The local governing body may only petition the circuit court for such concurrent jurisdiction pursuant to a request by the local law-enforcement agency.C\n\nEach public institution of higher education and private institution of higher education that establishes a campus police force pursuant to this article shall enter into and become a party to a mutual aid agreement with an adjacent local law-enforcement agency or the Department of State Police for the use of their regular and auxiliary joint forces, equipment, and materials when needed in the investigation of any felony criminal sexual assault or medically unattended death occurring on property owned or controlled by such institution or any death resulting from an incident occurring on such property. Such mutual aid agreements shall include provisions requiring either the campus police force or the agency with which it has established a mutual aid agreement pursuant to this subsection, in the event that such police force or agency conducts an investigation that involves a felony criminal sexual assault as set forth in Article 7 (&#xA7; 18.2-61 et seq.) of Chapter 4 of Title 18.2 occurring on campus, in or on a noncampus building or property, or on public property, to notify the local attorney for the Commonwealth of such investigation within 48 hours of beginning such investigation. No such notification provision shall require a campus police force or the agency with which it has established a mutual aid agreement to disclose identifying information about the victim. The local governing body may only <span class=\"dictionary\">petition<\/span> the <span class=\"dictionary\">circuit<\/span> <span class=\"dictionary\">court<\/span> for such concurrent <span class=\"dictionary\">jurisdiction<\/span> pursuant to a request by the local <span class=\"dictionary\">law<\/span>-enforcement agency. <a id=\"paragraph-288195\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-815\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Each <span class=\"dictionary\">public institution of higher education<\/span> and <span class=\"dictionary\">private institution of higher education<\/span> that establishes a <span class=\"dictionary\">campus<\/span> police force pursuant to this article shall enter into and become a <span class=\"dictionary\">party<\/span> to a mutual aid agreement with an adjacent local <span class=\"dictionary\">law<\/span>-enforcement agency or the Department of State Police for the use of their regular and auxiliary joint forces, equipment, and <span class=\"dictionary\">materials<\/span> when needed in the investigation of any <span class=\"dictionary\">felony<\/span> criminal sexual <span class=\"dictionary\">assault<\/span> or medically unattended death occurring on property owned or controlled by such institution or any death resulting from an incident occurring on such property. Such mutual aid agreements shall include provisions requiring either the <span class=\"dictionary\">campus<\/span> police force or the agency with which it has established a mutual aid agreement pursuant to this subsection, in the event that such police force or agency conducts an investigation that involves a <span class=\"dictionary\">felony<\/span> criminal sexual <span class=\"dictionary\">assault<\/span> as set forth in Article 7 (&#xA7; <a class=\"law\" title=\"Rape\" href=\"\/18.2-61\/\">18.2-61<\/a> et seq.) of Chapter 4 of Title 18.2 occurring on <span class=\"dictionary\">campus<\/span>, in or on a <span class=\"dictionary\">noncampus building or property<\/span>, or on <span class=\"dictionary\">public property<\/span>, to notify the local attorney for the Commonwealth of such investigation within 48 hours of beginning such investigation. No such notification provision shall require a <span class=\"dictionary\">campus<\/span> police force or the agency with which it has established a mutual aid agreement to disclose identifying information about the victim. Nothing in this section prohibits a <span class=\"dictionary\">campus<\/span> police force or auxiliary police force from requesting assistance from any appropriate <span class=\"dictionary\">law<\/span>-enforcement agency of the Commonwealth with which the institution has not entered into a mutual aid agreement. <a id=\"paragraph-288196\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-815\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Each <span class=\"dictionary\">public institution of higher education<\/span> and <span class=\"dictionary\">nonprofit <span class=\"dictionary\">private institution of higher education<\/span><\/span> that (i) has not established a <span class=\"dictionary\">campus<\/span> police force or auxiliary police force pursuant to this article and (ii) has a security department, relies on local or state police forces, or <span class=\"dictionary\">contracts<\/span> for security services from private parties pursuant to &#xA7; <a class=\"law\" title=\"Security departments and other security services\" href=\"\/23.1-818\/\">23.1-818<\/a> shall enter into and become a <span class=\"dictionary\">party<\/span> to a <span class=\"dictionary\">memorandum<\/span> of understanding with an adjacent local <span class=\"dictionary\">law<\/span>-enforcement agency or the Department of State Police (the Department) to require either such local <span class=\"dictionary\">law<\/span>-enforcement agency or the Department, in the event that such agency or the Department conducts an investigation that involves a <span class=\"dictionary\">felony<\/span> criminal sexual <span class=\"dictionary\">assault<\/span> as set forth in Article 7 (&#xA7; <a class=\"law\" title=\"Rape\" href=\"\/18.2-61\/\">18.2-61<\/a> et seq.) of Chapter 4 of Title 18.2 occurring on <span class=\"dictionary\">campus<\/span>, in or on a <span