Gifts with a value of less than $20 are not subject to aggregation for purposes of this prohibition.C\n\nNo officer or employee of a state governmental or advisory agency or candidate required to file the disclosure form prescribed in &#xA7; 2.2-3117 or a member of his immediate family shall solicit, accept, or receive any single gift with a value in excess of $100 or any combination of gifts with an aggregate value in excess of $100 within any calendar year for himself or a member of his immediate family from any person that he or a member of his immediate family knows or has reason to know is (i) a lobbyist registered pursuant to Article 3 (&#xA7; 2.2-418 et seq.) of Chapter 4; (ii) a lobbyist&#8217;s principal as defined in &#xA7; 2.2-419; or (iii) a person, organization, or business who is or is seeking to become a party to a contract with the state governmental or advisory agency of which he is an officer or an employee or over which he has the authority to direct such agency&#8217;s activities. Gifts with a value of less than $20 are not subject to aggregation for purposes of this prohibition.D\n\nNotwithstanding the provisions of subsections B and C, such officer, employee, or candidate or a member of his immediate family may accept or receive a gift of food and beverages, entertainment, or the cost of admission with a value in excess of $100 when such gift is accepted or received while in attendance at a widely attended event and is associated with the event. Such gifts shall be reported on the disclosure form prescribed in &#xA7; 2.2-3117.E\n\nNotwithstanding the provisions of subsections B and C, such officer or employee or a member of his immediate family may accept or receive a gift from a foreign dignitary with a value exceeding $100 for which the fair market value or a gift of greater or equal value has not been provided or exchanged so long as such foreign dignitary is not a representative of a foreign country of concern. Such gift shall be accepted on behalf of the Commonwealth or a locality and archived in accordance with guidelines established by the Library of Virginia. Such gift shall be disclosed as having been accepted on behalf of the Commonwealth or a locality, but the value of such gift shall not be required to be disclosed.F\n\nNotwithstanding the provisions of subsections B and C, such officer, employee, or candidate or a member of his immediate family may accept or receive certain gifts with a value in excess of $100 from a person listed in subsection B or C if such gift was provided to such officer, employee, or candidate or a member of his immediate family on the basis of a personal friendship. Notwithstanding any other provision of law, a person listed in subsection B or C may be a personal friend of such officer, employee, or candidate or his immediate family for purposes of this subsection. In determining whether a person listed in subsection B or C is a personal friend, the following factors shall be considered: (i) the circumstances under which the gift was offered; (ii) the history of the relationship between the person and the donor, including the nature and length of the friendship and any previous exchange of gifts between them; (iii) to the extent known to the person, whether the donor personally paid for the gift or sought a tax deduction or business reimbursement for the gift; and (iv) whether the donor has given the same or similar gifts to other persons required to file the disclosure form prescribed in &#xA7; 2.2-3117 or 30-111.G\n\nNotwithstanding the provisions of subsections B and C, such officer, employee, or candidate or a member of his immediate family may accept or receive gifts of travel, including travel-related transportation, lodging, hospitality, food or beverages, or other thing of value, with a value in excess of $100 that is paid for or provided by a person listed in subsection B or C when the officer, employee, or candidate has submitted a request for approval of such travel to the Council and has received the approval of the Council pursuant to &#xA7; 30-356.1. Such gifts shall be reported on the disclosure form prescribed in &#xA7; 2.2-3117.H\n\nDuring the pendency of a civil action in any state or federal court to which the Commonwealth is a party, the Governor or the Attorney General or any employee of the Governor or the Attorney General who is subject to the provisions of this chapter shall not solicit, accept, or receive any gift from any person that he knows or has reason to know is a person, organization, or business that is a party to such civil action. A person, organization, or business that is a party to such civil action shall not knowingly give any gift to the Governor or the Attorney General or any of their employees who are subject to the provisions of this chapter.I\n\nThe $100 limitation imposed in accordance with this section shall be adjusted by the Council every five