The term includes a competent authority under the Convention.\n\t\t\t&#8220;Home state&#8221; means the state or foreign country in which a child lived with a parent or a person acting as parent for at least six consecutive months immediately preceding the time of filing of a petition or comparable pleading for support and, if a child is less than six months old, the state or foreign country in which the child lived from birth with any of them. A period of temporary absence of any of them is counted as part of the six-month or other period.\n\t\t\t&#8220;Income&#8221; includes earnings or other periodic entitlements to money from any source and any other property subject to withholding for support under the law of the Commonwealth.\n\t\t\t&#8220;Income-withholding order&#8221; means an order or other legal process directed to an obligor&#8217;s employer or other debtor, to withhold support from the obligor&#8217;s income as defined in &#xA7; 63.2-1900.\n\t\t\t&#8220;Initiating tribunal&#8221; means the tribunal of a state or foreign country from which a petition or comparable pleading is forwarded or in which a petition or comparable pleading is filed for forwarding to another state or foreign country.\n\t\t\t&#8220;Issuing foreign country&#8221; means the foreign country in which a tribunal issues a support order or a judgment determining parentage of a child.\n\t\t\t&#8220;Issuing state&#8221; means the state in which a tribunal issues a support order or a judgment determining parentage of a child.\n\t\t\t&#8220;Issuing tribunal&#8221; means the tribunal of a state or foreign country that issues a support order or a judgment determining parentage of a child.\n\t\t\t&#8220;Law&#8221; includes decisional and statutory law and rules and regulations having the force of law.\n\t\t\t&#8220;Obligee&#8221; means (i) an individual to whom a duty of support is or is alleged to be owed or in whose favor a support order or a judgment determining parentage of a child has been issued, (ii) a foreign country, state, or political subdivision of a state to which the rights under a duty of support or support order have been assigned or which has independent claims based on financial assistance provided to an individual obligee in place of child support, (iii) an individual seeking a judgment determining parentage of the individual&#8217;s child, or (iv) a person that is a creditor in a proceeding under Article 13 (&#xA7; 20-88.83 et seq.).\n\t\t\t&#8220;Obligor&#8221; means an individual, or the estate of a decedent that (i) owes or is alleged to owe a duty of support, (ii) is alleged but has not been adjudicated to be a parent of a child, (iii) is liable under a support order, or (iv) is a debtor in a proceeding under Article 13 (&#xA7; 20-88.83 et seq.).\n\t\t\t&#8220;Outside the Commonwealth&#8221; means a location in another state, political subdivision of a state, or a country other than the United States, whether or not the country is a foreign country.\n\t\t\t&#8220;Person&#8221; means an individual, corporation, business trust, estate, trust, partnership, limited liability company, association, joint venture, public corporation, government or governmental subdivision, agency, or instrumentality, or any other legal or commercial entity.\n\t\t\t&#8220;Record&#8221; means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form.\n\t\t\t&#8220;Register&#8221; means to file in a tribunal of the Commonwealth a support order or judgment determining parentage of a child issued in another state or a foreign country.\n\t\t\t&#8220;Registering tribunal&#8221; means a tribunal in which a support order or judgment determining parentage of a child is registered.\n\t\t\t&#8220;Responding state&#8221; means a state or a foreign country in which a petition or comparable pleading for support or to determine parentage of a child is filed or to which a petition or comparable pleading is forwarded for filing from another state or a foreign country.\n\t\t\t&#8220;Responding tribunal&#8221; means the authorized tribunal in a responding state or foreign country.\n\t\t\t&#8220;Spousal-support order&#8221; means a support order for a spouse or former spouse of the obligor.\n\t\t\t&#8220;State&#8221; means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands or any territory or insular possession under the jurisdiction of the United States. means a support order of a <span class=\"dictionary\">foreign tribunal<\/span>.\n\t\t\t&#8220;<span class=\"dictionary\">Foreign tribunal<\/span>&#8221; means a <span class=\"dictionary\">court<\/span>, administrative agency, or quasi-judicial entity of a foreign country which is authorized to establish, enforce, or modify <span class=\"dictionary\">support orders<\/span> or to determine parentage of a child. The term includes a competent authority under the <span class=\"dictionary\">Convention<\/span>.