therefore, every person should be required to comply with wildlife preservation, protection, management, and restoration statutes, laws, rules, regulations, and ordinances of the participating states as a condition precedent to the continuance or issuance of any license to hunt, fish, trap, or possess wildlife;5\n\nViolation of wildlife laws interferes with the management of wildlife resources and may endanger the safety of persons and property;6\n\nThe mobility of many wildlife law violators necessitates the maintenance of channels of communication among the various states;7\n\nIn most instances, a person who is cited for a wildlife violation in a state other than the person&#8217;s home state:i\n\nIs required to post collateral or a bond to secure an appearance for a trial at a later date;ii\n\nIs taken into custody until the collateral or bond is posted; oriii\n\nIs taken directly to court for an immediate appearance;8\n\nThe purpose of the enforcement practices set forth in paragraph (7) of this subsection is to ensure compliance with the terms of a wildlife citation by the cited person who, if permitted to continue on the person&#8217;s way after receiving the citation, could return to the person&#8217;s home state and disregard any duty under the terms of the citation;9\n\nIn most instances, a person receiving a wildlife citation in the person&#8217;s home state is permitted to accept the citation from the officer at the scene of the violation and immediately continue on the person&#8217;s way after agreeing or being instructed to comply with the terms of the citation;10\n\nThe practices described in paragraph (7) of this subsection cause unnecessary inconvenience and, at times, a hardship for the person who is unable at the time to post collateral, furnish a bond, stand trial, or pay a fine, and thus is compelled to remain in custody until some alternative arrangement is made; and11\n\nThe enforcement practices described in paragraph (7) of this subsection consume an undue amount of law-enforcement time.b\n\nIt is the policy of the participating states to:1\n\nPromote compliance with the statutes, laws, regulations, rules, and ordinances relating to management of wildlife resources in their respective states;2\n\nRecognize a suspension of wildlife license privileges of any person whose license privileges have been suspended by a participating state and treat that suspension as if it had occurred in each respective state;3\n\nAllow a violator, except as provided in Article III, subsection (b) of this compact, to accept a wildlife citation and, without delay, proceed on the person&#8217;s way, regardless of the violator&#8217;s home state, if that state is a party to this compact;4\n\nReport to the appropriate participating state, as provided in the compact manual, any conviction recorded against a person whose home state was not the issuing state;5\n\nAllow the home state to recognize and treat convictions recorded against its residents, which convictions occurred in a participating state, as though they had occurred in the home state;6\n\nExtend cooperation to its fullest extent among the participating states for enforcing compliance with the terms of a wildlife citation issued in one participating state to a resident of another participating state;7\n\nMaximize the effective use of law-enforcement personnel and information; and8\n\nAssist court systems in the efficient disposition of wildlife violations.c\n\nThe purpose of this compact is to:1\n\nProvide a means through which participating states may join in a reciprocal program to effectuate the policies enumerated in subsection (b) of this article in a uniform and orderly manner; and2\n\nProvide for the fair and impartial treatment of wildlife violators operating within participating states in recognition of the violator&#8217;s right to due process and the sovereign status of a participating state.\n\t\t\t\tARTICLE II\n\t\t\t\tDefinitions\n\t\t\t\tAs used in this compact, unless the context requires otherwise, the following words have the meanings indicated:a\n\n&#8220;Citation&#8221; means any summons, complaint, summons and complaint, ticket, penalty assessment, or other official document issued to a person by a wildlife officer or other law-enforcement officer for a wildlife violation that contains an order requiring the person to respond.b\n\n&#8220;Collateral&#8221; means any cash or other security deposited to secure an appearance for trial in connection with the issuance by a wildlife officer or other law-enforcement officer of a citation for a wildlife violation.c\n\n&#8220;Compliance&#8221; with respect to a citation means the act of answering a citation through an appearance in a court or tribunal, or through the payment of fines, costs, and surcharges, if any.d\n\n&#8220;Conviction&#8221; means a conviction that results in suspension or revocation of a license, including any court conviction, for an offense related to the preservation, protection, management, or restoration of wildlife that is prohibited by state statute, law, regulation, rule, or ordinance. The term also includes the forfeiture of any bail, bond, or other security deposited to secure the appearance of a person charged with having committed the offense, the payment of a penalty assessment, a plea of nolo contendere, or the imposition of a deferred or suspended sentence by the court.e\n\n&#8220;Court&#8221; means a court of law, including magistrate&#8217;s court and the justice of the peace court.f\n\n&#8220;Home state&#8221; means the state of primary residence of a person.g\n\n&#8220;Issuing state&#8221; means the participating state that issues a wildlife citation to the violator.h\n\n&#8220;License&#8221; means a license, permit, or other public document that conveys to the person to whom it was issued the privilege of pursuing, possessing, or taking any wildlife regulated by statute, law, regulation, rule, or ordinance of a participating state.i\n\n&#8220;Licensing authority&#8221; means the governmental unit in each participating state that is authorized by law to issue or approve licenses or permits to hunt, fish, trap, or possess wildlife.j\n\n&#8220;Participating state&#8221; means a state that enacts legislation to become a member of this Wildlife Violator Compact.k\n\n&#8220;Personal recognizance&#8221; means an agreement by a person made at the time of issuance of the wildlife citation that such person will comply with the terms of the citation.l\n\n&#8220;State&#8221; means any state, territory, or possession of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the provinces of Canada, and other countries.m\n\n&#8220;Suspension&#8221; means any revocation, denial, or withdrawal of any or all license privileges, including the privilege to apply for, purchase, or exercise the benefits conferred by a license.n\n\n&#8220;Terms of the citation&#8221; means the conditions and options expressly stated upon the citation.o\n\n&#8220;Wildlife&#8221; means all species of animals including, but not limited to, mammals, birds, fish, reptiles, amphibians, mollusks, and crustaceans, that are defined as &#8220;wildlife&#8221; and are protected or otherwise regulated by statute, law, rule, regulation, or ordinance in a participating state. Species included in the definition of &#8220;wildlife&#8221; vary from state to state and the determination of whether a species is &#8220;wildlife&#8221; for the purposes of this Compact shall be based on the law of the issuing state.p\n\n&#8220;Wildlife law&#8221; means a statute, law, regulation, rule, or ordinance developed and enacted for the management of wildlife resources and the uses thereof.q\n\n&#8220;Wildlife officer&#8221; means any individual authorized by a participating state to issue a citation for a wildlife violation.r\n\n&#8220;Wildlife violation&#8221; means any cited violation of a statute, law, regulation, rule, or ordinance developed and enacted for the management of wildlife resources and the uses thereof.\n\t\t\tARTICLE III\n\t\t\tProcedures for Issuing Statea\n\nWhen issuing a citation for a wildlife violation, a wildlife officer shall issue a citation to any person whose primary residence is in a participating state in the same manner as though the person were a resident of the issuing state and shall not require such person to post collateral to secure appearance, subject to the exceptions noted in subsection (b) of this article, if the officer receives the recognizance of such person that he will comply with the terms of the citation.b\n\nPersonal recognizance is acceptable if not prohibited by local law; by policy, procedure, or regulation of the issuing agency; or by the compact manual and if the violator provides adequate proof of identification to the wildlife officer.c\n\nUpon conviction or failure of a person to comply with the terms of a wildlife citation, the appropriate official shall report the conviction or failure to comply to the licensing authority of the participating state in which the wildlife citation was issued. The report shall be made in accordance with procedures specified by the issuing state and must contain information as specified in the compact manual as minimum requirements for effective processing by the home state.d\n\nUpon receiving the report of conviction or noncompliance pursuant to subsection (c) of this article, the licensing authority of the issuing state shall transmit to the licensing authority of the home state of the violator the information in the form and content prescribed in the compact manual.