If the <span class=\"dictionary\">Council<\/span> revokes an <span class=\"dictionary\">institution<\/span>&#8217;s authorization to confer or grant academic or professional <span class=\"dictionary\">degrees<\/span>, the <span class=\"dictionary\">institution<\/span> is required to seek recertification annually until it meets the criteria of this subsection. <a id=\"paragraph-266844\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-219\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> In addition to such other requirements as are established in this article or the regulations of the <span class=\"dictionary\">Council<\/span>, any <span class=\"dictionary\">out-of-state<\/span> <span class=\"dictionary\">institution of higher education<\/span> or <span class=\"dictionary\">academic-<span class=\"dictionary\">vocational <span class=\"dictionary\">non-<span class=\"dictionary\">college<\/span> degree school<\/span><\/span><\/span> shall provide verification that: <a id=\"paragraph-266845\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-219\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> The institution or school is fully accredited by an accrediting agency recognized by the U.S. Department of Education; <a id=\"paragraph-266846\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-219\/#E1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> All courses, <span class=\"dictionary\">degrees<\/span>, or <span class=\"dictionary\">certificates<\/span> offered at any <span class=\"dictionary\">site<\/span> are also offered at an <span class=\"dictionary\">out-of-state<\/span> campus of the institution or school; <a id=\"paragraph-266847\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-219\/#E2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> All credits earned at any <span class=\"dictionary\">site<\/span> are transferable to an <span class=\"dictionary\">out-of-state<\/span> campus of the institution or school; and <a id=\"paragraph-266848\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-219\/#E3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> The institution or school has complied with the requirements of either Article 17 (&#xA7; <a class=\"law\" title=\"Authority to transact business required\" href=\"\/13.1-757\/\">13.1-757<\/a> et seq.) of Chapter 9 of Title 13.1 or Article 14 (&#xA7; <a class=\"law\" title=\"Authority to transact business required\" href=\"\/13.1-919\/\">13.1-919<\/a> et seq.) of Chapter 10 of Title 13.1. <a id=\"paragraph-266849\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-219\/#E4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> Any degree-granting <span class=\"dictionary\">postsecondary school<\/span> providing distance learning to residents of the Commonwealth from a location outside of the Commonwealth shall be certified to operate in the Commonwealth or shall be a participant in a reciprocity agreement to which the Commonwealth belongs, in accordance with <span class=\"dictionary\">Council<\/span>&#8217;s authority pursuant to &#xA7; <a class=\"law\" title=\"Distance learning reciprocity agreements; participation; Distance Learning Reciprocity Advisory Council\" href=\"\/23.1-211\/\">23.1-211<\/a>, for the purpose of consumer protection. <a id=\"paragraph-266850\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-219\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> Any <span class=\"dictionary\">postsecondary school<\/span> that seeks to conduct distance learning activities from a <span class=\"dictionary\">site<\/span> shall apply for <span class=\"dictionary\">Council<\/span> approval to conduct such activity and shall comply with this article and the <span class=\"dictionary\">Council<\/span>&#8217;s regulations in the same manner as any other <span class=\"dictionary\">postsecondary school<\/span> subject to this article. <a id=\"paragraph-266851\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-219\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nCOUNCIL CERTIFICATION; REQUIREMENTS AND PROHIBITIONS (\u00a7 23.1-219)\n\nA. Without obtaining the certification of the Council or a determination that\nthe activity or program is exempt from such certification requirements, no\npostsecondary school subject to the provisions of this article shall:\n\n   1. Use the term &#8220;college&#8221; or &#8220;university&#8221; or\n   abbreviations or words of similar meaning in its name or in any manner in\n   connection with its academic affairs or business;\n\n   2. Enroll students;\n\n   3. Offer degrees, courses for degree credit, programs of study leading to a\n   degree, or courses for nondegree credit, either at a site or via a distance\n   learning modality; or\n\n   4. Initiate other programs for degree credit or award degrees or certificates\n   at a new or additional level.\n\nB. All institutions of higher education and academic-vocational non-college\ndegree schools subject to the provisions of this article shall be fully\naccredited by an accrediting agency recognized by the U.S. Department of\nEducation.\n\nC. All out-of-state academic-vocational non-college degree schools subject to\nthe provisions of this article shall disclose their accreditation status in all\nwritten materials advertising or describing such school that are distributed to\nprospective or enrolled students or the general public.\n\nD. No postsecondary school shall be required to obtain another certification\nfrom the Council to operate in the Commonwealth if it (i) was formed, chartered,\nor established in the Commonwealth or chartered by an Act of Congress; (ii) has\nmaintained its main campus continuously in the Commonwealth for at least 20\ncalendar years under its current ownership; (iii) was continuously approved or\nauthorized to confer or grant academic or professional degrees by the Council,\nthe Board of Education, or an act of the General Assembly during those 20 years;\nand (iv) is fully accredited by an accrediting agency that is recognized by and\nhas met the criteria for Title IV eligibility of the U.S. Department of\nEducation. If the Council revokes an institution&#8217;s authorization to confer\nor grant academic or professional degrees, the institution is required to seek\nrecertification annually until it meets the criteria of this subsection.\n\nE. In addition to such other requirements as are established in this article or\nthe regulations of the Council, any out-of-state institution of higher education\nor academic-vocational non-college degree school shall provide verification\nthat:\n\n   1. The institution or school is fully accredited by an accrediting agency\n   recognized by the U.S. Department of Education;\n\n   2. All courses, degrees, or certificates offered at any site are also offered\n   at an out-of-state campus of the institution or school;\n\n   3. All credits earned at any site are transferable to an out-of-state campus\n   of the institution or school; and\n\n   4. The institution or school has complied with the requirements of either\n   Article 17 (&#xA7; 13.1-757 et seq.) of Chapter 9 of Title 13.1 or Article 14\n   (&#xA7; 13.1-919 et seq.) of Chapter 10 of Title 13.1.\n\nF. Any degree-granting postsecondary school providing distance learning to\nresidents of the Commonwealth from a location outside of the Commonwealth shall\nbe certified to operate in the Commonwealth or shall be a participant in a\nreciprocity agreement to which the Commonwealth belongs, in accordance with\nCouncil&#8217;s authority pursuant to &#xA7; 23.1-211, for the purpose of\nconsumer protection.\n\nG.