\n\t\t\t&#8220;<span class=\"dictionary\">Home state<\/span>&#8221; means the state or foreign country in which a child lived with a parent or a <span class=\"dictionary\">person<\/span> acting as parent for at least six consecutive months immediately preceding the time of filing of a <span class=\"dictionary\">petition<\/span> or comparable pleading for support and, if a child is less than six months old, the state or foreign country in which the child lived from birth with any of them. A period of temporary absence of any of them is counted as part of the six-month or other period.\n\t\t\t&#8220;<span class=\"dictionary\">Income<\/span>&#8221; includes earnings or other periodic entitlements to money from any source and any other property subject to withholding for support under the <span class=\"dictionary\">law<\/span> of the Commonwealth.\n\t\t\t&#8220;<span class=\"dictionary\"><span class=\"dictionary\">Income<\/span>-withholding order<\/span>&#8221; means an order or other legal process directed to an <span class=\"dictionary\">obligor<\/span>&#8217;s <span class=\"dictionary\">employer<\/span> or other debtor, to withhold support from the <span class=\"dictionary\">obligor<\/span>&#8217;s <span class=\"dictionary\">income<\/span> as defined in &#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/63.2-1900\/\">63.2-1900<\/a>.\n\t\t\t&#8220;<span class=\"dictionary\">Initiating tribunal<\/span>&#8221; means the tribunal of a state or foreign country from which a <span class=\"dictionary\">petition<\/span> or comparable pleading is forwarded or in which a <span class=\"dictionary\">petition<\/span> or comparable pleading is filed for forwarding to another state or foreign country.\n\t\t\t&#8220;<span class=\"dictionary\">Issuing foreign country<\/span>&#8221; means the foreign country in which a tribunal <span class=\"dictionary\">issues<\/span> a support order or a <span class=\"dictionary\">judgment<\/span> determining parentage of a child.\n\t\t\t&#8220;<span class=\"dictionary\">Issuing state<\/span>&#8221; means the state in which a tribunal <span class=\"dictionary\">issues<\/span> a support order or a <span class=\"dictionary\">judgment<\/span> determining parentage of a child.\n\t\t\t&#8220;<span class=\"dictionary\">Issuing tribunal<\/span>&#8221; means the tribunal of a state or foreign country that <span class=\"dictionary\">issues<\/span> a support order or a <span class=\"dictionary\">judgment<\/span> determining parentage of a child.\n\t\t\t&#8220;<span class=\"dictionary\">Law<\/span>&#8221; includes decisional and statutory <span class=\"dictionary\">law<\/span> and rules and regulations having the force of <span class=\"dictionary\">law<\/span>.\n\t\t\t&#8220;<span class=\"dictionary\">Obligee<\/span>&#8221; means (i) an individual to whom a <span class=\"dictionary\">duty of support<\/span> is or is alleged to be owed or in whose favor a support order or a <span class=\"dictionary\">judgment<\/span> determining parentage of a child has been issued, (ii) a foreign country, state, or political subdivision of a state to which the rights under a <span class=\"dictionary\">duty of support<\/span> or support order have been assigned or which has independent claims based on financial assistance provided to an individual <span class=\"dictionary\">obligee<\/span> in place of child support, (iii) an individual seeking a <span class=\"dictionary\">judgment<\/span> determining parentage of the individual&#8217;s child, or (iv) a <span class=\"dictionary\">person<\/span> that is a <span class=\"dictionary\">creditor<\/span> in a proceeding under Article 13 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/20-88.83\/\">20-88.83<\/a> et seq.).\n\t\t\t&#8220;<span class=\"dictionary\">Obligor<\/span>&#8221; means an individual, or the estate of a decedent that (i) owes or is alleged to owe a <span class=\"dictionary\">duty of support<\/span>, (ii) is alleged but has not been adjudicated to be a parent of a child, (iii) is liable under a support order, or (iv) is a debtor in a proceeding under Article 13 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/20-88.83\/\">20-88.83<\/a> et seq.).\n\t\t\t&#8220;<span class=\"dictionary\">Outside the Commonwealth<\/span>&#8221; means a location in another state, political subdivision of a state, or a country other than the United <span class=\"dictionary\">States<\/span>, whether or not the country is a foreign country.\n\t\t\t&#8220;<span class=\"dictionary\">Person<\/span>&#8221; means an individual, corporation, business trust, estate, trust, partnership, limited liability company, association, joint venture, public corporation, government or governmental subdivision, agency, or instrumentality, or any other legal or commercial entity.\n\t\t\t&#8220;<span class=\"dictionary\">Record<\/span>&#8221; means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form.\n\t\t\t&#8220;<span class=\"dictionary\">Register<\/span>&#8221; means to file in a tribunal of the Commonwealth a support order or <span class=\"dictionary\">judgment<\/span> determining parentage of a child issued in another state or a foreign country.\n\t\t\t&#8220;<span class=\"dictionary\">Registering tribunal<\/span>&#8221; means a tribunal in which a support order or <span class=\"dictionary\">judgment<\/span> determining parentage of a child is registered.