This subdivision shall not be construed to prohibit sole source or emergency procurements awarded pursuant to subsections E and F of &#xA7; 2.2-4303.\n\t\t\t\tSubdivision 2 shall not apply to (i) the installation of artificial turf and track surfaces, (ii) stream restoration, (iii) stormwater management practices, or (iv) the installation of playground equipment, including all associated and necessary construction and maintenance.\n\t\t\t\tIn instances where any authority, department, agency, or institution of the Commonwealth desires to purchase information technology and telecommunications goods and services from another public body&#8217;s contract and the procurement was conducted on behalf of other public bodies, such purchase shall be permitted if approved by the Chief Information Officer of the Commonwealth. Any public body that enters into a cooperative procurement agreement with a county, city, or town whose governing body has adopted alternative policies and procedures pursuant to subdivisions A 9 and A 10 of &#xA7; 2.2-4343 shall comply with the alternative policies and procedures adopted by the governing body of such county, city, or town.C\n\nSubject to the provisions of &#xA7;&#xA7; 2.2-1110, 2.2-1111, 2.2-1120 and 2.2-2012, any authority, department, agency, or institution of the Commonwealth may participate in, sponsor, conduct, or administer a joint procurement arrangement in conjunction with public bodies, private health or educational institutions or with public agencies or institutions of the several states, territories of the United States, or the District of Columbia, for the purpose of combining requirements to effect cost savings or reduce administrative expense in any acquisition of goods and services, other than professional services, and construction.\n\t\t\tA public body may purchase from any authority, department, agency or institution of the Commonwealth&#8217;s contract even if it did not participate in the request for proposal or invitation to bid, if the request for proposal or invitation to bid specified that the procurement was a cooperative procurement being conducted on behalf of other public bodies. In such instances, deviation from the procurement procedures set forth in this chapter and the administrative policies and procedures established to implement this chapter shall be permitted, if approved by the Director of the Division of Purchases and Supply.\n\t\t\tPursuant to &#xA7; 2.2-2012, such approval is not required if the procurement arrangement is for telecommunications and information technology goods and services of every description. In instances where the procurement arrangement is for telecommunications and information technology goods and services, such arrangement shall be permitted if approved by the Chief Information Officer of the Commonwealth. Association even if it did not participate in the request for proposal or invitation to bid, if the request for proposal or invitation to bid specified that the procurement was a cooperative procurement being conducted on behalf of other public bodies, except for: <a id=\"paragraph-220408\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4304\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> <span class=\"dictionary\">Contracts<\/span> for architectural or engineering <span class=\"dictionary\">services<\/span>; This subdivision shall not be construed to prohibit sole source or emergency procurements awarded pursuant to subsections E and F of &#xA7; <a class=\"law\" title=\"Methods of procurement\" href=\"\/2.2-4303\/\">2.2-4303<\/a>.\n\t\t\t\tSubdivision 2 shall not apply to (i) the installation of artificial turf and track surfaces, (ii) stream restoration, (iii) stormwater management practices, or (iv) the installation of playground equipment, including all associated and necessary <span class=\"dictionary\">construction<\/span> and maintenance.\n\t\t\t\tIn instances where any authority, department, agency, or institution of the Commonwealth desires to purchase information technology and telecommunications <span class=\"dictionary\">goods<\/span> and <span class=\"dictionary\">services<\/span> from another <span class=\"dictionary\">public body<\/span>&#8217;s <span class=\"dictionary\">contract<\/span> and the procurement was conducted on behalf of other public bodies, such purchase shall be permitted if approved by the Chief Information Officer of the Commonwealth. Any <span class=\"dictionary\">public body<\/span> that enters into a cooperative procurement agreement with a county, city, or town whose governing body has adopted alternative policies and procedures pursuant to subdivisions A 9 and A 10 of &#xA7; <a class=\"law\" title=\"Exemption from operation of chapter for certain transactions\" href=\"\/2.2-4343\/\">2.2-4343<\/a> shall comply with the alternative policies and procedures adopted by the governing body of such county, city, or town. <a id=\"paragraph-220410\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4304\/#B2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Subject to the provisions of &#xA7;&#xA7; <a class=\"law\" title=\"Using agencies to purchase through Division of Purchases and Supply; exception\" href=\"\/2.2-1110\/\">2.2-1110<\/a>, <a class=\"law\" title=\"Purchases to be made in accordance with the Virginia Public Procurement Act (\u00a7 2.2-4300 et seq.) and regulations of Division; exempt purchases\" href=\"\/2.2-1111\/\">2.2-1111<\/a>, <a class=\"law\" title=\"Direct purchases by using agencies and certain charitable corporations and private nonprofit institutions of higher education\" href=\"\/2.2-1120\/\">2.2-1120<\/a> and <a class=\"law\" title=\"Additional powers and duties related to the procurement of information technology\" href=\"\/2.2-2012\/\">2.2-2012<\/a>, any authority, department, agency, or institution of the Commonwealth may participate in, sponsor, conduct, or administer a joint procurement arrangement in conjunction with public bodies, private health or educational institutions or with public agencies or institutions of the several states, territories of the United States, or the District of Columbia, for the purpose of combining requirements to effect cost savings or reduce administrative expense in any acquisition of <span class=\"dictionary\">goods<\/span> and services, other than <span class=\"dictionary\">professional services<\/span>, and <span class=\"dictionary\">construction<\/span>.