In such cases, the agency shall state in writing the nature of the emergency and of the necessity for such action and may adopt the regulations. Pursuant to &#xA7; 2.2-4012, such regulations shall become effective upon approval by the Governor and filing with the Registrar of Regulations.C\n\nAll emergency regulations shall be limited to no more than 18 months in duration. During the 18-month period, an agency may issue additional emergency regulations as needed addressing the subject matter of the initial emergency regulation, but any such additional emergency regulations shall not be effective beyond the 18-month period from the effective date of the initial emergency regulation. If the agency wishes to continue regulating the subject matter governed by the emergency regulation beyond the 18-month limitation, a regulation to replace the emergency regulation shall be promulgated in accordance with this article. The Notice of Intended Regulatory Action to promulgate a replacement regulation shall be filed with the Registrar within 60 days of the effective date of the emergency regulation and published as soon as practicable, and the proposed replacement regulation shall be filed with the Registrar within 180 days after the effective date of the emergency regulation and published as soon as practicable.D\n\nIn the event that an agency concludes that despite its best efforts a replacement regulation cannot be adopted before expiration of the 18-month period described in subsection C, it may seek the prior written approval of the Governor to extend the duration of the emergency regulation for a period of not more than six additional months. Any such request must be submitted to the Governor at least 30 days prior to the scheduled expiration of the emergency regulation and shall include a description of the agency&#8217;s efforts to adopt a replacement regulation together with the reasons that a replacement regulation cannot be adopted before the scheduled expiration of the emergency regulation. <a class=\"law\" title=\"Exemptions from requirements of this article\" href=\"\/2.2-4006\/\">2.2-4006<\/a>. In such <span class=\"dictionary\">cases<\/span>, the <span class=\"dictionary\">agency<\/span> shall state in writing the nature of the emergency and of the necessity for such action and may adopt the <span class=\"dictionary\">regulations<\/span>. Pursuant to &#xA7; <a class=\"law\" title=\"Purpose; adoption; effective date; filing; duties of Registrar of Regulations\" href=\"\/2.2-4012\/\">2.2-4012<\/a>, such <span class=\"dictionary\">regulations<\/span> shall become effective upon approval by the Governor and filing with the <span class=\"dictionary\">Registrar<\/span> of <span class=\"dictionary\">Regulations<\/span>. <a id=\"paragraph-240324\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4011\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> All emergency <span class=\"dictionary\">regulations<\/span> shall be limited to no more than 18 months in duration. During the 18-month period, an <span class=\"dictionary\">agency<\/span> may <span class=\"dictionary\">issue<\/span> additional emergency <span class=\"dictionary\">regulations<\/span> as needed addressing the subject matter of the initial emergency <span class=\"dictionary\">regulation<\/span>, but any such additional emergency <span class=\"dictionary\">regulations<\/span> shall not be effective beyond the 18-month period from the effective date of the initial emergency <span class=\"dictionary\">regulation<\/span>. If the <span class=\"dictionary\">agency<\/span> wishes to continue regulating the subject matter governed by the emergency <span class=\"dictionary\">regulation<\/span> beyond the 18-month limitation, a <span class=\"dictionary\">regulation<\/span> to replace the emergency <span class=\"dictionary\">regulation<\/span> shall be promulgated in accordance with this article. The Notice of Intended Regulatory Action to promulgate a replacement <span class=\"dictionary\">regulation<\/span> shall be filed with the <span class=\"dictionary\">Registrar<\/span> within 60 days of the effective date of the emergency <span class=\"dictionary\">regulation<\/span> and published as soon as practicable, and the proposed replacement <span class=\"dictionary\">regulation<\/span> shall be filed with the <span class=\"dictionary\">Registrar<\/span> within 180 days after the effective date of the emergency <span class=\"dictionary\">regulation<\/span> and published as soon as practicable. <a id=\"paragraph-240325\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4011\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> In the event that an <span class=\"dictionary\">agency<\/span> concludes that despite its best efforts a replacement <span class=\"dictionary\">regulation<\/span> cannot be adopted before expiration of the 18-month period described in subsection C, it may seek the prior written approval of the Governor to extend the duration of the emergency <span class=\"dictionary\">regulation<\/span> for a period of not more than six additional months. Any such request must be submitted to the Governor at least 30 days prior to the scheduled expiration of the emergency <span class=\"dictionary\">regulation<\/span> and shall include a description of the <span class=\"dictionary\">agency<\/span>&#8217;s efforts to adopt a replacement <span class=\"dictionary\">regulation<\/span> together with the reasons that a replacement <span class=\"dictionary\">regulation<\/span> cannot be adopted before the scheduled expiration of the emergency <span class=\"dictionary\">regulation<\/span>. Upon approval of the Governor, provided such approval occurs prior to the scheduled expiration of the emergency <span class=\"dictionary\">regulation<\/span>, the duration of the emergency <span class=\"dictionary\">regulation<\/span> shall be extended for a period of no more than six months. Such approval shall be in the sole discretion of the Governor and shall not be subject to judicial review. Agencies shall notify the <span class=\"dictionary\">Registrar<\/span> of <span class=\"dictionary\">Regulations<\/span> of the new expiration date of the emergency <span class=\"dictionary\">regulation<\/span> as soon as practicable. <a id=\"paragraph-240326\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4011\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> Emergency <span class=\"dictionary\">regulations<\/span> shall be published as soon as practicable in the Register. <a id=\"paragraph-240327\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4011\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> The <span class=\"dictionary\">Regulations<\/span> of the Marine Resources Commission shall be excluded from the provisions of this section. <a id=\"paragraph-240328\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4011\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nEMERGENCY REGULATIONS; PUBLICATION; EXCEPTIONS (\u00a7 2.2-4011)\n\nA.
