{"formats":[{"name":"JSON","format":"json","url":"\/downloads\/2025\/code-json\/24.2-955.1.json"},{"name":"Plain Text","format":"text","url":"\/downloads\/2025\/code-text\/24.2-955.1.txt"},{"name":"XML","format":"xml","url":"\/downloads\/2025\/code-xml\/24.2-955.1.xml"},{"name":"HTML","format":"html","url":"\/downloads\/2025\/code-html\/24.2-955.1.html"}],"law_id":79350,"edition_id":1,"section_id":79350,"structure_id":16245,"section_number":"24.2-955.1","catch_line":"Definitions","history":"2002, c. 487, \u00a7 24.2-942; 2003, c. 237; 2006, cc. 787, 892; 2015, c. 573; 2020, cc. 551, 554, 615.","full_text":"As used in this chapter, unless the context requires a different meaning:\n\t\t&#8220;Advertisement&#8221; means any message appearing in the print media, on television, on radio, or on an online platform, that constitutes a contribution or expenditure under Chapter 9.3 (\u00a7 24.2-945 et seq.). &#8220;Advertisement&#8221; shall not include novelty items authorized by a candidate including, but not limited to, pens, pencils, magnets, and buttons to be attached to wearing apparel.\n\t\t&#8220;Authorized by ______&#8221; means the same as &#8220;authorization&#8221; as defined in \u00a7 24.2-945.1.\n\t\t&#8220;Campaign telephone calls&#8221; means a series of telephone calls or text messages, electronic or otherwise, made (i) to 25 or more telephone numbers in the Commonwealth, (ii) during the 180 days before a general or special election or during the 90 days before a primary or other political party nominating event, (iii) conveying or soliciting information relating to any candidate or political party participating in the election, primary, or other nominating event, and (iv) under an agreement to compensate the telephone callers.\n\t\t&#8220;Candidate&#8221; means &#8220;candidate&#8221; as defined in \u00a7 24.2-101.\n\t\t&#8220;Candidate campaign committee&#8221; or &#8220;campaign committee&#8221; means &#8220;campaign committee&#8221; as defined in \u00a7 24.2-945.1.\n\t\t&#8220;Coordinated&#8221; or &#8220;coordination&#8221; means an expenditure that is made (i) at the express request or suggestion of a candidate, a candidate&#8217;s campaign committee, or an agent of the candidate or his campaign committee or (ii) with material involvement of the candidate, a candidate&#8217;s campaign committee, or an agent of the candidate or his campaign committee in devising the strategy, content, means of dissemination, or timing of the expenditure.\n\t\t&#8220;Conspicuous&#8221; means so written, displayed, or communicated that a reasonable person ought to have noticed it.\n\t\t&#8220;Full-screen&#8221; means the only picture appearing on the television screen during the oral disclosure statement that (i) contains the disclosing person, (ii) occupies all visible space on the television screen, and (iii) contains the image of the disclosing person that occupies at least 50% of the vertical height of the television screen.\n\t\t&#8220;Independent expenditure&#8221; means &#8220;independent expenditure&#8221; as defined in \u00a7 24.2-945.1.\n\t\t&#8220;Name of candidate&#8221; means (i) the full name of the candidate as it appears on the statement of qualification filed pursuant to \u00a7 24.2-501 or as it will appear on the ballot or (ii) the first name, middle name, or &#8220;nickname&#8221; of the candidate as it appears on his statement of qualification and a last name of the candidate as it appears on his statement of qualification.\n\t\t&#8220;Occurrence&#8221; means one broadcast of a radio or television political campaign advertisement.\n\t\t&#8220;Online platform&#8221; means any public-facing website, web application, or digital application, including a social network, ad network, or search engine, that sells advertisements.\n\t\t&#8220;Online political advertisement&#8221; means an advertisement that is placed or promoted for a fee on an online platform.\n\t\t&#8220;Online political advertiser&#8221; means any person who purchases an advertisement from an online platform or promotes an advertisement on an online platform for a fee.\n\t\t&#8220;Political action committee&#8221; means &#8220;political action committee&#8221; as defined in \u00a7 24.2-945.1.\n\t\t&#8220;Political committee&#8221; means &#8220;political committee&#8221; as defined in \u00a7 24.2-945.1.\n\t\t&#8220;Political party&#8221; has the same meaning as &#8220;party&#8221; or &#8220;political party&#8221; as defined in \u00a7 24.2-101.