Its supervision shall ensure that major risks to election integrity are (i) identified and assessed and (ii) addressed as necessary to promote election uniformity, legality, and purity. It shall make rules and regulations and issue instructions and provide information consistent with the election laws to the electoral boards and registrars to promote the proper administration of election laws. Electoral boards and registrars shall provide information requested by the State Board and shall follow (a) the elections laws and (b) the rules and regulations of the State Board insofar as they do not conflict with Virginia or federal law. The State Board shall post on the Internet within three business days any rules or regulations made by the State Board. Upon request and at a reasonable charge not to exceed the actual cost incurred, the State Board shall provide to any requesting political party or candidate, within three days of the receipt of the request, copies of any instructions or information provided by the State Board to the local electoral boards and registrars.B\n\nThe State Board, through the Department of Elections, shall ensure that the members of the electoral boards are properly trained to carry out their duties by offering training annually, or more often, as it deems appropriate, and without charging any fees to the electoral boards for the training.C\n\nThe State Board, through the Department of Elections, shall conduct a certification program for the general registrars and shall require each general registrar to receive certification through such program from the Department within 12 months of his initial appointment or any subsequent reappointment. The State Board shall develop a training curriculum for the certification program and standards for completing the program and maintaining certification, including required hours of annual training. No fees shall be charged to a general registrar for any required training as part of the certification program. The <span class=\"dictionary\">State Board<\/span> shall review the standardized training <span class=\"dictionary\">materials<\/span> and the content of the online training course every two years in the year immediately following a <span class=\"dictionary\">general election<\/span> for federal office. <a id=\"paragraph-284580\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/24.2-103\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> The <span class=\"dictionary\">State Board<\/span> may institute proceedings pursuant to &#xA7; <a class=\"law\" title=\"Removal of members of local electoral boards and general registrars\" href=\"\/24.2-234.1\/\">24.2-234.1<\/a> for the removal of any member of an electoral board or <span class=\"dictionary\">general registrar<\/span> who fails to discharge the duties of his office in accordance with <span class=\"dictionary\">law<\/span>. Such action shall require a recorded majority vote of the Board. <a id=\"paragraph-284581\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/24.2-103\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> The <span class=\"dictionary\">State Board<\/span> may <span class=\"dictionary\">petition<\/span> a <span class=\"dictionary\">circuit<\/span> <span class=\"dictionary\">court<\/span> or the Supreme <span class=\"dictionary\">Court<\/span>, whichever is appropriate, for a <span class=\"dictionary\">writ of mandamus<\/span> or prohibition, or other available legal relief, for the purpose of ensuring that elections are conducted as provided by <span class=\"dictionary\">law<\/span>. <a id=\"paragraph-284582\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/24.2-103\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> The <span class=\"dictionary\">Department of Elections<\/span> shall supervise its own staff to assure that no member of its staff shall serve (i) as the chairman of a <span class=\"dictionary\">political party<\/span> or other officer of a state-, local-, or district-level <span class=\"dictionary\">political party<\/span> committee or (ii) as a paid or volunteer worker in the campaign of a <span class=\"dictionary\">candidate<\/span> for nomination or election to an office filled by election in whole or in part by the <span class=\"dictionary\">qualified voters<\/span> of the Commonwealth. <a id=\"paragraph-284583\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/24.2-103\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"H\"><p><span class=\"prefix-number\">H.<\/span> The <span class=\"dictionary\">Department of Elections<\/span> shall employ a Director of Operations who shall be responsible for managing the day-to-day operations at the <span class=\"dictionary\">Department of Elections<\/span> and ensuring (i) fulfillment of the Department&#8217;s mission and responsibilities; (ii) compliance with state and federal election <span class=\"dictionary\">laws<\/span> and regulations; and (iii) compliance with the Department&#8217;s business, administrative, and financial policies. This position shall be a full-time classified position subject to the Virginia Personnel Act (&#xA7; <a class=\"law\" title=\"Short title; purpose\" href=\"\/2.2-2900\/\">2.2-2900<\/a> et seq.). <a id=\"paragraph-284584\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/24.2-103\/#H\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I\"><p><span class=\"prefix-number\">I.<\/span> The <span class=\"dictionary\">State Board<\/span> shall adopt a seal for its use and bylaws for its own proceedings. <a id=\"paragraph-284585\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/24.2-103\/#I\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"J\"><p><span class=\"prefix-number\">J.<\/span> The <span class=\"dictionary\">State Board<\/span> shall submit an annual report to the Governor and the General Assembly on the activities of the <span class=\"dictionary\">State Board<\/span> and the <span class=\"dictionary\">Department of Elections<\/span> in the previous year. Such report shall be governed by the provisions of &#xA7; <a class=\"law\" title=\"Furnishing reports; Governor authorized to require reports\" href=\"\/2.2-608\/\">2.2-608<\/a>. <a id=\"paragraph-284586\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/24.2-103\/#J\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nPOWERS AND DUTIES IN GENERAL; REPORT (\u00a7 24.2-103)\n\nA. The State Board, through the Department of Elections, shall supervise and\ncoordinate the work of the county and city electoral boards and of the\nregistrars to obtain uniformity in their practices and proceedings and legality\nand purity in all elections. Its supervision shall ensure that major risks to\nelection integrity are (i) identified and assessed and (ii) addressed as\nnecessary to promote election uniformity, legality, and purity. It shall make\nrules and regulations and issue instructions and provide information consistent\nwith the election laws to the electoral boards and registrars to promote the\nproper administration of election laws. Electoral boards and registrars shall\nprovide information requested by the State Board and shall follow (a) the\nelections laws and (b) the rules and regulations of the State Board insofar as\nthey do not conflict with Virginia or federal law. The State Board shall post on\nthe Internet within three business days any rules or regulations made by the\nState Board. Upon request and at a reasonable charge not to exceed the actual\ncost incurred, the State Board shall provide to any requesting political party\nor candidate, within three days of the receipt of the request, copies of any\ninstructions or information provided by the State Board to the local electoral\nboards and registrars.\n\nB. The State Board, through the Department of Elections, shall ensure that the\nmembers of the electoral boards are properly trained to carry out their duties\nby offering training annually, or more often, as it deems appropriate, and\nwithout charging any fees to the electoral boards for the training.\n\nC. The State Board, through the Department of Elections, shall conduct a\ncertification program for the general registrars and shall require each general\nregistrar to receive certification through such program from the Department\nwithin 12 months of his initial appointment or any subsequent reappointment. The\nState Board may grant a waiver requested by a local electoral board to extend,\non a case-by-case basis, this deadline by up to three months. The State Board\nshall develop a training curriculum for the certification program and standards\nfor completing the program and maintaining certification, including required\nhours of annual training. No fees shall be charged to a general registrar for\nany required training as part of the certification program. The State Board\nshall review the certification program every four years, or more often as it\ndeems appropriate.\n\nD. The State Board shall set the training standards for the officers of election\nand shall develop standardized training programs for the officers of election to\nbe conducted by the local electoral boards and the general registrars. Training\nof the officers of election shall be conducted and certified as provided by\n&#xA7; 24.2-115.2. The State Board shall provide standardized training materials\nfor such training and shall also offer on the Department of Elections website a\ntraining course for officers of election. The content of the online training\ncourse shall be consistent with the standardized training programs developed\npursuant to this section.
