2022, cc. 554, 609.","full_text":"A\n\nAlthough required to comply with \u00a7 2.2-4103 of the Virginia Register Act (\u00a7 2.2-4100 et seq.), the following agencies shall be exempted from the provisions of this chapter, except to the extent that they are specifically made subject to \u00a7\u00a7 2.2-4024, 2.2-4030, and 2.2-4031:1\n\nThe General Assembly.2\n\nCourts, any agency of the Supreme Court, and any agency that by the Constitution is expressly granted any of the powers of a court of record.3\n\nThe Department of Wildlife Resources in promulgating regulations regarding the management of wildlife and for all case decisions rendered pursuant to any provisions of Chapters 2 (&#xA7; 29.1-200 et seq.), 3 (&#xA7; 29.1-300 et seq.), 4 (&#xA7; 29.1-400 et seq.), 5 (&#xA7; 29.1-500 et seq.), and 7 (&#xA7; 29.1-700 et seq.) of Title 29.1.4\n\nThe Virginia Housing Development Authority.5\n\nMunicipal corporations, counties, and all local, regional, or multijurisdictional authorities created under this Code, including those with federal authorities.6\n\nEducational institutions operated by the Commonwealth, provided that, with respect to &#xA7; 2.2-4031, such educational institutions shall be exempt from the publication requirements only with respect to regulations that pertain to (i) their academic affairs, (ii) the selection, tenure, promotion, and disciplining of faculty and employees, (iii) the selection of students, and (iv) rules of conduct and disciplining of students.7\n\nThe Milk Commission in promulgating regulations regarding (i) producers&#8217; licenses and bases, (ii) classification and allocation of milk, computation of sales, and shrinkage, and (iii) class prices for producers&#8217; milk, time and method of payment, butterfat testing, and differential.8\n\nThe Virginia Resources Authority.9\n\nAgencies expressly exempted by any other provision of this Code.10\n\nThe Department of General Services in promulgating standards for the inspection of buildings for asbestos pursuant to &#xA7; 2.2-1164.11\n\nThe State Council of Higher Education for Virginia, in developing, issuing, and revising guidelines pursuant to &#xA7; 23.1-207.12\n\nThe Commissioner of Agriculture and Consumer Services in adopting regulations pursuant to subsection B of &#xA7; 3.2-6002 and in adopting regulations pursuant to &#xA7; 3.2-6023.13\n\nThe Commissioner of Agriculture and Consumer Services and the Board of Agriculture and Consumer Services in promulgating regulations pursuant to subsections B and D of &#xA7; 3.2-3601, subsection B of &#xA7; 3.2-3701, &#xA7; 3.2-4002, subsections B and D of &#xA7; 3.2-4801, &#xA7;&#xA7; 3.2-5121 and 3.2-5206, and subsection A of &#xA7; 3.2-5406.14\n\nThe Board of Optometry when specifying therapeutic pharmaceutical agents, treatment guidelines, and diseases and abnormal conditions of the human eye and its adnexa for TPA-certification of optometrists pursuant to Article 5 (&#xA7; 54.1-3222 et seq.) of Chapter 32 of Title 54.1.15\n\nThe Commissioner of the Department of Veterans Services in adopting regulations pursuant to &#xA7; 2.2-2001.3.16\n\nThe State Board of Education, in developing, issuing, and revising guidelines pursuant to &#xA7; 22.1-203.2.17\n\nThe Virginia Racing Commission, (i) when acting by and through its duly appointed stewards or in matters related to any specific race meeting or (ii) in promulgating technical rules regulating actual live horse racing at race meetings licensed by the Commission.18\n\nThe Virginia Small Business Financing Authority.19\n\nThe Virginia Economic Development Partnership Authority.20\n\nThe Board of Agriculture and Consumer Services in adopting, amending, or repealing regulations pursuant to subsection A (ii) of &#xA7; 9.1-102, provided such actions are authorized by the Governor in the interest of public safety.B\n\nAgency action relating to the following subjects shall be exempted from the provisions of this chapter:1\n\nMoney or damage claims against the Commonwealth or agencies thereof.2\n\nThe award or denial of state contracts, as well as decisions regarding compliance therewith.3\n\nThe location, design, specifications, or construction of public buildings or other facilities.4\n\nGrants of state or federal funds or property.5\n\nThe chartering of corporations.6\n\nCustomary military, militia, naval, or police functions.7\n\nThe selection, tenure, dismissal, direction, or control of any officer or