This exemption does not apply if children merely change their enrollment to a different focus area at a site offering a variety of activities and such children&#8217;s attendance exceeds 25 days in a three-month period.2\n\nPrograms of instructional or recreational activities wherein no child under age five attends for more than six hours weekly with no class or activity period to exceed one and one-half hours, and no child five years of age or above attends for more than six hours weekly when school is in session or 12 hours weekly when school is not in session. Competition, performances, and exhibitions related to the instructional or recreational activity shall be excluded when determining the hours of program operation.3\n\nInstructional programs offered by private schools that serve school-age children and that satisfy compulsory attendance laws or provide services under the Individuals with Disabilities Education Act, as amended, and programs of school-sponsored extracurricular activities that are focused on single interests such as, but not limited to, music, sports, drama, civic service, or foreign language.4\n\nInstructional programs offered by public schools that serve preschool-age children, satisfy compulsory attendance laws, or provide services under the Individuals with Disabilities Education Act (20 U.S.C. &#xA7; 1400 et seq.), as amended, and programs of school-sponsored extracurricular activities that are focused on single interests such as, but not limited to, music, sports, drama, civic service, or foreign language.5\n\nEarly intervention programs for children eligible under Part C of the Individuals with Disabilities Education Act (20 U.S.C. &#xA7; 1431 et seq.), as amended, wherein no child attends for more than a total of six hours per week.6\n\nPractice or competition in organized competitive sports leagues.7\n\nPrograms of religious instruction, such as Sunday schools, vacation Bible schools, Bar Mitzvah or Bat Mitzvah classes, and nurseries offered by religious institutions and provided for the duration of specified religious services or related activities to allow parents or guardians or their designees who are on site to attend such religious services and activities.8\n\nA program of instructional or athletic experience operated during the summer months by, and as an extension of, an accredited private elementary, middle, or high school program as set forth in &#xA7; 22.1-19 and administered by the Virginia Council for Private Education.9\n\nPrograms providing instructional experience in horse riding, provided that (i) such a program is taught (a) by an adult with a recognized certification in horse riding instruction and (b) to fewer than 12 children at any time, (ii) at least one adult actively supervises no more than three children at any time during such a program, and (iii) the majority of programming for any such program relates to horse riding and equine activities.B\n\nThe following child day programs shall not be required to be licensed:1\n\nA child day center that has obtained an exemption pursuant to &#xA7; 22.1-289.031.2\n\nA program where, by written policy given to and signed by a parent or guardian, school-age children are free to enter and leave the premises without permission. A program that would qualify for this exemption except that it assumes responsibility for the supervision, protection, and well-being of several children with disabilities who are mainstreamed shall not be subject to licensure.3\n\nA program that operates no more than a total of 20 program days in the course of a calendar year, provided that programs serving children under age six operate no more than two consecutive weeks without a break of at least a week.4\n\nChild-minding services that are not available for more than three hours per day for any individual child offered on site in commercial or recreational establishments if the parent or guardian (i) can be contacted and can resume responsibility for the child&#8217;s supervision within 30 minutes and (ii) is receiving or providing services or participating in activities offered by the establishment.5\n\nA certified preschool or nursery school program operated by an accredited private school as set forth in &#xA7; 22.1-19 and administered by the Virginia Council for Private Education that complies with the provisions of &#xA7; 22.1-289.03.6\n\nA program of recreational activities offered by local governments, staffed by local government employees, and attended by school-age children. Such programs shall be subject to safety and supervisory standards established by the local government offering the program.7\n\nA program offered by a local school division, operated for no more than four hours per day on full instructional days or for more than four hours per day on shortened instructional days or noninstructional days, staffed by local school division employees, and attended by children who are at least three years of age and are enrolled in public school or a preschool program within such school division. Such programs shall be subject to safety and supervisory standards established by the local school division offering the program.8\n\nChild-minding services offered by a business on the premises of the business to no more than four children under the age of 13 at any given time and for no more than eight hours per day, provided that the parent or guardian of every child receiving care is an employee of the business who is on the premises of the business and can resume responsibility for the child&#8217;s supervision within 30 minutes upon request.9\n\nA program offered by a private school accredited by and in good standing with the Virginia Council for Private Education, operated for no more than four hours per day, staffed by the accredited private school&#8217;s employees, and attended by school-age children who are enrolled in the accredited private school. Such programs shall be subject to safety and supervisory standards established by the Virginia Council for Private Education.10\n\nA child day program