This term is synonymous with Effective Neutralizing\nPower (ENP).\n\t\t“Fineness” means the percentage by weight of the material that\nwill pass through United States Standards sieves of specified sizes.\n\t\t“Industrial co-product used to neutralize soil acid” means a waste\nor by-product of an industrial process that contains any compound not normally\nfound in limestone that has the capacity, and whose intended purpose is, to\nneutralize soil acidity.\n\t\t“Kind” means one of the two classes of liming material.\n\t\t“Label” means any written or printed matter on, or attached to,\nthe package, or on the delivery ticket that accompanies bulk shipments, of any\nliming material.\n\t\t“Licensed” or “licensee” means the person issued a\nlicense to distribute any liming material in the Commonwealth.\n\t\t“Limestone” means a material consisting essentially of calcium\ncarbonate, or a combination of calcium carbonate and magnesium carbonate,\ncapable of neutralizing soil acidity.\n\t\t“Liming material” means any agricultural liming material and any\nindustrial co-product used to neutralize soil acid.\n\t\t“Manufacturer” means any person who manufactures, produces,\ncompounds, mixes, blends, imports or consigns liming material, or who offers for\nsale, sells, barters or otherwise supplies liming material.\n\t\t“Percent” or “percentage” means by weight.\n\t\t“Quantity statement” means the net weight (mass), net volume\n(liquid or dry), count or other form of measurement of a commodity.\n\t\t“Registrant” means the person registering any liming material\npursuant to the provisions of this chapter.\n\t\t“Standard liming ton” means a ton of agricultural liming material\nwith a calcium carbonate equivalent of 90 percent.\n\t\t“Stop sale, use, removal or seizure order” means an order that\nprohibits the distributor from selling, relocating, using, or disposing of a lot\nof liming material, or portion thereof, in any manner, until the Commissioner or\na court gives written permission to sell, relocate, use or dispose of the lot of\nliming material or portion thereof.\n\t\t“Ton” means a unit of 2,000 pounds avoirdupois weight.\n\t\t“Type” means the identification of the agricultural liming\nmaterial as follows:\n\n1. “Burnt” means any agricultural liming material with calcium and\nmagnesium compounds capable of neutralizing soil acidity, and that consists\nessentially of calcium oxide, or a combination of calcium oxide and magnesium\noxide.\n\n2. “Calcitic” means any agricultural liming material in which 85\npercent or more of the total neutralizing value, expressed as calcium carbonate\nequivalent, is derived from calcium.\n\n3. “Dolomitic” means any agricultural liming material in which 15\npercent or more of the total carbonate content is magnesium carbonate.\n\n4. “Hydrated” means any agricultural liming material, made from\nburnt lime, that consists essentially of: (i) calcium hydroxide; (ii) a\ncombination of calcium hydroxide, magnesium oxide and magnesium hydroxide; or\n(iii) a combination of calcium hydroxide, and either magnesium oxide or\nmagnesium hydroxide.\n\n5. “Marl” means a granular or loosely consolidated earthy\nagricultural liming material composed largely of calcium carbonate.\n\nHISTORY: 1994, c. 649, \u00a7 3.1-126.2:1; 2002, c. 473; 2008, c. 860.","edition":{"id":1,"name":"2025","slug":"2025","date_created":"2026-06-21 22:39:22","date_modified":"2026-06-21 22:39:22","current":1,"order_by":1,"last_import":null}}
