means:\n\n1\n\nA pecuniary item, including money, or a bank bill or note;2\n\nA promissory note, bill of exchange, order, draft, warrant, check, or bond given for the payment of money;3\n\nA contract, agreement, promise, or other obligation for an advance, conveyance, forgiveness of indebtedness, deposit, distribution, loan, payment, gift, pledge, or transfer of money;4\n\nA stock, bond, note, or other investment interest in an entity;5\n\nA receipt given for the payment of money or other property;6\n\nA right in action;7\n\nA gift, tangible good, chattel, or an interest in a gift, tangible good, or chattel;8\n\nA loan or forgiveness of indebtedness;9\n\nA work of art, antique, or collectible;10\n\nAn automobile or other means of personal transportation;11\n\nReal property or an interest in real property, including title to realty, a fee simple or partial interest, present or future, contingent or vested within realty, a leasehold interest, or other beneficial interest in realty;12\n\nAn honorarium or compensation for services;13\n\nA rebate or discount in the price of anything of value unless the rebate or discount is made in the ordinary course of business to a member of the public without regard to that person&#8217;s status as an executive or legislative official, or the sale or trade of something for reasonable compensation that would ordinarily not be available to a member of the public;14\n\nA promise or offer of employment; or15\n\nAny other thing of value that is pecuniary or compensatory in value to a person.\n\t\t\t&#8220;Anything of value&#8221; does not mean a campaign contribution properly received and reported pursuant to Chapter 9.3 (&#xA7; 24.2-945 et seq.) of Title 24.2.\n\t\t\t&#8220;Compensation&#8221; means:1\n\nAn advance, conveyance, forgiveness of indebtedness, deposit, distribution, loan, payment, gift, pledge, or transfer of money or anything of value; or2\n\nA contract, agreement, promise or other obligation for an advance, conveyance, forgiveness of indebtedness, deposit, distribution, loan, payment, gift, pledge, or transfer of money or anything of value, for services rendered or to be rendered.\n\t\t\t&#8220;Compensation&#8221; does not mean reimbursement of expenses if the reimbursement does not exceed the amount actually expended for the expenses and it is substantiated by an itemization of expenses.\n\t\t\t&#8220;Council&#8221; means the Virginia Conflict of Interest and Ethics Advisory Council established in &#xA7; 30-355.\n\t\t\t&#8220;Executive action&#8221; means the proposal, drafting, development, consideration, amendment, adoption, approval, promulgation, issuance, modification, rejection, or postponement by an executive agency or official of legislation or executive orders issued by the Governor. &#8220;Executive action&#8221; includes procurement transactions.\n\t\t\t&#8220;Executive agency&#8221; means an agency, board, commission, or other body in the executive branch of state government. &#8220;Executive agency&#8221; includes the State Corporation Commission, the Virginia Workers&#8217; Compensation Commission, and the Virginia Lottery.\n\t\t\t&#8220;Executive official&#8221; means:1\n\nThe Governor;2\n\nThe Lieutenant Governor;3\n\nThe Attorney General;4\n\nAny officer or employee of the office of the Governor, Lieutenant Governor, or Attorney General other than a clerical or secretarial employee;5\n\nThe Governor&#8217;s Secretaries, the Deputy Secretaries, and the chief executive officer of each executive agency; or6\n\nMembers of supervisory and policy boards, commissions and councils, as defined in &#xA7; 2.2-2100, however selected.\n\t\t\t&#8220;Expenditure&#8221; means:1\n\nA purchase, payment, distribution, loan, forgiveness of a loan or payment of a loan by a third party, advance, deposit, transfer of funds, a promise to make a payment, or a gift of money or anything of value for any purpose;2\n\nA payment to a lobbyist for salary, fee, reimbursement for expenses, or other purpose by a person employing, retaining, or contracting for the services of the lobbyist separately or jointly with other persons;3\n\nA payment in support of or assistance to a lobbyist or the lobbyist&#8217;s activities, including the direct payment of expenses incurred at the request or suggestion of the lobbyist;4\n\nA payment that directly benefits an executive or legislative official or a member of the official&#8217;s immediate family;5\n\nA payment, including compensation, payment, or reimbursement for the services, time, or expenses of an employee for or in connection with direct communication with an executive or legislative official;6\n\nA payment for or in connection with soliciting or urging other persons to enter into direct communication with an executive or legislative official; or7\n\nA payment or reimbursement for categories of expenditures required to be reported pursuant to this chapter.\n\t\t\t&#8220;Expenditure&#8221; does not mean a campaign contribution properly received and reported pursuant to Chapter 9.3 (&#xA7; 24.2-945 et seq.) of Title 24.2.\n\t\t\t&#8220;Fair market value&#8221; means the price that a good or service would bring between a willing seller and a willing buyer in the open market after negotiations. If the fair market value cannot be determined, the actual price paid for the good or service shall be given consideration.\n\t\t\t&#8220;Gift&#8221; means anything of value, including any gratuity, favor, discount, entertainment, hospitality, loan, forbearance, or other item having monetary value, and includes services as well as gifts of transportation, local travel, lodgings, and meals, whether provided in-kind or by purchase of a ticket, payment in advance, or reimbursement after the expense has been incurred.