Such 90-day period may be extended by a period not to exceed 30 days by mutual agreement of the parties. Such performance expectations and measures shall include applicable federal and state accountability requirements and may be refined or amended by mutual agreement after the public charter school has collected baseline achievement data for its enrolled students.B\n\nThe academic and operational performance expectations and measures in the charter contract shall be based on a performance framework that clearly sets forth the academic and operational performance indicators, measures, and metrics that will guide the local school board&#8217;s evaluations of each public charter school. Within 10 days of executing a charter <span class=\"dictionary\">contract<\/span>, the local <span class=\"dictionary\">school board<\/span> shall submit to the Board written notification of the charter <span class=\"dictionary\">contract<\/span> execution, including a copy of the executed charter <span class=\"dictionary\">contract<\/span> and any <span class=\"dictionary\">attachments<\/span>. <a id=\"paragraph-269650\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-212.7\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> No public charter school shall commence operations without a charter <span class=\"dictionary\">contract<\/span> executed in accordance with this section and approved in an open meeting of the local <span class=\"dictionary\">school board<\/span>. <a id=\"paragraph-269651\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-212.7\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"H\"><p><span class=\"prefix-number\">H.<\/span> If the charter application proposes a program to increase the educational opportunities for at-risk students, including those proposals for residential charter schools for at-risk students, the local <span class=\"dictionary\">school board<\/span> or relevant <span class=\"dictionary\">school boards<\/span>, as the case may be, on behalf of the public charter school, shall also request that the Board approve an Individual School Accreditation Plan for the evaluation of the performance of the school as authorized by the Standards of Accreditation pursuant to 8VAC20-131-280 C of the Virginia Administrative Code. <a id=\"paragraph-269652\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-212.7\/#H\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I\"><p><span class=\"prefix-number\">I.<\/span> Any <span class=\"dictionary\">material<\/span> revision of the terms of the <span class=\"dictionary\">contract<\/span> may be made only with the approval of the local <span class=\"dictionary\">school board<\/span> or relevant <span class=\"dictionary\">school boards<\/span> and the management committee of the public charter school. <a id=\"paragraph-269653\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-212.7\/#I\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nCONTRACTS FOR PUBLIC CHARTER SCHOOLS (\u00a7 22.1-212.7)\n\nA. Within 90 days of approval of a charter application, the local school board\nand the management committee of the approved public charter school shall execute\na charter contract that clearly sets forth (i) the academic and operational\nperformance expectations and measures by which the public charter school will be\njudged and (ii) the administrative relationship between the local school board\nand public charter school, including each party&#8217;s rights and duties. Such\n90-day period may be extended by a period not to exceed 30 days by mutual\nagreement of the parties. Such performance expectations and measures shall\ninclude applicable federal and state accountability requirements and may be\nrefined or amended by mutual agreement after the public charter school has\ncollected baseline achievement data for its enrolled students.\n\nB. The academic and operational performance expectations and measures in the\ncharter contract shall be based on a performance framework that clearly sets\nforth the academic and operational performance indicators, measures, and metrics\nthat will guide the local school board&#8217;s evaluations of each public\ncharter school. The performance framework shall include indicators, measures,\nand metrics for:\n\n   1. Student academic proficiency;\n\n   2. Student academic growth;\n\n   3. Achievement gaps in both proficiency and growth between the major student\n   subgroups based on gender, race, poverty status, special education status,\n   English language learner status, and gifted status;\n\n   4. Attendance;\n\n   5. Recurrent annual enrollment;\n\n   6. Postsecondary education readiness of high school students;\n\n   7. Financial performance and sustainability; and\n\n   8. The performance and stewardship of the management committee, including\n   compliance with all applicable laws, regulations, and terms of the charter\n   contract.\n\nC. The performance framework shall allow the inclusion of additional rigorous,\nvalid, and reliable indicators proposed by a public charter school to augment\nexternal evaluations of its performance, provided that the local school board\napproves the quality and rigor of such indicators and such indicators are\nconsistent with the purposes of this article.\n\nD. The performance framework shall require the disaggregation of all student\nperformance data by major student subgroups based on gender, race, poverty\nstatus, special education status, English language learner status, and gifted\nstatus.\n\nE. Annual performance targets shall be set by each public charter school and the\nlocal school board and shall be designed to help each school meet applicable\nfederal, state, and local school board expectations.\n\nF. The charter contract shall be signed by the chairman of the local school\nboard and the president or chairman of the public charter school&#8217;s\nmanagement committee.