\n\t\t&#8220;Political party committee&#8221; means any state political party committee, congressional district political party committee, county or city political party committee, or organized political party group of elected officials. The term shall not include any other organization or auxiliary associated with or using the name of a political party.\n\t\t&#8220;Print media&#8221; means billboards, cards, newspapers, newspaper inserts, magazines, printed material disseminated through the mail, pamphlets, fliers, bumper stickers, periodicals, websites, electronic mail, non-video or non-audio messages placed or promoted for a fee on an online platform, yard signs, and outdoor advertising facilities. If a single print media advertisement consists of multiple pages, folds, or faces, the disclosure requirement of this section applies only to one page, fold, or face.\n\t\t&#8220;Radio&#8221; means any radio broadcast station that is subject to the provisions of 47 U.S.C. \u00a7\u00a7 315 and 317.\n\t\t&#8220;Scan line&#8221; means a standard term of measurement used in the electronic media industry calculating a certain area in a television advertisement.\n\t\t&#8220;Sponsor&#8221; means a candidate, candidate campaign committee, political committee, or person that purchases an advertisement.\n\t\t&#8220;Telephone call&#8221; means any single telephone call or text message, electronic or otherwise, that when combined with other telephone calls or text messages constitutes campaign telephone calls.\n\t\t&#8220;Television&#8221; means any television broadcast station, cable television system, wireless-cable multipoint distribution system, satellite company, or telephone company transmitting video programming that is subject to the provisions of 47 U.S.C. \u00a7\u00a7 315 and 317.\n\t\t&#8220;Unobscured&#8221; means that the only printed material that may appear on the television screen is a visual disclosure statement required by law, and that nothing is blocking the view of the disclosing person&#8217;s face.\n\t\t&#8220;Yard sign&#8221; means a sign paid for or distributed by a candidate, campaign committee, or political committee to be placed on public or private property. If a single <span class=\"dictionary\">print media<\/span> advertisement consists of multiple pages, folds, or faces, the disclosure requirement of this section applies only to one page, fold, or face.\n\t\t&#8220;<span class=\"dictionary\">Radio<\/span>&#8221; means any <span class=\"dictionary\">radio<\/span> broadcast station that is subject to the provisions of 47 U.S.C. \u00a7\u00a7&nbsp;315 and 317.\n\t\t&#8220;<span class=\"dictionary\">Scan line<\/span>&#8221; means a standard term of measurement used in the electronic media industry calculating a certain area in a <span class=\"dictionary\">television<\/span> advertisement.\n\t\t&#8220;<span class=\"dictionary\">Sponsor<\/span>&#8221; means a candidate, <span class=\"dictionary\">candidate campaign committee<\/span>, <span class=\"dictionary\">political committee<\/span>, or person that purchases an advertisement.\n\t\t&#8220;<span class=\"dictionary\">Telephone call<\/span>&#8221; means any single <span class=\"dictionary\">telephone call<\/span> or text message, electronic or otherwise, that when combined with other telephone calls or text messages constitutes <span class=\"dictionary\">campaign telephone calls<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Television<\/span>&#8221; means any <span class=\"dictionary\">television<\/span> broadcast station, cable <span class=\"dictionary\">television<\/span> system, wireless-cable multipoint distribution system, satellite company, or telephone company transmitting video programming that is subject to the provisions of 47 U.S.C. \u00a7\u00a7&nbsp;315 and 317.\n\t\t&#8220;<span class=\"dictionary\">Unobscured<\/span>&#8221; means that the only printed <span class=\"dictionary\">material<\/span> that may appear on the <span class=\"dictionary\">television<\/span> screen is a visual <span class=\"dictionary\">disclosure statement<\/span> required by <span class=\"dictionary\">law<\/span>, and that nothing is blocking the view of the disclosing person&#8217;s face.\n\t\t&#8220;<span class=\"dictionary\">Yard sign<\/span>&#8221; means a sign paid for or distributed by a candidate, campaign committee, or <span class=\"dictionary\">political committee<\/span> to be placed on public or private property. <span class=\"dictionary\">Yard signs<\/span> paid for or distributed prior to July 1, 2015, shall not be subject to the provisions of \u00a7\u00a7&nbsp;<a class=\"law\" title=\"Requirements for print media advertisements sponsored by a candidate campaign committee\" href=\"\/24.2-956\/\">24.2-956<\/a> and <a class=\"law\" title=\"Requirements for print media advertisements sponsored by a person or political committee, other than a candidate campaign committee\" href=\"\/24.2-956.1\/\">24.2-956.1<\/a>.