\n\t\t\t&#8220;Gift&#8221; does not mean:1\n\nPrinted informational or promotional material;2\n\nA gift that is not used and, no later than 60 days after receipt, is returned to the donor or delivered to a charitable organization and is not claimed as a charitable contribution for federal income tax purposes;3\n\nA devise or inheritance;4\n\nA gift of a value of less than $20;5\n\nAny offer of a ticket, coupon, or other admission or pass unless the ticket, coupon, admission, or pass is used;6\n\nAny food or beverages provided to an individual at an event at which the individual is performing official duties related to his public service;7\n\nAny food and beverages received at or registration or attendance fees waived for any event at which the individual is a featured speaker, presenter, or lecturer;8\n\nAn unsolicited award of appreciation or recognition in the form of a plaque, trophy, wall memento, or similar item that is given in recognition of public, civic, charitable, or professional service;9\n\nAny gift to an individual&#8217;s spouse, child, uncle, aunt, niece, nephew, or first cousin; a person to whom the donee is engaged to be married; the donee&#8217;s or his spouse&#8217;s parent, grandparent, grandchild, brother, sister, step-parent, step-grandparent, step-grandchild, step-brother, or step-sister; or the donee&#8217;s brother&#8217;s or sister&#8217;s spouse or the donee&#8217;s son-in-law or daughter-in-law;10\n\nTravel provided to facilitate attendance by a legislator at a regular or special session of the General Assembly, a meeting of a legislative committee or commission, or a national conference where attendance is approved by the House Committee on Rules or its Chairman or the Senate Committee on Rules or its Chairman;11\n\nTravel related to an official meeting of, or any meal provided for attendance at such meeting by, the Commonwealth, its political subdivisions, or any board, commission, authority, or other entity, or any charitable organization established pursuant to &#xA7; 501(c)(3) of the Internal Revenue Code affiliated with such entity, to which such person has been appointed or elected or is a member by virtue of his office or employment; or12\n\nAttendance at a reception or similar function where food, such as hors d&#8217;oeuvres, and beverages that can be conveniently consumed by a person while standing or walking are offered.\n\t\t\t&#8220;Immediate family&#8221; means (i) the spouse and (ii) any other person who resides in the same household as the executive or legislative official and who is a dependent of the official.\n\t\t\t&#8220;Legislative action&#8221; means:1\n\nPreparation, research, drafting, introduction, consideration, modification, amendment, approval, passage, enactment, tabling, postponement, defeat, or rejection of a bill, resolution, amendment, motion, report, nomination, appointment, or other matter by the General Assembly or a legislative official;2\n\nAction by the Governor in approving, vetoing, or recommending amendments for a bill passed by the General Assembly; or3\n\nAction by the General Assembly in overriding or sustaining a veto by the Governor, considering amendments recommended by the Governor, or considering, confirming, or rejecting an appointment of the Governor.\n\t\t\t&#8220;Legislative official&#8221; means:1\n\nA member or member-elect of the General Assembly;2\n\nA member of a committee, subcommittee, commission, or other entity established by and responsible to the General Assembly or either house of the General Assembly; or3\n\nPersons employed by the General Assembly or an entity established by and responsible to the General Assembly.\n\t\t\t&#8220;Lobbying&#8221; means:1\n\nInfluencing or attempting to influence executive or legislative action through oral or written communication with an executive or legislative official; or2\n\nSolicitation of others to influence an executive or legislative official.\n\t\t\t&#8220;Lobbying&#8221; does not mean:1\n\nRequests for appointments, information on the status of pending executive and legislative actions, or other ministerial contacts if there is no attempt to influence executive or legislative actions;2\n\nResponses to published notices soliciting public comment submitted to the public official designated in the notice to receive the responses;3\n\nThe solicitation of an association by its members to influence legislative or executive action; or4\n\nCommunications between an association and its members and communications between a principal and its lobbyists.\n\t\t\t&#8220;Lobbyist&#8221; means:1\n\nAn individual who is employed and receives payments, or who contracts for economic consideration, including reimbursement for reasonable travel and living expenses, for the purpose of lobbying;2\n\nAn individual who represents an organization, association, or other group for the purpose of lobbying; or3\n\nA local government employee who lobbies.\n\t\t\t&#8220;Lobbyist&#8217;s principal&#8221; or &#8220;principal&#8221; means the entity on whose behalf the lobbyist influences or attempts to influence executive or legislative action. An organization whose employees conduct lobbying activities on its behalf is both a principal and an employer of the lobbyists. In the case of a coalition or association that employs or retains others to conduct lobbying activities on behalf of its membership, the principal is the coalition or association and not its individual members.\n\t\t\t&#8220;Local government&#8221; means:1\n\nAny county, city, town, or other local or regional political subdivision;2\n\nAny school division;3\n\nAny organization or entity that exercises governmental powers that is established pursuant to an interstate compact; or4\n\nAny organization composed of members representing entities listed in subdivisions 1, 2, or 3 of this definition.\n\t\t\t&#8220;Local government employee&#8221; means a public employee of a local government.