The parental notification shall include information that is available at the time on (a) the name or any identifiable features of the controlled substance and (b) whether the confirmed or suspected overdose occurred on school premises during regular school hours or during school-sanctioned activities whether on or off school premises. The school principal or his designee shall use methods of communication for such parental notifications that are considered regular forms of communication for other schoolwide notifications. Within 24 hours after any parental notification made pursuant to this subsection, each school principal or his designee shall also provide a similar notification to the Department.C\n\nEach school principal or his designee shall issue an updated notification to the parent of each student in the relevant elementary or secondary school to correct any inaccuracy subsequently discovered after the initial notification made pursuant to subsection B.D\n\nEach principal, headmaster, or other chief administrator of each private elementary or secondary school in the Commonwealth or his designee shall notify the parent of each student enrolled in such school within 24 hours of the earlier of (i) law enforcement or medical personnel confirming a school-connected student overdose or (ii) the principal, headmaster, or other chief administrator having knowledge of a suspected school-connected student overdose. The guidelines shall include (i) a model action plan for each school board and private elementary or secondary school to follow in responding to any school-connected student overdose, including, if applicable, communicating and coordinating with (a) the Department and (b) the applicable law-enforcement liaison or the local law-enforcement agency that, pursuant to &#xA7; 22.1-280.2:3, employs such school division&#8217;s school resource officers; (ii) criteria for issuing parental notifications pursuant to subsections B through E to ensure sensitivity to the privacy interests of affected individuals and compliance with any applicable law, rules, or regulations relating to the disclosure and protection of a minor&#8217;s personal, confidential, or otherwise sensitive information, including the federal Family Educational Rights and Privacy Act (20 U.S.C. &#xA7; 1232g) (FERPA) and related regulations; and (iii) guidance on (a) issuing parental notifications pursuant to subsections B through E in scenarios under which the facts or circumstances are unclear and (b) the division superintendent issuing divisionwide parental notifications of school-connected student overdoses when such notifications may be warranted, including a series of overdoses involving multiple students over a short period of time.G\n\nEach school board shall adopt, implement, and maintain policies consistent with subsections B and C and the guidelines developed by the Board pursuant to subsection F. That modification is as follows: in 2025, chapters <a href=\"https:\/\/legacylis.virginia.gov\/cgi-bin\/legp604.exe?251+ful+CHAP0576\">576<\/a> and <a href=\"https:\/\/legacylis.virginia.gov\/cgi-bin\/legp604.exe?251+ful+CHAP0583\">583<\/a>.<\/p>","references":false,"refers_to":[{"id":78459,"section_number":"22.1-280.2:3","catch_line":"School boards; safety and security personnel","order_by":null,"url":"\/22.1-280.2_3\/"}],"permalink":{"id":182279,"object_type":"law","relational_id":64351,"identifier":"22.1-272.1:1","token":"22.1\/14\/2\/22.1-272.1_1","url":"\/22.1-272.1_1\/","edition_id":1,"permalink":0,"preferred":1},"url":"\/22.1-272.1_1\/","token":"22.1\/14\/2\/22.1-272.1_1","dublin_core":{"Title":"School-connected student overdose policies; parental notification; guidelines","Type":"Text","Format":"text\/html","Identifier":"\u00a7 22.1-272.1:1","Relation":"Code of Virginia"},"html":"\n\t\t\t\t\t\t<section id=\"A\"><p><span class=\"prefix-number\">A.<\/span> As used in this section:\n\t\t\t&#8220;Overdose&#8221; means a life-threatening condition resulting from the consumption or use of a controlled substance.\n\t\t\t&#8220;<span class=\"dictionary\">School-connected student overdose<\/span>&#8221; means any overdose of a student enrolled in a public or private <span class=\"dictionary\">elementary<\/span> or secondary school in the Commonwealth that occurs (i) on the premises of such school during regular school hours or (ii) during school-sanctioned activities whether on or off the premises of such school.