years, as of January 1 of that year, in an amount equal to the annual increases for that five-year period in the United States Average Consumer Price Index for all items, all urban consumers (CPI-U), as published by the Bureau of Labor Statistics of the U.S. Department of Labor, rounded to the nearest whole dollar.J\n\nThe provisions of this section shall not apply to any justice of the Supreme Court of Virginia, judge of the Court of Appeals of Virginia, judge of any circuit court, or judge or substitute judge of any district court. means an event at which at least 25 persons have been invited to attend or there is a reasonable expectation that at least 25 persons will attend the event and the event is open to individuals (i) who are members of a public, civic, charitable, or professional organization, (ii) who are from a particular industry or profession, or (iii) who represent persons interested in a particular <span class=\"dictionary\">issue<\/span>. <a id=\"paragraph-261280\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-3103.1\/#A\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> No <span class=\"dictionary\">officer<\/span> or <span class=\"dictionary\">employee<\/span> of a local governmental or <span class=\"dictionary\">advisory agency<\/span> or <span class=\"dictionary\">candidate<\/span> required to file the disclosure form prescribed in &#xA7; <a class=\"law\" title=\"Disclosure form\" href=\"\/2.2-3117\/\">2.2-3117<\/a> or a member of his <span class=\"dictionary\">immediate family<\/span> shall solicit, accept, or receive any single <span class=\"dictionary\">gift<\/span> with a value in excess of $100 or any combination of <span class=\"dictionary\">gifts<\/span> with an aggregate value in excess of $100 within any calendar year for himself or a member of his <span class=\"dictionary\">immediate family<\/span> from any person that he or a member of his <span class=\"dictionary\">immediate family<\/span> knows or has reason to know is (i) a lobbyist registered pursuant to Article 3 (&#xA7; <a class=\"law\" title=\"Statement of intent and purposes\" href=\"\/2.2-418\/\">2.2-418<\/a> et seq.) of Chapter 4; (ii) a lobbyist&#8217;s principal as defined in &#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/2.2-419\/\">2.2-419<\/a>; or (iii) a <span class=\"dictionary\">person, organization, or business<\/span> who is or is seeking to become a <span class=\"dictionary\">party<\/span> to a <span class=\"dictionary\">contract<\/span> with the local agency of which he is an <span class=\"dictionary\">officer<\/span> or an <span class=\"dictionary\">employee<\/span>. <span class=\"dictionary\">Gifts<\/span> with a value of less than $20 are not subject to aggregation for purposes of this prohibition. <a id=\"paragraph-261281\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-3103.1\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> No <span class=\"dictionary\">officer<\/span> or <span class=\"dictionary\">employee<\/span> of a state governmental or <span class=\"dictionary\">advisory agency<\/span> or <span class=\"dictionary\">candidate<\/span> required to file the disclosure form prescribed in &#xA7; <a class=\"law\" title=\"Disclosure form\" href=\"\/2.2-3117\/\">2.2-3117<\/a> or a member of his <span class=\"dictionary\">immediate family<\/span> shall solicit, accept, or receive any single <span class=\"dictionary\">gift<\/span> with a value in excess of $100 or any combination of <span class=\"dictionary\">gifts<\/span> with an aggregate value in excess of $100 within any calendar year for himself or a member of his <span class=\"dictionary\">immediate family<\/span> from any person that he or a member of his <span class=\"dictionary\">immediate family<\/span> knows or has reason to know is (i) a lobbyist registered pursuant to Article 3 (&#xA7; <a class=\"law\" title=\"Statement of intent and purposes\" href=\"\/2.2-418\/\">2.2-418<\/a> et seq.) of Chapter 4; (ii) a lobbyist&#8217;s principal as defined in &#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/2.2-419\/\">2.2-419<\/a>; or (iii) a <span class=\"dictionary\">person, organization, or business<\/span> who is or is seeking to become a <span class=\"dictionary\">party<\/span> to a <span class=\"dictionary\">contract<\/span> with the state governmental or <span class=\"dictionary\">advisory agency<\/span> of which he is an <span class=\"dictionary\">officer<\/span> or an <span class=\"dictionary\">employee<\/span> or over which he has the authority to direct such agency&#8217;s activities. <span class=\"dictionary\">Gifts<\/span> with a value of less than $20 are not subject to aggregation for purposes of this prohibition. <a id=\"paragraph-261282\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-3103.1\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Notwithstanding the provisions of subsections B and C, such <span class=\"dictionary\">officer<\/span>, <span