\n\t\t\t&#8220;Person&#8221; means an individual, proprietorship, firm, partnership, joint venture, joint stock company, syndicate, business trust, estate, company, corporation, association, club, committee, organization, or group of persons acting in concert.\n\t\t\t&#8220;Procurement transaction&#8221; means all functions that pertain to obtaining all goods, services, or construction on behalf of an executive agency, including description of requirements, selection and solicitation of sources, preparation and award of contract, and all phases of contract administration where the stated or expected value of the contract is $5 million or more.\n\t\t\t&#8220;Secretary&#8221; means the Secretary of the Commonwealth.\n\t\t\t&#8220;Value&#8221; means the actual cost or fair market value of an item or items, whichever is greater. If the fair market value cannot be determined, the actual amount paid for the item or items shall be given consideration.\n\t\t\t&#8220;Widely attended event&#8221; means an event at which at least 25 persons have been invited to attend or there is a reasonable expectation that at least 25 persons will attend the event and the event is open to individuals (i) who are members of a public, civic, charitable, or professional organization, (ii) who are from a particular industry or profession, or (iii) who represent persons interested in a particular issue.","order_by":null,"text":{"0":{"id":265815,"text":"As used in this article, unless the context requires a different meaning:\n\t\t&#8220;Anything of value&#8221; <a id=\"paragraph-265817\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"3\"><p><span class=\"prefix-number\">3.<\/span> A <span class=\"dictionary\">contract<\/span>, agreement, promise, or other obligation for an advance, conveyance, forgiveness of indebtedness, deposit, distribution, loan, payment, <span class=\"dictionary\">gift<\/span>, pledge, or transfer of money; <a id=\"paragraph-265818\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"4\"><p><span class=\"prefix-number\">4.<\/span> A stock, <span class=\"dictionary\">bond<\/span>, note, or other investment interest in an entity; <a id=\"paragraph-265819\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"5\"><p><span class=\"prefix-number\">5.<\/span> A receipt given for the payment of money or other property; <a id=\"paragraph-265820\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"6\"><p><span class=\"prefix-number\">6.<\/span> A right in action; <a id=\"paragraph-265821\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"7\"><p><span class=\"prefix-number\">7.<\/span> A <span class=\"dictionary\">gift<\/span>, tangible good, chattel, or an interest in a <span class=\"dictionary\">gift<\/span>, tangible good, or chattel; <a id=\"paragraph-265822\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"8\"><p><span class=\"prefix-number\">8.<\/span> A loan or forgiveness of indebtedness; <a id=\"paragraph-265823\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"9\"><p><span class=\"prefix-number\">9.<\/span> A work of art, antique, or collectible; <a id=\"paragraph-265824\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"10\"><p><span class=\"prefix-number\">10.<\/span> An automobile or other means of personal transportation; <a id=\"paragraph-265825\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"11\"><p><span class=\"prefix-number\">11.<\/span> Real property or an interest in real property, including title to realty, a fee simple or partial interest, present or future, contingent or vested within realty, a leasehold interest, or other beneficial interest in realty; <a id=\"paragraph-265826\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#11\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"12\"><p><span class=\"prefix-number\">12.<\/span> An honorarium or <span class=\"dictionary\">compensation<\/span> for services; <a id=\"paragraph-265827\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#12\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"13\"><p><span class=\"prefix-number\">13.<\/span> A rebate or discount in the price of <span class=\"dictionary\">anything of value<\/span> unless the rebate or discount is made in the ordinary course of business to a member of the public without regard to that <span class=\"dictionary\">person<\/span>&#8217;s status as an executive or legislative official, or the sale or trade of something for reasonable <span class=\"dictionary\">compensation<\/span> that would ordinarily not be available to a member of the public; <a id=\"paragraph-265828\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#13\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"14\"><p><span class=\"prefix-number\">14.<\/span> A promise or offer of employment; or <a id=\"paragraph-265829\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#14\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"15\"><p><span class=\"prefix-number\">15.<\/span> Any other thing of value that is pecuniary or compensatory in value to a <span class=\"dictionary\">person<\/span>.\n\t\t\t&#8220;<span class=\"dictionary\">Anything of value<\/span>&#8221; does not mean a campaign contribution properly received and reported pursuant to Chapter 9.3 (&#xA7; <a class=\"law\" title=\"Elections to which chapter applicable; chapter exclusive\" href=\"\/24.2-945\/\">24.2-945<\/a> et seq.) of Title 24.2.\n\t\t\t&#8220;<span class=\"dictionary\">Compensation<\/span>&#8221; means: <a id=\"paragraph-265830\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#15\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"1\"><p><span class=\"prefix-number\">1.<\/span> An advance, conveyance, forgiveness of indebtedness, deposit, distribution, loan, payment, <span class=\"dictionary\">gift<\/span>, pledge, or transfer of money or <span class=\"dictionary\">anything of value<\/span>; or <a id=\"paragraph-265831\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"2\"><p><span class=\"prefix-number\">2.