The Office exists to investigate and bring actions to combat discrimination based on the protected classes listed in subsection A.C\n\nThe powers and duties of the Office shall be to:1\n\nReceive, investigate, seek to conciliate, refer to another agency, hold hearings pursuant to the Virginia Administrative Process Act (&#xA7; 2.2-4000 et seq.), and make findings and recommendations upon complaints alleging unlawful discriminatory practices, including complaints alleging a pattern and practice of unlawful discriminatory practices, pursuant to the Virginia Human Rights Act (&#xA7; 2.2-3900 et seq.);2\n\nAdopt, promulgate, amend, and rescind regulations consistent with this article and the provisions of the Virginia Human Rights Act (&#xA7; 2.2-3900 et seq.) pursuant to the Virginia Administrative Process Act (&#xA7; 2.2-4000 et seq.). However, the Office shall not have the authority to adopt regulations on a substantive matter when another <span class=\"dictionary\">state agency<\/span> is authorized to adopt such regulations; <a id=\"paragraph-300147\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-520\/#C2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Inquire into incidents that may constitute unlawful acts of discrimination or unfounded charges of unlawful discrimination under state or federal <span class=\"dictionary\">law<\/span> and take such action within the Office&#8217;s authority designed to prevent such acts; <a id=\"paragraph-300148\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-520\/#C3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Seek through appropriate enforcement authorities, prevention of or relief from an alleged unlawful discriminatory practice; <a id=\"paragraph-300149\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-520\/#C4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Appoint and compensate qualified <span class=\"dictionary\">hearing<\/span> officers from the list of <span class=\"dictionary\">hearing<\/span> officers maintained by the Executive Secretary of the Supreme <span class=\"dictionary\">Court<\/span> of Virginia; <a id=\"paragraph-300150\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-520\/#C5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Promote creation of local commissions to aid in effectuating the policies of this article and to enter into cooperative worksharing or other agreements with federal agencies or local commissions, including the deferral of complaints of discrimination to federal agencies or local commissions; <a id=\"paragraph-300151\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-520\/#C6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Make studies and appoint advisory councils to effectuate the purposes and policies of the article and to make the results thereof available to the public; <a id=\"paragraph-300152\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-520\/#C7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> Accept public grants or private gifts, bequests, or other payments, as appropriate; <a id=\"paragraph-300153\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-520\/#C8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> Receive complaints, seek to conciliate, and inquire into incidents that may constitute an unlawful pattern or practice of conduct by <span class=\"dictionary\">law<\/span>-enforcement officers that deprives persons of rights, <span class=\"dictionary\">privileges<\/span>, or immunities secured or protected by the <span class=\"dictionary\">laws<\/span> of the United States and the Commonwealth and take such action within the Office&#8217;s authority, including requesting the <span class=\"dictionary\">Attorney General<\/span> to <span class=\"dictionary\">issue<\/span> a civil investigative demand pursuant to subsection D of &#xA7; <a class=\"law\" title=\"Public integrity; law-enforcement misconduct\" href=\"\/2.2-511.1\/\">2.2-511.1<\/a>, designed to prevent such conduct; and <a id=\"paragraph-300154\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-520\/#C9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> Furnish technical assistance upon request of persons subject to this article to further comply with the article or an <span class=\"dictionary\">order<\/span> issued thereunder. <a id=\"paragraph-300155\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/2.2-520\/#C10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nOFFICE OF CIVIL RIGHTS CREATED; DUTIES (\u00a7 2.2-520)\n\nA. It is the policy of the Commonwealth of Virginia to provide for equal\nopportunities throughout the Commonwealth to all its citizens, regardless of\nrace, color, religion, national origin, sex, pregnancy, childbirth or related\nmedical conditions, age, sexual orientation, gender identity, disability,\nfamilial status, marital status, or status as a veteran and, to that end, to\nprohibit discriminatory practices with respect to employment, places of public\naccommodation, including educational institutions, and real estate transactions\nby any person or group of persons, including state and local law-enforcement\nagencies, in order that the peace, health, safety, prosperity, and general\nwelfare of all the inhabitants of the Commonwealth be protected and ensured.\n\nB. To carry out this policy, there is created in the Department of Law an Office\nof Civil Rights (the Office) to assist in the prevention of and relief from\nalleged unlawful discriminatory practices. The Office exists to investigate and\nbring actions to combat discrimination based on the protected classes listed in\nsubsection A.\n\nC. The powers and duties of the Office shall be to:\n\n   1. Receive, investigate, seek to conciliate, refer to another agency, hold\n   hearings pursuant to the Virginia Administrative Process Act (&#xA7; 2.2-4000\n   et seq.), and make findings and recommendations upon complaints alleging\n   unlawful discriminatory practices, including complaints alleging a pattern and\n   practice of unlawful discriminatory practices, pursuant to the Virginia Human\n   Rights Act (&#xA7; 2.2-3900 et seq.);\n\n   2. Adopt, promulgate, amend, and rescind regulations consistent with this\n   article and the provisions of the Virginia Human Rights Act (&#xA7; 2.2-3900\n   et seq.) pursuant to the Virginia Administrative Process Act (&#xA7; 2.2-4000\n   et seq.).