\n\t\t\tARTICLE IV\n\t\t\tProcedure for Home Statea\n\nUpon receipt of a report from the licensing authority of the issuing state reporting the failure of a violator to comply with the terms of a citation, the licensing authority of the home state shall notify the violator and shall initiate a suspension action in accordance with the home state&#8217;s suspension procedures and shall suspend the violator&#8217;s license privileges until satisfactory evidence of compliance with the terms of the wildlife citation has been furnished by the issuing state to the home state licensing authority. Due process safeguards shall be accorded to the violator.b\n\nUpon receipt of a report of conviction from the licensing authority of the issuing state, the licensing authority of the home state shall enter such conviction in its records and shall treat such conviction as though the conviction had occurred in the home state for the purposes of the suspension of license privileges.c\n\nThe licensing authority of the home state shall maintain a record of actions taken and shall make reports to issuing states as provided in the compact manual.\n\t\t\tARTICLE V\n\t\t\tReciprocal Recognition of Suspensiona\n\nAll participating states shall recognize the suspension of license privileges of a person by a participating state as though the violation resulting in the suspension had occurred in their state and could have been the basis for suspension of license privileges in their state.b\n\nEach participating state shall communicate suspension information to other participating states in a form and content prescribed in the compact manual.\n\t\t\tARTICLE VI\n\t\t\tApplicability of Other Laws\n\t\t\tExcept as expressly required by provisions of this compact, nothing in this compact may be construed to affect the right of a participating state to apply any of its laws relating to license privileges to any person or circumstance or to invalidate or prevent any agreement or other cooperative arrangement between a participating state and a nonparticipating state concerning the enforcement of wildlife laws.\n\t\t\tARTICLE VII\n\t\t\tCompact Administrator Proceduresa\n\nFor the purpose of administering the provisions of this compact and to serve as a governing body for the resolution of all matters relating to the operation of this compact, a Board of Compact Administrators is established. The board shall be composed of one representative from each of the participating states to be known as the compact administrator. The compact administrator shall be appointed by the head of the licensing authority of each participating state and shall serve and be subject to removal in accordance with the laws of the state he or she represents. A compact administrator may provide for an alternate for the discharge of his or her duties and the performance of his or her functions as a board member. An alternate is not entitled to serve unless written notification of the alternate&#8217;s identity has been given to the board.b\n\nEach member of the Board of Compact Administrators shall be entitled to one vote. No action of the board shall be binding unless taken at a meeting at which a majority of the total number of the board&#8217;s votes are cast in favor thereof. Action by the board shall be only at a meeting at which a majority of the participating states are represented.c\n\nThe board shall elect annually from its membership a chairman and vice chairman.d\n\nThe board shall adopt bylaws not inconsistent with the provisions of this compact or the laws of a participating state for the conduct of its business and shall have the power to amend and rescind its bylaws.e\n\nThe board may accept for any of its purposes and functions under this compact any and all donations and grants of moneys, equipment, supplies, materials, and services, conditional or otherwise, from any state, the United States, or any governmental unit, and may receive, utilize, and dispose of those grants and donations.f\n\nThe board may contract with, or accept services or personnel from, any governmental or intergovernmental unit, individual, firm, or corporation, or any private nonprofit organization or institution.g\n\nThe board shall formulate all necessary procedures and develop uniform forms and documents for administering the provisions of this compact. All procedures and forms adopted pursuant to board action shall be contained in a compact manual.\n\t\t\tARTICLE VIII\n\t\t\tEntry into Compact and Withdrawala\n\nThis compact shall become effective at such time as it is adopted in substantially similar form by two or more states.b\n\nEntry into the compact shall be made by resolution of ratification executed by the authorized officials of the applying state and submitted to the chairman of the board. The resolution shall substantially be in the form and content as provided in the compact manual and shall include the following:1\n\nA citation of the authority from which the state is empowered to become a party to this compact;2\n\nAn agreement of compliance with the terms and provisions of this compact; and3\n\nAn agreement that compact entry is with all states participating in the compact and with all additional states legally becoming a party to the compact.c\n\nThe effective date of entry shall be specified by the applying state, but may not be less than 60 days after notice has been given by the chairman of the Board of Compact Administrators or by the secretariat of the board to each participating state that the resolution from the applying state has been received.d\n\nA participating state may withdraw from this compact by official written notice to each participating state, but withdrawal shall not become effective until 90 days after the notice of withdrawal is given. The notice shall be directed to the compact administrator of each member state. The withdrawal of any state does not affect the validity of this compact as to the remaining participating states.\n\t\t\tARTICLE IX\n\t\t\tAmendments to the Compacta\n\nThis Compact may be amended from time to time. Amendments shall be presented in resolution form to the chairman of the Board of Compact Administrators and shall be initiated by one or more participating states.b\n\nAdoption of an amendment shall require endorsement by all participating states and shall become effective 30 days after the date of the last endorsement.c\n\nFailure of a participating state to respond to the compact chairman within 120 days after receipt of a proposed amendment shall constitute endorsement of the proposed amendment.\n\t\t\tARTICLE X\n\t\t\tConstruction and Severability\n\t\t\tThis compact shall be liberally construed so as to effectuate the purposes stated herein. The provisions of this compact shall be severable and if any phrase, clause, sentence, or provision of this compact is declared to be contrary to the constitution of a participating state or of the United States, or if the applicability thereof to any government, unit, individual, or circumstance is held invalid, the validity of the remainder of this compact shall not be affected thereby. The board shall be composed of one representative from each of the participating states to be known as the compact administrator. The compact administrator shall be appointed by the head of the licensing authority of each participating state and shall serve and be subject to removal in accordance with the laws of the state he or she represents. A compact administrator may provide for an alternate for the discharge of his or her duties and the performance of his or her functions as a board member. The provisions of this compact shall be severable and if any phrase, clause, sentence, or provision of this compact is declared to be contrary to the constitution of a participating state or of the United States, or if the applicability thereof to any government, unit, individual, or circumstance is held invalid, the validity of the remainder of this compact shall not be affected thereby. <a id=\"paragraph-289191\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#a6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"a7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> In most instances, a person who is cited for a <span class=\"dictionary\">wildlife violation<\/span> in a state other than the person&#8217;s <span class=\"dictionary\">home state<\/span>: <a id=\"paragraph-289192\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#a7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"i\"><p><span class=\"prefix-number\">i.