An applicant for voluntary registration shall file with the Superintendent, prior to beginning any such operation and thereafter biennially, an application which shall include, but not be limited to, the following:1\n\nThe name, address, phone number, and social security number of the person maintaining the family day home;2\n\nThe number and ages of the children to receive care;3\n\nA sworn statement or affirmation in which the applicant attests to the accuracy of the information submitted to the Superintendent; and4\n\nDocumentation that the background check requirements for registered family day homes in Article 5 (&#xA7; 22.1-289.034 et seq.) have been met.B\n\nThe Board shall adopt regulations for voluntarily registered family day homes that include, but are not limited to:1\n\nThe criteria and process for the approval of the certificate of registration;2\n\nRequirements for a self-administered health and safety guidelines evaluation checklist;3\n\nA schedule for fees to be paid by the providers to the contract organization or to the Department if it implements the provisions of this section for processing applications for the voluntary registration of family day homes. The charges collected shall be maintained for the purpose of recovering administrative costs incurred in processing applications and certifying such homes as eligible or registered;4\n\nThe criteria and process for the renewal of the certificate of registration; and5\n\nThe requirement that upon receipt of a complaint concerning a registered family day home, the Superintendent shall cause an investigation to be made, including on-site visits as he deems necessary, of the activities, services, and facilities. The person who maintains such home shall afford the Superintendent reasonable opportunity to inspect the operator&#8217;s facilities and records and to interview any employees and any child or other person within his custody or control. Whenever a registered family day home is determined by the Superintendent to be in noncompliance with the regulations for voluntarily registered family day homes, the Superintendent shall give reasonable notice to the operator of the nature of the noncompliance and may thereafter revoke or suspend the registration.C\n\nUpon receiving the application on forms prescribed by the Superintendent, and after having determined that the home has satisfied the requirements of the regulations for voluntarily registered family day homes, the Superintendent shall issue a certificate of registration to the family day home.D\n\nThe Superintendent shall contract in accordance with the requirements of the Virginia Public Procurement Act (&#xA7; 2.2-4300 et seq.) with qualified local agencies and community organizations to review applications and certify family day homes as eligible for registration, pursuant to the regulations for voluntarily registered family day homes. If no qualified local agencies or community organizations are available, the Superintendent shall implement the provisions of this section. For the purposes of this subsection, &#8220;qualified&#8221; means demonstrated ability to provide sound financial management and administrative services including application processing, maintenance of records and reports, technical assistance, consultation, training, monitoring, and random inspections.E\n\nThe scope of services in contracts shall include:1\n\nThe identification of family day homes which may meet the standards for voluntary registration provided in subsection A; and2\n\nA requirement that the contract organization shall provide administrative services, including, but not limited to, processing applications for the voluntary registration of family day homes; certifying such homes as eligible for registration; providing technical assistance, training and consultation with family day homes; ensuring providers&#8217; compliance with the regulations for voluntarily registered family day homes, including monitoring and random inspections; and maintaining permanent records regarding all family day homes which it may certify as eligible for registration.F\n\nThe contract organization, upon determining that a family day home has satisfied the requirements of the regulations for voluntarily registered family day homes, shall certify the home as eligible for registration on forms prescribed by the Superintendent. The charges collected shall be maintained for the purpose of recovering administrative costs incurred in processing applications and certifying such homes as eligible or registered; <a id=\"paragraph-308055\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.015\/#B3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> The criteria and process for the renewal of the certificate of registration; and <a id=\"paragraph-308056\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.015\/#B4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> The requirement that upon receipt of a complaint concerning a <span class=\"dictionary\">registered <span class=\"dictionary\">family day home<\/span><\/span>, the <span class=\"dictionary\">Superintendent<\/span> shall cause