If the unit is above the first floor and served by a common corridor, there must be two means of egress; and7\n\nIs free of barriers to egress, ingress, and use by a displaced person with a disability.\n\t\t\t&#8220;Displaced person&#8221; means:1\n\nAny person who moves from real property, or moves his personal property from real property (i) as a direct result of a written notice of intent to acquire or the acquisition of such real property, in whole or in part, for any program or project undertaken by a state agency or (ii) on which such person is a residential tenant or conducts a small business, a farm operation or a business described in clause 4 of the definition of &#8220;business&#8221; in this section as a direct result of rehabilitation, demolition, or other displacing activity as the state agency may prescribe, under a program or project undertaken by the state agency in any case in which the state agency determines that such displacement is permanent;2\n\nSolely for the purposes of &#xA7;&#xA7; 25.1-406, 25.1-407, and 25.1-411, any person who moves from real property, or moves his personal property from real property: (i) as a direct result of a written notice of intent to acquire or the acquisition of other real property, in whole or in part, on which such person conducts a business or farm operation, for a program or project undertaken by a state agency or (ii) as a direct result of rehabilitation, demolition, or other displacing activity as the state agency may prescribe, of other real property on which such person conducts a business or farm operation, under a program or project undertaken by the state agency in any case in which the state agency determines that such displacement is permanent; and3\n\nAny person who moves or discontinues his business or moves other personal property, or moves from his dwelling, as the direct result of (i) federally assisted activities for the enforcement of a building code or other similar code or (ii) a program of rehabilitation or demolition of buildings conducted pursuant to a federally assisted governmental program.\n\t\t\tThe term &#8220;displaced person&#8221; does not include (i) a person who has been determined, according to criteria established by the state agency, to be either in unlawful occupancy of the displacement dwelling or to have occupied such dwelling for the purpose of obtaining assistance under this chapter or (ii) in any case where the state agency acquires property for a program or project, any person, other than a person who was an occupant of the property at the time it was acquired, who occupies such property on a rental basis for a short term or a period subject to termination when the property is needed for the program or project.\n\t\t\t&#8220;Dwelling&#8221; means the place of permanent or customary and usual residence of a person, according to local custom or law, including a single-family house, a single family unit in a two-family, multi-family, or multi-purpose property; a unit of a condominium or cooperative housing project; a nonhousekeeping unit; a mobile home; or any other residential unit.\n\t\t\t&#8220;Farm operation&#8221; means any activity conducted solely or primarily for the production of one or more agricultural products or commodities, including timber, for sale or home use, and customarily producing such products or commodities in sufficient quantity to be capable of contributing materially to the operator&#8217;s support.\n\t\t\t&#8220;Mortgage&#8221; means such classes of liens as are commonly given to secure advances on, or the unpaid purchase price of, real property, together with the credit instruments, if any, secured thereby.\n\t\t\t&#8220;Nonprofit organization&#8221; means an organization that is exempt from paying federal income taxes under &#xA7; 501 of the Internal Revenue Code (26 U.S.C. &#xA7; 501).\n\t\t\t&#8220;Person&#8221; means any (i) individual or (ii) partnership, corporation, limited liability company, association, or other business entity.\n\t\t\t&#8220;Uneconomic remnant&#8221; If the unit is above the first floor and served by a common corridor, there must be two means of egress; and <a id=\"paragraph-284131\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/25.1-400\/#6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"7\"><p><span class=\"prefix-number\">7.<\/span> Is free of barriers to egress, ingress, and use by a displaced <span class=\"dictionary\">person<\/span> with a disability.\n\t\t\t&#8220;Displaced <span class=\"dictionary\">person<\/span>&#8221; means: <a id=\"paragraph-284132\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/25.1-400\/#7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"1\"><p><span class=\"prefix-number\">1.