\n\t\t\tA <span class=\"dictionary\">public body<\/span> may purchase from any authority, department, agency or institution of the Commonwealth&#8217;s <span class=\"dictionary\">contract<\/span> even if it did not participate in the request for proposal or invitation to bid, if the request for proposal or invitation to bid specified that the procurement was a cooperative procurement being conducted on behalf of other public bodies. In such instances, deviation from the procurement procedures set forth in this chapter and the administrative policies and procedures established to implement this chapter shall be permitted, if approved by the Director of the Division of Purchases and Supply.\n\t\t\tPursuant to &#xA7; <a class=\"law\" title=\"Additional powers and duties related to the procurement of information technology\" href=\"\/2.2-2012\/\">2.2-2012<\/a>, such approval is not required if the procurement arrangement is for telecommunications and information technology <span class=\"dictionary\">goods<\/span> and services of every description. In instances where the procurement arrangement is for telecommunications and information technology <span class=\"dictionary\">goods<\/span> and services, such arrangement shall be permitted if approved by the Chief Information Officer of the Commonwealth. However, such acquisitions shall be procured competitively.\n\t\t\tNothing herein shall prohibit the payment by direct or indirect means of any administrative fee that will allow for participation in any such arrangement. <a id=\"paragraph-220411\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4304\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> As authorized by the United States Congress and consistent with applicable federal regulations, and provided the terms of the <span class=\"dictionary\">contract<\/span> permit such purchases: <a id=\"paragraph-220412\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4304\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Any authority, department, agency, or institution of the Commonwealth may purchase <span class=\"dictionary\">goods<\/span> and <span class=\"dictionary\">nonprofessional services<\/span>, other than telecommunications and information technology, from a U.S. General Services Administration <span class=\"dictionary\">contract<\/span> or a <span class=\"dictionary\">contract<\/span> awarded by any other agency of the U.S. government, upon approval of the director of the Division of Purchases and Supply of the Department of General Services; <a id=\"paragraph-220413\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4304\/#D1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Any authority, department, agency, or institution of the Commonwealth may purchase telecommunications and information technology <span class=\"dictionary\">goods<\/span> and <span class=\"dictionary\">nonprofessional services<\/span> from a U.S. General Services Administration <span class=\"dictionary\">contract<\/span> or a <span class=\"dictionary\">contract<\/span> awarded by any other agency of the U.S. government, upon approval of the Chief Information Officer of the Commonwealth; <a id=\"paragraph-220414\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4304\/#D2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Any county, city, town, or school board may purchase <span class=\"dictionary\">goods<\/span> and <span class=\"dictionary\">nonprofessional services<\/span> from a U.S. General Services Administration <span class=\"dictionary\">contract<\/span> or a <span class=\"dictionary\">contract<\/span> awarded by any other agency of the U.S. government; and <a id=\"paragraph-220415\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4304\/#D3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> The Department of General Services and the Virginia Information Technologies Agency shall review and revise their procurement procedures to encourage the use of U.S. General Services Administration <span class=\"dictionary\">contracts<\/span> or <span class=\"dictionary\">contracts<\/span> awarded by any other agency of the United States government where appropriate. <a id=\"paragraph-220416\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4304\/#D4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nJOINT AND COOPERATIVE PROCUREMENT (\u00a7 2.2-4304)\n\nA. In such instances, deviation\nfrom the procurement procedures set forth in this chapter and the administrative\npolicies and procedures established to implement this chapter shall be\npermitted, if approved by the Director of the Division of Purchases and Supply.\n\t\t\tPursuant to &#xA7; 2.2-2012, such approval is not required if the procurement\narrangement is for telecommunications and information technology goods and\nservices of every description. In instances where the procurement arrangement is\nfor telecommunications and information technology goods and services, such\narrangement shall be permitted if approved by the Chief Information Officer of\nthe Commonwealth. However, such acquisitions shall be procured competitively.\n\t\t\tNothing herein shall prohibit the payment by direct or indirect means of any\nadministrative fee that will allow for participation in any such arrangement.\n\nD. As authorized by the United States Congress and consistent with applicable\nfederal regulations, and provided the terms of the contract permit such\npurchases:\n\n   1. Any authority, department, agency, or institution of the Commonwealth may\n   purchase goods and nonprofessional services, other than telecommunications and\n   information technology, from a U.S. General Services Administration contract\n   or a contract awarded by any other agency of the U.S. government, upon\n   approval of the director of the Division of Purchases and Supply of the\n   Department of General Services;\n\n   2. Any authority, department, agency, or institution of the Commonwealth may\n   purchase telecommunications and information technology goods and\n   nonprofessional services from a U.S. General Services Administration contract\n   or a contract awarded by any other agency of the U.S. government, upon\n   approval of the Chief Information Officer of the Commonwealth;\n\n   3. Any county, city, town, or school board may purchase goods and\n   nonprofessional services from a U.S. General Services Administration contract\n   or a contract awarded by any other agency of the U.S. government; and\n\n   4.
