112 Subpart A and Subpart Q apply to such produce; and <a id=\"paragraph-199056\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/3.2-5146\/#D5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> An entity that provides a written assurance under 21 C.F.R. &#xA7; EXCLUSION;\nEXEMPTION (\u00a7 3.2-5146)\n\nA. As used in this chapter, unless the context requires a different meaning,\n&#8220;covered produce&#8221; means food that is produce within the meaning of\n21 C.F.R. Part 112 and that is a raw agricultural commodity, as defined in 21\nC.F.R &#xA7; 112.3(c), unless excluded under subsection C or exempted under\nsubsection D.\n\nB. &#8220;Covered produce&#8221; includes all of the following:\n\n   1. Fruits and vegetables such as almonds, apples, apricots, apriums,\n   artichokes-globe-type, Asian pears, avocados, babacos, bananas, Belgian\n   endive, blackberries, blueberries, boysenberries, brazil nuts, broad beans,\n   broccoli, brussels sprouts, burdock, cabbages, Chinese cabbages (bok choy,\n   mustard, and Napa), cantaloupes, carambolas, carrots, cauliflower, celeriac,\n   celery, chayote fruit, cherries (sweet), chestnuts, chicory (roots and tops),\n   citrus (such as clementine, grapefruit, lemons, limes, mandarin, oranges,\n   tangerines, tangors, and uniq fruit), cowpea beans, cress-garden, cucumbers,\n   curly endive, currants, dandelion leaves, fennel-Florence, garlic, genip,\n   gooseberries, grapes, green beans, guavas, herbs (such as basil, chives,\n   cilantro, oregano, and parsley), honeydew, huckleberries, Jerusalem\n   artichokes, kale, kiwifruit, kohlrabi, kumquats, leek, lettuce, lychees,\n   macadamia nuts, mangos, other melons (such as Canary, Crenshaw, and Persian),\n   mulberries, mushrooms, mustard greens, nectarines, onions, papayas, parsnips,\n   passion fruit, peaches, pears, peas, peas-pigeon, peppers (such as bell and\n   hot), pine nuts, pineapples, plantains, plums, plumcots, quince, radishes,\n   raspberries, rhubarb, rutabagas, scallions, shallots, snow peas, soursop,\n   spinach, sprouts (such as alfalfa and mung bean), strawberries, summer squash\n   (such as patty pan, yellow, and zucchini), sweetsop, Swiss chard, taro,\n   tomatoes, turmeric, turnips (roots and tops), walnuts, watercress,\n   watermelons, and yams; and\n\n   2. A mix of intact fruits and vegetables, such as a fruit basket.\n\nC. &#8220;Covered produce&#8221; does not include:\n\n   1. Produce that is rarely consumed raw, specifically the produce on the\n   following exhaustive list: asparagus; beans, black; beans, great Northern;\n   beans, kidney; beans, lima; beans, navy; beans, pinto; beets, garden (roots\n   and tops); beets, sugar; cashews; cherries, sour; chickpeas; cocoa beans;\n   coffee beans; collards; corn, sweet; cranberries; dates; dill (seeds and\n   weed); eggplants; figs; ginger; hazelnuts; horseradish; lentils; okra;\n   peanuts; pecans; peppermint; potatoes; pumpkins; squash, winter; sweet\n   potatoes; and water chestnuts;\n\n   2. Produce that is produced by an individual for personal consumption or\n   produced for consumption on the farm or another farm under the same\n   management; or\n\n   3. Produce that is not a raw agricultural commodity, as defined in 21 C.F.R\n   &#xA7; 112.3(c).\n\nD. Produce is eligible for exemption from the requirements of this chapter under\nthe following conditions:\n\n   1. The produce receives commercial processing that adequately reduces the\n   presence of microorganisms of public health significance;\n\n   2. The covered farm discloses in documents accompanying the produce, in\n   accordance with the practice of the trade, that the food is &#8220;not\n   processed to adequately reduce the presence of microorganisms of public health\n   significance&#8221;;\n\n   3. The covered farm complies with the requirements of 21 C.F.R. &#xA7;\n   112.2(b)(3);\n\n   4. The covered farm complies with the requirements of 21 C.F.R. &#xA7;\n   112.2(b)(4);\n\n   5. The requirements of 21 C.F.R. &#xA7; 112 Subpart A and Subpart Q apply to\n   such produce; and\n\n   6.