<\/span> Any <span class=\"dictionary\">person<\/span> who moves from real <span class=\"dictionary\">property<\/span>, or moves his personal <span class=\"dictionary\">property<\/span> from real <span class=\"dictionary\">property<\/span> (i) as a direct result of a written notice of <span class=\"dictionary\">intent<\/span> to acquire or the acquisition of such real <span class=\"dictionary\">property<\/span>, in whole or in part, for any program or project undertaken by a <span class=\"dictionary\">state agency<\/span> or (ii) on which such <span class=\"dictionary\">person<\/span> is a residential tenant or conducts a small <span class=\"dictionary\">business<\/span>, a <span class=\"dictionary\">farm operation<\/span> or a <span class=\"dictionary\">business<\/span> described in clause 4 of the definition of &#8220;<span class=\"dictionary\">business<\/span>&#8221; in this section as a direct result of rehabilitation, demolition, or other displacing activity as the <span class=\"dictionary\">state agency<\/span> may prescribe, under a program or project undertaken by the <span class=\"dictionary\">state agency<\/span> in any case in which the <span class=\"dictionary\">state agency<\/span> determines that such displacement is permanent; <a id=\"paragraph-284133\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/25.1-400\/#1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"2\"><p><span class=\"prefix-number\">2.<\/span> Solely for the purposes of &#xA7;&#xA7; <a class=\"law\" title=\"Moving and related expenses\" href=\"\/25.1-406\/\">25.1-406<\/a>, <a class=\"law\" title=\"Optional moving expense allowance for persons displaced from dwelling\" href=\"\/25.1-407\/\">25.1-407<\/a>, and <a class=\"law\" title=\"Relocation planning, assistance coordination, and advisory services\" href=\"\/25.1-411\/\">25.1-411<\/a>, any <span class=\"dictionary\">person<\/span> who moves from real <span class=\"dictionary\">property<\/span>, or moves his personal <span class=\"dictionary\">property<\/span> from real <span class=\"dictionary\">property<\/span>: (i) as a direct result of a written notice of <span class=\"dictionary\">intent<\/span> to acquire or the acquisition of other real <span class=\"dictionary\">property<\/span>, in whole or in part, on which such <span class=\"dictionary\">person<\/span> conducts a <span class=\"dictionary\">business<\/span> or <span class=\"dictionary\">farm operation<\/span>, for a program or project undertaken by a <span class=\"dictionary\">state agency<\/span> or (ii) as a direct result of rehabilitation, demolition, or other displacing activity as the <span class=\"dictionary\">state agency<\/span> may prescribe, of other real <span class=\"dictionary\">property<\/span> on which such <span class=\"dictionary\">person<\/span> conducts a <span class=\"dictionary\">business<\/span> or <span class=\"dictionary\">farm operation<\/span>, under a program or project undertaken by the <span class=\"dictionary\">state agency<\/span> in any case in which the <span class=\"dictionary\">state agency<\/span> determines that such displacement is permanent; and <a id=\"paragraph-284134\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/25.1-400\/#2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"3\"><p><span class=\"prefix-number\">3.<\/span> Any <span class=\"dictionary\">person<\/span> who moves or discontinues his <span class=\"dictionary\">business<\/span> or moves other personal <span class=\"dictionary\">property<\/span>, or moves from his dwelling, as the direct result of (i) federally assisted activities for the enforcement of a building code or other similar code or (ii) a program of rehabilitation or demolition of buildings conducted pursuant to a federally assisted governmental program.\n\t\t\tThe term &#8220;displaced <span class=\"dictionary\">person<\/span>&#8221; does not include (i) a <span class=\"dictionary\">person<\/span> who has been determined, according to criteria established by the <span class=\"dictionary\">state agency<\/span>, to be either in unlawful occupancy of the displacement dwelling or to have occupied such dwelling for the purpose of obtaining assistance under this chapter or (ii) in any case where the <span class=\"dictionary\">state agency<\/span> acquires <span class=\"dictionary\">property<\/span> for a program or project, any <span class=\"dictionary\">person<\/span>, other than a <span class=\"dictionary\">person<\/span> who was an occupant of the <span class=\"dictionary\">property<\/span> at the time it was acquired, who occupies such <span class=\"dictionary\">property<\/span> on a rental basis for a short term or a period subject to termination when the <span class=\"dictionary\">property<\/span> is needed for the program or project.\n\t\t\t&#8220;Dwelling&#8221; means the place of permanent or customary and usual residence of a <span class=\"dictionary\">person<\/span>, according to local custom or <span class=\"dictionary\">law<\/span>, including a single-family house, a single family unit in a two-family, multi-family, or multi-purpose <span class=\"dictionary\">property<\/span>; a unit of a condominium or cooperative housing project; a nonhousekeeping unit; a mobile home; or any other residential unit.\n\t\t\t&#8220;<span class=\"dictionary\">Farm operation<\/span>&#8221; means any activity conducted solely or primarily for the production of one or more agricultural products or commodities, including timber, for sale or home use, and customarily producing such products or commodities in sufficient quantity to be capable of contributing materially to the operator&#8217;s support.