employee of an agency of the Commonwealth.8\n\nThe conduct of elections or eligibility to vote.9\n\nInmates of prisons or other such facilities or parolees therefrom.10\n\nThe custody of persons in, or sought to be placed in, mental health facilities or penal or other state institutions as well as the treatment, supervision, or discharge of such persons.11\n\nTraffic signs, markers, or control devices.12\n\nInstructions for application or renewal of a license, certificate, or registration required by law.13\n\nContent of, or rules for the conduct of, any examination required by law.14\n\nThe administration of pools authorized by Chapter 47 (&#xA7; 2.2-4700 et seq.).15\n\nAny rules for the conduct of specific lottery games, so long as such rules are not inconsistent with duly adopted regulations of the Virginia Lottery Board, and provided that such regulations are published and posted.16\n\nOrders condemning or closing any shellfish, finfish, or crustacea growing area and the shellfish, finfish, or crustacea located thereon pursuant to Article 2 (&#xA7; 28.2-803 et seq.) of Chapter 8 of Title 28.2.17\n\nAny operating procedures for review of child deaths developed by the State Child Fatality Review Team pursuant to &#xA7; 32.1-283.1, any operating procedures for review of adult deaths developed by the Adult Fatality Review Team pursuant to &#xA7; 32.1-283.5, any operating procedures for review of adult deaths developed by the Maternal Mortality Review Team pursuant to &#xA7; 32.1-283.8, and any operating procedures for review of the deaths of persons with a developmental disability developed by the Developmental Disabilities Mortality Review Committee pursuant to &#xA7; 37.2-314.1.18\n\nThe regulations for the implementation of the Health Practitioners&#8217; Monitoring Program and the activities of the Health Practitioners&#8217; Monitoring Program Committee pursuant to Chapter 25.1 (&#xA7; class=\"dictionary\">Court<\/span>, and any <span class=\"dictionary\">agency<\/span> that by the Constitution is expressly granted any of the powers of a <span class=\"dictionary\">court<\/span> of class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> The Department of Wildlife Resources in promulgating <span class=\"dictionary\">regulations<\/span> regarding the management of wildlife and for all <span class=\"dictionary\">case decisions<\/span> rendered pursuant to any provisions of Chapters 2 (&#xA7; <a class=\"law\" title=\"Appointment of conservation police officers\" href=\"\/29.1-200\/\">29.1-200<\/a> et seq.), 3 (&#xA7; <a class=\"law\" title=\"Unlawful to hunt, trap or fish without license\" href=\"\/29.1-300\/\">29.1-300<\/a> et seq.), 4 (&#xA7; <a class=\"law\" title=\"Unlawful to deal in furs without a permit\" href=\"\/29.1-400\/\">29.1-400<\/a> et seq.), 5 (&#xA7; <a class=\"law\" title=\"Reserved\" href=\"\/29.1-500\/\">29.1-500<\/a> et seq.), and 7 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/29.1-700\/\">29.1-700<\/a> et seq.) of Title 29.1. <a id=\"paragraph-251704\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#A3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> The Virginia Housing Development Authority. <a id=\"paragraph-251705\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#A4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Municipal corporations, counties, and all local, regional, or multijurisdictional authorities created under this Code, including those with federal authorities. <a id=\"paragraph-251706\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#A5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Educational institutions operated by the Commonwealth, provided that, with respect to &#xA7; <a class=\"law\" title=\"Publication of Virginia Register of Regulations; exceptions; notice of public hearings of proposed regulations\" href=\"\/2.2-4031\/\">2.2-4031<\/a>, such educational institutions shall be exempt from the publication requirements only with respect to <span class=\"dictionary\">regulations<\/span> that pertain to (i) their academic affairs, (ii) the selection, tenure, promotion, and disciplining of faculty and employees, (iii) the selection of students, and (iv) <span class=\"dictionary\">rules<\/span> of conduct and disciplining of students. <a id=\"paragraph-251707\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#A6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> The Milk Commission in