I, c. 217; 2023, c. 785.","full_text":"A\n\nThe Department of Elections shall provide for the continuing operation and maintenance of a central recordkeeping system, the Virginia voter registration system, for all voters registered in the Commonwealth.\n\t\t\tIn order to operate and maintain the system, the Department shall:1\n\nMaintain a complete, separate, and accurate record of all registered voters in the Commonwealth. Such system shall automatically register a person who has preregistered pursuant to &#xA7; 24.2-403.1 upon that person becoming eligible for registration under &#xA7; 24.2-403 or reaching 18 years of age, whichever comes first. Such system shall also assign a unique identifier to each voter registered in the system.2\n\nRequire the general registrars to enter the names of all registered voters into the system and to change or correct registration records as necessary.3\n\nProvide to each general registrar voter confirmation documents for newly registered voters, including voters who were automatically registered pursuant to subdivision 1, and for notice to registered voters on the system of changes and corrections in their registration records and polling places.4\n\nRequire the general registrars to delete from the record of registered voters the name of any voter who (i) is deceased, (ii) is no longer qualified to vote in the county or city where he is registered due to removal of his residence, (iii) has been convicted of a felony, (iv) has been adjudicated incapacitated, (v) is known not to be a United States citizen by reason of reports from the Department of Motor Vehicles pursuant to &#xA7; 24.2-410.1 or from the Department of Elections based on information received from the Systematic Alien Verification for Entitlements Program (SAVE Program) pursuant to subsection E, or (vi) is otherwise no longer qualified to vote as may be provided by law. Such action shall be taken no later than 30 days after notification from the Department. The Department shall promptly provide the information referred to in this subdivision, upon receiving it, to general registrars.5\n\nRetain on the system for four years a separate record for registered voters whose names have been deleted, with the reason for deletion.6\n\nRetain on the system permanently a separate record for information received regarding deaths, felony convictions, and adjudications of incapacity pursuant to &#xA7;&#xA7; 24.2-408 through 24.2-410.7\n\nProvide to each general registrar, at least 16 days prior to a general or primary election and three days prior to a special election, an alphabetical list of all registered voters in each precinct or portion of a precinct in which the election is being held in the county, city, or town. These precinct lists shall be used as the official lists of qualified voters and shall constitute the pollbooks. The Department shall provide instructions for the division of the pollbooks and precinct lists into sections to accommodate the efficient processing of voter lines at the polls. Prior to any general, primary, or special election, the Department shall provide any general registrar, upon his request, with a separate electronic list of all registered voters in the registrar&#8217;s county or city. If electronic pollbooks are used in the locality or electronic voter registration inquiry devices are used in precincts in the locality, the Department shall provide a regional or statewide list of registered voters to the general registrar of the locality. The Department shall determine whether regional or statewide data is provided. Neither the pollbook nor the regional or statewide list of registered voters shall include the day and month of birth of the voter, but shall include the voter&#8217;s year of birth.8\n\nAcquire by purchase, lease, or contract equipment necessary to execute the duties of the Department.9\n\nUse any source of information that may assist in carrying out the purposes of this section. All agencies of the Commonwealth shall cooperate with the Department in procuring and exchanging identification information for the purpose of maintaining the voter registration system. The Department may share any information that it receives from another agency of the Commonwealth with any Chief Election Officer of another state for the maintenance of the voter registration system.10\n\nCooperate with other states and jurisdictions to develop systems to compare voters, voter history, and voter registration lists to ensure the accuracy of the voter registration rolls, to identify voters whose addresses have changed, to prevent duplication of registration in more than one state or jurisdiction, and to determine eligibility of individuals to vote in Virginia.11\n\nReprint and impose a