<\/span> A <span class=\"dictionary\">contract<\/span>, agreement, promise or other obligation for an advance, conveyance, forgiveness of indebtedness, deposit, distribution, loan, payment, <span class=\"dictionary\">gift<\/span>, pledge, or transfer of money or <span class=\"dictionary\">anything of value<\/span>, for services rendered or to be rendered.\n\t\t\t&#8220;<span class=\"dictionary\">Compensation<\/span>&#8221; does not mean reimbursement of expenses if the reimbursement does not exceed the amount actually expended for the expenses and it is substantiated by an itemization of expenses.\n\t\t\t&#8220;<span class=\"dictionary\">Council<\/span>&#8221; means the Virginia <span class=\"dictionary\">Conflict of Interest<\/span> and Ethics Advisory <span class=\"dictionary\">Council<\/span> established in &#xA7; <a class=\"law\" title=\"Virginia Conflict of Interest and Ethics Advisory Council; membership; terms; quorum; expenses\" href=\"\/30-355\/\">30-355<\/a>.\n\t\t\t&#8220;<span class=\"dictionary\">Executive action<\/span>&#8221; means the proposal, drafting, development, consideration, amendment, adoption, approval, promulgation, issuance, modification, rejection, or postponement by an <span class=\"dictionary\">executive agency<\/span> or official of legislation or executive <span class=\"dictionary\">orders<\/span> issued by the Governor. &#8220;<span class=\"dictionary\">Executive action<\/span>&#8221; includes <span class=\"dictionary\">procurement transactions<\/span>.\n\t\t\t&#8220;<span class=\"dictionary\">Executive agency<\/span>&#8221; means an agency, board, commission, or other body in the executive branch of state government. &#8220;<span class=\"dictionary\">Executive agency<\/span>&#8221; includes the State Corporation Commission, the Virginia Workers&#8217; <span class=\"dictionary\">Compensation<\/span> Commission, and the Virginia Lottery.\n\t\t\t&#8220;Executive official&#8221; means: <a id=\"paragraph-265832\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"1\"><p><span class=\"prefix-number\">1.<\/span> The Governor; <a id=\"paragraph-265833\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"2\"><p><span class=\"prefix-number\">2.<\/span> The Lieutenant Governor; <a id=\"paragraph-265834\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"3\"><p><span class=\"prefix-number\">3.<\/span> The <span class=\"dictionary\">Attorney General<\/span>; <a id=\"paragraph-265835\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"4\"><p><span class=\"prefix-number\">4.<\/span> Any officer or employee of the office of the Governor, Lieutenant Governor, or <span class=\"dictionary\">Attorney General<\/span> other than a clerical or secretarial employee; <a id=\"paragraph-265836\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"5\"><p><span class=\"prefix-number\">5.<\/span> The Governor&#8217;s Secretaries, the Deputy Secretaries, and the chief executive officer of each <span class=\"dictionary\">executive agency<\/span>; or <a id=\"paragraph-265837\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"6\"><p><span class=\"prefix-number\">6.<\/span> Members of supervisory and policy boards, commissions and <span class=\"dictionary\">councils<\/span>, as defined in &#xA7; <a class=\"law\" title=\"Classification of executive branch boards, commissions and councils\" href=\"\/2.2-2100\/\">2.2-2100<\/a>, however selected.\n\t\t\t&#8220;<span class=\"dictionary\">Expenditure<\/span>&#8221; means: <a id=\"paragraph-265838\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"1\"><p><span class=\"prefix-number\">1.<\/span> A purchase, payment, distribution, loan, forgiveness of a loan or payment of a loan by a third <span class=\"dictionary\">party<\/span>, advance, deposit, transfer of funds, a promise to make a payment, or a <span class=\"dictionary\">gift<\/span> of money or <span class=\"dictionary\">anything of value<\/span> for any purpose; <a id=\"paragraph-265839\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"2\"><p><span class=\"prefix-number\">2.<\/span> A payment to a lobbyist for salary, fee, reimbursement for expenses, or other purpose by a <span class=\"dictionary\">person<\/span> employing, retaining, or contracting for the services of the lobbyist separately or jointly with other <span class=\"dictionary\">persons<\/span>; <a id=\"paragraph-265840\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"3\"><p><span class=\"prefix-number\">3.<\/span> A payment in support of or assistance to a lobbyist or the lobbyist&#8217;s activities, including the direct payment of expenses incurred at the request or suggestion of the lobbyist; <a id=\"paragraph-265841\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"4\"><p><span class=\"prefix-number\">4.<\/span> A payment that directly benefits an executive or legislative official or a member of the official&#8217;s <span class=\"dictionary\">immediate family<\/span>; <a id=\"paragraph-265842\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"5\"><p><span class=\"prefix-number\">5.<\/span> A payment, including <span class=\"dictionary\">compensation<\/span>, payment, or reimbursement for the services, time, or expenses of an employee for or in connection with direct communication with an executive or legislative official; <a id=\"paragraph-265843\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"6\"><p><span class=\"prefix-number\">6.<\/span> A payment for or in connection with soliciting or urging other <span class=\"dictionary\">persons<\/span> to enter into direct communication with an executive or legislative official; or <a id=\"paragraph-265844\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"7\"><p><span class=\"prefix-number\">7.<\/span> A payment or reimbursement for categories of <span class=\"dictionary\">expenditures<\/span> required to be reported pursuant to this chapter.