionary\">Office<\/span> of the State Inspector General as a result of an investigation conducted pursuant to this chapter. <a id=\"paragraph-254782\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-309\/#C4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> The State Inspector General shall submit an annual report to the General Assembly on or before December 1 of each year that states the number of complaints received by the <span class=\"dictionary\">Office<\/span> alleging abuse, neglect, or inadequate care at a state psychiatric hospital during the prior fiscal year and the number of such complaints that were fully investigated by the <span class=\"dictionary\">Office<\/span>. <a id=\"paragraph-254783\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-309\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nPOWERS AND DUTIES OF STATE INSPECTOR GENERAL (\u00a7 2.2-309)\n\nA. However, if the complaint concerns the president of\nthe institution or its internal audit department, or if the State Inspector\nGeneral otherwise concludes that his office should investigate the complaint to\nensure a comprehensive and fully independent investigation, the investigation\nshall be conducted by the State Inspector General. The State Inspector General\nmay provide assistance for investigations as may be requested by the public\ninstitution of higher education.\n\t\t\tThe public institution of higher education shall provide periodic updates on\nthe status of investigations, whether they originated internally or were\nreferred by the State Inspector General, and report annually to the State\nInspector General on the results of all such investigations.\n\nC. The State Inspector General shall establish procedures governing the intake\nand investigation of complaints alleging allegations of fraud, waste, abuse, or\ncorruption by a state agency or nonstate agency or by any officer or employee of\na state agency or nonstate agency. Such procedures shall:\n\n   1. Provide that the State Inspector General, or his designee, shall review\n   each decision to dismiss an allegation reported to the State Fraud, Waste, and\n   Abuse Hotline at the initial intake stage without further investigation.\n\n   2. Require that (i) investigators of the Office of the State Inspector General\n   directly investigate allegations of serious administrative violations and (ii)\n   other agency internal audit divisions may investigate allegations meeting\n   certain criteria specified by the State Inspector General, only if the\n   internal audit division has demonstrated the ability to conduct investigations\n   in an independent, effective, and timely manner. Criteria may include\n   allegations below a specified dollar threshold.\n\n   3. Require oversight by the Office of the State Inspector General of all\n   investigations referred to other agencies to ensure quality, timeliness, and\n   independence.\n\n   4. Develop a process for the regular review of the status of recommendations\n   made by the Office of the State Inspector General as a result of an\n   investigation conducted pursuant to this chapter.\n\nD.