class=\"dictionary\">employee<\/span>, or <span class=\"dictionary\">candidate<\/span> or a member of his <span class=\"dictionary\">immediate family<\/span> may accept or receive a <span class=\"dictionary\">gift<\/span> of food and beverages, entertainment, or the cost of admission with a value in excess of $100 when such <span class=\"dictionary\">gift<\/span> is accepted or received while in attendance at a <span class=\"dictionary\">widely attended event<\/span> and is associated with the event. Such <span class=\"dictionary\">gifts<\/span> shall be reported on the disclosure form prescribed in &#xA7; <a class=\"law\" title=\"Disclosure form\" href=\"\/2.2-3117\/\">2.2-3117<\/a>. <a id=\"paragraph-261283\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-3103.1\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> Notwithstanding the provisions of subsections B and C, such <span class=\"dictionary\">officer<\/span> or <span class=\"dictionary\">employee<\/span> or a member of his <span class=\"dictionary\">immediate family<\/span> may accept or receive a <span class=\"dictionary\">gift<\/span> from a foreign dignitary with a value exceeding $100 for which the fair market value or a <span class=\"dictionary\">gift<\/span> of greater or equal value has not been provided or exchanged so long as such foreign dignitary is not a representative of a <span class=\"dictionary\">foreign country of concern<\/span>. Such <span class=\"dictionary\">gift<\/span> shall be accepted on behalf of the Commonwealth or a locality and archived in accordance with guidelines established by the Library of Virginia. Such <span class=\"dictionary\">gift<\/span> shall be disclosed as having been accepted on behalf of the Commonwealth or a locality, but the value of such <span class=\"dictionary\">gift<\/span> shall not be required to be disclosed. <a id=\"paragraph-261284\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-3103.1\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> Notwithstanding the provisions of subsections B and C, such <span class=\"dictionary\">officer<\/span>, <span class=\"dictionary\">employee<\/span>, or <span class=\"dictionary\">candidate<\/span> or a member of his <span class=\"dictionary\">immediate family<\/span> may accept or receive certain <span class=\"dictionary\">gifts<\/span> with a value in excess of $100 from a person listed in subsection B or C if such <span class=\"dictionary\">gift<\/span> was provided to such <span class=\"dictionary\">officer<\/span>, <span class=\"dictionary\">employee<\/span>, or <span class=\"dictionary\">candidate<\/span> or a member of his <span class=\"dictionary\">immediate family<\/span> on the basis of a personal friendship. Notwithstanding any other provision of <span class=\"dictionary\">law<\/span>, a person listed in subsection B or C may be a personal friend of such <span class=\"dictionary\">officer<\/span>, <span class=\"dictionary\">employee<\/span>, or <span class=\"dictionary\">candidate<\/span> or his <span class=\"dictionary\">immediate family<\/span> for purposes of this subsection. In determining whether a person listed in subsection B or C is a personal friend, the following factors shall be considered: (i) the circumstances under which the <span class=\"dictionary\">gift<\/span> was offered; (ii) the history of the relationship between the person and the donor, including the nature and length of the friendship and any previous exchange of <span class=\"dictionary\">gifts<\/span> between them; (iii) to the extent known to the person, whether the donor personally paid for the <span class=\"dictionary\">gift<\/span> or sought a tax deduction or business reimbursement for the <span class=\"dictionary\">gift<\/span>; and (iv) whether the donor has given the same or similar <span class=\"dictionary\">gifts<\/span> to other persons required to file the disclosure form prescribed in &#xA7; <a class=\"law\" title=\"Disclosure form\" href=\"\/2.2-3117\/\">2.2-3117<\/a> or <a class=\"law\" title=\"Disclosure form\" href=\"\/30-111\/\">30-111<\/a>. <a id=\"paragraph-261285\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-3103.1\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> Notwithstanding the provisions of subsections B and C, such <span class=\"dictionary\">officer<\/span>, <span class=\"dictionary\">employee<\/span>, or <span class=\"dictionary\">candidate<\/span> or a member of his <span class=\"dictionary\">immediate family<\/span> may accept or receive <span class=\"dictionary\">gifts<\/span> of travel, including travel-related transportation, lodging, hospitality, food or beverages, or other thing of value, with a value in excess of $100 that is paid for or provided by a person listed in subsection B or C when the <span class=\"dictionary\">officer<\/span>, <span class=\"dictionary\">employee<\/span>, or <span class=\"dictionary\">candidate<\/span> has submitted a request for approval of such travel to the <span class=\"dictionary\">Council<\/span> and has received the approval of the <span class=\"dictionary\">Council<\/span> pursuant to &#xA7; <a class=\"law\" title=\"Request for approval for certain travel\" href=\"\/30-356.1\/\">30-356.1<\/a>. Such <span class=\"dictionary\">gifts<\/span> shall be reported on the disclosure form prescribed in &#xA7; <a class=\"law\" title=\"Disclosure form\" href=\"\/2.2-3117\/\">2.2-3117<\/a>. <a id=\"paragraph-261286\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-3103.1\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"H\"><p><span class=\"prefix-number\">H.