\n\t\t\t&#8220;<span class=\"dictionary\">Mortgage<\/span>&#8221; means such classes of <span class=\"dictionary\">liens<\/span> as are commonly given to secure advances on, or the unpaid purchase price of, real <span class=\"dictionary\">property<\/span>, together with the credit instruments, if any, secured thereby.\n\t\t\t&#8220;<span class=\"dictionary\">Nonprofit organization<\/span>&#8221; means an organization that is exempt from paying federal income taxes under &#xA7; 501 of the Internal Revenue Code (26 U.S.C. &#xA7; 501).\n\t\t\t&#8220;<span class=\"dictionary\">Person<\/span>&#8221; means any (i) individual or (ii) partnership, corporation, limited liability company, association, or other <span class=\"dictionary\">business<\/span> entity.\n\t\t\t&#8220;<span class=\"dictionary\">Uneconomic remnant<\/span>&#8221; means a parcel of real <span class=\"dictionary\">property<\/span> in which the <span class=\"dictionary\">owner<\/span> is left with an interest after the partial acquisition of the <span class=\"dictionary\">owner<\/span>&#8217;s <span class=\"dictionary\">property<\/span> and which the <span class=\"dictionary\">state agency<\/span> has determined has little or no value or utility to the <span class=\"dictionary\">owner<\/span>. <a id=\"paragraph-284135\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/25.1-400\/#3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nDEFINITIONS (\u00a7 25.1-400)\n\nAs used in this chapter, unless the context requires a different meaning:\n\t\t&#8220;Business&#8221; means any lawful activity, except a farm operation,\nconducted primarily:\n\n1. For the purchase, sale, lease and rental of personal and of real property,\nand for the manufacture, processing, or marketing of products, commodities, or\nany other personal property;\n\n2. For the sale of services to the public;\n\n3. By a nonprofit organization; or\n\n4. Solely for the purposes of &#xA7; 25.1-406, for assisting in the purchase,\nsale, resale, manufacture, processing, or marketing of products, commodities,\npersonal property, or services by the erection and maintenance of an outdoor\nadvertising display or displays, whether or not such display or displays are\nlocated on the premises on which any of the above activities are conducted.\n\t\t\t&#8220;Comparable replacement dwelling&#8221; means any dwelling that is (i)\ndecent, safe and sanitary; (ii) adequate in size to accommodate the occupants;\n(iii) within the financial means of the displaced person; (iv) functionally\nequivalent; (v) in an area not subject to unreasonable adverse environmental\nconditions; and (vi) in a location generally not less desirable than the\nlocation of the displaced person&#8217;s dwelling with respect to public\nutilities, facilities, services and the displaced person&#8217;s place of\nemployment.\n\t\t\t&#8220;Decent, safe, and sanitary dwelling&#8221; means a dwelling that:\n\n1. Is structurally sound, weather tight and in good repair;\n\n2. Has a safe electrical wiring system adequate for lighting and appliances;\n\n3. Contains a heating system capable of maintaining a healthful temperature;\n\n4. Is adequate in size with respect to the number of rooms and area of living\nspace needed to accommodate the displaced household;\n\n5. Has a separate, well-lighted and ventilated bathroom that provides privacy to\nthe user and contains sink, toilet, and bathing facilities (shower or bath, or\nboth), all operational and connected to a functional water and sewer disposal\nsystem;\n\n6. Provides unobstructed egress to safe open space at ground level. If the unit\nis above the first floor and served by a common corridor, there must be two\nmeans of egress; and\n\n7. Is free of barriers to egress, ingress, and use by a displaced person with a\ndisability.\n\t\t\t&#8220;Displaced person&#8221; means:\n\n1. Any person who moves from real property, or moves his personal property from\nreal property (i) as a direct result of a written notice of intent to acquire or\nthe acquisition of such real property, in whole or in part, for any program or\nproject undertaken by a state agency or (ii) on which such person is a\nresidential tenant or conducts a small business, a farm operation or a business\ndescribed in clause 4 of the definition of &#8220;business&#8221; in this\nsection as a direct result of rehabilitation, demolition, or other displacing\nactivity as the state agency may prescribe, under a program or project\nundertaken by the state agency in any case in which the state agency determines\nthat such displacement is permanent;\n\n2. Solely for the purposes of &#xA7;&#xA7; 25.1-406, 25.1-407, and 25.1-411, any\nperson who moves from real property, or moves his personal property from real\nproperty: (i) as a direct result of a written notice of intent to acquire or the\nacquisition of other real property, in whole or in part, on which such person\nconducts a business or farm operation, for a program or project undertaken by a\nstate agency or (ii) as a direct result of rehabilitation, demolition, or other\ndisplacing activity as the state agency may prescribe, of other real property on\nwhich such person conducts a business or farm operation, under a program or\nproject undertaken by the state agency in any case in which the state agency\ndetermines that such displacement is permanent; and\n\n3.