reasonable charge for the sale of any part of Title 24.2, lists of precincts and polling places, statements of election results by precinct, and any other items required of the Department by law. Receipts from such sales shall be credited to the Board for reimbursement of printing expenses.B\n\nThe Department shall be authorized to provide for the production, distribution, and receipt of information and lists through the Virginia voter registration system by any appropriate means including, but not limited to, paper and electronic means. The Virginia Freedom of Information Act (&#xA7; 2.2-3700 et seq.) shall not apply to records about individuals maintained in this system.C\n\nThe State Board shall institute procedures to ensure that each requirement of this section is fulfilled. As part of its procedures, the State Board shall provide that the general registrar shall mail notice of any cancellation pursuant to clause (v) of subdivision A 4 to the person whose registration is cancelled.D\n\nThe State Board shall promulgate rules and regulations to ensure the uniform application of the law for determining a person&#8217;s residence.E\n\nThe Department shall apply to participate in the Systematic Alien Verification for Entitlements Program (SAVE Program) operated by U.S. Citizenship and Immigration Services of the U.S. Department of Homeland Security for the purposes of verifying that voters listed in the Virginia voter registration system are United States citizens. Upon approval of the application, the Department shall enter into any required memorandum of agreement with U.S. Citizenship and Immigration Services. The State Board shall promulgate rules and regulations governing the use of the immigration status and citizenship status information received from the SAVE Program.F\n\nThe Department shall report annually by October 1 for the preceding 12 months ending August 31 to the Committees on Privileges and Elections on each of its activities undertaken to maintain the Virginia voter registration system and the results of those activities. The Department&#8217;s report shall be governed by the provisions of &#xA7; 2.2-608 and shall encompass activities undertaken pursuant to subdivisions A 9 and 10 and subsection E and pursuant to &#xA7;&#xA7; 24.2-404.3, 24.2-404.4, 24.2-408, 24.2-409, 24.2-409.1, 24.2-410, 24.2-410.1, 24.2-427, and 24.2-428. This report shall contain the methodology used in gathering and analyzing the data. Such system shall automatically register a person who has preregistered pursuant to &#xA7; <a class=\"law\" title=\"Preregistration of persons 16 years of age or older\" href=\"\/24.2-403.1\/\">24.2-403.1<\/a> upon that person becoming eligible for registration under &#xA7; <a class=\"law\" title=\"Persons under 18 years of age\" href=\"\/24.2-403\/\">24.2-403<\/a> or reaching 18 years of age, whichever comes first. Such system shall also assign a unique identifier to each voter registered in the system. <a id=\"paragraph-214469\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/24.2-404\/#A1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Require the <span class=\"dictionary\">general registrars<\/span> to enter the names of all <span class=\"dictionary\">registered voters<\/span> into the system and to change or correct <span class=\"dictionary\">registration records<\/span> as necessary. <a id=\"paragraph-214470\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/24.2-404\/#A2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Provide to each <span class=\"dictionary\">general registrar<\/span> voter confirmation documents for newly <span class=\"dictionary\">registered voters<\/span>, including voters who were automatically registered pursuant to subdivision 1, and for notice to <span class=\"dictionary\">registered voters<\/span> on the system of changes and corrections in their <span class=\"dictionary\">registration records<\/span> and <span class=\"dictionary\">polling places<\/span>. <a id=\"paragraph-214471\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/24.2-404\/#A3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Require the <span class=\"dictionary\">general registrars<\/span> to delete from the record of <span class=\"dictionary\">registered voters<\/span> the name of any voter who (i) is deceased, (ii) is no longer qualified to vote in the county or city where he is registered due to removal of his <span class=\"dictionary\">residence<\/span>, (iii) has been convicted of a <span class=\"dictionary\">felony<\/span>, (iv) has been adjudicated incapacitated, (v) is known not to be a United States citizen by reason of reports from the Department of Motor Vehicles pursuant to &#xA7; <a class=\"law\" title=\"Citizenship status; Department of Motor