promulgating <span class=\"dictionary\">regulations<\/span> regarding (i) producers&#8217; licenses and bases, (ii) classification and allocation of milk, computation of sales, and shrinkage, and (iii) class prices for producers&#8217; milk, time and method of payment, butterfat testing, and differential. <a id=\"paragraph-251708\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#A7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> The Virginia Resources Authority. <a id=\"paragraph-251709\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#A8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> Agencies expressly exempted by any other provision of this Code. <a id=\"paragraph-251710\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#A9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> The Department of General Services in promulgating standards for the inspection of buildings for asbestos pursuant to &#xA7; <a class=\"law\" title=\"Standards for inspection of buildings for asbestos\" href=\"\/2.2-1164\/\">2.2-1164<\/a>. <a id=\"paragraph-251711\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#A10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A11\" class=\"indent-1\"><p><span class=\"prefix-number\">11.<\/span> The State Council of Higher Education for Virginia, in developing, issuing, and revising guidelines pursuant to &#xA7; <a class=\"law\" title=\"Tuition relief and refunds and reinstatement for certain students in the Armed Forces\" href=\"\/23.1-207\/\">23.1-207<\/a>. <a id=\"paragraph-251712\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#A11\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A12\" class=\"indent-1\"><p><span class=\"prefix-number\">12.<\/span> The Commissioner of Agriculture and Consumer Services in adopting <span class=\"dictionary\">regulations<\/span> pursuant to subsection B of &#xA7; <a class=\"law\" title=\"Contagious and infectious diseases; prevention and eradication; presence of biological residues\" href=\"\/3.2-6002\/\">3.2-6002<\/a> and in adopting <span class=\"dictionary\">regulations<\/span> pursuant to &#xA7; <a class=\"law\" title=\"Prevention and control measures; penalty\" href=\"\/3.2-6023\/\">3.2-6023<\/a>. <a id=\"paragraph-251713\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#A12\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A13\" class=\"indent-1\"><p><span class=\"prefix-number\">13.<\/span> The Commissioner of Agriculture and Consumer Services and the Board of Agriculture and Consumer Services in promulgating <span class=\"dictionary\">regulations<\/span> pursuant to subsections B and D of &#xA7; <a class=\"law\" title=\"Authority of the Board and the Commissioner to adopt regulations\" href=\"\/3.2-3601\/\">3.2-3601<\/a>, subsection B of &#xA7; <a class=\"law\" title=\"Authority of Board and Commissioner to adopt regulations\" href=\"\/3.2-3701\/\">3.2-3701<\/a>, &#xA7; <a class=\"law\" title=\"Authority of Commissioner to adopt regulations\" href=\"\/3.2-4002\/\">3.2-4002<\/a>, subsections B and D of &#xA7; <a class=\"law\" title=\"Authority of the Board and the Commissioner to adopt regulations\" href=\"\/3.2-4801\/\">3.2-4801<\/a>, &#xA7;&#xA7; <a class=\"law\" title=\"Authority to adopt regulations; conformity with federal regulations; hearings; enforcement of article; review of regulations\" href=\"\/3.2-5121\/\">3.2-5121<\/a> and <a class=\"law\" title=\"Board authorized to establish standards and adopt regulations; guidance of State Health Commissioner\" href=\"\/3.2-5206\/\">3.2-5206<\/a>, and subsection A of &#xA7; <a class=\"law\" title=\"Meat inspection regulations\" href=\"\/3.2-5406\/\">3.2-5406<\/a>. <a id=\"paragraph-251714\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#A13\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A14\" class=\"indent-1\"><p><span class=\"prefix-number\">14.<\/span> The Board of Optometry when specifying therapeutic pharmaceutical agents, treatment guidelines, and diseases and abnormal conditions of the human eye and its adnexa for TPA-certification of optometrists pursuant to Article 5 (&#xA7; <a class=\"law\" title=\"TPA certification; certification for treatment of diseases or abnormal conditions with therapeutic pharmaceutical agents (TPAs)\" href=\"\/54.1-3222\/\">54.1-3222<\/a> et seq.) of Chapter 32 of Title 54.1. <a id=\"paragraph-251715\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#A14\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A15\" class=\"indent-1\"><p><span class=\"prefix-number\">15.