The hearing shall be scheduled within a reasonable time of the date of the summary suspension.D\n\nAny licensee or certificate holder whose license or certificate has been suspended shall not engage in the activity for which he has been certified or licensed pending the hearing.E\n\nThe Board shall suspend a license or certificate if a civil penalty is not paid within 60 days or a challenge is not made pursuant to subsection D of &#xA7; 3.2-3943. When deciding whether to deny, suspend, revoke, or modify any certificate or license, the Board shall give due consideration to: (i) the history of previous violations; (ii) the seriousness of the violation including any irreparable harm to the environment and any hazards to the health and safety of the public; or in selling or offering to sell pesticides; <a id=\"paragraph-281175\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/3.2-3940\/#A6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Stored or disposed of containers or pesticides by means other than those prescribed on the <span class=\"dictionary\">label<\/span> or by regulation; <a id=\"paragraph-281176\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/3.2-3940\/#A7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> Provided or made available any <span class=\"dictionary\">restricted use pesticide<\/span> to any person not <span class=\"dictionary\">certified<\/span> to apply such product; <a id=\"paragraph-281177\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/3.2-3940\/#A8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> Failed to notify the <span class=\"dictionary\">Department<\/span> of a reportable pesticide spill, accident, or incident; <a id=\"paragraph-281178\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/3.2-3940\/#A9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> Acted as a <span class=\"dictionary\">pesticide business<\/span> without first obtaining the <span class=\"dictionary\">pesticide business<\/span> license required in &#xA7; <a class=\"law\" title=\"Annual business license required\" href=\"\/3.2-3924\/\">3.2-3924<\/a>; or <a id=\"paragraph-281179\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/3.2-3940\/#A10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A11\" class=\"indent-1\"><p><span class=\"prefix-number\">11.<\/span> Failed to pay any civil <span class=\"dictionary\">penalty<\/span> assessed by the <span class=\"dictionary\">Board<\/span>. <a id=\"paragraph-281180\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/3.2-3940\/#A11\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> After opportunity for a <span class=\"dictionary\">hearing<\/span>, the <span class=\"dictionary\">Board<\/span> may deny, suspend, revoke, or modify the provision of any <span class=\"dictionary\">certificate<\/span> if it finds that the applicant or the holder of a <span class=\"dictionary\">certificate<\/span> has: <a id=\"paragraph-281181\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/3.2-3940\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Made claims through any media that intentionally misrepresent the effects on the environment likely to result from the application of a pesticide; <a id=\"paragraph-281182\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/3.2-3940\/#B1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Used or caused to be used any pesticide inconsistent with: (i) the <span class=\"dictionary\">label<\/span> registered by the U.S. Environmental Protection Agency; (ii) a Virginia state registered use; or (iii) other permissible <span class=\"dictionary\">uses<\/span>; <a id=\"paragraph-281183\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/3.2-3940\/#B2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Applied any pesticide in a negligent manner; <a id=\"paragraph-281184\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/3.2-3940\/#B3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Failed to comply with the provisions of Article 3, regulations adopted hereunder, or of any lawful <span class=\"dictionary\">order<\/span> of the <span class=\"dictionary\">Commissioner<\/span> or the <span class=\"dictionary\">Board<\/span>; <a id=\"paragraph-281185\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/3.2-3940\/#B4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Failed to: (i) keep and maintain required records or reports; or (ii) furnish or permit access to any such records or reports for copying by the <span class=\"dictionary\">Commissioner<\/span>; <a id=\"paragraph-281186\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/3.2-3940\/#B5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Made false or fraudulent records, invoices, or reports concerning the use or application of any pesticide; <a id=\"paragraph-281187\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/3.2-3940\/#B6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Used or caused to be used any <span class=\"dictionary\">pesticide classified for restricted use<\/span> unless <span class=\"dictionary\">under the direct supervision of<\/span> a <span class=\"dictionary\">certified applicator<\/span>; <a id=\"paragraph-281188\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/3.2-3940\/#B7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> Used <span class=\"dictionary\">fraud<\/span> or misrepresentation in applying for a <span class=\"dictionary\">certificate<\/span> or renewal of a <span class=\"dictionary\">certificate<\/span>; <a id=\"paragraph-281189\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/3.2-3940\/#B8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> Failed to comply with any limitations or restrictions on a <span class=\"dictionary\">certification<\/span>; <a id=\"paragraph-281190\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/3.2-3940\/#B9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> Aided, abetted, or conspired with any person to violate the provisions of Article 3; <a id=\"paragraph-281191\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/3.2-3940\/#B10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B11\" class=\"indent-1\"><p><span class=\"prefix-number\">11.<\/span> Impersonated any federal, state, or local official; <a id=\"paragraph-281192\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/3.2-3940\/#B11\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B12\" class=\"indent-1\"><p><span class=\"prefix-number\">12.