class=\"dictionary\">noncampus building or property<\/span>, or on <span class=\"dictionary\">public property<\/span>, to notify the local attorney for the Commonwealth of such investigation within 48 hours of beginning such investigation. No such notification provision shall require the <span class=\"dictionary\">law<\/span>-enforcement agency or the Department to disclose identifying information about the victim. <a id=\"paragraph-288197\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-815\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> All mutual aid agreements and memoranda of understanding entered into pursuant to this section shall specify the procedure for sharing information. <a id=\"paragraph-288198\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/23.1-815\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nCAMPUS POLICE FORCES AND AUXILIARY POLICE FORCES; POWERS AND DUTIES;\nJURISDICTION (\u00a7 23.1-815)\n\nA. As used in this section:\n\t\t\t&#8220;Campus&#8221; means (i) any building or property owned or controlled\nby an institution of higher education located within the same reasonably\ncontiguous geographic area of the institution and used by the institution in\ndirect support of, or in a manner relating to, the institution&#8217;s\neducational purposes, including residence halls, and (ii) any building or\nproperty that is within or reasonably contiguous to the area described in clause\n(i) that is owned by the institution but controlled by another person, is\nfrequently used by students, and supports institutional purposes, such as a food\nor other retail vendor.\n\t\t\t&#8220;Noncampus building or property&#8221; means (i) any building or\nproperty owned or controlled by a student organization that is officially\nrecognized by an institution of higher education or (ii) any building or\nproperty owned or controlled by an institution of higher education that is used\nin direct support of, or in relation to, the institution&#8217;s educational\npurposes, is frequently used by students, and is not within the same reasonably\ncontiguous geographic area of the institution.\n\t\t\t&#8220;Public property&#8221; means all public property, including\nthoroughfares, streets, sidewalks, and parking facilities, that is within the\ncampus, or immediately adjacent to and accessible from the campus.\n\nB. A campus police officer appointed as provided in &#xA7; 23.1-812 or a member\nof an auxiliary police force appointed and activated pursuant to &#xA7;&#xA7;\n23.1-811 and 23.1-812 shall be deemed police officers of localities who may\nexercise the powers and duties conferred by law upon such police officers,\nincluding the provisions of Chapters 5 (&#xA7; 19.2-52 et seq.), 7 (&#xA7;\n19.2-71 et seq.), and 23 (&#xA7; 19.2-387 et seq.) of Title 19.2, (i) upon any\nproperty owned or controlled by the public institution of higher education or\nprivate institution of higher education, or, upon request, any property owned or\ncontrolled by another public institution of higher education or private\ninstitution of higher education, and upon the streets, sidewalks, and highways\nimmediately adjacent to any such property; (ii) pursuant to a mutual aid\nagreement (a) as provided for in &#xA7; 15.2-1727 or (b) between the governing\nboard of a public institution of higher education or private institution of\nhigher education and another public institution of higher education or private\ninstitution of higher education in the Commonwealth or an adjacent political\nsubdivision; (iii) in close pursuit of a person as provided in &#xA7; 19.2-77;\nand (iv) upon approval by the appropriate circuit court of a petition by the\nlocal governing body for concurrent jurisdiction in designated areas with the\npolice officers of the locality in which the institution, its satellite\ncampuses, or other properties are located. The local governing body may only\npetition the circuit court for such concurrent jurisdiction pursuant to a\nrequest by the local law-enforcement agency.\n\nC. Each public institution of higher education and private institution of higher\neducation that establishes a campus police force pursuant to this article shall\nenter into and become a party to a mutual aid agreement with an adjacent local\nlaw-enforcement agency or the Department of State Police for the use of their\nregular and auxiliary joint forces, equipment, and materials when needed in the\ninvestigation of any felony criminal sexual assault or medically unattended\ndeath occurring on property owned or controlled by such institution or any death\nresulting from an incident occurring on such property. Such mutual aid\nagreements shall include provisions requiring either the campus police force or\nthe agency with which it has established a mutual aid agreement pursuant to this\nsubsection, in the event that such police force or agency conducts an\ninvestigation that involves a felony criminal sexual assault as set forth in\nArticle 7 (&#xA7; 18.2-61 et seq.) of Chapter 4 of Title 18.2 occurring on\ncampus, in or on a noncampus building or property, or on public property, to\nnotify the local attorney for the Commonwealth of such investigation within 48\nhours of beginning such investigation. No such notification provision shall\nrequire a campus police force or the agency with which it has established a\nmutual aid agreement to disclose identifying information about the victim.\nNothing in this section prohibits a campus police force or auxiliary police\nforce from requesting assistance from any appropriate law-enforcement agency of\nthe Commonwealth with which the institution has not entered into a mutual aid\nagreement.\n\nD. No such notification provision shall require the law-enforcement\nagency or the Department to disclose identifying information about the victim.\n\nE.