<\/span> The Commissioner of the Department of Veterans Services in adopting <span class=\"dictionary\">regulations<\/span> pursuant to &#xA7; <a class=\"law\" title=\"Virginia War Memorial division\" href=\"\/2.2-2001.3\/\">2.2-2001.3<\/a>. <a id=\"paragraph-251716\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#A15\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A16\" class=\"indent-1\"><p><span class=\"prefix-number\">16.<\/span> The State Board of Education, in developing, issuing, and revising guidelines pursuant to &#xA7; <a class=\"law\" title=\"Guidelines for constitutional compliance for student prayer\" href=\"\/22.1-203.2\/\">22.1-203.2<\/a>. <a id=\"paragraph-251717\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#A16\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A17\" class=\"indent-1\"><p><span class=\"prefix-number\">17.<\/span> The Virginia Racing Commission, (i) when acting by and through its duly appointed stewards or in matters related to any specific race meeting or (ii) in promulgating technical <span class=\"dictionary\">rules<\/span> regulating actual live horse racing at race meetings licensed by the Commission. <a id=\"paragraph-251718\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#A17\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A18\" class=\"indent-1\"><p><span class=\"prefix-number\">18.<\/span> The Virginia Small Business Financing Authority. <a id=\"paragraph-251719\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#A18\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A19\" class=\"indent-1\"><p><span class=\"prefix-number\">19.<\/span> The Virginia Economic Development Partnership Authority. <a id=\"paragraph-251720\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#A19\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A20\" class=\"indent-1\"><p><span class=\"prefix-number\">20.<\/span> The Board of Agriculture and Consumer Services in adopting, amending, or repealing <span class=\"dictionary\">regulations<\/span> pursuant to subsection A (ii) of &#xA7; <a class=\"law\" title=\"Rules and regulations\" href=\"\/59.1-156\/\">59.1-156<\/a>. <a id=\"paragraph-251721\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#A20\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A21\" class=\"indent-1\"><p><span class=\"prefix-number\">21.<\/span> The Insurance Continuing Education Board pursuant to &#xA7; <a class=\"law\" title=\"Insurance continuing education board; approval of credits\" href=\"\/38.2-1867\/\">38.2-1867<\/a>. <a class=\"law\" title=\"List and reports of diseases and dangerous microbes and pathogens\" href=\"\/32.1-35\/\">32.1-35<\/a> and in adopting, amending, or repealing <span class=\"dictionary\">regulations<\/span> pursuant to subsection C of &#xA7; <a class=\"law\" title=\"Regulations governing restaurants; advisory standards for exempt entities\" href=\"\/35.1-14\/\">35.1-14<\/a> that incorporate the Food and Drug Administration&#8217;s Food Code pertaining to restaurants or food service. <a id=\"paragraph-251723\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#A22\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A23\" class=\"indent-1\"><p><span class=\"prefix-number\">23.<\/span> The Board of Pharmacy when specifying special subject requirements for continuing education for pharmacists pursuant to &#xA7; <a class=\"law\" title=\"Continuing education requirements; exemptions; extensions; procedures; out-of-state licensees; nonpractice licenses\" href=\"\/54.1-3314.1\/\">54.1-3314.1<\/a>. <a id=\"paragraph-251724\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#A23\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A24\" class=\"indent-1\"><p><span class=\"prefix-number\">24.<\/span> The Virginia Department of Veterans Services when promulgating <span class=\"dictionary\">rules<\/span> and <span class=\"dictionary\">regulations<\/span> pursuant to &#xA7; <a class=\"law\" Veterans Services; rules and regulations\" href=\"\/58.1-3219.11\/\">58.1-3219.11<\/a>. <a id=\"paragraph-251725\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#A24\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A25\" class=\"indent-1\"><p><span class=\"prefix-number\">25.