Such <span class=\"dictionary\">public contract<\/span> shall instead be deemed to provide for the application of the <span class=\"dictionary\">law<\/span> of the Commonwealth of Virginia, without regard to such contract&#8217;s choice of <span class=\"dictionary\">law<\/span> provisions, and to provide for <span class=\"dictionary\">jurisdiction<\/span> in the <span class=\"dictionary\">courts<\/span> of the Commonwealth. <a id=\"paragraph-253921\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4311.3\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> The provisions of this section shall only apply to a county, city, town, political subdivision, or public institution of higher education, or to a <span class=\"dictionary\">public body<\/span> listed as an independent agency in the appropriation act, if its governing body has adopted the provisions of this section as part of its procurement policies and procedures. <a id=\"paragraph-253922\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-4311.3\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nCOMPLIANCE WITH STATE LAW; CONTRACT TERMS INCONSISTENT WITH STATE LAW (\u00a7\n2.2-4311.3)\n\nA. As used in this section, &#8220;information technology goods and\nservices&#8221; means communications, telecommunications, automated data\nprocessing, applications, databases, data networks, management information\nsystems, and other related goods and services.\n\nB. No term or provision in any public contract for the acquisition of\ninformation technology goods or services shall be valid or enforceable to the\nextent that it is in conflict with Virginia law. A public contract containing\nsuch a term or provision shall otherwise remain enforceable.\n\nC. Any term or provision in such a public contract that (i) makes the public\ncontract subject to, governed by, or interpreted under the laws of another state\nor country or (ii) requires or permits any litigation or other dispute\nresolution proceeding arising from the public contract to be conducted in\nanother state or country shall be void.