that (i) serves only dependent children of military personnel and (ii) (a) is located on a military base or federal property or (b) is certified as a family child care provider by a branch of the Armed Forces of the United States. Any branch of the Armed Forces of the United States or its agent, including an installation commander of a military base on which a child day program is located, may assume responsibility for approving or determining which children may be served by the program that is so exempted from licensure.11\n\nAn out-of-school time program pursuant to &#xA7; 22.1-289.02 that (i) is affiliated with a national organization with established health and safety requirements; (ii) is in compliance with any health and safety requirements established by the national organization described in clause (i); (iii) has adopted standards and requirements relating to staff training and qualifications that are consistent with the Board&#8217;s regulations relating to staff training requirements and qualifications; (iv) requires all applicants for employment, employees, applicants to serve as volunteers, and volunteers to undergo a background check in accordance with &#xA7; 22.1-289.039 and, if applicable, in accordance with the provisions of &#xA7; 22.1-289.040; and (v) has policies and procedures relating to emergency preparedness and response, child abuse prevention and response, and internal incident reporting and investigation. If there is a conflict between any of the health and safety requirements established by the national organization or any other standards, requirements, policies, or procedures adopted by the out-of-school time program and the Board&#8217;s regulations, the Board shall conduct an internal review process and consult with the out-of-school time program provider to ensure substantial compliance with the Board&#8217;s regulations.C\n\nChild day programs that are exempt from licensure pursuant to subsection B, except for child day programs that are exempt from licensure pursuant to subdivision B 1, 5, or 11, shall:1\n\nFile with the Superintendent annually and prior to beginning operation of a child day program a statement indicating the intent to operate a child day program, identifying the specific provision of this section relied upon for exemption from licensure, and certifying that the child day program has disclosed in writing to the parents or guardians of the children in the program the fact that it is exempt from licensure;2\n\nReport to the Superintendent all incidents involving serious physical injury to or death of children attending the child day program. Reports of serious physical injuries, which shall include any physical injuries that require an emergency referral to an offsite health care professional or treatment in a hospital, shall be submitted annually. This exemption does not apply if children merely change their enrollment to a different focus area at a site offering a variety of activities and such children&#8217;s attendance exceeds 25 days in a three-month period. <a id=\"paragraph-200497\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#A1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Programs of instructional or recreational activities wherein no child under age five attends for more than six hours weekly with no class or activity period to exceed one and one-half hours, and no child five years of age or above attends for more than six hours weekly when school is in session or 12 hours weekly when school is not in session. Competition, performances, and exhibitions related to the instructional or recreational activity shall be excluded when determining the hours of program operation. <a id=\"paragraph-200498\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#A2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Instructional programs offered by private schools that serve school-age children and that satisfy compulsory attendance <span class=\"dictionary\">laws<\/span> or provide services under the Individuals with Disabilities Education Act, as amended, and programs of school-sponsored extracurricular activities that are focused on single interests such as, but not limited to, music, sports, drama, civic service, or foreign language. <a id=\"paragraph-200499\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#A3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Instructional programs offered by public schools that serve preschool-age children, satisfy compulsory attendance <span class=\"dictionary\">laws<\/span>, or provide services under the Individuals with Disabilities Education Act (20 U.S.C. &#xA7; 1400 et seq.), as amended, and programs of school-sponsored extracurricular activities that are focused on single interests such as, but not limited to, music, sports, drama, civic service, or foreign language. <a id=\"paragraph-200500\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#A4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Early intervention programs for children eligible under Part C of the Individuals with Disabilities Education Act (20 U.S.C. &#xA7; 1431 et seq.), as amended, wherein no child attends for more than a total of six hours per week. <a id=\"paragraph-200501\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#A5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Practice or competition in organized competitive sports leagues. <a id=\"paragraph-200502\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#A6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Programs of religious instruction, such as Sunday schools, vacation Bible schools, Bar Mitzvah or Bat Mitzvah classes, and nurseries offered by religious institutions and provided for the duration of specified religious services or related activities to allow <span class=\"dictionary\"><span class=\"dictionary\">parents<\/span><\/span> or guardians or their designees who are on site to attend such religious services and activities. <a id=\"paragraph-200503\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#A7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> A