an investigation to be made, including on-site visits as he deems necessary, of the activities, services, and facilities. The person who maintains such home shall afford the <span class=\"dictionary\">Superintendent<\/span> reasonable opportunity to inspect the operator&#8217;s facilities and records and to interview any employees and any child or other person within his <span class=\"dictionary\">custody<\/span> or control. Whenever a <span class=\"dictionary\">registered <span class=\"dictionary\">family day home<\/span><\/span> is determined by the <span class=\"dictionary\">Superintendent<\/span> to be in noncompliance with the regulations for voluntarily <span class=\"dictionary\">registered <span class=\"dictionary\">family day homes<\/span><\/span>, the <span class=\"dictionary\">Superintendent<\/span> shall give reasonable notice to the operator of the nature of the noncompliance and may thereafter revoke or suspend the registration. <a id=\"paragraph-308057\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.015\/#B5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Upon receiving the application on forms prescribed by the <span class=\"dictionary\">Superintendent<\/span>, and after having determined that the home has satisfied the requirements of the regulations for voluntarily <span class=\"dictionary\">registered <span class=\"dictionary\">family day homes<\/span><\/span>, the <span class=\"dictionary\">Superintendent<\/span> shall <span class=\"dictionary\">issue<\/span> a certificate of registration to the <span class=\"dictionary\">family day home<\/span>. <a id=\"paragraph-308058\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.015\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> The <span class=\"dictionary\">Superintendent<\/span> shall <span class=\"dictionary\">contract<\/span> in accordance with the requirements of the Virginia Public Procurement Act (&#xA7; <a class=\"law\" title=\"Short title; purpose; declaration of intent\" href=\"\/2.2-4300\/\">2.2-4300<\/a> et seq.) with <span class=\"dictionary\">qualified<\/span> local agencies and community organizations to review applications and certify <span class=\"dictionary\">family day homes<\/span> as eligible for registration, pursuant to the regulations for voluntarily <span class=\"dictionary\">registered <span class=\"dictionary\">family day homes<\/span><\/span>. If no <span class=\"dictionary\">qualified<\/span> local agencies or community organizations are available, the <span class=\"dictionary\">Superintendent<\/span> shall implement the provisions of this section. For the purposes of this subsection, &#8220;<span class=\"dictionary\">qualified<\/span>&#8221; means demonstrated ability to provide sound financial management and administrative services including application processing, maintenance of records and reports, technical assistance, consultation, training, monitoring, and random inspections. <a id=\"paragraph-308059\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.015\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> The scope of services in <span class=\"dictionary\">contracts<\/span> shall include: <a id=\"paragraph-308060\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.015\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> The identification of <span class=\"dictionary\">family day homes<\/span> which may meet the standards for voluntary registration provided in subsection A; and <a id=\"paragraph-308061\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.015\/#E1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> A requirement that the <span class=\"dictionary\">contract<\/span> organization shall provide administrative services, including, but not limited to, processing applications for the voluntary registration of <span class=\"dictionary\">family day homes<\/span>; certifying such homes as eligible for registration; providing technical assistance, training and consultation with <span class=\"dictionary\">family day homes<\/span>; ensuring providers&#8217; compliance with the regulations for voluntarily <span class=\"dictionary\">registered <span class=\"dictionary\">family day homes<\/span><\/span>, including monitoring and random inspections; and maintaining permanent records regarding all <span class=\"dictionary\">family day homes<\/span> which it may certify as eligible for registration. <a id=\"paragraph-308062\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.015\/#E2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> The <span class=\"dictionary\">contract<\/span> organization, upon determining that a <span class=\"dictionary\">family day home<\/span> has satisfied the requirements of the regulations for voluntarily <span class=\"dictionary\">registered <span class=\"dictionary\">family day homes<\/span><\/span>, shall certify the home as eligible for registration on forms prescribed by the <span class=\"dictionary\">Superintendent<\/span>. The <span class=\"dictionary\">Superintendent<\/span>, upon determining that certification has been properly issued, may register the <span class=\"dictionary\">family day home<\/span>. <a