<\/span> The Virginia Department of Criminal Justice Services when developing, issuing, or revising any training standards established by the Criminal Justice Services Board under &#xA7; <a class=\"law\" title=\"Powers and duties of the Board and the Department\" href=\"\/9.1-102\/\">9.1-102<\/a>, provided such actions are authorized by the Governor in the interest of public safety. <a id=\"paragraph-251726\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#A25\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> <span class=\"dictionary\">Agency action<\/span> relating to the following subjects shall be exempted from the provisions of this chapter: <a id=\"paragraph-251727\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Money or damage claims against the Commonwealth or agencies thereof. <a id=\"paragraph-251728\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#B1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> The award or denial of state <span class=\"dictionary\">contracts<\/span>, as well as decisions regarding compliance therewith. <a id=\"paragraph-251729\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#B2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> The location, design, specifications, or construction of public buildings or other facilities. <a id=\"paragraph-251730\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#B3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Grants of state or federal funds or property. <a id=\"paragraph-251731\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#B4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> The chartering of corporations. <a id=\"paragraph-251732\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#B5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Customary military, militia, naval, or police functions. <a id=\"paragraph-251733\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#B6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> The selection, tenure, <span class=\"dictionary\">dismissal<\/span>, direction, or control of any officer or employee of an agency of the Commonwealth. <a id=\"paragraph-251734\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#B7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> The conduct of elections or eligibility to vote. <a id=\"paragraph-251735\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#B8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> Inmates of prisons or other such facilities or parolees therefrom. <a id=\"paragraph-251736\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#B9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> The <span class=\"dictionary\">custody<\/span> of persons in, or sought to be placed in, mental health facilities or penal or other state institutions as well as the treatment, supervision, or discharge of such persons. <a id=\"paragraph-251737\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#B10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B11\" class=\"indent-1\"><p><span class=\"prefix-number\">11.<\/span> Traffic signs, markers, or control devices. <a id=\"paragraph-251738\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#B11\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B12\" class=\"indent-1\"><p><span class=\"prefix-number\">12.<\/span> Instructions for application or renewal of a license, certificate, or registration required by <span class=\"dictionary\">law<\/span>. <a id=\"paragraph-251739\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#B12\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B13\" class=\"indent-1\"><p><span class=\"prefix-number\">13.<\/span> Content of, or <span class=\"dictionary\">rules<\/span> for the conduct of, any examination required by <span class=\"dictionary\">law<\/span>. <a id=\"paragraph-251740\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#B13\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B14\" class=\"indent-1\"><p><span class=\"prefix-number\">14.<\/span> The administration of pools authorized by Chapter 47 (&#xA7; <a class=\"law\" title=\"Authorization to Treasury Board to provide certain assistance\" href=\"\/2.2-4700\/\">2.2-4700<\/a> et seq.). <a id=\"paragraph-251741\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#B14\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B15\" class=\"indent-1\"><p><span class=\"prefix-number\">15.