program of instructional or athletic experience operated during the summer months by, and as an extension of, an accredited private <span class=\"dictionary\">elementary<\/span>, middle, or high school program as set forth in &#xA7; <a class=\"law\" title=\"Accreditation of elementary, middle, and high schools; nursery schools; recognition of certain organizations; child day center regulation\" href=\"\/22.1-19\/\">22.1-19<\/a> and administered by the Virginia Council for Private Education. <a id=\"paragraph-200504\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#A8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> Programs providing instructional experience in horse riding, provided that (i) such a program is taught (a) by an adult with a recognized certification in horse riding instruction and (b) to fewer than 12 children at any time, (ii) at least one adult actively supervises no more than three children at any time during such a program, and (iii) the majority of programming for any such program relates to horse riding and equine activities. <a id=\"paragraph-200505\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#A9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> The following <span class=\"dictionary\">child day programs<\/span> shall not be required to be licensed: <a id=\"paragraph-200506\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> A <span class=\"dictionary\">child day center<\/span> that has obtained an exemption pursuant to &#xA7; <a class=\"law\" title=\"Child day center operated by religious institution exempt from licensure; annual statement and documentary evidence required; enforcement; injunctive relief\" href=\"\/22.1-289.031\/\">22.1-289.031<\/a>. <a id=\"paragraph-200507\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#B1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> A program where, by written policy given to and signed by a <span class=\"dictionary\">parent<\/span> or guardian, school-age children are free to enter and leave the premises without permission. A program that would qualify for this exemption except that it assumes responsibility for the supervision, protection, and well-being of several children with disabilities who are mainstreamed shall not be subject to licensure. <a id=\"paragraph-200508\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#B2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> A program that operates no more than a total of 20 program days in the course of a calendar year, provided that programs serving children under age six operate no more than two consecutive weeks without a break of at least a week. <a id=\"paragraph-200509\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#B3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Child-minding services that are not available for more than three hours per day for any individual child offered on site in commercial or recreational establishments if the <span class=\"dictionary\">parent<\/span> or guardian (i) can be contacted and can resume responsibility for the child&#8217;s supervision within 30 minutes and (ii) is receiving or providing services or participating in activities offered by the establishment. <a id=\"paragraph-200510\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#B4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> A certified preschool or nursery school program operated by an accredited private school as set forth in &#xA7; <a class=\"law\" title=\"Accreditation of elementary, middle, and high schools; nursery schools; recognition of certain organizations; child day center regulation\" href=\"\/22.1-19\/\">22.1-19<\/a> and administered by the Virginia Council for Private Education that complies with the provisions of &#xA7; <a class=\"law\" title=\"Early childhood care and education system; establishment; need-based and demand-based funding\" href=\"\/22.1-289.03\/\">22.1-289.03<\/a>. <a id=\"paragraph-200511\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#B5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> A program of recreational activities offered by local governments, staffed by local government employees, and attended by school-age children. Such programs shall be subject to safety and supervisory standards established by the local government offering the program. <a id=\"paragraph-200512\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#B6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> A program offered by a local school division, operated for no more than four hours per day on full instructional days or for more than four hours per day on shortened instructional days or noninstructional days, staffed by local school division employees, and attended by children who are at least three years of age and are enrolled in public school or a preschool program within such school division. Such programs shall be subject to safety and supervisory standards established by the local school division offering the program. <a id=\"paragraph-200513\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#B7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> Child-minding services offered by a business on the premises of the business to no more than four children under the age of 13 at any given time and for no more than eight hours per day, provided that the <span class=\"dictionary\">parent<\/span> or guardian of every child receiving care is an employee of the business who is on the premises of the business and can resume responsibility for the child&#8217;s supervision within 30 minutes upon request. <a id=\"paragraph-200514\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#B8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> A program offered by a private school accredited by and in good standing with the Virginia Council for Private Education, operated for no more than four hours per day, staffed by the accredited private school&#8217;s employees, and attended by school-age children who are enrolled in the accredited