The caution for mercurials and similar toxic substances shall be a poison statement or symbol.C\n\nFor agricultural seeds:1\n\nThe recognized name of each kind (or kind and variety if that kind has been adopted by the Board pursuant to subdivision 6 of § 3.2-4001) of agricultural seed component in excess of five percent of the whole and the percentage by weight in order of predominance. Mixtures and agricultural seed may be sold by kind name if the seed is not for the production of an agricultural crop and the label clearly indicates “NOT FOR AGRICULTURAL PRODUCTION”;2\n\nThe word “mixture” or “mixed” shall appear conspicuously on the label if the guarantor is required to name more than one agricultural seed component;3\n\nThe lot number or other lot identification;4\n\nThe origin, if known; if not known, that fact shall be stated;5\n\nThe percentage by weight of all weed seeds;6\n\nThe name and number per ounce, pound, or metric equivalent of each kind of restricted noxious-weed seed present, subject to subdivision 1 e of § 3.2-4015;7\n\nThe percentage by weight of agricultural and vegetable seeds other than the kind or kind and variety named on the label. A.<\/span> All seed sold, offered for sale<\/span>, transported, or advertised for planting purposes and all screenings<\/span> shall bear or have attached in a conspicuous place a plainly written or printed label in the English language that provides the following information without further modification or denial in the labeling<\/span> or advertisement<\/span>. <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

B.<\/span> For treated<\/span> seed: <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

1.<\/span> A word or statement indicating that the seed has been treated<\/span>; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

2.<\/span> The commonly accepted chemical or generic name of the applied substance or treatment; and <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

3.<\/span> A caution statement such as “Do not use for food or feed or oil purposes” if any substance in the amount present is harmful to human or other vertebrate animals. The caution for mercurials and similar toxic substances shall be a poison statement or symbol. <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

C.<\/span> For agricultural seeds<\/span>: <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

1.<\/span> The recognized name of each kind<\/span> (or kind<\/span> and variety<\/span> if that kind<\/span> has been adopted by the Board<\/span> pursuant to subdivision 6 of § 3.2-4001<\/a>) of agricultural seed<\/span> component in excess of five percent of the whole and the percentage by weight in order<\/span> of predominance. Mixtures<\/span> and agricultural seed<\/span> may be sold by kind<\/span> name if the seed is not for the production of an agricultural crop and the label clearly indicates “NOT FOR AGRICULTURAL PRODUCTION”; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

2.<\/span> The word “mixture<\/span>” or “mixed” shall appear conspicuously on the label if the guarantor<\/span> is required to name more than one agricultural seed<\/span> component; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

3.<\/span> The lot<\/span> number or other lot<\/span> identification; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

4.<\/span> The origin<\/span>, if known; if not known, that fact<\/span> shall be stated; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

5.<\/span> The percentage by weight of all weed seeds<\/span>; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

12.<\/span> The code designation<\/span> of the person who transports or delivers for transportation said seed in interstate commerce and the name and address of: (i) the person who sells, labels, or offers the seed for sale<\/span>; or (ii) the person to whom the seed is sold or shipped for resale. <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

D.<\/span> For vegetable seeds<\/span> in containers of one half pound or less: <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

1.<\/span> The name of kind<\/span> and variety<\/span> of seed; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

2.<\/span> The year packeted or put up, provided that the words “packed for” shall precede the year, or the percentage of germination<\/span> and the month and year the test was completed to determine such percentage; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

3.<\/span> The quantity statement<\/span>, except as provided by appropriate regulations; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

4.<\/span> The name and address of the person who labels, sells, or offers to sell the seed; and <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

5.<\/span> For the seeds that germinate less than the standard last established by regulations:\n\t\t\t\ta. The percentage of germination<\/span>, exclusive of hard or dormant seed<\/span>;\n\t\t\t\tb. The percentage of any hard or dormant seed<\/span>;\n\t\t\t\tc. The month and year the test was completed to determine the percentages in subdivisions a and b;\n\t\t\t\td. 5.<\/span> The name and address of the person who labels, sells, or offers to sell the seed; and <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

6.<\/span> The labeling<\/span> requirements of subdivisions 1 through 5 for vegetable seeds<\/span> sold from open containers shall be deemed to have been met if the seed is weighed from a properly labeled container in the presence of the purchaser. <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

F.<\/span> Seeds or screenings<\/span> offered for sale<\/span> or distribution must be plainly labeled to indicate that such seeds or screenings<\/span> are not for planting purposes if containing more than: (i) two percent by weight weed seeds<\/span>; or (ii) prohibited noxious-weed seeds<\/span><\/span> and restricted noxious-weed seeds<\/span><\/span> in excess of the amounts prescribed by regulations. <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