<\/span> Any <span class=\"dictionary\">rules<\/span> for the conduct of specific lottery games, so long as such <span class=\"dictionary\">rules<\/span> are not inconsistent with duly adopted <span class=\"dictionary\">regulations<\/span> of the Virginia Lottery Board, and provided that such <span class=\"dictionary\">regulations<\/span> are published and posted. <a id=\"paragraph-251742\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#B15\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B16\" class=\"indent-1\"><p><span class=\"prefix-number\">16.<\/span> <span class=\"dictionary\">Orders<\/span> condemning or closing any shellfish, finfish, or crustacea growing area and the shellfish, finfish, or crustacea located thereon pursuant to Article 2 (&#xA7; <a class=\"law\" title=\"Examination, analysis and inspection\" href=\"\/28.2-803\/\">28.2-803<\/a> et seq.) of Chapter 8 of Title 28.2. <a id=\"paragraph-251743\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#B16\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B17\" class=\"law\" title=\"State Child Fatality Review Team; membership; access to and maintenance of records; confidentiality; etc\" href=\"\/32.1-283.1\/\">32.1-283.1<\/a>, any operating procedures for review of adult deaths developed by the Adult Fatality Review Team pursuant to &#xA7; <a class=\"law\" title=\"Adult Fatality Review Team; duties; membership; confidentiality; penalties; report; etc\" href=\"\/32.1-283.5\/\">32.1-283.5<\/a>, any operating procedures for review of adult deaths developed by the Maternal Mortality Review Team pursuant to &#xA7; <a class=\"law\" title=\"Maternal Mortality Review Team; duties; membership; confidentiality; penalties; report; etc\" href=\"\/32.1-283.8\/\">32.1-283.8<\/a>, and any operating procedures for review of the deaths of persons with a developmental disability developed by the Developmental Disabilities Mortality Review Committee pursuant to &#xA7; <a class=\"law\" title=\"Developmental Disabilities Mortality Review Committee; duties; membership; confidentiality; report; penalty\" href=\"\/37.2-314.1\/\">37.2-314.1<\/a>. <a id=\"paragraph-251744\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#B17\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B18\" class=\"indent-1\"><p><span class=\"prefix-number\">18.<\/span> The <span class=\"dictionary\">regulations<\/span> for the implementation of the Health Practitioners&#8217; Monitoring Program and the activities of the Health Practitioners&#8217; Monitoring Program Committee pursuant to Chapter 25.1 (&#xA7; <a fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B20\" class=\"indent-1\"><p><span class=\"prefix-number\">20.<\/span> Loans from the Small Business Environmental Compliance Assistance class=\"indent-1\"><p><span class=\"prefix-number\">22.<\/span> The types of pari-mutuel wagering pools available for live or simulcast horse racing. <a id=\"paragraph-251749\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#B22\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B23\" class=\"indent-1\"><p><span class=\"prefix-number\">23.<\/span> The administration of medication or other substances foreign to the natural horse. <a id=\"paragraph-251750\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#B23\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B24\" class=\"indent-1\"><p><span class=\"prefix-number\">24.<\/span> Any <span class=\"dictionary\">rules<\/span> adopted by the Department of Agriculture and Consumer Services for the approval and conduct of game variations for the conduct of raffles, bingo, network bingo, and instant bingo games, provided that such <span class=\"dictionary\">rules<\/span> are (i) consistent with Article 1.1:1 (&#xA7; <a class=\"law\" title=\"State control of charitable gaming\" href=\"\/18.2-340.15\/\">18.2-340.15<\/a> et seq.) of Chapter 8 of Title 18.2 and (ii) published and posted. <a id=\"paragraph-251751\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4002\/#B24\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> <span class=\"dictionary\">Minor<\/span> changes to <span class=\"dictionary\">regulations<\/span> published in the Virginia Administrative Code under the Virginia Register Act (&#xA7; <a class=\"law\" title=\"Short title; purpose of chapter; declaration of policy\" href=\"\/2.2-4100\/\">2.2-4100<\/a> et seq.), made by the Virginia Code Commission pursuant to &#xA7; <a class=\"law\" VIRGINIA\n\nEXEMPTIONS FROM CHAPTER GENERALLY (\u00a7 2.2-4002)\n\nA. The Department of Wildlife Resources in promulgating regulations regarding\n   the management of wildlife and for all case decisions rendered pursuant to any\n   provisions of Chapters 2 (&#xA7; 29.1-200 et seq.), 3 (&#xA7; 29.1-300 et\n   seq.), 4 (&#xA7; 29.1-400 et seq.), 5 (&#xA7; 29.1-500 et seq.), and 7 (&#xA7;\n   29.1-700 et seq.) of Title 29.1.