<\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nDEFINITIONS (\u00a7 24.2-955.1)\n\nAs used in this chapter, unless the context requires a different meaning:\n\t\t&#8220;Advertisement&#8221; means any message appearing in the print media, on\ntelevision, on radio, or on an online platform, that constitutes a contribution\nor expenditure under Chapter 9.3 (\u00a7 24.2-945 et seq.).\n&#8220;Advertisement&#8221; shall not include novelty items authorized by a\ncandidate including, but not limited to, pens, pencils, magnets, and buttons to\nbe attached to wearing apparel.\n\t\t&#8220;Authorized by ______&#8221; means the same as\n&#8220;authorization&#8221; as defined in \u00a7 24.2-945.1.\n\t\t&#8220;Campaign telephone calls&#8221; means a series of telephone calls or\ntext messages, electronic or otherwise, made (i) to 25 or more telephone numbers\nin the Commonwealth, (ii) during the 180 days before a general or special\nelection or during the 90 days before a primary or other political party\nnominating event, (iii) conveying or soliciting information relating to any\ncandidate or political party participating in the election, primary, or other\nnominating event, and (iv) under an agreement to compensate the telephone\ncallers.\n\t\t&#8220;Candidate&#8221; means &#8220;candidate&#8221; as defined in \u00a7\n24.2-101.\n\t\t&#8220;Candidate campaign committee&#8221; or &#8220;campaign committee&#8221;\nmeans &#8220;campaign committee&#8221; as defined in \u00a7 24.2-945.1.\n\t\t&#8220;Coordinated&#8221; or &#8220;coordination&#8221; means an expenditure\nthat is made (i) at the express request or suggestion of a candidate, a\ncandidate&#8217;s campaign committee, or an agent of the candidate or his\ncampaign committee or (ii) with material involvement of the candidate, a\ncandidate&#8217;s campaign committee, or an agent of the candidate or his\ncampaign committee in devising the strategy, content, means of dissemination, or\ntiming of the expenditure.\n\t\t&#8220;Conspicuous&#8221; means so written, displayed, or communicated that a\nreasonable person ought to have noticed it.\n\t\t&#8220;Full-screen&#8221; means the only picture appearing on the television\nscreen during the oral disclosure statement that (i) contains the disclosing\nperson, (ii) occupies all visible space on the television screen, and (iii)\ncontains the image of the disclosing person that occupies at least 50% of the\nvertical height of the television screen.\n\t\t&#8220;Independent expenditure&#8221; means &#8220;independent\nexpenditure&#8221; as defined in \u00a7 24.2-945.1.\n\t\t&#8220;Name of candidate&#8221; means (i) the full name of the candidate as it\nappears on the statement of qualification filed pursuant to \u00a7 24.2-501 or as it\nwill appear on the ballot or (ii) the first name, middle name, or\n&#8220;nickname&#8221; of the candidate as it appears on his statement of\nqualification and a last name of the candidate as it appears on his statement of\nqualification.\n\t\t&#8220;Occurrence&#8221; means one broadcast of a radio or television\npolitical campaign advertisement.\n\t\t&#8220;Online platform&#8221; means any public-facing website, web\napplication, or digital application, including a social network, ad network, or\nsearch engine, that sells advertisements.\n\t\t&#8220;Online political advertisement&#8221; means an advertisement that is\nplaced or promoted for a fee on an online platform.\n\t\t&#8220;Online political advertiser&#8221; means any person who purchases an\nadvertisement from an online platform or promotes an advertisement on an online\nplatform for a fee.\n\t\t&#8220;Political action committee&#8221; means &#8220;political action\ncommittee&#8221; as defined in \u00a7 24.2-945.1.\n\t\t&#8220;Political committee&#8221; means &#8220;political committee&#8221; as\ndefined in \u00a7 24.2-945.1.\n\t\t&#8220;Political party&#8221; has the same meaning as &#8220;party&#8221; or\n&#8220;political party&#8221; as defined in \u00a7 24.2-101.\n\t\t&#8220;Political party committee&#8221; means any state political party\ncommittee, congressional district political party committee, county or city\npolitical party committee, or organized political party group of elected\nofficials.
