2022, c. 437.","full_text":"A\n\nThe Commission shall:1\n\nStimulate and encourage throughout the Commonwealth growth in artistic quality and excellence, public interest and participation in the arts, and access to high-quality and affordable literary, visual, and performing arts for all Virginians;2\n\nMake recommendations concerning appropriate methods to encourage economic viability, an intellectually stimulating environment for artists, and participation in and appreciation of the arts to meet the legitimate needs and aspirations of persons in all parts of the Commonwealth;3\n\nPromote the development and implementation of a planned, sequential, and comprehensive program of arts education, taught by licensed teachers endorsed in arts education, in the public elementary and secondary schools of the Commonwealth;4\n\nProvide supplemental learning opportunities to the public school arts education curriculum;5\n\nEncourage the development of a network of professional arts organizations, the media, and arts promoters for the production of classical and new works of art and diversity in artistic expressions in media including the literary, visual, and performing arts;6\n\nProvide funding for and technical assistance to artists, recognized nonprofit arts organizations, and arts organizations and activities that celebrate and preserve the various cultures represented among the citizens of the Commonwealth;7\n\nEncourage and support the creation of new works of art, arts organizations whose primary objective is to increase public access to the arts, particularly in underserved areas, and performing arts tours to increase the availability of this form of artistic expression throughout the Commonwealth;8\n\nEstablish a program of financial assistance to provide scholarships, grants, and other awards to artists who demonstrate exceptional ability and talent;9\n\nEstablish an advisory panel composed of artists, arts administrators, and citizens to advise the Commission concerning fiscal matters;10\n\nEncourage arts organizations to dedicate to their endowments at least $1 of the price of each adult admission to performances or exhibitions or at least one percent of moneys collected in fund campaigns;11\n\nEncourage arts organizations to develop and implement endowment enlargement plans that yield enough income to underwrite one-third of the organizations&#8217; annual operating costs;12\n\nApply to and enter into contracts and agreements with the United States or any appropriate agency or officer of the United States for participation in or receipt of funding from any federal program respecting the arts;13\n\nProvide incentives to local governing bodies to encourage public support and funding of the arts;14\n\nAccept, hold, and administer gifts, contributions, and bequests of money or any other thing to be used for carrying out the purposes of this article;15\n\nDevelop specific procedures for the administration and implementation of a grantmaking program, so long as any such program is for the benefit of a nonprofit organization qualifying as a &#xA7; 501(c)(3) organization under the Internal Revenue Code and prepare written guidelines to govern such program;16\n\nAdminister any funds available to the Commission and disburse such funds in accordance with the purposes of this article;17\n\nMake expenditures from the Fund&#8217;s interest and income to promote the arts in the Commonwealth in accordance with &#xA7; <a id=\"paragraph-219083\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-3223\/#A16\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A17\" class=\"indent-1\"><p><span class=\"prefix-number\">17.<\/span> Make expenditures from the Fund&#8217;s interest and income to promote the arts in the Commonwealth in accordance with &#xA7; <a class=\"law\" title=\"Gifts and bequests; exemption from taxation\" href=\"\/23.1-3228\/\">23.1-3228<\/a> and assist nonprofit arts and cultural institutions and organizations in the Commonwealth to assess, enhance, and plan for enhancement of their fiscal stability, financial management and control capabilities, and capacity to raise funds for the furtherance of their respective missions from nongovernmental sources; <a id=\"paragraph-219084\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-3223\/#A17\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A18\" class=\"indent-1\"><p><span class=\"prefix-number\">18.<\/span> Enter into <span class=\"dictionary\">contracts<\/span> and execute all instruments necessary and appropriate to carry out the Commission&#8217;s purposes; <a id=\"paragraph-219085\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-3223\/#A18\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A19\" class=\"indent-1\"><p><span class=\"prefix-number\">19.<\/span> Explore and make recommendations concerning other possible dedicated revenue sources for the Fund; and <a id=\"paragraph-219086\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-3223\/#A19\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A20\" class=\"indent-1\"><p><span class=\"prefix-number\">20.<\/span> Perform any lawful acts necessary or appropriate to carry out the purposes of the Commission. <a id=\"paragraph-219087\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-3223\/#A20\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> Nothing in this article shall be construed to affect the statutory purposes of the Virginia Museum of Fine Arts. <a id=\"paragraph-219088\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-3223\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nDUTIES OF THE COMMISSION (\u00a7 23.1-3223)\n\nA. The Commission shall:\n\n   1. Stimulate and encourage throughout the Commonwealth growth in artistic\n   quality and excellence, public interest and participation in the arts, and\n   access to high-quality and affordable literary, visual, and performing arts\n   for all Virginians;\n\n   2. Make recommendations concerning appropriate methods to encourage economic\n   viability, an intellectually stimulating environment for artists, and\n   participation in and appreciation of the arts to meet the legitimate needs and\n   aspirations of persons in all parts of the Commonwealth;\n\n   3. Promote the development and implementation of a planned, sequential, and\n   comprehensive program of arts education, taught by licensed teachers endorsed\n   in arts education, in the public elementary and secondary schools of the\n   Commonwealth;\n\n   4. Provide supplemental learning opportunities to the public school arts\n   education curriculum;\n\n   5. Encourage the development of a network of professional arts organizations,\n   the media, and arts promoters for the production of classical and new works of\n   art and diversity in artistic expressions in media including the literary,\n   visual, and performing arts;\n\n   6. Provide funding for and technical assistance to artists, recognized\n   nonprofit arts organizations, and arts organizations and activities that\n   celebrate and preserve the various cultures represented among the citizens of\n   the Commonwealth;\n\n   7. Encourage and support the creation of new works of art, arts organizations\n   whose primary objective is to increase public access to the arts, particularly\n   in underserved areas, and performing arts tours to increase the availability\n   of this form of artistic expression throughout the Commonwealth;\n\n   8. Establish a program of financial assistance to provide scholarships,\n   grants, and other awards to artists who demonstrate exceptional ability and\n   talent;\n\n   9. Establish an advisory panel composed of artists, arts administrators, and\n   citizens to advise the Commission concerning fiscal matters;\n\n   10. Encourage arts organizations to dedicate to their endowments at least $1\n   of the price of each adult admission to performances or exhibitions or at\n   least one percent of moneys collected in fund campaigns;\n\n   11. Encourage arts organizations to develop and implement endowment\n   enlargement plans that yield enough income to underwrite one-third of the\n   organizations&#8217; annual operating costs;\n\n   12. Apply to and enter into contracts and agreements with the United States or\n   any appropriate agency or officer of the United States for participation in or\n   receipt of funding from any federal program respecting the arts;\n\n   13. Provide incentives to local governing bodies to encourage public support\n   and funding of the arts;\n\n   14. Accept, hold, and administer gifts, contributions, and bequests of money\n   or any other thing to be used for carrying out the purposes of this article;\n\n   15. Develop specific procedures for the administration and implementation of a\n   grantmaking program, so long as any such program is for the benefit of a\n   nonprofit organization qualifying as a &#xA7; 501(c)(3) organization under the\n   Internal Revenue Code and prepare written guidelines to govern such program;\n\n   16. Administer any funds available to the Commission and disburse such funds\n   in accordance with the purposes of this article;\n\n   17.