private school. Such programs shall be subject to safety and supervisory standards established by the Virginia Council for Private Education. <a id=\"paragraph-200515\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#B9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> A <span class=\"dictionary\">child day program<\/span> that (i) serves only dependent children of military personnel and (ii) (a) is located on a military base or federal property or (b) is certified as a family child care provider by a branch of the Armed Forces of the United States. Any branch of the Armed Forces of the United States or its agent, including an installation commander of a military base on which a <span class=\"dictionary\">child day program<\/span> is located, may assume responsibility for approving or determining which children may be served by the program that is so exempted from licensure. <a id=\"paragraph-200516\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#B10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B11\" class=\"indent-1\"><p><span class=\"prefix-number\">11.<\/span> An <span class=\"dictionary\">out-of-school time program<\/span> pursuant to &#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/22.1-289.02\/\">22.1-289.02<\/a> that (i) is affiliated with a national organization with established health and safety requirements; (ii) is in compliance with any health and safety requirements established by the national organization described in clause (i); (iii) has adopted standards and requirements relating to staff training and qualifications that are consistent with the <span class=\"dictionary\">Board<\/span>&#8217;s regulations relating to staff training requirements and qualifications; (iv) requires all applicants for employment, employees, applicants to serve as volunteers, and volunteers to undergo a background check in accordance with &#xA7; <a class=\"law\" title=\"Records check by unlicensed child day center; penalty\" href=\"\/22.1-289.039\/\">22.1-289.039<\/a> and, if applicable, in accordance with the provisions of &#xA7; <a class=\"law\" title=\"Child day centers and family day homes receiving federal, state, or local child care funds; eligibility requirements\" href=\"\/22.1-289.040\/\">22.1-289.040<\/a>; and (v) has policies and procedures relating to emergency preparedness and response, child abuse prevention and response, and internal incident reporting and investigation. If there is a conflict between any of the health and safety requirements established by the national organization or any other standards, requirements, policies, or procedures adopted by the <span class=\"dictionary\">out-of-school time program<\/span> and the <span class=\"dictionary\">Board<\/span>&#8217;s regulations, the <span class=\"dictionary\">Board<\/span> shall conduct an internal review process and consult with the <span class=\"dictionary\">out-of-school time program<\/span> provider to ensure substantial compliance with the <span class=\"dictionary\">Board<\/span>&#8217;s regulations. <a id=\"paragraph-200517\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#B11\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> <span class=\"dictionary\">Child day programs<\/span> that are exempt from licensure pursuant to subsection B, except for <span class=\"dictionary\">child day programs<\/span> that are exempt from licensure pursuant to subdivision B 1, 5, or 11, shall: <a id=\"paragraph-200518\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> File with the <span class=\"dictionary\">Superintendent<\/span> annually and prior to beginning operation of a <span class=\"dictionary\">child day program<\/span> a statement indicating the <span class=\"dictionary\">intent<\/span> to operate a <span class=\"dictionary\">child day program<\/span>, identifying the specific provision of this section relied upon for exemption from licensure, and certifying that the <span class=\"dictionary\">child day program<\/span> has disclosed in writing to the <span class=\"dictionary\"><span class=\"dictionary\">parents<\/span><\/span> or guardians of the children in the program the <span class=\"dictionary\">fact<\/span> that it is exempt from licensure; <a id=\"paragraph-200519\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#C1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Report to the <span class=\"dictionary\">Superintendent<\/span> all incidents involving serious physical injury to or death of children attending the <span class=\"dictionary\">child day program<\/span>. Reports of serious physical injuries, which shall include any physical injuries that require an emergency referral to an offsite health care professional or treatment in a hospital, shall be submitted annually. Reports of deaths shall be submitted no later than one business day after the death occurred; and <a id=\"paragraph-200520\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#C2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Post in a visible location on the premises notice that the <span class=\"dictionary\">child day program<\/span> is operating as a program exempt from licensure with basic health and safety requirements but has no direct oversight by the <span class=\"dictionary\">Department<\/span>. <a id=\"paragraph-200521\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#C3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> <span class=\"dictionary\">Child day programs<\/span> that are exempt from licensure pursuant to subsection B, except for <span class=\"dictionary\">child day programs<\/span> that are exempt from licensure pursuant to subdivision B 1, 5, 6, 7, or 11 shall: <a id=\"paragraph-200522\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Have a person trained and certified in first aid and cardiopulmonary resuscitation present at the <span class=\"dictionary\">child day program<\/span> whenever children are present or at any other location in which children attending the <span class=\"dictionary\">child day program<\/span> are present; <a