\n\n   4. The Virginia Housing Development Authority.\n\n   5. Municipal corporations, counties, and all local, regional, or\n   multijurisdictional authorities created under this Code, including those with\n   federal authorities.\n\n   6. Educational institutions operated by the Commonwealth, provided that, with\n   respect to &#xA7; 2.2-4031, such educational institutions shall be exempt from\n   the publication requirements only with respect to regulations that pertain to\n   (i) their academic affairs, (ii) the selection, tenure, promotion, and\n   disciplining of faculty and employees, (iii) the selection of students, and\n   (iv) rules of conduct and disciplining of students.\n\n   7. The Milk Commission in promulgating regulations regarding (i)\n   producers&#8217; licenses and bases, (ii) classification and allocation of\n   milk, computation of sales, and shrinkage, and (iii) class prices for\n   producers&#8217; milk, time and method of payment, butterfat testing, and\n   differential.\n\n   8. The Virginia Resources Authority.\n\n   9. Agencies expressly exempted by any other provision of this Code.\n\n   10. The Department of General Services in promulgating standards for the\n   inspection of buildings for asbestos pursuant to &#xA7; 2.2-1164.\n\n   11. The State Council of Higher Education for Virginia, in developing,\n   issuing, and revising guidelines pursuant to &#xA7; 23.1-207.\n\n   12. The Commissioner of Agriculture and Consumer Services in adopting\n   regulations pursuant to subsection B of &#xA7; 3.2-6002 and in adopting\n   regulations pursuant to &#xA7; 3.2-6023.\n\n   13. The Commissioner of Agriculture and Consumer Services and the Board of\n   Agriculture and Consumer Services in promulgating regulations pursuant to\n   subsections B and D of &#xA7; 3.2-3601, subsection B of &#xA7; 3.2-3701,\n   &#xA7; 3.2-4002, subsections B and D of &#xA7; 3.2-4801, &#xA7;&#xA7; 3.2-5121\n   and 3.2-5206, and subsection A of &#xA7; 3.2-5406.\n\n   14. The Board of Optometry when specifying therapeutic pharmaceutical agents,\n   treatment guidelines, and diseases and abnormal conditions of the human eye\n   and its adnexa for TPA-certification of optometrists pursuant to Article 5\n   (&#xA7; 54.1-3222 et seq.) of Chapter 32 of Title 54.1.\n\n   15. The Commissioner of the Department of Veterans Services in adopting\n   regulations pursuant to &#xA7; 2.2-2001.3.\n\n   16. The State Board of Education, in developing, issuing, and revising\n   guidelines pursuant to &#xA7; 22.1-203.2.\n\n   17. The Virginia Racing Commission, (i) when acting by and through its duly\n   appointed stewards or in matters related to any specific race meeting or (ii)\n   in promulgating technical rules regulating actual live horse racing at race\n   meetings licensed by the Commission.\n\n   18. The Virginia Small Business Financing Authority.\n\n   19. The Virginia Economic Development Partnership Authority.\n\n   20. The Board of Agriculture and Consumer Services in adopting, amending, or\n   repealing regulations pursuant to subsection A (ii) of &#xA7; 59.1-156.\n\n   21. The Insurance Continuing Education Board pursuant to &#xA7; 38.2-1867.\n\n   22. The Board of Health in promulgating the list of diseases that shall be\n   reported to the Department of Health pursuant to &#xA7; 32.1-35 and in\n   adopting, amending, or repealing regulations pursuant to subsection C of\n   &#xA7; 35.1-14 that incorporate the Food and Drug Administration&#8217;s Food\n   Code pertaining to restaurants or food service.\n\n   23. The Board of Pharmacy when specifying special subject requirements for\n   continuing education for pharmacists pursuant to &#xA7; 54.1-3314.1.\n\n   24. The Virginia Department of Veterans Services when promulgating rules and\n   regulations pursuant to &#xA7; 58.1-3219.7 or 58.1-3219.11.\n\n   25. The Virginia Department of Criminal Justice Services when developing,\n   issuing, or revising any training standards established by the Criminal\n   Justice Services Board under &#xA7; 9.1-102, provided such actions are\n   authorized by the Governor in the interest of public safety.\n\nB.