\n\t\t\t&#8220;<span class=\"dictionary\">Expenditure<\/span>&#8221; does not mean a campaign contribution properly received and reported pursuant to Chapter 9.3 (&#xA7; <a class=\"law\" title=\"Elections to which chapter applicable; chapter exclusive\" href=\"\/24.2-945\/\">24.2-945<\/a> et seq.) of Title 24.2.\n\t\t\t&#8220;<span class=\"dictionary\">Fair market value<\/span>&#8221; means the price that a good or service would bring between a willing seller and a willing buyer in the open market after negotiations. If the <span class=\"dictionary\">fair market value<\/span> cannot be determined, the actual price paid for the good or service shall be given consideration.\n\t\t\t&#8220;<span class=\"dictionary\">Gift<\/span>&#8221; means <span class=\"dictionary\">anything of value<\/span>, including any gratuity, favor, discount, entertainment, hospitality, loan, forbearance, or other item having monetary value, and includes services as well as <span class=\"dictionary\">gifts<\/span> of transportation, local travel, lodgings, and meals, whether provided in-kind or by purchase of a ticket, payment in advance, or reimbursement after the expense has been incurred.\n\t\t\t&#8220;<span class=\"dictionary\">Gift<\/span>&#8221; does not mean: <a id=\"paragraph-265845\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"1\"><p><span class=\"prefix-number\">1.<\/span> Printed informational or promotional <span class=\"dictionary\">material<\/span>; <a id=\"paragraph-265846\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"2\"><p><span class=\"prefix-number\">2.<\/span> A <span class=\"dictionary\">gift<\/span> that is not used and, no later than 60 days after receipt, is returned to the donor or delivered to a charitable organization and is not claimed as a charitable contribution for federal income tax purposes; <a id=\"paragraph-265847\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"3\"><p><span class=\"prefix-number\">3.<\/span> A devise or inheritance; <a id=\"paragraph-265848\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"4\"><p><span class=\"prefix-number\">4.<\/span> A <span class=\"dictionary\">gift<\/span> of a value of less than $20; <a id=\"paragraph-265849\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"5\"><p><span class=\"prefix-number\">5.<\/span> Any offer of a ticket, coupon, or other admission or pass unless the ticket, coupon, admission, or pass is used; <a id=\"paragraph-265850\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"6\"><p><span class=\"prefix-number\">6.<\/span> Any food or beverages provided to an individual at an event at which the individual is performing official duties related to his public service; <a id=\"paragraph-265851\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"7\"><p><span class=\"prefix-number\">7.<\/span> Any food and beverages received at or registration or attendance fees waived for any event at which the individual is a featured speaker, presenter, or lecturer; <a id=\"paragraph-265852\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"8\"><p><span class=\"prefix-number\">8.<\/span> An unsolicited award of appreciation or recognition in the form of a plaque, trophy, wall memento, or similar item that is given in recognition of public, civic, charitable, or professional service; <a id=\"paragraph-265853\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"9\"><p><span class=\"prefix-number\">9.<\/span> Any <span class=\"dictionary\">gift<\/span> to an individual&#8217;s spouse, child, uncle, aunt, niece, nephew, or first cousin; a <span class=\"dictionary\">person<\/span> to whom the donee is engaged to be married; the donee&#8217;s or his spouse&#8217;s parent, grandparent, grandchild, brother, sister, step-parent, step-grandparent, step-grandchild, step-brother, or step-sister; or the donee&#8217;s brother&#8217;s or sister&#8217;s spouse or the donee&#8217;s son-in-<span class=\"dictionary\">law<\/span> or daughter-in-<span class=\"dictionary\">law<\/span>; <a id=\"paragraph-265854\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"10\"><p><span class=\"prefix-number\">10.<\/span> Travel provided to facilitate attendance by a legislator at a regular or special session of the General Assembly, a meeting of a legislative committee or commission, or a national conference where attendance is approved by the House Committee on Rules or its Chairman or the Senate Committee on Rules or its Chairman; <a id=\"paragraph-265855\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"11\"><p><span class=\"prefix-number\">11.<\/span> Travel related to an official meeting of, or any meal provided for attendance at such meeting by, the Commonwealth, its political subdivisions, or any board, commission, authority, or other entity, or any charitable organization established pursuant to &#xA7; 501(c)(3) of the Internal Revenue Code affiliated with such entity, to which such <span class=\"dictionary\">person<\/span> has been appointed or elected or is a member by virtue of his office or employment; or <a id=\"paragraph-265856\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#11\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"12\"><p><span class=\"prefix-number\">12.<\/span> Attendance at a reception or similar function where food, such as hors d&#8217;oeuvres, and beverages that can be conveniently consumed by a <span class=\"dictionary\">person<\/span> while standing or walking are offered.\n\t\t\t&#8220;<span class=\"dictionary\">Immediate family<\/span>&#8221; means (i) the spouse and (ii) any other <span class=\"dictionary\">person<\/span> who resides in the same household as the executive or legislative official and who is a dependent of the official.\n\t\t\t&#8220;Legislative action&#8221; means: <a id=\"paragraph-265857\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#12\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"1\"><p><span class=\"prefix-number\">1.