<\/span> Is required to post <span class=\"dictionary\">collateral<\/span> or a <span class=\"dictionary\">bond<\/span> to secure an <span class=\"dictionary\">appearance<\/span> for a <span class=\"dictionary\">trial<\/span> at a later date; <a id=\"paragraph-289193\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#i\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"iii\" class=\"indent-1\"><p><span class=\"prefix-number\">ii.<\/span> Is taken into <span class=\"dictionary\">custody<\/span> until the <span class=\"dictionary\">collateral<\/span> or <span class=\"dictionary\">bond<\/span> is posted; or <a id=\"paragraph-289194\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#iii\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"iiii\" class=\"indent-1\"><p><span class=\"prefix-number\">iii.<\/span> Is taken directly to <span class=\"dictionary\">court<\/span> for an immediate <span class=\"dictionary\">appearance<\/span>; <a id=\"paragraph-289195\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#iiii\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"i8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> The purpose of the enforcement practices set forth in paragraph (7) of this subsection is to ensure <span class=\"dictionary\">compliance<\/span> with the terms of a wildlife citation by the cited person who, if permitted to continue on the person&#8217;s way after receiving the citation, could return to the person&#8217;s <span class=\"dictionary\">home state<\/span> and disregard any duty under the <span class=\"dictionary\">terms of the citation<\/span>; <a id=\"paragraph-289196\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#i8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"i9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> In most instances, a person receiving a wildlife citation in the person&#8217;s <span class=\"dictionary\">home state<\/span> is permitted to accept the citation from the officer at the scene of the violation and immediately continue on the person&#8217;s way after agreeing or being instructed to comply with the <span class=\"dictionary\">terms of the citation<\/span>; <a id=\"paragraph-289197\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#i9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"i10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> The practices described in paragraph (7) of this subsection cause unnecessary inconvenience and, at times, a hardship for the person who is unable at the time to post <span class=\"dictionary\">collateral<\/span>, furnish a <span class=\"dictionary\">bond<\/span>, stand <span class=\"dictionary\">trial<\/span>, or pay a fine, and thus is compelled to remain in <span class=\"dictionary\">custody<\/span> until some alternative arrangement is made; and <a id=\"paragraph-289198\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#i10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"i11\" class=\"indent-1\"><p><span class=\"prefix-number\">11.<\/span> The enforcement practices described in paragraph (7) of this subsection consume an undue amount of law-enforcement time. <a id=\"paragraph-289199\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#i11\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"b\"><p><span class=\"prefix-number\">b.<\/span> It is the policy of the <span class=\"dictionary\">participating states<\/span> to: <a id=\"paragraph-289200\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#b\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"b1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Promote <span class=\"dictionary\">compliance<\/span> with the <span class=\"dictionary\">statutes<\/span>, laws, <span class=\"dictionary\">regulations<\/span>, rules, and <span class=\"dictionary\">ordinances<\/span> relating to management of wildlife resources in their respective states; <a id=\"paragraph-289201\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#b1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"b2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Recognize a <span class=\"dictionary\">suspension<\/span> of wildlife <span class=\"dictionary\">license<\/span> <span class=\"dictionary\">privileges<\/span> of any person whose <span class=\"dictionary\">license<\/span> <span class=\"dictionary\">privileges<\/span> have been suspended by a <span class=\"dictionary\">participating state<\/span> and treat that <span class=\"dictionary\">suspension<\/span> as if it had occurred in each respective state; <a id=\"paragraph-289202\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#b2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"b3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Allow a violator, except as provided in Article III, subsection (b) of this compact, to accept a wildlife citation and, without delay, proceed on the person&#8217;s way, regardless of the violator&#8217;s <span class=\"dictionary\">home state<\/span>, if that state is a <span class=\"dictionary\">party<\/span> to this compact; <a id=\"paragraph-289203\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#b3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"b4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Report to the appropriate <span class=\"dictionary\">participating state<\/span>, as provided in the compact manual, any <span class=\"dictionary\">conviction<\/span> recorded against a person whose <span class=\"dictionary\">home state<\/span> was not the <span class=\"dictionary\">issuing state<\/span>; <a id=\"paragraph-289204\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#b4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"b5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Allow the <span class=\"dictionary\">home state<\/span> to recognize and treat <span class=\"dictionary\">convictions<\/span> recorded against its residents, which <span class=\"dictionary\">convictions<\/span> occurred in a <span class=\"dictionary\">participating state<\/span>, as though they had occurred in the <span class=\"dictionary\">home state<\/span>; <a id=\"paragraph-289205\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#b5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"b6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Extend cooperation to its fullest extent among the <span class=\"dictionary\">participating states<\/span> for enforcing <span class=\"dictionary\">compliance<\/span> with the terms of a wildlife citation issued in one <span class=\"dictionary\">participating state<\/span> to a resident of another <span class=\"dictionary\">participating state<\/span>; <a id=\"paragraph-289206\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#b6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"b7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Maximize the effective use of law-enforcement personnel and information; and <a id=\"paragraph-289207\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#b7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"b8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> Assist <span class=\"dictionary\">court<\/span> systems in the efficient <span class=\"dictionary\">disposition<\/span> of <span class=\"dictionary\">wildlife violations<\/span>. <a id=\"paragraph-289208\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#b8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"c\"><p><span class=\"prefix-number\">c.<\/span> The purpose of this compact is to: <a id=\"paragraph-289209\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#c\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"c1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Provide a means through which <span class=\"dictionary\">participating states<\/span> may join in a reciprocal program to effectuate the policies enumerated in subsection (b) of this article in a uniform and orderly manner; and <a id=\"paragraph-289210\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#c1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"c2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Provide for the fair and impartial treatment of wildlife violators operating within <span class=\"dictionary\">participating states<\/span> in recognition of the violator&#8217;s right to <span class=\"dictionary\">due process<\/span> and the sovereign status of a <span class=\"dictionary\">participating state<\/span>.\n\t\t\t\tARTICLE II\n\t\t\t\tDefinitions\n\t\t\t\tAs used in this compact, unless the context requires otherwise, the following words have the meanings indicated: <a id=\"paragraph-289211\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#c2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"a\"><p><span class=\"prefix-number\">a.<\/span> &#8220;Citation&#8221; means any <span class=\"dictionary\">summons<\/span>, complaint, <span class=\"dictionary\">summons<\/span> and complaint, ticket, <span class=\"dictionary\">penalty<\/span> assessment, or other official document issued to a person by a <span class=\"dictionary\">wildlife officer<\/span> or other law-enforcement officer for a <span class=\"dictionary\">wildlife violation<\/span> that contains an <span class=\"dictionary\">order<\/span> requiring the person to respond. <a id=\"paragraph-289212\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#a\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"b\"><p><span class=\"prefix-number\">b.