<a id=\"paragraph-310824\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-1016\/#D1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> If the <span class=\"dictionary\">capital project<\/span> is funded in whole or in part with a general fund appropriation for that purpose or proceeds from <span class=\"dictionary\">bonds<\/span> issued under Article X, Section 9 (a), 9 (b), or 9 (c) of the Constitution of Virginia, or under Article X, Section 9 (d) of the Constitution of Virginia, if such issuance is supported by general funds, the project shall remain subject to the pre-appropriation approvals that are in effect within the executive and legislative branches of state government but may be exempt under the <span class=\"dictionary\">management agreement<\/span> from any state post-appropriation review, approval, administrative, or other policy or procedure functions performed or required by the Department of General Services, the Division of Engineering and Buildings, the Department of Planning and Budget, and any other state agency that supports the functions performed by such departments; and <a id=\"paragraph-310825\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-1016\/#D2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> If a <span class=\"dictionary\">covered institution<\/span> constructs improvements on land or renovates property that was originally acquired or constructed in whole or in part with a general fund appropriation for that purpose or proceeds from <span class=\"dictionary\">bonds<\/span> issued under Article X, Section 9 (a), 9 (b), or 9 (c) of the Constitution of Virginia, or under Article X, Section 9 (d) of the Constitution of Virginia, if such issuance is supported by general funds, and such improvements or renovations are undertaken entirely with funds not appropriated by the General Assembly, such improvements or renovations shall be consistent with such institution&#8217;s master plan approved by its <span class=\"dictionary\">governing board<\/span> and, if the cost of such improvements or renovations is reasonably expected to exceed $2 million, the institution&#8217;s decision to undertake such improvements or renovations shall be communicated to the Governor and to the Chairmen of the Senate Committee on Finance and Appropriations and the House Committee on Appropriations no later than 60 days prior to the (i) commencement of construction or renovation or (ii) issuance of <span class=\"dictionary\"><span class=\"dictionary\">bonds<\/span>, notes, or other obligations<\/span> to finance such construction or renovation. <a id=\"paragraph-310826\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-1016\/#D3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> Each <span class=\"dictionary\">covered institution<\/span> may designate a full-time employee to be its own building official and may determine the suitability for occupancy of and <span class=\"dictionary\">issue<\/span> certifications for building occupancy for all <span class=\"dictionary\">capital projects<\/span> undertaken at such institution. Such building official shall: <a id=\"paragraph-310827\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-1016\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Ensure that the Virginia Uniform Statewide Building Code (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/36-97\/\">36-97<\/a> et seq.) requirements are met for that <span class=\"dictionary\">capital project<\/span> and that such project has been inspected by the State Fire Marshal or his designee prior to issuing any such certification; <a id=\"paragraph-310828\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-1016\/#E1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Report directly and exclusively to the <span class=\"dictionary\">governing board<\/span> of the institution and be subject to review by the appropriate personnel in the Department of General Services; <a id=\"paragraph-310829\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-1016\/#E2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Be certified by the Department of Housing and Community Development to perform this function; and <a id=\"paragraph-310830\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-1016\/#E3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Have adequate resources and staff who are certified by the Department of Housing and Community Development in accordance with &#xA7; <a class=\"law\" title=\"Powers and duties of Board; appointment of Building Code Academy Advisory Committee\" href=\"\/36-137\/\">36-137<\/a> for such purpose and who shall review plans, specifications, and documents for compliance with codes and standards and perform required inspections of the work in progress and the completed project. <a id=\"paragraph-310831\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-1016\/#E4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> No individual licensed professional architect or engineer hired or contracted to perform the functions set forth in subsection E shall also perform other code-related design, construction, <span class=\"dictionary\">facilities<\/span>-related project management, or <span class=\"dictionary\">facilities<\/span> management functions for the institution on the same project. <a id=\"paragraph-310832\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-1016\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nCOVERED INSTITUTIONS; OPERATIONAL AUTHORITY; FINANCIAL OPERATIONS; CAPITAL\nPROJECTS (\u00a7 23.1-1016)\n\nA. The governing board of each covered institution shall adopt policies for the\nreview, approval, and implementation of all capital projects undertaken by the\ninstitution.\n\nB. All capital projects of a covered institution, whether funded by an\nappropriation of the General Assembly or otherwise, shall be approved by the\ninstitution&#8217;s governing board.\n\nC. Except as otherwise provided in subdivision D 2, capital projects undertaken\nat a covered institution may be exempt from any capital outlay oversight\nperformed or required by the Department of General Services, the Division of\nEngineering and Buildings, the Department of Planning and Budget, and any other\nstate agency that supports the functions performed by such departments.\n\nD. Capital projects undertaken at a covered institution are subject to the\ninstitution&#8217;s capital project policies adopted pursuant to subsection A\nand:\n\n   1. Any capital project undertaken at a covered institution that costs $300,000\n   or more is subject to the environmental, historic preservation, and\n   conservation requirements of state law that are generally applicable to\n   capital projects in the Commonwealth;\n\n   2.