\n\t\t\t&#8220;<span class=\"dictionary\">Suspected <span class=\"dictionary\">school-connected student overdose<\/span><\/span>&#8221; means a <span class=\"dictionary\">school-connected student overdose<\/span> that is believed to have occurred and for which the response is the administration of naloxone, another opioid antagonist, or another similar medication with the <span class=\"dictionary\">intent<\/span> to counter or temporarily <span class=\"dictionary\">reverse<\/span> the effects of such overdose. <a id=\"paragraph-234189\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-272.1_1\/#A\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> Each school principal or his designee shall notify the <span class=\"dictionary\">parent<\/span> of each student enrolled in the relevant public <span class=\"dictionary\">elementary<\/span> or secondary school within 24 hours of the earlier of (i) <span class=\"dictionary\">law<\/span> enforcement or medical personnel confirming a <span class=\"dictionary\">school-connected student overdose<\/span> or (ii) the school principal having knowledge of a <span class=\"dictionary\">suspected <span class=\"dictionary\">school-connected student overdose<\/span><\/span>. The parental notification shall include information that is available at the time on (a) the name or any identifiable features of the controlled substance and (b) whether the confirmed or suspected overdose occurred on school premises during regular school hours or during school-sanctioned activities whether on or off school premises. The school principal or his designee shall use methods of communication for such parental notifications that are considered regular forms of communication for other schoolwide notifications. Within 24 hours after any parental notification made pursuant to this subsection, each school principal or his designee shall also provide a similar notification to the <span class=\"dictionary\">Department<\/span>. <a id=\"paragraph-234190\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-272.1_1\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Each school principal or his designee shall <span class=\"dictionary\">issue<\/span> an updated notification to the <span class=\"dictionary\">parent<\/span> of each student in the relevant <span class=\"dictionary\">elementary<\/span> or secondary school to correct any inaccuracy subsequently discovered after the initial notification made pursuant to subsection B. <a id=\"paragraph-234191\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-272.1_1\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Each principal, headmaster, or other chief administrator of each private <span class=\"dictionary\">elementary<\/span> or secondary school in the Commonwealth or his designee shall notify the <span class=\"dictionary\">parent<\/span> of each student enrolled in such school within 24 hours of the earlier of (i) <span class=\"dictionary\">law<\/span> enforcement or medical personnel confirming a <span class=\"dictionary\">school-connected student overdose<\/span> or (ii) the principal, headmaster, or other chief administrator having knowledge of a <span class=\"dictionary\">suspected <span class=\"dictionary\">school-connected student overdose<\/span><\/span>. Within 24 hours after any parental notification made pursuant to this subsection, each principal, headmaster, or other chief administrator or his designee shall also provide a similar notification to the Virginia Council for Private Education. <a id=\"paragraph-234192\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-272.1_1\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> Each principal, headmaster, or other chief administrator or his designee shall <span class=\"dictionary\">issue<\/span> an updated notification to the <span class=\"dictionary\">parent<\/span> of each student enrolled in such school to correct any inaccuracy subsequently discovered after the initial notification made pursuant to subsection D. <a id=\"paragraph-234193\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-272.1_1\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> The Board shall establish and maintain guidelines for <span class=\"dictionary\">school-connected student overdose<\/span> response and parental notification policies to aid local <span class=\"dictionary\">school boards<\/span> and private <span class=\"dictionary\">elementary<\/span> or secondary schools in the implementation of such policies. The guidelines shall include (i) a model action plan for each <span class=\"dictionary\">school board<\/span> and private <span class=\"dictionary\">elementary<\/span> or secondary school to follow in responding to any <span class=\"dictionary\">school-connected student overdose<\/span>, including, if applicable, communicating and coordinating with (a) the <span class=\"dictionary\">Department<\/span> and (b) the applicable <span class=\"dictionary\">law<\/span>-enforcement liaison or the local <span class=\"dictionary\">law<\/span>-enforcement agency that, pursuant to &#xA7; <a class=\"law\" title=\"School boards; safety and security personnel\" href=\"\/22.1-280.2_3\/\">22.1-280.2:3<\/a>, employs such school division&#8217;s school resource officers; (ii) criteria for issuing parental notifications pursuant to subsections B through E to ensure sensitivity to the privacy interests of affected individuals and compliance with any