id=\"paragraph-308063\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.015\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> The provisions of this section shall not apply to any <span class=\"dictionary\">family day home<\/span> located in a county, city, or town in which the <span class=\"dictionary\">governing body<\/span> provides by <span class=\"dictionary\">ordinance<\/span> for the regulation and licensing of persons who provide child-care services for compensation and for the regulation and licensing of child-care facilities pursuant to the provisions of &#xA7; <a class=\"law\" title=\"Regulation of child-care services and facilities in cities and certain counties\" href=\"\/15.2-914\/\">15.2-914<\/a>. <a id=\"paragraph-308064\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.015\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nVOLUNTARY REGISTRATION OF FAMILY DAY HOMES; INSPECTIONS; INVESTIGATION UPON\nRECEIPT OF COMPLAINT; REVOCATION OR SUSPENSION OF REGISTRATION (\u00a7 22.1-289.015)\n\nA. Any person who maintains a family day home serving fewer than five children,\nexclusive of the provider&#8217;s own children and any children who reside in\nthe home, may apply for voluntary registration. An applicant for voluntary\nregistration shall file with the Superintendent, prior to beginning any such\noperation and thereafter biennially, an application which shall include, but not\nbe limited to, the following:\n\n   1. The name, address, phone number, and social security number of the person\n   maintaining the family day home;\n\n   2. The number and ages of the children to receive care;\n\n   3. A sworn statement or affirmation in which the applicant attests to the\n   accuracy of the information submitted to the Superintendent; and\n\n   4. Documentation that the background check requirements for registered family\n   day homes in Article 5 (&#xA7; 22.1-289.034 et seq.) have been met.\n\nB. The Board shall adopt regulations for voluntarily registered family day homes\nthat include, but are not limited to:\n\n   1. The criteria and process for the approval of the certificate of\n   registration;\n\n   2. Requirements for a self-administered health and safety guidelines\n   evaluation checklist;\n\n   3. A schedule for fees to be paid by the providers to the contract\n   organization or to the Department if it implements the provisions of this\n   section for processing applications for the voluntary registration of family\n   day homes. Whenever a registered family day home is\n   determined by the Superintendent to be in noncompliance with the regulations\n   for voluntarily registered family day homes, the Superintendent shall give\n   reasonable notice to the operator of the nature of the noncompliance and may\n   thereafter revoke or suspend the registration.\n\nC. Upon receiving the application on forms prescribed by the Superintendent, and\nafter having determined that the home has satisfied the requirements of the\nregulations for voluntarily registered family day homes, the Superintendent\nshall issue a certificate of registration to the family day home.\n\nD. The Superintendent shall contract in accordance with the requirements of the\nVirginia Public Procurement Act (&#xA7; 2.2-4300 et seq.) with qualified local\nagencies and community organizations to review applications and certify family\nday homes as eligible for registration, pursuant to the regulations for\nvoluntarily registered family day homes. If no qualified local agencies or\ncommunity organizations are available, the Superintendent shall implement the\nprovisions of this section. For the purposes of this subsection,\n&#8220;qualified&#8221; means demonstrated ability to provide sound financial\nmanagement and administrative services including application processing,\nmaintenance of records and reports, technical assistance, consultation,\ntraining, monitoring, and random inspections.\n\nE. The scope of services in contracts shall include:\n\n   1. The identification of family day homes which may meet the standards for\n   voluntary registration provided in subsection A; and\n\n   2. A requirement that the contract organization shall provide administrative\n   services, including, but not limited to, processing applications for the\n   voluntary registration of family day homes; certifying such homes as eligible\n   for registration; providing technical assistance, training and consultation\n   with family day homes; ensuring providers&#8217; compliance with the\n   regulations for voluntarily registered family day homes, including monitoring\n   and random inspections; and maintaining permanent records regarding all family\n   day homes which it may certify as eligible for registration.\n\nF. The contract organization, upon determining that a family day home has\nsatisfied the requirements of the regulations for voluntarily registered family\nday homes, shall certify the home as eligible for registration on forms\nprescribed by the Superintendent. The Superintendent, upon determining that\ncertification has been properly issued, may register the family day home.\n\nG.