<\/span> Made any statement, declaration, or representation implying that any person certified or registered under the provisions of Article 3 is recommended or endorsed by any agency of the Commonwealth; or <a id=\"paragraph-281193\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/3.2-3940\/#B12\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B13\" class=\"indent-1\"><p><span class=\"prefix-number\">13.<\/span> Been convicted or is subject to a <span class=\"dictionary\">final order<\/span> assessing a <span class=\"dictionary\">penalty<\/span> pursuant to &#xA7; 14 (a) or (b) of the Federal <span class=\"dictionary\">Insecticide<\/span>, <span class=\"dictionary\">Fungicide<\/span> and <span class=\"dictionary\">Rodenticide<\/span> Act (7 U.S.C. &#xA7; 136 et seq.). <a id=\"paragraph-281194\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/3.2-3940\/#B13\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> The <span class=\"dictionary\">Commissioner<\/span> may, without a <span class=\"dictionary\">hearing<\/span>, suspend the license of any person <span class=\"dictionary\">licensed<\/span> or certified simultaneously with the institution of proceedings for a <span class=\"dictionary\">hearing<\/span>, if he finds there is a substantial danger to the public health, safety, or the environment. The <span class=\"dictionary\">hearing<\/span> shall be scheduled within a reasonable time of the date of the summary suspension. <a id=\"paragraph-281195\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/3.2-3940\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Any <span class=\"dictionary\">licensee<\/span> or <span class=\"dictionary\">certificate<\/span> holder whose license or <span class=\"dictionary\">certificate<\/span> has been suspended shall not engage in the activity for which he has been certified or <span class=\"dictionary\">licensed<\/span> pending the <span class=\"dictionary\">hearing<\/span>. <a id=\"paragraph-281196\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/3.2-3940\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> The <span class=\"dictionary\">Board<\/span> shall suspend a license or <span class=\"dictionary\">certificate<\/span> if a civil <span class=\"dictionary\">penalty<\/span> is not paid within 60 days or a challenge is not made pursuant to subsection D of &#xA7; <a class=\"law\" title=\"Civil penalties; procedure\" href=\"\/3.2-3943\/\">3.2-3943<\/a>. When deciding whether to deny, suspend, revoke, or modify any <span class=\"dictionary\">certificate<\/span> or license, the <span class=\"dictionary\">Board<\/span> shall give due consideration to: (i) the history of previous violations; (ii) the seriousness of the violation including any irreparable harm to the environment and any hazards to the health and safety of the public; and (iii) the demonstrated good faith in attempting to achieve compliance with the chapter after notification of the violation. <a id=\"paragraph-281197\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/3.2-3940\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nADMINISTRATIVE VIOLATIONS (\u00a7 3.2-3940)\n\nA. In addition to imposing civil penalties and referring violations for criminal\nprosecution, the Board may deny, suspend, modify, or revoke a license after\nproviding an opportunity for a hearing if it finds that the applicant, licensee,\nor his employee has committed any of the following violations:\n\n   1. Made false or fraudulent claims through any media misrepresenting the\n   effect of materials or methods;\n\n   2. Made a pesticide recommendation inconsistent with the label registered\n   pursuant to this chapter, provided that such deviation may include provisions\n   set forth in Section 2 (ee) of the Federal Insecticide, Fungicide, and\n   Rodenticide Act (7 U.S.C. &#xA7; 136 et seq.);\n\n   3. Acted as a pesticide business with negligence, incompetence, or misconduct;\n\n   4. Made false or fraudulent records, invoices, or reports;\n\n   5. Failed to submit records required by the Board;\n\n   6. Used fraud, misrepresentation, or false information in an application for a\n   license or a renewal of a license; or in selling or offering to sell\n   pesticides;\n\n   7. Stored or disposed of containers or pesticides by means other than those\n   prescribed on the label or by regulation;\n\n   8. Provided or made available any restricted use pesticide to any person not\n   certified to apply such product;\n\n   9. Failed to notify the Department of a reportable pesticide spill, accident,\n   or incident;\n\n   10. Acted as a pesticide business without first obtaining the pesticide\n   business license required in &#xA7; 3.2-3924; or\n\n   11. Failed to pay any civil penalty assessed by the Board.\n\nB. After opportunity for a hearing, the Board may deny, suspend, revoke, or\nmodify the provision of any certificate if it finds that the applicant or the\nholder of a certificate has:\n\n   1. Made false or fraudulent records, invoices, or reports concerning the use\n   or application of any pesticide;\n\n   7. Used or caused to be used any pesticide classified for restricted use\n   unless under the direct supervision of a certified applicator;\n\n   8. Used fraud or misrepresentation in applying for a certificate or renewal of\n   a certificate;\n\n   9. Failed to comply with any limitations or restrictions on a certification;\n\n   10. Aided, abetted, or conspired with any person to violate the provisions of\n   Article 3;\n\n   11. Impersonated any federal, state, or local official;\n\n   12. Made any statement, declaration, or representation implying that any\n   person certified or registered under the provisions of Article 3 is\n   recommended or endorsed by any agency of the Commonwealth; or\n\n   13. Been convicted or is subject to a final order assessing a penalty pursuant\n   to &#xA7; 14 (a) or (b) of the Federal Insecticide, Fungicide and Rodenticide\n   Act (7 U.S.C. &#xA7; 136 et seq.).\n\nC. The Commissioner may, without a hearing, suspend the license of any person\nlicensed or certified simultaneously with the institution of proceedings for a\nhearing, if he finds there is a substantial danger to the public health, safety,\nor the environment. The hearing shall be scheduled within a reasonable time of\nthe date of the summary suspension.\n\nD. Any licensee or certificate holder whose license or certificate has been\nsuspended shall not engage in the activity for which he has been certified or\nlicensed pending the hearing.\n\nE.