Vehicles to furnish lists of noncitizens\" href=\"\/24.2-410.1\/\">24.2-410.1<\/a> or from the <span class=\"dictionary\">Department of Elections<\/span> based on information received from the Systematic Alien Verification for Entitlements Program (SAVE Program) pursuant to subsection E, or (vi) is otherwise no longer qualified to vote as may be provided by <span class=\"dictionary\">law<\/span>. Such action shall be taken no later than 30 days after notification from the Department. The Department shall promptly provide the information referred to in this subdivision, upon receiving it, to <span class=\"dictionary\">general registrars<\/span>. <a id=\"paragraph-214472\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/24.2-404\/#A4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Retain on the system for four years a separate record for <span class=\"dictionary\">registered voters<\/span> whose names have been deleted, with the reason for deletion. <a id=\"paragraph-214473\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/24.2-404\/#A5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Retain on the system permanently a separate record for information received regarding deaths, <span class=\"dictionary\">felony<\/span> <span class=\"dictionary\">convictions<\/span>, and adjudications of incapacity pursuant to &#xA7;&#xA7; <a class=\"law\" title=\"State Registrar of Vital Records to transmit weekly lists of decedents to Department of Elections\" href=\"\/24.2-408\/\">24.2-408<\/a> through <a class=\"law\" title=\"Clerks of circuit courts to furnish lists of certain adjudications\" href=\"\/24.2-410\/\">24.2-410<\/a>. <a id=\"paragraph-214474\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/24.2-404\/#A6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Provide to each <span class=\"dictionary\">general registrar<\/span>, at least 16 days prior to a general or <span class=\"dictionary\">primary election<\/span> and three days prior to a <span class=\"dictionary\">special election<\/span>, an alphabetical list of all <span class=\"dictionary\">registered voters<\/span> in each <span class=\"dictionary\">precinct<\/span> or portion of a <span class=\"dictionary\">precinct<\/span> in which the election is being held in the county, city, or town. These <span class=\"dictionary\">precinct<\/span> lists shall be used as the official lists of <span class=\"dictionary\">qualified voters<\/span> and shall constitute the pollbooks. The Department shall provide instructions for the division of the pollbooks and <span class=\"dictionary\">precinct<\/span> lists into sections to accommodate the efficient processing of voter lines at the polls. Prior to any general, primary, or <span class=\"dictionary\">special election<\/span>, the Department shall provide any <span class=\"dictionary\">general registrar<\/span>, upon his request, with a separate electronic list of all <span class=\"dictionary\">registered voters<\/span> in the registrar&#8217;s county or city. If electronic pollbooks are used in the locality or electronic voter registration inquiry devices are used in <span class=\"dictionary\">precincts<\/span> in the locality, the Department shall provide a regional or statewide list of <span class=\"dictionary\">registered voters<\/span> to the <span class=\"dictionary\">general registrar<\/span> of the locality. The Department shall determine whether regional or statewide data is provided. Neither the pollbook nor the regional or statewide list of <span class=\"dictionary\">registered voters<\/span> shall include the day and month of birth of the voter, but shall include the voter&#8217;s year of birth. <a id=\"paragraph-214475\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/24.2-404\/#A7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> Acquire by purchase, lease, or <span class=\"dictionary\">contract<\/span> equipment necessary to execute the duties of the Department. <a id=\"paragraph-214476\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/24.2-404\/#A8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> Use any source of information that may assist in carrying out the purposes of this section. All agencies of the Commonwealth shall cooperate with the Department in procuring and exchanging identification information for the purpose of maintaining the <span class=\"dictionary\">voter registration system<\/span>. The Department may share any information that it receives from another agency of the Commonwealth with any Chief Election Officer of another state for the maintenance of the <span class=\"dictionary\">voter registration system<\/span>. <a id=\"paragraph-214477\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/24.2-404\/#A9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> Cooperate with other states and <span class=\"dictionary\">jurisdictions<\/span> to develop systems to compare voters, voter history, and voter registration lists to ensure the accuracy of the voter registration rolls, to identify voters whose addresses have changed, to prevent duplication of registration in more than one state or <span class=\"dictionary\">jurisdiction<\/span>, and to determine eligibility of individuals to vote in Virginia. <a id=\"paragraph-214478\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/24.2-404\/#A10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A11\" class=\"indent-1\"><p><span class=\"prefix-number\">11.