\n\t\t\t&#8220;<span class=\"dictionary\">Responding state<\/span>&#8221; means a state or a foreign country in which a <span class=\"dictionary\">petition<\/span> or comparable pleading for support or to determine parentage of a child is filed or to which a <span class=\"dictionary\">petition<\/span> or comparable pleading is forwarded for filing from another state or a foreign country.\n\t\t\t&#8220;<span class=\"dictionary\">Responding tribunal<\/span>&#8221; means the authorized tribunal in a <span class=\"dictionary\">responding state<\/span> or foreign country.\n\t\t\t&#8220;<span class=\"dictionary\">Spousal-support order<\/span>&#8221; means a support order for a spouse or former spouse of the <span class=\"dictionary\">obligor<\/span>.\n\t\t\t&#8220;State&#8221; means a state of the United <span class=\"dictionary\">States<\/span>, the District of Columbia, Puerto Rico, the United <span class=\"dictionary\">States<\/span> Virgin Islands or any territory or insular <span class=\"dictionary\">possession<\/span> under the <span class=\"dictionary\">jurisdiction<\/span> of the United <span class=\"dictionary\">States<\/span>. The term includes an Indian nation or tribe.\n\t\t\t&#8220;<span class=\"dictionary\">Support enforcement agency<\/span>&#8221; means a public official, governmental entity, or private agency authorized to (i) seek enforcement of <span class=\"dictionary\">support orders<\/span> or <span class=\"dictionary\">laws<\/span> relating to the <span class=\"dictionary\">duty of support<\/span>, (ii) seek establishment or modification of child support, (iii) request determination of parentage of a child, (iv) attempt to locate <span class=\"dictionary\">obligors<\/span> or their <span class=\"dictionary\">assets<\/span>, or (v) request determination of the controlling <span class=\"dictionary\">child support order<\/span>. A <span class=\"dictionary\">support enforcement agency<\/span> of the Commonwealth is not authorized to establish or enforce a support order for spousal support only.\n\t\t\t&#8220;Support order&#8221; means a <span class=\"dictionary\">judgment<\/span>, <span class=\"dictionary\">decree<\/span>, order, decision, or directive, whether temporary, final, or subject to modification, issued in a state or foreign country for the benefit of a child, a spouse, or a former spouse, which provides for monetary support, health care, arrearages, retroactive support, or reimbursement for financial assistance provided to an individual <span class=\"dictionary\">obligee<\/span> in place of child support. The term may include related costs and fees, interest, <span class=\"dictionary\">income<\/span> withholding, automatic adjustment, reasonable attorney&#8217;s fees, and other relief.\n\t\t\t&#8220;Tribunal&#8221; means a <span class=\"dictionary\">court<\/span>, administrative agency, or quasi-judicial entity authorized to establish, enforce, or modify <span class=\"dictionary\">support orders<\/span> or to determine parentage of a child; however, the <span class=\"dictionary\">support enforcement agency<\/span> of the Commonwealth has no authority to establish or enforce a support order for spousal support only. <a id=\"paragraph-307002\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/20-88.32\/#4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nDEFINITIONS (\u00a7 20-88.32)\n\nIn this chapter:\n\t\t&#8220;Child&#8221; means an individual, whether over or under the age of\nmajority, who is or is alleged to be owed a duty of support by the\nindividual&#8217;s parent or who is or is alleged to be the beneficiary of a\nsupport order directed to the parent.\n\t\t&#8220;Child support order&#8221; means a support order for a child, including\na child who has attained the age of majority under the law of the issuing state\nor foreign country.\n\t\t&#8220;Convention&#8221; means the Convention on the International Recovery of\nChild Support and Other Forms of Family Maintenance, concluded at The Hague on\nNovember 23, 2007.\n\t\t&#8220;Duty of support&#8221; means an obligation imposed or imposable by law\nto provide support for a child, spouse, or former spouse, including an\nunsatisfied obligation to provide support.\n\t\t&#8220;Employer&#8221; means the source of any income as defined in \u00a7\n63.2-1900.\n\t\t&#8220;Foreign country&#8221; means a country, including a political\nsubdivision thereof, other than the United States, that authorizes the issuance\nof support orders and:\n\n1. That has been declared under the law of the United States to be a foreign\nreciprocating country;\n\n2. That has established a reciprocal arrangement for child support with the\nCommonwealth as provided in &#xA7; 20-88.50;\n\n3. That has enacted a law or established procedures for the issuance and\nenforcement of support orders which are substantially similar to the procedures\nunder this chapter; or\n\n4. In which the Convention is in force with respect to the United States.\n\t\t\t&#8220;Foreign support order&#8221; means a support order of a foreign\ntribunal.\n\t\t\t&#8220;Foreign tribunal&#8221; means a court, administrative agency, or\nquasi-judicial entity of a foreign country which is authorized to establish,\nenforce, or modify support orders or to determine parentage of a child.