<\/span> Preparation, research, drafting, introduction, consideration, modification, amendment, approval, passage, enactment, tabling, postponement, defeat, or rejection of a bill, resolution, amendment, <span class=\"dictionary\">motion<\/span>, report, nomination, appointment, or other matter by the General Assembly or a legislative official; <a id=\"paragraph-265858\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"2\"><p><span class=\"prefix-number\">2.<\/span> Action by the Governor in approving, vetoing, or recommending amendments for a bill passed by the General Assembly; or <a id=\"paragraph-265859\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"3\"><p><span class=\"prefix-number\">3.<\/span> Action by the General Assembly in overriding or sustaining a veto by the Governor, considering amendments recommended by the Governor, or considering, confirming, or rejecting an appointment of the Governor.\n\t\t\t&#8220;Legislative official&#8221; means: <a id=\"paragraph-265860\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"1\"><p><span class=\"prefix-number\">1.<\/span> A member or member-elect of the General Assembly; <a id=\"paragraph-265861\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"2\"><p><span class=\"prefix-number\">2.<\/span> A member of a committee, subcommittee, commission, or other entity established by and responsible to the General Assembly or either house of the General Assembly; means: <a id=\"paragraph-265863\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"1\"><p><span class=\"prefix-number\">1.<\/span> Influencing or attempting to influence executive or legislative action through oral or written communication with an executive or legislative official; or <a id=\"paragraph-265864\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"2\"><p><span class=\"prefix-number\">2.<\/span> Solicitation of others to influence an executive or legislative official.\n\t\t\t&#8220;Lobbying&#8221; does not mean: <a id=\"paragraph-265865\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"1\"><p><span class=\"prefix-number\">1.<\/span> Requests for appointments, information on the status of pending executive and legislative actions, or other ministerial contacts if there is no attempt to influence executive or legislative actions; <a id=\"paragraph-265866\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"2\"><p><span class=\"prefix-number\">2.<\/span> Responses to published notices soliciting public comment submitted to the public official designated in the notice to receive the responses; <a id=\"paragraph-265867\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"3\"><p><span class=\"prefix-number\">3.<\/span> The solicitation of an association by its members to influence legislative or <span class=\"dictionary\">executive action<\/span>; or <a id=\"paragraph-265868\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"4\"><p><span class=\"prefix-number\">4.<\/span> Communications between an association and its members and communications between a <span class=\"dictionary\">principal<\/span> and its lobbyists.\n\t\t\t&#8220;Lobbyist&#8221; means: <a id=\"paragraph-265869\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"1\"><p><span class=\"prefix-number\">1.<\/span> An individual who is employed and receives payments, or who <span class=\"dictionary\">contracts<\/span> for economic consideration, including reimbursement for reasonable travel and living expenses, for the purpose of lobbying; <a id=\"paragraph-265870\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"2\"><p><span class=\"prefix-number\">2.<\/span> An individual who represents an organization, association, or other group for the purpose of lobbying; or <a id=\"paragraph-265871\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"3\"><p><span class=\"prefix-number\">3.<\/span> A <span class=\"dictionary\">local government employee<\/span> who lobbies.\n\t\t\t&#8220;Lobbyist&#8217;s <span class=\"dictionary\">principal<\/span>&#8221; or &#8220;<span class=\"dictionary\">principal<\/span>&#8221; means the entity on whose behalf the lobbyist influences or attempts to influence executive or legislative action. An organization whose employees conduct lobbying activities on its behalf is both a <span class=\"dictionary\">principal<\/span> and an employer of the lobbyists. In the case of a coalition or association that employs or retains others to conduct lobbying activities on behalf of its membership, the <span class=\"dictionary\">principal<\/span> is the coalition or association and not its individual members.\n\t\t\t&#8220;Local government&#8221; means: <a id=\"paragraph-265872\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"1\"><p><span class=\"prefix-number\">1.<\/span> Any county, city, town, or other local or regional political subdivision; <a id=\"paragraph-265873\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"2\"><p><span class=\"prefix-number\">2.<\/span> Any school division; <a id=\"paragraph-265874\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"3\"><p><span class=\"prefix-number\">3.<\/span> Any organization or entity that exercises governmental powers that is established pursuant to an interstate compact; or <a id=\"paragraph-265875\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"4\"><p><span class=\"prefix-number\">4.<\/span> Any organization composed of members representing entities listed in subdivisions 1, 2, or 3 of this definition.\n\t\t\t&#8220;<span class=\"dictionary\">Local government employee<\/span>&#8221; means a public employee of a local government.\n\t\t\t&#8220;<span class=\"dictionary\">Person<\/span>&#8221; means an individual, proprietorship, firm, partnership, joint venture, joint stock company, syndicate, business trust, estate, company, corporation, association, club, committee, organization, or group of <span class=\"dictionary\">persons<\/span> acting in concert.