<\/span> During the pendency of a <span class=\"dictionary\">civil action<\/span> in any state or federal <span class=\"dictionary\">court<\/span> to which the Commonwealth is a <span class=\"dictionary\">party<\/span>, the Governor or the <span class=\"dictionary\">Attorney General<\/span> or any <span class=\"dictionary\">employee<\/span> of the Governor or the <span class=\"dictionary\">Attorney General<\/span> who is subject to the provisions of this chapter shall not solicit, accept, or receive any <span class=\"dictionary\">gift<\/span> from any person that he knows or has reason to know is a <span class=\"dictionary\">person, organization, or business<\/span> that is a <span class=\"dictionary\">party<\/span> to such <span class=\"dictionary\">civil action<\/span>. A <span class=\"dictionary\">person, organization, or business<\/span> that is a <span class=\"dictionary\">party<\/span> to such <span class=\"dictionary\">civil action<\/span> shall not knowingly give any <span class=\"dictionary\">gift<\/span> to the Governor or the <span class=\"dictionary\">Attorney General<\/span> or any of their <span class=\"dictionary\">employees<\/span> who are subject to the provisions of this chapter. <a id=\"paragraph-261287\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-3103.1\/#H\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I\"><p><span class=\"prefix-number\">I.<\/span> The $100 limitation imposed in accordance with this section shall be adjusted by the <span class=\"dictionary\">Council<\/span> every five years, as of January 1 of that year, in an amount equal to the annual increases for that five-year period in the United States Average Consumer Price Index for all items, all urban consumers (CPI-U), as published by the Bureau of Labor Statistics of the U.S. Department of Labor, rounded to the nearest whole dollar. <a id=\"paragraph-261288\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-3103.1\/#I\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"J\"><p><span class=\"prefix-number\">J.<\/span> The provisions of this section shall not apply to any justice of the Supreme <span class=\"dictionary\">Court<\/span> of Virginia, <span class=\"dictionary\">judge<\/span> of the <span class=\"dictionary\">Court<\/span> of <span class=\"dictionary\">Appeals<\/span> of Virginia, <span class=\"dictionary\">judge<\/span> of any <span class=\"dictionary\">circuit<\/span> <span class=\"dictionary\">court<\/span>, or <span class=\"dictionary\">judge<\/span> or substitute <span class=\"dictionary\">judge<\/span> of any district <span class=\"dictionary\">court<\/span>. However, nothing in this subsection shall be construed to authorize the acceptance of any <span class=\"dictionary\">gift<\/span> if such acceptance would constitute a violation of the Canons of Judicial Conduct for the State of Virginia. <a id=\"paragraph-261289\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-3103.1\/#J\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nCERTAIN GIFTS PROHIBITED (\u00a7 2.2-3103.1)\n\nA. For purposes of this section:\n\t\t\t&#8220;Foreign country of concern&#8221; means any country designated by the\nSecretary of State to have repeatedly provided support for acts of international\nterrorism pursuant to the National Defense Authorization Act for Fiscal Year\n2019, P.L. 115-232 &#xA7; 1754(c), Aug. 13, 2018; the Arms Export Control Act\n&#xA7; 40, 22 U.S.C. &#xA7; 2780; or the Foreign Assistance Act of 1961 &#xA7;\n620A, 22 U.S.C. &#xA7; 2370.\n\t\t\t&#8220;Person, organization, or business&#8221; includes individuals who are\nofficers, directors, or owners of or who have a controlling ownership interest\nin such organization or business.\n\t\t\t&#8220;Widely attended event&#8221; means an event at which at least 25\npersons have been invited to attend or there is a reasonable expectation that at\nleast 25 persons will attend the event and the event is open to individuals (i)\nwho are members of a public, civic, charitable, or professional organization,\n(ii) who are from a particular industry or profession, or (iii) who represent\npersons interested in a particular issue.