<\/span> &#8220;<span class=\"dictionary\">Collateral<\/span>&#8221; means any cash or other security deposited to secure an <span class=\"dictionary\">appearance<\/span> for <span class=\"dictionary\">trial<\/span> in connection with the issuance by a <span class=\"dictionary\">wildlife officer<\/span> or other law-enforcement officer of a citation for a <span class=\"dictionary\">wildlife violation<\/span>. <a id=\"paragraph-289213\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#b\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"c\"><p><span class=\"prefix-number\">c.<\/span> &#8220;<span class=\"dictionary\">Compliance<\/span>&#8221; with respect to a citation means the act of answering a citation through an <span class=\"dictionary\">appearance<\/span> in a <span class=\"dictionary\">court<\/span> or tribunal, or through the payment of fines, costs, and surcharges, if any. <a id=\"paragraph-289214\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#c\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"d\"><p><span class=\"prefix-number\">d.<\/span> &#8220;<span class=\"dictionary\">Conviction<\/span>&#8221; means a <span class=\"dictionary\">conviction<\/span> that results in <span class=\"dictionary\">suspension<\/span> or <span class=\"dictionary\">revocation<\/span> of a <span class=\"dictionary\">license<\/span>, including any <span class=\"dictionary\">court<\/span> <span class=\"dictionary\">conviction<\/span>, for an <span class=\"dictionary\">offense<\/span> related to the preservation, protection, management, or restoration of wildlife that is prohibited by state <span class=\"dictionary\">statute<\/span>, law, <span class=\"dictionary\">regulation<\/span>, rule, or <span class=\"dictionary\">ordinance<\/span>. The term also includes the forfeiture of any <span class=\"dictionary\">bail<\/span>, <span class=\"dictionary\">bond<\/span>, or other security deposited to secure the <span class=\"dictionary\">appearance<\/span> of a person charged with having committed the <span class=\"dictionary\">offense<\/span>, the payment of a <span class=\"dictionary\">penalty<\/span> assessment, a <span class=\"dictionary\">plea<\/span> of <span class=\"dictionary\">nolo contendere<\/span>, or the imposition of a deferred or <span class=\"dictionary\">suspended sentence<\/span> by the <span class=\"dictionary\">court<\/span>. <a id=\"paragraph-289215\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#d\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"e\"><p><span class=\"prefix-number\">e.<\/span> &#8220;<span class=\"dictionary\">Court<\/span>&#8221; means a <span class=\"dictionary\">court<\/span> of law, including <span class=\"dictionary\">magistrate<\/span>&#8217;s <span class=\"dictionary\">court<\/span> and the justice of the peace <span class=\"dictionary\">court<\/span>. <a id=\"paragraph-289216\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#e\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"f\"><p><span class=\"prefix-number\">f.<\/span> &#8220;<span class=\"dictionary\">Home state<\/span>&#8221; means the state of primary residence of a person. <a id=\"paragraph-289217\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#f\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"g\"><p><span class=\"prefix-number\">g.<\/span> &#8220;<span class=\"dictionary\">Issuing state<\/span>&#8221; means the <span class=\"dictionary\">participating state<\/span> that <span class=\"dictionary\">issues<\/span> a wildlife citation to the violator. <a id=\"paragraph-289218\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#g\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"h\"><p><span class=\"prefix-number\">h.<\/span> &#8220;<span class=\"dictionary\">License<\/span>&#8221; means a <span class=\"dictionary\">license<\/span>, permit, or other public document that conveys to the person to whom it was issued the <span class=\"dictionary\">privilege<\/span> of pursuing, possessing, or taking any wildlife regulated by <span class=\"dictionary\">statute<\/span>, law, <span class=\"dictionary\">regulation<\/span>, rule, or <span class=\"dictionary\">ordinance<\/span> of a <span class=\"dictionary\">participating state<\/span>. <a id=\"paragraph-289219\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#h\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"i\"><p><span class=\"prefix-number\">i.<\/span> &#8220;<span class=\"dictionary\">Licensing authority<\/span>&#8221; means the governmental unit in each <span class=\"dictionary\">participating state<\/span> that is authorized by law to <span class=\"dictionary\">issue<\/span> or approve <span class=\"dictionary\">licenses<\/span> or permits to hunt, fish, trap, or possess wildlife. <a id=\"paragraph-289220\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#i\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"j\"><p><span class=\"prefix-number\">j.<\/span> &#8220;<span class=\"dictionary\">Participating state<\/span>&#8221; means a state that enacts legislation to become a member of this Wildlife Violator Compact. <a id=\"paragraph-289221\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#j\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"k\"><p><span class=\"prefix-number\">k.<\/span> &#8220;<span class=\"dictionary\">Personal recognizance<\/span>&#8221; means an agreement by a person made at the time of issuance of the wildlife citation that such person will comply with the <span class=\"dictionary\">terms of the citation<\/span>. <a id=\"paragraph-289222\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#k\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"l\"><p><span class=\"prefix-number\">l.<\/span> &#8220;State&#8221; means any state, territory, or <span class=\"dictionary\">possession<\/span> of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the provinces of Canada, and other countries. <a id=\"paragraph-289223\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#l\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"m\"><p><span class=\"prefix-number\">m.<\/span> &#8220;<span class=\"dictionary\">Suspension<\/span>&#8221; means any <span class=\"dictionary\">revocation<\/span>, denial, or withdrawal of any or all <span class=\"dictionary\">license<\/span> <span class=\"dictionary\">privileges<\/span>, including the <span class=\"dictionary\">privilege<\/span> to apply for, purchase, or exercise the benefits conferred by a <span class=\"dictionary\">license<\/span>. <a id=\"paragraph-289224\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#m\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"n\"><p><span class=\"prefix-number\">n.<\/span> &#8220;<span class=\"dictionary\">Terms of the citation<\/span>&#8221; means the conditions and options expressly stated upon the citation. <a id=\"paragraph-289225\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#n\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"o\"><p><span class=\"prefix-number\">o.<\/span> &#8220;Wildlife&#8221; means all species of animals including, but not limited to, mammals, birds, fish, reptiles, amphibians, mollusks, and crustaceans, that are defined as &#8220;wildlife&#8221; and are protected or otherwise regulated by <span class=\"dictionary\">statute<\/span>, law, rule, <span class=\"dictionary\">regulation<\/span>, or <span class=\"dictionary\">ordinance<\/span> in a <span class=\"dictionary\">participating state<\/span>. Species included in the definition of &#8220;wildlife&#8221; vary from state to state and the determination of whether a species is &#8220;wildlife&#8221; for the purposes of this Compact shall be based on the law of the <span class=\"dictionary\">issuing state<\/span>. <a id=\"paragraph-289226\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#o\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"p\"><p><span class=\"prefix-number\">p.<\/span> &#8220;<span class=\"dictionary\">Wildlife law<\/span>&#8221; means a <span class=\"dictionary\">statute<\/span>, law, <span class=\"dictionary\">regulation<\/span>, rule, or <span class=\"dictionary\">ordinance<\/span> developed and enacted for the management of wildlife resources and the uses thereof. <a id=\"paragraph-289227\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#p\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"q\"><p><span class=\"prefix-number\">q.<\/span> &#8220;<span class=\"dictionary\">Wildlife officer<\/span>&#8221; means any individual authorized by a <span class=\"dictionary\">participating state<\/span> to <span class=\"dictionary\">issue<\/span> a citation for a <span class=\"dictionary\">wildlife violation<\/span>. <a id=\"paragraph-289228\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#q\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"r\"><p><span class=\"prefix-number\">r.