\n\t\t\t&#8220;<span class=\"dictionary\">Procurement transaction<\/span>&#8221; means all functions that pertain to obtaining all goods, services, or construction on behalf of an <span class=\"dictionary\">executive agency<\/span>, including description of requirements, selection and solicitation of sources, preparation and award of <span class=\"dictionary\">contract<\/span>, and all phases of <span class=\"dictionary\">contract<\/span> administration where the stated or expected value of the <span class=\"dictionary\">contract<\/span> is $5 million or more.\n\t\t\t&#8220;<span class=\"dictionary\">Secretary<\/span>&#8221; means the <span class=\"dictionary\">Secretary<\/span> of the Commonwealth.\n\t\t\t&#8220;Value&#8221; means the actual cost or <span class=\"dictionary\">fair market value<\/span> of an item or items, whichever is greater. If the <span class=\"dictionary\">fair market value<\/span> cannot be determined, the actual amount paid for the item or items shall be given consideration.\n\t\t\t&#8220;<span class=\"dictionary\">Widely attended event<\/span>&#8221; means an event at which at least 25 <span class=\"dictionary\">persons<\/span> have been invited to attend or there is a reasonable expectation that at least 25 <span class=\"dictionary\">persons<\/span> will attend the event and the event is open to individuals (i) who are members of a public, civic, charitable, or professional organization, (ii) who are from a particular industry or profession, or (iii) who represent <span class=\"dictionary\">persons<\/span> interested in a particular <span class=\"dictionary\">issue<\/span>. <a id=\"paragraph-265876\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-419\/#4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nDEFINITIONS (\u00a7 2.2-419)\n\nAs used in this article, unless the context requires a different meaning:\n\t\t&#8220;Anything of value&#8221; means:\n\n1. A pecuniary item, including money, or a bank bill or note;\n\n2. A promissory note, bill of exchange, order, draft, warrant, check, or bond\ngiven for the payment of money;\n\n3. A contract, agreement, promise, or other obligation for an advance,\nconveyance, forgiveness of indebtedness, deposit, distribution, loan, payment,\ngift, pledge, or transfer of money;\n\n4. A stock, bond, note, or other investment interest in an entity;\n\n5. A receipt given for the payment of money or other property;\n\n6. A right in action;\n\n7. A gift, tangible good, chattel, or an interest in a gift, tangible good, or\nchattel;\n\n8. A loan or forgiveness of indebtedness;\n\n9. A work of art, antique, or collectible;\n\n10. An automobile or other means of personal transportation;\n\n11. Real property or an interest in real property, including title to realty, a\nfee simple or partial interest, present or future, contingent or vested within\nrealty, a leasehold interest, or other beneficial interest in realty;\n\n12. An honorarium or compensation for services;\n\n13. A rebate or discount in the price of anything of value unless the rebate or\ndiscount is made in the ordinary course of business to a member of the public\nwithout regard to that person&#8217;s status as an executive or legislative\nofficial, or the sale or trade of something for reasonable compensation that\nwould ordinarily not be available to a member of the public;\n\n14. A promise or offer of employment; or\n\n15. Any other thing of value that is pecuniary or compensatory in value to a\nperson.\n\t\t\t&#8220;Anything of value&#8221; does not mean a campaign contribution\nproperly received and reported pursuant to Chapter 9.3 (&#xA7; 24.2-945 et seq.)\nof Title 24.2.\n\t\t\t&#8220;Compensation&#8221; means:\n\n1. An advance, conveyance, forgiveness of indebtedness, deposit, distribution,\nloan, payment, gift, pledge, or transfer of money or anything of value; or\n\n2. A contract, agreement, promise or other obligation for an advance,\nconveyance, forgiveness of indebtedness, deposit, distribution, loan, payment,\ngift, pledge, or transfer of money or anything of value, for services rendered\nor to be rendered.\n\t\t\t&#8220;Compensation&#8221; does not mean reimbursement of expenses if the\nreimbursement does not exceed the amount actually expended for the expenses and\nit is substantiated by an itemization of expenses.\n\t\t\t&#8220;Council&#8221; means the Virginia Conflict of Interest and Ethics\nAdvisory Council established in &#xA7; 30-355.\n\t\t\t&#8220;Executive action&#8221; means the proposal, drafting, development,\nconsideration, amendment, adoption, approval, promulgation, issuance,\nmodification, rejection, or postponement by an executive agency or official of\nlegislation or executive orders issued by the Governor. &#8220;Executive\naction&#8221; includes procurement transactions.\n\t\t\t&#8220;Executive agency&#8221; means an agency, board, commission, or other\nbody in the executive branch of state government. &#8220;Executive agency&#8221;\nincludes the State Corporation Commission, the Virginia Workers&#8217;\nCompensation Commission, and the Virginia Lottery.\n\t\t\t&#8220;Executive official&#8221; means:\n\n1. The Governor;\n\n2. The Lieutenant Governor;\n\n3. The Attorney General;\n\n4. Any officer or employee of the office of the Governor, Lieutenant Governor,\nor Attorney General other than a clerical or secretarial employee;\n\n5. The Governor&#8217;s Secretaries, the Deputy Secretaries, and the chief\nexecutive officer of each executive agency; or\n\n6. Members of supervisory and policy boards, commissions and councils, as\ndefined in &#xA7; 2.2-2100, however selected.