id=\"paragraph-200523\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#D1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Maintain daily attendance records that document the arrival and departure of all children; <a id=\"paragraph-200524\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#D2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Have an emergency preparedness plan in place; <a id=\"paragraph-200525\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#D3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Comply with all applicable <span class=\"dictionary\">laws<\/span> and regulations governing transportation of children; and <a id=\"paragraph-200526\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#D4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Comply with all safe sleep guidelines recommended by the American Academy of Pediatrics. <a id=\"paragraph-200527\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#D5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> The <span class=\"dictionary\">Superintendent<\/span> shall inspect <span class=\"dictionary\">child day programs<\/span> that are exempt from licensure pursuant to subsection B to determine compliance with the provisions of this section only upon receipt of a complaint, except as otherwise provided by <span class=\"dictionary\">law<\/span>. <a id=\"paragraph-200528\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> <span class=\"dictionary\">Family day homes<\/span> that are members of a licensed <span class=\"dictionary\">family day system<\/span> shall not be required to obtain a license from the <span class=\"dictionary\">Superintendent<\/span>. <a id=\"paragraph-200529\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/22.1-289.030\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nEXEMPTIONS FROM LICENSURE (\u00a7 22.1-289.030)\n\nA. The following programs are not child day programs and shall not be required\nto be licensed:\n\n   1. A program of instructional experience in a single focus, such as, but not\n   limited to, computer science, archaeology, sport clinics, or music, if\n   children under the age of six do not attend at all and if no child is allowed\n   to attend for more than 25 days in any three-month period commencing with\n   enrollment. This exemption does not apply if children merely change their\n   enrollment to a different focus area at a site offering a variety of\n   activities and such children&#8217;s attendance exceeds 25 days in a\n   three-month period.\n\n   2. Programs of instructional or recreational activities wherein no child under\n   age five attends for more than six hours weekly with no class or activity\n   period to exceed one and one-half hours, and no child five years of age or\n   above attends for more than six hours weekly when school is in session or 12\n   hours weekly when school is not in session. Competition, performances, and\n   exhibitions related to the instructional or recreational activity shall be\n   excluded when determining the hours of program operation.\n\n   3. Instructional programs offered by private schools that serve school-age\n   children and that satisfy compulsory attendance laws or provide services under\n   the Individuals with Disabilities Education Act, as amended, and programs of\n   school-sponsored extracurricular activities that are focused on single\n   interests such as, but not limited to, music, sports, drama, civic service, or\n   foreign language.\n\n   4. Instructional programs offered by public schools that serve preschool-age\n   children, satisfy compulsory attendance laws, or provide services under the\n   Individuals with Disabilities Education Act (20 U.S.C. &#xA7; 1400 et seq.),\n   as amended, and programs of school-sponsored extracurricular activities that\n   are focused on single interests such as, but not limited to, music, sports,\n   drama, civic service, or foreign language.\n\n   5. Early intervention programs for children eligible under Part C of the\n   Individuals with Disabilities Education Act (20 U.S.C. &#xA7; 1431 et seq.),\n   as amended, wherein no child attends for more than a total of six hours per\n   week.\n\n   6. Practice or competition in organized competitive sports leagues.\n\n   7. Programs of religious instruction, such as Sunday schools, vacation Bible\n   schools, Bar Mitzvah or Bat Mitzvah classes, and nurseries offered by\n   religious institutions and provided for the duration of specified religious\n   services or related activities to allow parents or guardians or their\n   designees who are on site to attend such religious services and activities.\n\n   8. A program of instructional or athletic experience operated during the\n   summer months by, and as an extension of, an accredited private elementary,\n   middle, or high school program as set forth in &#xA7; 22.1-19 and administered\n   by the Virginia Council for Private Education.\n\n   9. Programs providing instructional experience in horse riding, provided that\n   (i) such a program is taught (a) by an adult with a recognized certification\n   in horse riding instruction and (b) to fewer than 12 children at any time,\n   (ii) at least one adult actively supervises no more than three children at any\n   time during such a program, and (iii) the majority of programming for any such\n   program relates to horse riding and equine activities.\n\nB. The following child day programs shall not be required to be licensed:\n\n   1. A child day center that has obtained an exemption pursuant to &#xA7;\n   22.1-289.031.\n\n   2. A program where, by written policy given to and signed by a parent or\n   guardian, school-age children are free to enter and leave the premises without\n   permission. A program that would qualify for this exemption except that it\n   assumes responsibility for the supervision, protection, and well-being of\n   several children with disabilities who are mainstreamed shall not be subject\n   to licensure.