<\/span> &#8220;<span class=\"dictionary\">Wildlife violation<\/span>&#8221; means any cited violation of a <span class=\"dictionary\">statute<\/span>, law, <span class=\"dictionary\">regulation<\/span>, rule, or <span class=\"dictionary\">ordinance<\/span> developed and enacted for the management of wildlife resources and the uses thereof.\n\t\t\tARTICLE III\n\t\t\tProcedures for <span class=\"dictionary\">Issuing State<\/span> <a id=\"paragraph-289229\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#r\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"a\"><p><span class=\"prefix-number\">a.<\/span> When issuing a citation for a <span class=\"dictionary\">wildlife violation<\/span>, a <span class=\"dictionary\">wildlife officer<\/span> shall <span class=\"dictionary\">issue<\/span> a citation to any person whose primary residence is in a <span class=\"dictionary\">participating state<\/span> in the same manner as though the person were a resident of the <span class=\"dictionary\">issuing state<\/span> and shall not require such person to post <span class=\"dictionary\">collateral<\/span> to secure <span class=\"dictionary\">appearance<\/span>, subject to the exceptions noted in subsection (b) of this article, if the officer receives the recognizance of such person that he will comply with the <span class=\"dictionary\">terms of the citation<\/span>. <a id=\"paragraph-289230\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#a\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"b\"><p><span class=\"prefix-number\">b.<\/span> <span class=\"dictionary\">Personal recognizance<\/span> is acceptable if not prohibited by local law; by policy, procedure, or <span class=\"dictionary\">regulation<\/span> of the issuing agency; or by the compact manual and if the violator provides adequate proof of identification to the <span class=\"dictionary\">wildlife officer<\/span>. <a id=\"paragraph-289231\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#b\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"c\"><p><span class=\"prefix-number\">c.<\/span> Upon <span class=\"dictionary\">conviction<\/span> or failure of a person to comply with the terms of a wildlife citation, the appropriate official shall report the <span class=\"dictionary\">conviction<\/span> or failure to comply to the <span class=\"dictionary\">licensing authority<\/span> of the <span class=\"dictionary\">participating state<\/span> in which the wildlife citation was issued. The report shall be made in accordance with procedures specified by the <span class=\"dictionary\">issuing state<\/span> and must contain information as specified in the compact manual as minimum requirements for effective processing by the <span class=\"dictionary\">home state<\/span>. <a id=\"paragraph-289232\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#c\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"d\"><p><span class=\"prefix-number\">d.<\/span> Upon receiving the report of <span class=\"dictionary\">conviction<\/span> or noncompliance pursuant to subsection (c) of this article, the <span class=\"dictionary\">licensing authority<\/span> of the <span class=\"dictionary\">issuing state<\/span> shall transmit to the <span class=\"dictionary\">licensing authority<\/span> of the <span class=\"dictionary\">home state<\/span> of the violator the information in the form and content prescribed in the compact manual.\n\t\t\tARTICLE IV\n\t\t\tProcedure for <span class=\"dictionary\">Home State<\/span> <a id=\"paragraph-289233\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#d\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"a\"><p><span class=\"prefix-number\">a.<\/span> Upon receipt of a report from the <span class=\"dictionary\">licensing authority<\/span> of the <span class=\"dictionary\">issuing state<\/span> reporting the failure of a violator to comply with the terms of a citation, the <span class=\"dictionary\">licensing authority<\/span> of the <span class=\"dictionary\">home state<\/span> shall notify the violator and shall initiate a <span class=\"dictionary\">suspension<\/span> action in accordance with the <span class=\"dictionary\">home state<\/span>&#8217;s <span class=\"dictionary\">suspension<\/span> procedures and shall suspend the violator&#8217;s <span class=\"dictionary\">license<\/span> <span class=\"dictionary\">privileges<\/span> until satisfactory <span class=\"dictionary\">evidence<\/span> of <span class=\"dictionary\">compliance<\/span> with the terms of the wildlife citation has been furnished by the <span class=\"dictionary\">issuing state<\/span> to the <span class=\"dictionary\">home state<\/span> <span class=\"dictionary\">licensing authority<\/span>. <span class=\"dictionary\">Due process<\/span> safeguards shall be accorded to the violator. <a id=\"paragraph-289234\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#a\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"b\"><p><span class=\"prefix-number\">b.<\/span> Upon receipt of a report of <span class=\"dictionary\">conviction<\/span> from the <span class=\"dictionary\">licensing authority<\/span> of the <span class=\"dictionary\">issuing state<\/span>, the <span class=\"dictionary\">licensing authority<\/span> of the <span class=\"dictionary\">home state<\/span> shall enter such <span class=\"dictionary\">conviction<\/span> in its records and shall treat such <span class=\"dictionary\">conviction<\/span> as though the <span class=\"dictionary\">conviction<\/span> had occurred in the <span class=\"dictionary\">home state<\/span> for the purposes of the <span class=\"dictionary\">suspension<\/span> of <span class=\"dictionary\">license<\/span> <span class=\"dictionary\">privileges<\/span>. <a id=\"paragraph-289235\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#b\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"c\"><p><span class=\"prefix-number\">c.<\/span> The <span class=\"dictionary\">licensing authority<\/span> of the <span class=\"dictionary\">home state<\/span> shall maintain a record of actions taken and shall make reports to <span class=\"dictionary\">issuing states<\/span> as provided in the compact manual.\n\t\t\tARTICLE V\n\t\t\tReciprocal Recognition of <span class=\"dictionary\">Suspension<\/span> <a id=\"paragraph-289236\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#c\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"a\"><p><span class=\"prefix-number\">a.<\/span> All <span class=\"dictionary\">participating states<\/span> shall recognize the <span class=\"dictionary\">suspension<\/span> of <span class=\"dictionary\">license<\/span> <span class=\"dictionary\">privileges<\/span> of a person by a <span class=\"dictionary\">participating state<\/span> as though the violation resulting in the <span class=\"dictionary\">suspension<\/span> had occurred in their state and could have been the basis for <span class=\"dictionary\">suspension<\/span> of <span class=\"dictionary\">license<\/span> <span class=\"dictionary\">privileges<\/span> in their state. <a id=\"paragraph-289237\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#a\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"b\"><p><span class=\"prefix-number\">b.<\/span> Each <span class=\"dictionary\">participating state<\/span> shall communicate <span class=\"dictionary\">suspension<\/span> information to other <span class=\"dictionary\">participating states<\/span> in a form and content prescribed in the compact manual.\n\t\t\tARTICLE VI\n\t\t\tApplicability of Other Laws\n\t\t\tExcept as expressly required by provisions of this compact, nothing in this compact may be construed to affect the right of a <span class=\"dictionary\">participating state<\/span> to apply any of its laws relating to <span class=\"dictionary\">license<\/span> <span class=\"dictionary\">privileges<\/span> to any person or circumstance or to invalidate or prevent any agreement or other cooperative arrangement between a <span class=\"dictionary\">participating state<\/span> and a nonparticipating state concerning the enforcement of <span class=\"dictionary\">wildlife laws<\/span>.\n\t\t\tARTICLE VII\n\t\t\tCompact Administrator Procedures <a id=\"paragraph-289238\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#b\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"a\"><p><span class=\"prefix-number\">a.<\/span> For the purpose of administering the provisions of this compact and to serve as a governing body for the resolution of all matters relating to the operation of this compact, a <span class=\"dictionary\">Board<\/span> of Compact Administrators is established. The <span class=\"dictionary\">board<\/span> shall be composed of one representative from each of the <span class=\"dictionary\">participating states<\/span> to be known as the compact administrator. The compact administrator shall be appointed by the head of the <span class=\"dictionary\">licensing authority<\/span> of each <span class=\"dictionary\">participating state<\/span> and shall serve and be subject to removal in accordance with the laws of the state he or she represents. A compact administrator may provide for an alternate for the discharge of his or her duties and the performance of his or her functions as a <span class=\"dictionary\">board<\/span> member. An alternate is not entitled to serve unless written notification of the alternate&#8217;s identity has been given to the <span class=\"dictionary\">board<\/span>. <a id=\"paragraph-289239\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#a\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"b\"><p><span class=\"prefix-number\">b.