means an item, question, or test that has not been made publicly available by the <span class=\"dictionary\">Department<\/span> of Education. <a id=\"paragraph-199448\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-19.1\/#A8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> Nothing in this section may be construed to prohibit or restrict the reasonable and necessary actions of the <span class=\"dictionary\">Board<\/span> of Education, <span class=\"dictionary\">Superintendent<\/span> of Public Instruction or the <span class=\"dictionary\">Department<\/span> of Education or their agents or employees engaged in test development or selection, test form construction, standard setting, test scoring, reporting test scores, or any other related activities which, in the <span class=\"dictionary\">judgment<\/span> of the <span class=\"dictionary\">Superintendent<\/span> of Public Instruction or <span class=\"dictionary\">Board<\/span> of Education, are necessary and appropriate. <a id=\"paragraph-199449\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-19.1\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Any <span class=\"dictionary\">person<\/span> who violates any provisions of this section may be assessed a civil <span class=\"dictionary\">penalty<\/span> not to exceed $1,000 for each violation. Furthermore, any <span class=\"dictionary\">person<\/span> whose administrative or teaching license has been suspended or revoked pursuant to &#xA7; <a class=\"law\" title=\"Violations related to secure mandatory tests\" href=\"\/22.1-292.1\/\">22.1-292.1<\/a> may be assessed a civil <span class=\"dictionary\">penalty<\/span> for the same violation under this section and the reasonable costs of any review or investigation of a violation of test security.\n\t\t\tAll civil penalties paid to the Commonwealth pursuant to this section shall be deposited into the Literary Fund. <a id=\"paragraph-199450\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-19.1\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> For the purpose of this section, &#8220;<span class=\"dictionary\">person<\/span>&#8221; shall not mean a student enrolled in a public school. <a id=\"paragraph-199451\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-19.1\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nACTION FOR VIOLATIONS RELATED TO SECURE MANDATORY TESTS (\u00a7 22.1-19.1)\n\nA. The Office of the Attorney General, on behalf of the Board of Education, may\nbring a cause of action in the circuit court having jurisdiction where the\nperson resides or where the act occurred for injunctive relief, civil penalty,\nor both, against any person who knowingly and willfully commits any of the\nfollowing acts related to secure mandatory tests required by the Board to be\nadministered to students:\n\n   1. Permitting unauthorized access to secure test questions prior to testing;\n\n   2. Copying or reproducing all or any portion of any secure test booklet;\n\n   3. Divulging the contents of any portion of a secure test;\n\n   4. Altering test materials or examinees&#8217; responses in any way;\n\n   5. Creating or making available answer keys to secure tests;\n\n   6. Making a false certification on the test security form established by the\n   Department of Education;\n\n   7. Excluding students from testing who are required to be assessed; or\n\n   8. Participating in, directing, aiding or abetting, or assisting in any of the\n   acts prohibited in this section.\n   \t\t\t\tFor the purpose of this subsection, &#8220;secure&#8221; means an item,\n   question, or test that has not been made publicly available by the Department\n   of Education.\n\nB. Nothing in this section may be construed to prohibit or restrict the\nreasonable and necessary actions of the Board of Education, Superintendent of\nPublic Instruction or the Department of Education or their agents or employees\nengaged in test development or selection, test form construction, standard\nsetting, test scoring, reporting test scores, or any other related activities\nwhich, in the judgment of the Superintendent of Public Instruction or Board of\nEducation, are necessary and appropriate.\n\nC. Any person who violates any provisions of this section may be assessed a\ncivil penalty not to exceed $1,000 for each violation. Furthermore, any person\nwhose administrative or teaching license has been suspended or revoked pursuant\nto &#xA7; 22.1-292.1 may be assessed a civil penalty for the same violation\nunder this section and the reasonable costs of any review or investigation of a\nviolation of test security.\n\t\t\tAll civil penalties paid to the Commonwealth pursuant to this section shall\nbe deposited into the Literary Fund.\n\nD.