\n\n   3. A program that operates no more than a total of 20 program days in the\n   course of a calendar year, provided that programs serving children under age\n   six operate no more than two consecutive weeks without a break of at least a\n   week.\n\n   4. Child-minding services that are not available for more than three hours per\n   day for any individual child offered on site in commercial or recreational\n   establishments if the parent or guardian (i) can be contacted and can resume\n   responsibility for the child&#8217;s supervision within 30 minutes and (ii) is\n   receiving or providing services or participating in activities offered by the\n   establishment.\n\n   5. A certified preschool or nursery school program operated by an accredited\n   private school as set forth in &#xA7; 22.1-19 and administered by the Virginia\n   Council for Private Education that complies with the provisions of &#xA7;\n   22.1-289.03.\n\n   6. A program of recreational activities offered by local governments, staffed\n   by local government employees, and attended by school-age children. Such\n   programs shall be subject to safety and supervisory standards established by\n   the local government offering the program.\n\n   7. A program offered by a local school division, operated for no more than\n   four hours per day on full instructional days or for more than four hours per\n   day on shortened instructional days or noninstructional days, staffed by local\n   school division employees, and attended by children who are at least three\n   years of age and are enrolled in public school or a preschool program within\n   such school division. Such programs shall be subject to safety and supervisory\n   standards established by the local school division offering the program.\n\n   8. Child-minding services offered by a business on the premises of the\n   business to no more than four children under the age of 13 at any given time\n   and for no more than eight hours per day, provided that the parent or guardian\n   of every child receiving care is an employee of the business who is on the\n   premises of the business and can resume responsibility for the child&#8217;s\n   supervision within 30 minutes upon request.\n\n   9. A program offered by a private school accredited by and in good standing\n   with the Virginia Council for Private Education, operated for no more than\n   four hours per day, staffed by the accredited private school&#8217;s\n   employees, and attended by school-age children who are enrolled in the\n   accredited private school. Such programs shall be subject to safety and\n   supervisory standards established by the Virginia Council for Private\n   Education.\n\n   10. A child day program that (i) serves only dependent children of military\n   personnel and (ii) (a) is located on a military base or federal property or\n   (b) is certified as a family child care provider by a branch of the Armed\n   Forces of the United States. Any branch of the Armed Forces of the United\n   States or its agent, including an installation commander of a military base on\n   which a child day program is located, may assume responsibility for approving\n   or determining which children may be served by the program that is so exempted\n   from licensure.\n\n   11. An out-of-school time program pursuant to &#xA7; 22.1-289.02 that (i) is\n   affiliated with a national organization with established health and safety\n   requirements; (ii) is in compliance with any health and safety requirements\n   established by the national organization described in clause (i); (iii) has\n   adopted standards and requirements relating to staff training and\n   qualifications that are consistent with the Board&#8217;s regulations relating\n   to staff training requirements and qualifications; (iv) requires all\n   applicants for employment, employees, applicants to serve as volunteers, and\n   volunteers to undergo a background check in accordance with &#xA7;\n   22.1-289.039 and, if applicable, in accordance with the provisions of &#xA7;\n   22.1-289.040; and (v) has policies and procedures relating to emergency\n   preparedness and response, child abuse prevention and response, and internal\n   incident reporting and investigation. If there is a conflict between any of\n   the health and safety requirements established by the national organization or\n   any other standards, requirements, policies, or procedures adopted by the\n   out-of-school time program and the Board&#8217;s regulations, the Board shall\n   conduct an internal review process and consult with the out-of-school time\n   program provider to ensure substantial compliance with the Board&#8217;s\n   regulations.\n\nC. Child day programs that are exempt from licensure pursuant to subsection B,\nexcept for child day programs that are exempt from licensure pursuant to\nsubdivision B 1, 5, or 11, shall:\n\n   1. File with the Superintendent annually and prior to beginning operation of a\n   child day program a statement indicating the intent to operate a child day\n   program, identifying the specific provision of this section relied upon for\n   exemption from licensure, and certifying that the child day program has\n   disclosed in writing to the parents or guardians of the children in the\n   program the fact that it is exempt from licensure;\n\n   2. Report to the Superintendent all incidents involving serious physical\n   injury to or death of children attending the child day program. Reports of\n   serious physical injuries, which shall include any physical injuries that\n   require an emergency referral to an offsite health care professional or\n   treatment in a hospital, shall be submitted annually. Post in a visible location on the premises notice that the child day\n   program is operating as a program exempt from licensure with basic health and\n   safety requirements but has no direct oversight by the Department.\n\nD. Child day programs that are exempt from licensure pursuant to subsection B,\nexcept for child day programs that are exempt from licensure pursuant to\nsubdivision B 1, 5, 6, 7, or 11 shall:\n\n   1.