<\/span> Each member of the <span class=\"dictionary\">Board<\/span> of Compact Administrators shall be entitled to one vote. No action of the <span class=\"dictionary\">board<\/span> shall be binding unless taken at a meeting at which a majority of the total number of the <span class=\"dictionary\">board<\/span>&#8217;s votes are cast in favor thereof. Action by the <span class=\"dictionary\">board<\/span> shall be only at a meeting at which a majority of the <span class=\"dictionary\">participating states<\/span> are represented. <a id=\"paragraph-289240\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#b\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"c\"><p><span class=\"prefix-number\">c.<\/span> The <span class=\"dictionary\">board<\/span> shall elect annually from its membership a chairman and vice chairman. <a id=\"paragraph-289241\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#c\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"d\"><p><span class=\"prefix-number\">d.<\/span> The <span class=\"dictionary\">board<\/span> shall adopt bylaws not inconsistent with the provisions of this compact or the laws of a <span class=\"dictionary\">participating state<\/span> for the conduct of its business and shall have the power to <span class=\"dictionary\">amend<\/span> and rescind its bylaws. <a id=\"paragraph-289242\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#d\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"e\"><p><span class=\"prefix-number\">e.<\/span> The <span class=\"dictionary\">board<\/span> may accept for any of its purposes and functions under this compact any and all donations and grants of moneys, equipment, supplies, <span class=\"dictionary\">materials<\/span>, and services, conditional or otherwise, from any state, the United States, or any governmental unit, and may receive, utilize, and dispose of those grants and donations. <a id=\"paragraph-289243\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#e\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"f\"><p><span class=\"prefix-number\">f.<\/span> The <span class=\"dictionary\">board<\/span> may <span class=\"dictionary\">contract<\/span> with, or accept services or personnel from, any governmental or intergovernmental unit, individual, firm, or corporation, or any private nonprofit organization or institution. <a id=\"paragraph-289244\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#f\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"g\"><p><span class=\"prefix-number\">g.<\/span> The <span class=\"dictionary\">board<\/span> shall formulate all necessary procedures and develop uniform forms and documents for administering the provisions of this compact. All procedures and forms adopted pursuant to <span class=\"dictionary\">board<\/span> action shall be contained in a compact manual.\n\t\t\tARTICLE VIII\n\t\t\tEntry into Compact and Withdrawal <a id=\"paragraph-289245\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#g\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"a\"><p><span class=\"prefix-number\">a.<\/span> This compact shall become effective at such time as it is adopted in substantially similar form by two or more states. <a id=\"paragraph-289246\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#a\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"b\"><p><span class=\"prefix-number\">b.<\/span> Entry into the compact shall be made by resolution of ratification executed by the authorized officials of the applying state and submitted to the chairman of the <span class=\"dictionary\">board<\/span>. The resolution shall substantially be in the form and content as provided in the compact manual and shall include the following: <a id=\"paragraph-289247\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#b\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"b1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> A citation of the authority from which the state is empowered to become a <span class=\"dictionary\">party<\/span> to this compact; <a id=\"paragraph-289248\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#b1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"b2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> An agreement of <span class=\"dictionary\">compliance<\/span> with the terms and provisions of this compact; and <a id=\"paragraph-289249\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#b2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"b3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> An agreement that compact entry is with all states participating in the compact and with all additional states legally becoming a <span class=\"dictionary\">party<\/span> to the compact. <a id=\"paragraph-289250\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#b3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"c\"><p><span class=\"prefix-number\">c.<\/span> The effective date of entry shall be specified by the applying state, but may not be less than 60 days after notice has been given by the chairman of the <span class=\"dictionary\">Board<\/span> of Compact Administrators or by the secretariat of the <span class=\"dictionary\">board<\/span> to each <span class=\"dictionary\">participating state<\/span> that the resolution from the applying state has been received. <a id=\"paragraph-289251\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#c\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"d\"><p><span class=\"prefix-number\">d.<\/span> A <span class=\"dictionary\">participating state<\/span> may withdraw from this compact by official written notice to each <span class=\"dictionary\">participating state<\/span>, but withdrawal shall not become effective until 90 days after the notice of withdrawal is given. The notice shall be directed to the compact administrator of each member state. The withdrawal of any state does not affect the validity of this compact as to the remaining <span class=\"dictionary\">participating states<\/span>.\n\t\t\tARTICLE IX\n\t\t\tAmendments to the Compact <a id=\"paragraph-289252\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#d\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"a\"><p><span class=\"prefix-number\">a.<\/span> This Compact may be amended from time to time. Amendments shall be presented in resolution form to the chairman of the <span class=\"dictionary\">Board<\/span> of Compact Administrators and shall be initiated by one or more <span class=\"dictionary\">participating states<\/span>. <a id=\"paragraph-289253\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#a\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"b\"><p><span class=\"prefix-number\">b.<\/span> Adoption of an amendment shall require endorsement by all <span class=\"dictionary\">participating states<\/span> and shall become effective 30 days after the date of the last endorsement. <a id=\"paragraph-289254\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#b\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"c\"><p><span class=\"prefix-number\">c.<\/span> Failure of a <span class=\"dictionary\">participating state<\/span> to respond to the compact chairman within 120 days after receipt of a proposed amendment shall constitute endorsement of the proposed amendment.\n\t\t\tARTICLE X\n\t\t\tConstruction and Severability\n\t\t\tThis compact shall be liberally construed so as to effectuate the purposes stated herein. The provisions of this compact shall be severable and if any phrase, clause, sentence, or provision of this compact is declared to be contrary to the constitution of a <span class=\"dictionary\">participating state<\/span> or of the United States, or if the applicability thereof to any government, unit, individual, or circumstance is held invalid, the validity of the remainder of this compact shall not be affected thereby. If this compact is held contrary to the constitution of a <span class=\"dictionary\">participating state<\/span>, the compact shall remain in full force and effect as to the remaining states and in full force and effect as to the <span class=\"dictionary\">participating state<\/span> affected as to all severable matters.\n\t\t\tARTICLE XI\n\t\t\tTitle\n\t\t\tThis compact shall be known as the &#8220;Wildlife Violator Compact.