<\/span> Reprint and impose a reasonable charge for the sale of any part of Title 24.2, lists of <span class=\"dictionary\">precincts<\/span> and <span class=\"dictionary\">polling places<\/span>, statements of election results by <span class=\"dictionary\">precinct<\/span>, and any other items required of the Department by <span class=\"dictionary\">law<\/span>. Receipts from such sales shall be credited to the <span class=\"dictionary\">Board<\/span> for reimbursement of printing expenses. <a id=\"paragraph-214479\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/24.2-404\/#A11\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> The Department shall be authorized to provide for the production, distribution, and receipt of information and lists through the <span class=\"dictionary\">Virginia <span class=\"dictionary\">voter registration system<\/span><\/span> by any appropriate means including, but not limited to, paper and electronic means. The Virginia Freedom of Information Act (&#xA7; <a class=\"law\" title=\"Short title; policy\" href=\"\/2.2-3700\/\">2.2-3700<\/a> et seq.) shall not apply to records about individuals maintained in this system. <a id=\"paragraph-214480\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/24.2-404\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> The <span class=\"dictionary\">State Board<\/span> shall institute procedures to ensure that each requirement of this section is fulfilled. As part of its procedures, the <span class=\"dictionary\">State Board<\/span> shall provide that the <span class=\"dictionary\">general registrar<\/span> shall mail notice of any cancellation pursuant to clause (v) of subdivision A 4 to the person whose registration is cancelled. <a id=\"paragraph-214481\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/24.2-404\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> The <span class=\"dictionary\">State Board<\/span> shall promulgate rules and regulations to ensure the uniform application of the <span class=\"dictionary\">law<\/span> for determining a person&#8217;s <span class=\"dictionary\">residence<\/span>. <a id=\"paragraph-214482\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/24.2-404\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> The Department shall apply to participate in the Systematic Alien Verification for Entitlements Program (SAVE Program) operated by U.S. Citizenship and Immigration Services of the U.S. Department of Homeland Security for the purposes of verifying that voters listed in the <span class=\"dictionary\">Virginia <span class=\"dictionary\">voter registration system<\/span><\/span> are United States citizens. Upon approval of the application, the Department shall enter into any required <span class=\"dictionary\">memorandum<\/span> of agreement with U.S. Citizenship and Immigration Services. The <span class=\"dictionary\">State Board<\/span> shall promulgate rules and regulations governing the use of the immigration status and citizenship status information received from the SAVE Program. <a id=\"paragraph-214483\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/24.2-404\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> The Department shall report annually by October 1 for the preceding 12 months ending August 31 to the Committees on <span class=\"dictionary\">Privileges<\/span> and Elections on each of its activities undertaken to maintain the <span class=\"dictionary\">Virginia <span class=\"dictionary\">voter registration system<\/span><\/span> and the results of those activities. The Department&#8217;s report shall be governed by the provisions of &#xA7; <a class=\"law\" title=\"Furnishing reports; Governor authorized to require reports\" href=\"\/2.2-608\/\">2.2-608<\/a> and shall encompass activities undertaken pursuant to subdivisions A 9 and 10 and subsection E and pursuant to &#xA7;&#xA7; <a class=\"law\" title=\"Duty of Department of Elections; verification of registered voter lists\" href=\"\/24.2-404.3\/\">24.2-404.3<\/a>, <a class=\"law\" title=\"Exchange of registered voter lists with other