\n\nB. No officer or employee of a local governmental or advisory agency or\ncandidate required to file the disclosure form prescribed in &#xA7; 2.2-3117 or\na member of his immediate family shall solicit, accept, or receive any single\ngift with a value in excess of $100 or any combination of gifts with an\naggregate value in excess of $100 within any calendar year for himself or a\nmember of his immediate family from any person that he or a member of his\nimmediate family knows or has reason to know is (i) a lobbyist registered\npursuant to Article 3 (&#xA7; 2.2-418 et seq.) of Chapter 4; (ii) a\nlobbyist&#8217;s principal as defined in &#xA7; 2.2-419; or (iii) a person,\norganization, or business who is or is seeking to become a party to a contract\nwith the local agency of which he is an officer or an employee. Gifts with a\nvalue of less than $20 are not subject to aggregation for purposes of this\nprohibition.\n\nC. No officer or employee of a state governmental or advisory agency or\ncandidate required to file the disclosure form prescribed in &#xA7; 2.2-3117 or\na member of his immediate family shall solicit, accept, or receive any single\ngift with a value in excess of $100 or any combination of gifts with an\naggregate value in excess of $100 within any calendar year for himself or a\nmember of his immediate family from any person that he or a member of his\nimmediate family knows or has reason to know is (i) a lobbyist registered\npursuant to Article 3 (&#xA7; 2.2-418 et seq.) of Chapter 4; (ii) a\nlobbyist&#8217;s principal as defined in &#xA7; 2.2-419; or (iii) a person,\norganization, or business who is or is seeking to become a party to a contract\nwith the state governmental or advisory agency of which he is an officer or an\nemployee or over which he has the authority to direct such agency&#8217;s\nactivities. Gifts with a value of less than $20 are not subject to aggregation\nfor purposes of this prohibition.\n\nD. Notwithstanding the provisions of subsections B and C, such officer,\nemployee, or candidate or a member of his immediate family may accept or receive\na gift of food and beverages, entertainment, or the cost of admission with a\nvalue in excess of $100 when such gift is accepted or received while in\nattendance at a widely attended event and is associated with the event. Such\ngifts shall be reported on the disclosure form prescribed in &#xA7; 2.2-3117.\n\nE. Notwithstanding the provisions of subsections B and C, such officer or\nemployee or a member of his immediate family may accept or receive a gift from a\nforeign dignitary with a value exceeding $100 for which the fair market value or\na gift of greater or equal value has not been provided or exchanged so long as\nsuch foreign dignitary is not a representative of a foreign country of concern.\nSuch gift shall be accepted on behalf of the Commonwealth or a locality and\narchived in accordance with guidelines established by the Library of Virginia.\nSuch gift shall be disclosed as having been accepted on behalf of the\nCommonwealth or a locality, but the value of such gift shall not be required to\nbe disclosed.\n\nF. Notwithstanding the provisions of subsections B and C, such officer,\nemployee, or candidate or a member of his immediate family may accept or receive\ncertain gifts with a value in excess of $100 from a person listed in subsection\nB or C if such gift was provided to such officer, employee, or candidate or a\nmember of his immediate family on the basis of a personal friendship.\nNotwithstanding any other provision of law, a person listed in subsection B or C\nmay be a personal friend of such officer, employee, or candidate or his\nimmediate family for purposes of this subsection. Notwithstanding the provisions of subsections B and C, such officer,\nemployee, or candidate or a member of his immediate family may accept or receive\ngifts of travel, including travel-related transportation, lodging, hospitality,\nfood or beverages, or other thing of value, with a value in excess of $100 that\nis paid for or provided by a person listed in subsection B or C when the\nofficer, employee, or candidate has submitted a request for approval of such\ntravel to the Council and has received the approval of the Council pursuant to\n&#xA7; 30-356.1. Such gifts shall be reported on the disclosure form prescribed\nin &#xA7; 2.2-3117.\n\nH. During the pendency of a civil action in any state or federal court to which\nthe Commonwealth is a party, the Governor or the Attorney General or any\nemployee of the Governor or the Attorney General who is subject to the\nprovisions of this chapter shall not solicit, accept, or receive any gift from\nany person that he knows or has reason to know is a person, organization, or\nbusiness that is a party to such civil action. A person, organization, or\nbusiness that is a party to such civil action shall not knowingly give any gift\nto the Governor or the Attorney General or any of their employees who are\nsubject to the provisions of this chapter.\n\nI.