G.<\/span> For seeds in preplanted containers, mats, tapes, or other planting devices: <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

1.<\/span> For flower seeds<\/span>:\n\t\t\t\ta. The name of the kind<\/span> and variety<\/span> or a statement of type and performance characteristics, as prescribed in the regulations adopted pursuant to the provisions of this article;\n\t\t\t\tb. The month and year seed was tested or the year the seed was packaged;\n\t\t\t\tc. The quantity statement<\/span>, except as provided by regulations;\n\t\t\t\td. The name and address of the person who labels, sells, or offers to sell seed; and\n\t\t\t\te. Other special labeling<\/span> requirements as determined by the Board<\/span>. <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

2.<\/span> For seeds of those kinds<\/span> with standard testing procedures that germinate less than the germination<\/span> standard established by regulations:\n\t\t\t\ta. The percentage of germination<\/span> exclusive of hard seed<\/span>; and\n\t\t\t\tb. The words “below standard” in not less than eight-point type. <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

3.<\/span> For seeds placed in a germination<\/span> medium, mat, tape, or other device making it difficult to determine the quantity of seed without removal, a statement to indicate the minimum number of seeds in the container. <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

H.<\/span> For flower seeds<\/span> in containers other than packets<\/span> prepared for use in home flower gardens or household plantings and other than preplanted containers, mats, tapes, or other planting devices: <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

1.<\/span> The name of the kind<\/span> and variety<\/span> or a statement of type and performance characteristics as prescribed in regulations; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

2.<\/span> The lot<\/span> number or other lot<\/span> identification; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

3.<\/span> The month and year that the seed was tested or the year the seed was packaged; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

15.<\/span> The total number of seed per pound; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

16.<\/span> The moisture content; and <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

17.<\/span> The name and address of the person who labels, sells, or offers to sell the seed. <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

J.<\/span> For lawn or turf seed mixtures<\/span> in prepacked containers of 100 pounds or less the information shall include: <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

1.<\/span> The recognized name of each kind<\/span> or kind<\/span> and variety<\/span> of each agricultural seed<\/span> component in excess of five percent of the whole, and the percentage by weight of each in order<\/span> of its predominance; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

2.<\/span> The registered name of the mixture<\/span>; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

3.<\/span> The lot<\/span> number or other lot<\/span> identification; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

4.<\/span> The percentage by weight of all weed seeds<\/span>; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

5.<\/span> The name and number per ounce or per pound of each kind<\/span> of restricted noxious-weed seeds<\/span><\/span> present, subject to subdivision 1 e of § 3.2-4015<\/a>; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

6.<\/span> The percentage by weight of other agricultural seeds<\/span> not claimed in the formula; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

8.<\/span> For each named agricultural seed<\/span>:\n\t\t\t\ta. The percentage of germination<\/span>, exclusive of hard seed<\/span>;\n\t\t\t\tb. The percentage of any hard seed<\/span>;\n\t\t\t\tc. The month and year the test was completed to determine the percentages in subdivisions a and b; provided that the date of the first test of the components may be given for the entire mixture<\/span>; and\n\t\t\t\td. For cool-season lawn and turf seeds<\/span><\/span> and mixtures thereof, a “sell by” statement, which may provide a date no more than 15 months from the date of the germination<\/span> test exclusive of the month of the germination<\/span> test. <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

9.<\/span> The quantity statement<\/span>; and <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

10.<\/span> The code designation<\/span> of the person who transports or delivers for transportation the seed and the name and address of: (i) the person who sells, labels, or offers to sell the seed; or (ii) the person to whom the seed is sold or shipped for resale. <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

K.<\/span> For transgenetic<\/span> seed, in addition to any other requirements, the guarantor<\/span> shall label all seed produced from transgenetic<\/span> plant material<\/span> pursuant to regulation. <\/i><\/a><\/p><\/section>","plain_text":" CODE OF VIRGINIA\n\nLABELING AND ADVERTISING REQUIREMENTS (\u00a7 3.2-4008)\n\nA. Such information may be\n designated as “other crop seed,” “other variety,” or\n as both;\n\n 8. The percentage by weight of inert matter;\n\n 9. For each named agricultural seed:\n \t\t\t\ta. For vegetable seeds in containers of one half pound or less:\n\n 1. The name of kind and variety of seed;\n\n 2. The year packeted or put up, provided that the words “packed\n for” shall precede the year, or the percentage of germination and the\n month and year the test was completed to determine such percentage;\n\n 3. The quantity statement, except as provided by appropriate regulations;\n\n 4. The name and address of the person who labels, sells, or offers to sell the\n seed; and\n\n 5.