states\" href=\"\/24.2-404.4\/\">24.2-404.4<\/a>, <a class=\"law\" title=\"State Registrar of Vital Records to transmit weekly lists of decedents to Department of Elections\" href=\"\/24.2-408\/\">24.2-408<\/a>, <a class=\"law\" title=\"Central Criminal Records Exchange to transmit lists of felony convictions to Department of Elections\" href=\"\/24.2-409\/\">24.2-409<\/a>, <a class=\"law\" title=\"Department of Elections to transmit information pertaining to persons convicted of a felony in federal court\" href=\"\/24.2-409.1\/\">24.2-409.1<\/a>, <a class=\"law\" title=\"Clerks of circuit courts to furnish lists of certain adjudications\" href=\"\/24.2-410\/\">24.2-410<\/a>, <a class=\"law\" title=\"Citizenship status; Department of Motor Vehicles to furnish lists of noncitizens\" href=\"\/24.2-410.1\/\">24.2-410.1<\/a>, <a class=\"law\" title=\"Cancellation of registration by voter or for persons known to be deceased or disqualified to vote\" href=\"\/24.2-427\/\">24.2-427<\/a>, and <a class=\"law\" title=\"Regular periodic review of registration records; notice to voters identified as having moved; placement on inactive status for failure to respond to notice\" href=\"\/24.2-428\/\">24.2-428<\/a>. The Department of Elections shall provide for the continuing operation and\nmaintenance of a central recordkeeping system, the Virginia voter registration\nsystem, for all voters registered in the Commonwealth.\n\t\t\tIn order to operate and maintain the system, the Department shall:\n\n   1. Maintain a complete, separate, and accurate record of all registered voters\n   in the Commonwealth. The Department may share\n   any information that it receives from another agency of the Commonwealth with\n   any Chief Election Officer of another state for the maintenance of the voter\n   registration system.\n\n   10. Cooperate with other states and jurisdictions to develop systems to\n   compare voters, voter history, and voter registration lists to ensure the\n   accuracy of the voter registration rolls, to identify voters whose addresses\n   have changed, to prevent duplication of registration in more than one state or\n   jurisdiction, and to determine eligibility of individuals to vote in Virginia.\n\n   11. Reprint and impose a reasonable charge for the sale of any part of Title\n   24.2, lists of precincts and polling places, statements of election results by\n   precinct, and any other items required of the Department by law. Receipts from\n   such sales shall be credited to the Board for reimbursement of printing\n   expenses.\n\nB. The Department shall be authorized to provide for the production,\ndistribution, and receipt of information and lists through the Virginia voter\nregistration system by any appropriate means including, but not limited to,\npaper and electronic means. The Virginia Freedom of Information Act (&#xA7;\n2.2-3700 et seq.) shall not apply to records about individuals maintained in\nthis system.\n\nC. The State Board shall institute procedures to ensure that each requirement of\nthis section is fulfilled. As part of its procedures, the State Board shall\nprovide that the general registrar shall mail notice of any cancellation\npursuant to clause (v) of subdivision A 4 to the person whose registration is\ncancelled.\n\nD. The State Board shall promulgate rules and regulations to ensure the uniform\napplication of the law for determining a person&#8217;s residence.\n\nE. The Department shall apply to participate in the Systematic Alien\nVerification for Entitlements Program (SAVE Program) operated by U.S.\nCitizenship and Immigration Services of the U.S. Department of Homeland Security\nfor the purposes of verifying that voters listed in the Virginia voter\nregistration system are United States citizens. Upon approval of the\napplication, the Department shall enter into any required memorandum of\nagreement with U.S. Citizenship and Immigration Services. The State Board shall\npromulgate rules and regulations governing the use of the immigration status and\ncitizenship status information received from the SAVE Program.\n\nF. The Department shall report annually by October 1 for the preceding 12 months\nending August 31 to the Committees on Privileges and Elections on each of its\nactivities undertaken to maintain the Virginia voter registration system and the\nresults of those activities. The Department&#8217;s report shall be governed by\nthe provisions of &#xA7; 2.2-608 and shall encompass activities undertaken\npursuant to subdivisions A 9 and 10 and subsection E and pursuant to\n&#xA7;&#xA7; 24.2-404.3, 24.2-404.4, 24.2-408, 24.2-409, 24.2-409.1, 24.2-410,\n24.2-410.1, 24.2-427, and 24.2-428. This report shall contain the methodology\nused in gathering and analyzing the data.