&#8221; <a id=\"paragraph-289255\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/29.1-530.5\/#c\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nWILDLIFE VIOLATOR COMPACT (\u00a7 29.1-530.5)\n\nARTICLE I\n\t\tFindings, Declaration of Policy, and Purpose\n\na. The participating states find that:\n\n   1. Wildlife resources are managed in trust by the respective states for the\n   benefit of all residents and visitors;\n\n   2. The protection of the wildlife resources of a state is materially affected\n   by the degree of compliance with state statutes, laws, regulations, rules, and\n   ordinances relating to the management of those resources;\n\n   3. The preservation, protection, management, and restoration of wildlife\n   contributes immeasurably to the aesthetic, recreational, and economic aspects\n   of such natural resources;\n\n   4. Wildlife resources are valuable without regard to political boundaries;\n   therefore, every person should be required to comply with wildlife\n   preservation, protection, management, and restoration statutes, laws, rules,\n   regulations, and ordinances of the participating states as a condition\n   precedent to the continuance or issuance of any license to hunt, fish, trap,\n   or possess wildlife;\n\n   5. Violation of wildlife laws interferes with the management of wildlife\n   resources and may endanger the safety of persons and property;\n\n   6. The mobility of many wildlife law violators necessitates the maintenance of\n   channels of communication among the various states;\n\n   7. In most instances, a person who is cited for a wildlife violation in a\n   state other than the person&#8217;s home state:\n\ni. Is required to post collateral or a bond to secure an appearance for a trial\nat a later date;\n\n   ii. Is taken into custody until the collateral or bond is posted; or\n\n   iii. Is taken directly to court for an immediate appearance;\n\n   8. The purpose of the enforcement practices set forth in paragraph (7) of this\n   subsection is to ensure compliance with the terms of a wildlife citation by\n   the cited person who, if permitted to continue on the person&#8217;s way after\n   receiving the citation, could return to the person&#8217;s home state and\n   disregard any duty under the terms of the citation;\n\n   9. In most instances, a person receiving a wildlife citation in the\n   person&#8217;s home state is permitted to accept the citation from the officer\n   at the scene of the violation and immediately continue on the person&#8217;s\n   way after agreeing or being instructed to comply with the terms of the\n   citation;\n\n   10. The practices described in paragraph (7) of this subsection cause\n   unnecessary inconvenience and, at times, a hardship for the person who is\n   unable at the time to post collateral, furnish a bond, stand trial, or pay a\n   fine, and thus is compelled to remain in custody until some alternative\n   arrangement is made; and\n\n   11. The enforcement practices described in paragraph (7) of this subsection\n   consume an undue amount of law-enforcement time.\n\nb. It is the policy of the participating states to:\n\n   1. Promote compliance with the statutes, laws, regulations, rules, and\n   ordinances relating to management of wildlife resources in their respective\n   states;\n\n   2. Recognize a suspension of wildlife license privileges of any person whose\n   license privileges have been suspended by a participating state and treat that\n   suspension as if it had occurred in each respective state;\n\n   3. Allow a violator, except as provided in Article III, subsection (b) of this\n   compact, to accept a wildlife citation and, without delay, proceed on the\n   person&#8217;s way, regardless of the violator&#8217;s home state, if that\n   state is a party to this compact;\n\n   4. Report to the appropriate participating state, as provided in the compact\n   manual, any conviction recorded against a person whose home state was not the\n   issuing state;\n\n   5. Allow the home state to recognize and treat convictions recorded against\n   its residents, which convictions occurred in a participating state, as though\n   they had occurred in the home state;\n\n   6. Extend cooperation to its fullest extent among the participating states for\n   enforcing compliance with the terms of a wildlife citation issued in one\n   participating state to a resident of another participating state;\n\n   7. Maximize the effective use of law-enforcement personnel and information;\n   and\n\n   8. Assist court systems in the efficient disposition of wildlife violations.\n\nc. The purpose of this compact is to:\n\n   1. Provide a means through which participating states may join in a reciprocal\n   program to effectuate the policies enumerated in subsection (b) of this\n   article in a uniform and orderly manner; and\n\n   2. Provide for the fair and impartial treatment of wildlife violators\n   operating within participating states in recognition of the violator&#8217;s\n   right to due process and the sovereign status of a participating state.\n   \t\t\t\tARTICLE II\n   \t\t\t\tDefinitions\n   \t\t\t\tAs used in this compact, unless the context requires otherwise, the\n   following words have the meanings indicated:\n\na. &#8220;Citation&#8221; means any summons, complaint, summons and complaint,\nticket, penalty assessment, or other official document issued to a person by a\nwildlife officer or other law-enforcement officer for a wildlife violation that\ncontains an order requiring the person to respond.\n\nb. &#8220;Collateral&#8221; means any cash or other security deposited to secure\nan appearance for trial in connection with the issuance by a wildlife officer or\nother law-enforcement officer of a citation for a wildlife violation.\n\nc. &#8220;Compliance&#8221; with respect to a citation means the act of\nanswering a citation through an appearance in a court or tribunal, or through\nthe payment of fines, costs, and surcharges, if any.\n\nd. &#8220;Conviction&#8221; means a conviction that results in suspension or\nrevocation of a license, including any court conviction, for an offense related\nto the preservation, protection, management, or restoration of wildlife that is\nprohibited by state statute, law, regulation, rule, or ordinance. The term also\nincludes the forfeiture of any bail, bond, or other security deposited to secure\nthe appearance of a person charged with having committed the offense, the\npayment of a penalty assessment, a plea of nolo contendere, or the imposition of\na deferred or suspended sentence by the court.\n\ne. &#8220;Court&#8221; means a court of law, including magistrate&#8217;s court\nand the justice of the peace court.\n\nf. &#8220;Home state&#8221; means the state of primary residence of a person.\n\ng. &#8220;Issuing state&#8221; means the participating state that issues a\nwildlife citation to the violator.\n\nh. &#8220;License&#8221; means a license, permit, or other public document that\nconveys to the person to whom it was issued the privilege of pursuing,\npossessing, or taking any wildlife regulated by statute, law, regulation, rule,\nor ordinance of a participating state.\n\ni. &#8220;Licensing authority&#8221; means the governmental unit in each\nparticipating state that is authorized by law to issue or approve licenses or\npermits to hunt, fish, trap, or possess wildlife.\n\nj. &#8220;Participating state&#8221; means a state that enacts legislation to\nbecome a member of this Wildlife Violator Compact.\n\nk. &#8220;Personal recognizance&#8221; means an agreement by a person made at\nthe time of issuance of the wildlife citation that such person will comply with\nthe terms of the citation.\n\nl. &#8220;State&#8221; means any state, territory, or possession of the United\nStates, the District of Columbia, the Commonwealth of Puerto Rico, the provinces\nof Canada, and other countries.\n\nm. &#8220;Suspension&#8221; means any revocation, denial, or withdrawal of any\nor all license privileges, including the privilege to apply for, purchase, or\nexercise the benefits conferred by a license.\n\nn. &#8220;Terms of the citation&#8221; means the conditions and options\nexpressly stated upon the citation.\n\no. &#8220;Wildlife&#8221; means all species of animals including, but not\nlimited to, mammals, birds, fish, reptiles, amphibians, mollusks, and\ncrustaceans, that are defined as &#8220;wildlife&#8221; and are protected or\notherwise regulated by statute, law, rule, regulation, or ordinance in a\nparticipating state. Species included in the definition of\n&#8220;wildlife&#8221; vary from state to state and the determination of whether\na species is &#8220;wildlife&#8221; for the purposes of this Compact shall be\nbased on the law of the issuing state.\n\np. &#8220;Wildlife law&#8221; means a statute, law, regulation, rule, or\nordinance developed and enacted for the management of wildlife resources and the\nuses thereof.\n\nq. &#8220;Wildlife officer&#8221; means any individual authorized by a\nparticipating state to issue a citation for a wildlife violation.\n\nr. &#8220;Wildlife violation&#8221; means any cited violation of a statute, law,\nregulation, rule, or ordinance developed and enacted for the management of\nwildlife resources and the uses thereof.\n\t\t\tARTICLE III\n\t\t\tProcedures for Issuing State\n\na. When issuing a citation for a wildlife violation, a wildlife officer shall\nissue a citation to any person whose primary residence is in a participating\nstate in the same manner as though the person were a resident of the issuing\nstate and shall not require such person to post collateral to secure appearance,\nsubject to the exceptions noted in subsection (b) of this article, if the\nofficer receives the recognizance of such person that he will comply with the\nterms of the citation.