\n\t\t\t&#8220;Expenditure&#8221; means:\n\n1. A purchase, payment, distribution, loan, forgiveness of a loan or payment of\na loan by a third party, advance, deposit, transfer of funds, a promise to make\na payment, or a gift of money or anything of value for any purpose;\n\n2. A payment to a lobbyist for salary, fee, reimbursement for expenses, or other\npurpose by a person employing, retaining, or contracting for the services of the\nlobbyist separately or jointly with other persons;\n\n3. A payment in support of or assistance to a lobbyist or the lobbyist&#8217;s\nactivities, including the direct payment of expenses incurred at the request or\nsuggestion of the lobbyist;\n\n4. A payment that directly benefits an executive or legislative official or a\nmember of the official&#8217;s immediate family;\n\n5. A payment, including compensation, payment, or reimbursement for the\nservices, time, or expenses of an employee for or in connection with direct\ncommunication with an executive or legislative official;\n\n6. A payment for or in connection with soliciting or urging other persons to\nenter into direct communication with an executive or legislative official; or\n\n7. A payment or reimbursement for categories of expenditures required to be\nreported pursuant to this chapter.\n\t\t\t&#8220;Expenditure&#8221; does not mean a campaign contribution properly\nreceived and reported pursuant to Chapter 9.3 (&#xA7; 24.2-945 et seq.) of Title\n24.2.\n\t\t\t&#8220;Fair market value&#8221; means the price that a good or service would\nbring between a willing seller and a willing buyer in the open market after\nnegotiations. If the fair market value cannot be determined, the actual price\npaid for the good or service shall be given consideration.\n\t\t\t&#8220;Gift&#8221; means anything of value, including any gratuity, favor,\ndiscount, entertainment, hospitality, loan, forbearance, or other item having\nmonetary value, and includes services as well as gifts of transportation, local\ntravel, lodgings, and meals, whether provided in-kind or by purchase of a\nticket, payment in advance, or reimbursement after the expense has been\nincurred.\n\t\t\t&#8220;Gift&#8221; does not mean:\n\n1. Printed informational or promotional material;\n\n2. A gift that is not used and, no later than 60 days after receipt, is returned\nto the donor or delivered to a charitable organization and is not claimed as a\ncharitable contribution for federal income tax purposes;\n\n3. A devise or inheritance;\n\n4. A gift of a value of less than $20;\n\n5. Any offer of a ticket, coupon, or other admission or pass unless the ticket,\ncoupon, admission, or pass is used;\n\n6. Any food or beverages provided to an individual at an event at which the\nindividual is performing official duties related to his public service;\n\n7. Any food and beverages received at or registration or attendance fees waived\nfor any event at which the individual is a featured speaker, presenter, or\nlecturer;\n\n8. An unsolicited award of appreciation or recognition in the form of a plaque,\ntrophy, wall memento, or similar item that is given in recognition of public,\ncivic, charitable, or professional service;\n\n9. Any gift to an individual&#8217;s spouse, child, uncle, aunt, niece, nephew,\nor first cousin; a person to whom the donee is engaged to be married; the\ndonee&#8217;s or his spouse&#8217;s parent, grandparent, grandchild, brother,\nsister, step-parent, step-grandparent, step-grandchild, step-brother, or\nstep-sister; or the donee&#8217;s brother&#8217;s or sister&#8217;s spouse or\nthe donee&#8217;s son-in-law or daughter-in-law;\n\n10. Travel provided to facilitate attendance by a legislator at a regular or\nspecial session of the General Assembly, a meeting of a legislative committee or\ncommission, or a national conference where attendance is approved by the House\nCommittee on Rules or its Chairman or the Senate Committee on Rules or its\nChairman;\n\n11. Travel related to an official meeting of, or any meal provided for\nattendance at such meeting by, the Commonwealth, its political subdivisions, or\nany board, commission, authority, or other entity, or any charitable\norganization established pursuant to &#xA7; 501(c)(3) of the Internal Revenue\nCode affiliated with such entity, to which such person has been appointed or\nelected or is a member by virtue of his office or employment; or\n\n12. Attendance at a reception or similar function where food, such as hors\nd&#8217;oeuvres, and beverages that can be conveniently consumed by a person\nwhile standing or walking are offered.\n\t\t\t&#8220;Immediate family&#8221; means (i) the spouse and (ii) any other person\nwho resides in the same household as the executive or legislative official and\nwho is a dependent of the official.\n\t\t\t&#8220;Legislative action&#8221; means:\n\n1. Preparation, research, drafting, introduction, consideration, modification,\namendment, approval, passage, enactment, tabling, postponement, defeat, or\nrejection of a bill, resolution, amendment, motion, report, nomination,\nappointment, or other matter by the General Assembly or a legislative official;\n\n2. Action by the Governor in approving, vetoing, or recommending amendments for\na bill passed by the General Assembly; or\n\n3. Action by the General Assembly in overriding or sustaining a veto by the\nGovernor, considering amendments recommended by the Governor, or considering,\nconfirming, or rejecting an appointment of the Governor.\n\t\t\t&#8220;Legislative official&#8221; means:\n\n1. A member or member-elect of the General Assembly;\n\n2. A member of a committee, subcommittee, commission, or other entity\nestablished by and responsible to the General Assembly or either house of the\nGeneral Assembly; or\n\n3. Persons employed by the General Assembly or an entity established by and\nresponsible to the General Assembly.\n\t\t\t&#8220;Lobbying&#8221; means:\n\n1. Influencing or attempting to influence executive or legislative action\nthrough oral or written communication with an executive or legislative official;\nor\n\n2. Solicitation of others to influence an executive or legislative official.\n\t\t\t&#8220;Lobbying&#8221; does not mean:\n\n1.