applicable <span class=\"dictionary\">law<\/span>, rules, or regulations relating to the disclosure and protection of a <span class=\"dictionary\">minor<\/span>&#8217;s personal, confidential, or otherwise sensitive information, including the federal Family Educational Rights and Privacy Act (20 U.S.C. &#xA7; 1232g) (FERPA) and related regulations; and (iii) guidance on (a) issuing parental notifications pursuant to subsections B through E in scenarios under which the <span class=\"dictionary\">facts<\/span> or circumstances are unclear and (b) the <span class=\"dictionary\">division superintendent<\/span> issuing divisionwide parental notifications of <span class=\"dictionary\">school-connected student overdoses<\/span> when such notifications may be warranted, including a series of overdoses involving multiple students over a short period of time. <a id=\"paragraph-234194\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-272.1_1\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> Each <span class=\"dictionary\">school board<\/span> shall adopt, implement, and maintain policies consistent with subsections B and C and the guidelines developed by the Board pursuant to subsection F. Each private <span class=\"dictionary\">elementary<\/span> or secondary school shall adopt, implement, and maintain policies consistent with subsections D and E and the guidelines developed by the Board pursuant to subsection F. <a id=\"paragraph-234195\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-272.1_1\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"H\"><p><span class=\"prefix-number\">H.<\/span> Notwithstanding any other provision of this section, each local <span class=\"dictionary\">school board<\/span>, <span class=\"dictionary\">division superintendent<\/span>, and public or private <span class=\"dictionary\">elementary<\/span> or secondary school administrator or other employee shall take reasonable steps to protect the privacy and dignity of individuals involved in any confirmed or <span class=\"dictionary\">suspected <span class=\"dictionary\">school-connected student overdose<\/span><\/span>. <a id=\"paragraph-234196\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-272.1_1\/#H\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nSCHOOL-CONNECTED STUDENT OVERDOSE POLICIES; PARENTAL NOTIFICATION; GUIDELINES\n(\u00a7 22.1-272.1:1)\n\nA. The parental notification\nshall include information that is available at the time on (a) the name or any\nidentifiable features of the controlled substance and (b) whether the confirmed\nor suspected overdose occurred on school premises during regular school hours or\nduring school-sanctioned activities whether on or off school premises. The\nschool principal or his designee shall use methods of communication for such\nparental notifications that are considered regular forms of communication for\nother schoolwide notifications. Within 24 hours after any parental notification\nmade pursuant to this subsection, each school principal or his designee shall\nalso provide a similar notification to the Department.\n\nC. Each school principal or his designee shall issue an updated notification to\nthe parent of each student in the relevant elementary or secondary school to\ncorrect any inaccuracy subsequently discovered after the initial notification\nmade pursuant to subsection B.\n\nD. Each principal, headmaster, or other chief administrator of each private\nelementary or secondary school in the Commonwealth or his designee shall notify\nthe parent of each student enrolled in such school within 24 hours of the\nearlier of (i) law enforcement or medical personnel confirming a\nschool-connected student overdose or (ii) the principal, headmaster, or other\nchief administrator having knowledge of a suspected school-connected student\noverdose. The parental notification shall include information that is available\nat the time on (a) the name or any identifiable features of the controlled\nsubstance and (b) whether the confirmed or suspected overdose occurred on school\npremises during regular school hours or during school-sanctioned activities\nwhether on or off school premises. The principal, headmaster, or other chief\nadministrator or his designee shall use methods of communication for such\nparental notifications that are considered regular forms of communication for\nother schoolwide notifications. Within 24 hours after any parental notification\nmade pursuant to this subsection, each principal, headmaster, or other chief\nadministrator or his designee shall also provide a similar notification to the\nVirginia Council for Private Education.\n\nE. Each principal, headmaster, or other chief administrator or his designee\nshall issue an updated notification to the parent of each student enrolled in\nsuch school to correct any inaccuracy subsequently discovered after the initial\nnotification made pursuant to subsection D.\n\nF.