\n\nb. Personal recognizance is acceptable if not prohibited by local law; by\npolicy, procedure, or regulation of the issuing agency; or by the compact manual\nand if the violator provides adequate proof of identification to the wildlife\nofficer.\n\nc. Upon conviction or failure of a person to comply with the terms of a wildlife\ncitation, the appropriate official shall report the conviction or failure to\ncomply to the licensing authority of the participating state in which the\nwildlife citation was issued. The report shall be made in accordance with\nprocedures specified by the issuing state and must contain information as\nspecified in the compact manual as minimum requirements for effective processing\nby the home state.\n\nd. Upon receiving the report of conviction or noncompliance pursuant to\nsubsection (c) of this article, the licensing authority of the issuing state\nshall transmit to the licensing authority of the home state of the violator the\ninformation in the form and content prescribed in the compact manual.\n\t\t\tARTICLE IV\n\t\t\tProcedure for Home State\n\na. Upon receipt of a report from the licensing authority of the issuing state\nreporting the failure of a violator to comply with the terms of a citation, the\nlicensing authority of the home state shall notify the violator and shall\ninitiate a suspension action in accordance with the home state&#8217;s\nsuspension procedures and shall suspend the violator&#8217;s license privileges\nuntil satisfactory evidence of compliance with the terms of the wildlife\ncitation has been furnished by the issuing state to the home state licensing\nauthority. Due process safeguards shall be accorded to the violator.\n\nb. Upon receipt of a report of conviction from the licensing authority of the\nissuing state, the licensing authority of the home state shall enter such\nconviction in its records and shall treat such conviction as though the\nconviction had occurred in the home state for the purposes of the suspension of\nlicense privileges.\n\nc. The licensing authority of the home state shall maintain a record of actions\ntaken and shall make reports to issuing states as provided in the compact\nmanual.\n\t\t\tARTICLE V\n\t\t\tReciprocal Recognition of Suspension\n\na. All participating states shall recognize the suspension of license privileges\nof a person by a participating state as though the violation resulting in the\nsuspension had occurred in their state and could have been the basis for\nsuspension of license privileges in their state.\n\nb. Each participating state shall communicate suspension information to other\nparticipating states in a form and content prescribed in the compact manual.\n\t\t\tARTICLE VI\n\t\t\tApplicability of Other Laws\n\t\t\tExcept as expressly required by provisions of this compact, nothing in this\ncompact may be construed to affect the right of a participating state to apply\nany of its laws relating to license privileges to any person or circumstance or\nto invalidate or prevent any agreement or other cooperative arrangement between\na participating state and a nonparticipating state concerning the enforcement of\nwildlife laws.\n\t\t\tARTICLE VII\n\t\t\tCompact Administrator Procedures\n\na. For the purpose of administering the provisions of this compact and to serve\nas a governing body for the resolution of all matters relating to the operation\nof this compact, a Board of Compact Administrators is established. The board\nshall be composed of one representative from each of the participating states to\nbe known as the compact administrator. The compact administrator shall be\nappointed by the head of the licensing authority of each participating state and\nshall serve and be subject to removal in accordance with the laws of the state\nhe or she represents. A compact administrator may provide for an alternate for\nthe discharge of his or her duties and the performance of his or her functions\nas a board member. An alternate is not entitled to serve unless written\nnotification of the alternate&#8217;s identity has been given to the board.\n\nb. Each member of the Board of Compact Administrators shall be entitled to one\nvote. No action of the board shall be binding unless taken at a meeting at which\na majority of the total number of the board&#8217;s votes are cast in favor\nthereof. Action by the board shall be only at a meeting at which a majority of\nthe participating states are represented.\n\nc. The board shall elect annually from its membership a chairman and vice\nchairman.\n\nd. The board shall adopt bylaws not inconsistent with the provisions of this\ncompact or the laws of a participating state for the conduct of its business and\nshall have the power to amend and rescind its bylaws.\n\ne. The board may accept for any of its purposes and functions under this compact\nany and all donations and grants of moneys, equipment, supplies, materials, and\nservices, conditional or otherwise, from any state, the United States, or any\ngovernmental unit, and may receive, utilize, and dispose of those grants and\ndonations.\n\nf. The board may contract with, or accept services or personnel from, any\ngovernmental or intergovernmental unit, individual, firm, or corporation, or any\nprivate nonprofit organization or institution.\n\ng. The board shall formulate all necessary procedures and develop uniform forms\nand documents for administering the provisions of this compact. All procedures\nand forms adopted pursuant to board action shall be contained in a compact\nmanual.\n\t\t\tARTICLE VIII\n\t\t\tEntry into Compact and Withdrawal\n\na. This compact shall become effective at such time as it is adopted in\nsubstantially similar form by two or more states.\n\nb. Entry into the compact shall be made by resolution of ratification executed\nby the authorized officials of the applying state and submitted to the chairman\nof the board. The resolution shall substantially be in the form and content as\nprovided in the compact manual and shall include the following:\n\n   1. A citation of the authority from which the state is empowered to become a\n   party to this compact;\n\n   2. An agreement of compliance with the terms and provisions of this compact;\n   and\n\n   3. An agreement that compact entry is with all states participating in the\n   compact and with all additional states legally becoming a party to the\n   compact.\n\nc. The effective date of entry shall be specified by the applying state, but may\nnot be less than 60 days after notice has been given by the chairman of the\nBoard of Compact Administrators or by the secretariat of the board to each\nparticipating state that the resolution from the applying state has been\nreceived.\n\nd. A participating state may withdraw from this compact by official written\nnotice to each participating state, but withdrawal shall not become effective\nuntil 90 days after the notice of withdrawal is given. The notice shall be\ndirected to the compact administrator of each member state. The withdrawal of\nany state does not affect the validity of this compact as to the remaining\nparticipating states.\n\t\t\tARTICLE IX\n\t\t\tAmendments to the Compact\n\na. This Compact may be amended from time to time. Amendments shall be presented\nin resolution form to the chairman of the Board of Compact Administrators and\nshall be initiated by one or more participating states.\n\nb. Adoption of an amendment shall require endorsement by all participating\nstates and shall become effective 30 days after the date of the last\nendorsement.\n\nc. Failure of a participating state to respond to the compact chairman within\n120 days after receipt of a proposed amendment shall constitute endorsement of\nthe proposed amendment.\n\t\t\tARTICLE X\n\t\t\tConstruction and Severability\n\t\t\tThis compact shall be liberally construed so as to effectuate the purposes\nstated herein. The provisions of this compact shall be severable and if any\nphrase, clause, sentence, or provision of this compact is declared to be\ncontrary to the constitution of a participating state or of the United States,\nor if the applicability thereof to any government, unit, individual, or\ncircumstance is held invalid, the validity of the remainder of this compact\nshall not be affected thereby. If this compact is held contrary to the\nconstitution of a participating state, the compact shall remain in full force\nand effect as to the remaining states and in full force and effect as to the\nparticipating state affected as to all severable matters.\n\t\t\tARTICLE XI\n\t\t\tTitle\n\t\t\tThis compact shall be known as the &#8220;Wildlife Violator Compact.&#8221;\n\nHISTORY: 2009, c. 648.","edition":{"id":1,"name":"2025","slug":"2025","date_created":"2026-06-21 22:39:22","date_modified":"2026-06-21 22:39:22","current":1,"order_by":1,"last_import":null}}
