All amounts paid as civil penalties for violations of this article or regulations promulgated pursuant thereto shall be paid into the state treasury and shall be deposited in the emergency medical services special fund established pursuant to &#xA7; 46.2-694, to be used only for emergency medical services purposes; and10\n\nProcedures for when emergency medical services agencies in medically underserved areas as defined by the Board may transport patients to 24-hour urgent care facilities or appropriate medical care facilities other than hospitals. emergency medical services personnel and vehicles; response times; enforcement provisions; civil penalties","Type":"Text","Format":"text\/html","Identifier":"\u00a7 32.1-111.4","Relation":"Code of Virginia"},"html":"\n\t\t\t\t\t\t<section id=\"A\"><p><span class=\"prefix-number\">A.<\/span> The <span class=\"dictionary\">Board<\/span> shall prescribe by regulation: <a id=\"paragraph-249976\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-111.4\/#A\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Requirements for recordkeeping, supplies, operating procedures, and other <span class=\"dictionary\"><span class=\"dictionary\">emergency medical services<\/span> agency<\/span> operations; <a id=\"paragraph-249977\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-111.4\/#A1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Requirements for the sanitation and maintenance of <span class=\"dictionary\"><span class=\"dictionary\">emergency medical services<\/span> vehicles<\/span> and their medical supplies and equipment; <a id=\"paragraph-249978\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-111.4\/#A2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Procedures, including the requirements for forms, to authorize qualified <span class=\"dictionary\"><span class=\"dictionary\">emergency medical services<\/span> personnel<\/span> to follow Do Not Resuscitate <span class=\"dictionary\">Orders<\/span> pursuant to &#xA7; <a class=\"law\" title=\"Durable Do Not Resuscitate Orders\" href=\"\/54.1-2987.1\/\">54.1-2987.1<\/a>; <a id=\"paragraph-249979\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-111.4\/#A3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Requirements for the composition, administration, duties, and responsibilities of the <span class=\"dictionary\">Advisory Board<\/span>; <a id=\"paragraph-249980\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-111.4\/#A4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Requirements, developed in consultation with the <span class=\"dictionary\">Advisory Board<\/span>, governing the training, certification, and recertification of <span class=\"dictionary\"><span class=\"dictionary\">emergency medical services<\/span> personnel<\/span>; <a id=\"paragraph-249981\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-111.4\/#A5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Requirements for written notification to the <span class=\"dictionary\">Advisory Board<\/span>, the <span class=\"dictionary\">Office of <span class=\"dictionary\">Emergency Medical Services<\/span><\/span>, and the Financial Assistance and Review Committee of the Board&#8217;s action, and the reasons therefor, on requests and recommendations of the <span class=\"dictionary\">Advisory Board<\/span>, the <span class=\"dictionary\">Office of <span class=\"dictionary\">Emergency Medical Services<\/span><\/span>, or the Financial Assistance and Review Committee, no later than five business days after reaching its decision, specifying whether the Board has approved, denied, or not acted on such requests and recommendations; <a id=\"paragraph-249982\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-111.4\/#A6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Authorization procedures, developed in consultation with the <span class=\"dictionary\">Advisory Board<\/span>, that allow the <span class=\"dictionary\">possession<\/span> and administration of epinephrine or a medically accepted equivalent for emergency cases of anaphylactic shock by certain levels of certified <span class=\"dictionary\"><span class=\"dictionary\">emergency medical services<\/span> personnel<\/span> as authorized by &#xA7; <a class=\"law\" title=\"Professional use by practitioners\" href=\"\/54.1-3408\/\">54.1-3408<\/a> and authorization procedures that allow the <span class=\"dictionary\">possession<\/span> and administration of oxygen with the authority of the local <span class=\"dictionary\">operational medical director<\/span> and an <span class=\"dictionary\"><span class=\"dictionary\">emergency medical services<\/span> agency<\/span> that holds a valid license issued by the <span class=\"dictionary\">Commissioner<\/span>; <a id=\"paragraph-249983\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-111.4\/#A7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> A uniform definition of &#8220;response time&#8221; and requirements, developed in consultation with the <span class=\"dictionary\">Advisory Board<\/span>, for each <span class=\"dictionary\"><span class=\"dictionary\">emergency medical services<\/span> agency<\/span> to measure response times starting from the time a call for <span class=\"dictionary\">emergency medical services<\/span> is received until the time (i) appropriate <span class=\"dictionary\"><span class=\"dictionary\">emergency medical services<\/span> personnel<\/span> are responding and (ii) appropriate <span class=\"dictionary\"><span class=\"dictionary\">emergency medical services<\/span> personnel<\/span> arrive on the scene, and requirements for <span class=\"dictionary\">emergency medical services<\/span> agencies to collect and report such data to the Director of the <span class=\"dictionary\">Office of <span class=\"dictionary\">Emergency Medical Services<\/span><\/span>, who shall compile such information and make it available to the public, upon request; <a id=\"paragraph-249984\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-111.4\/#A8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> Enforcement provisions, including, but not limited to, civil penalties that the <span class=\"dictionary\">Commissioner<\/span> may assess against any <span class=\"dictionary\"><span class=\"dictionary\">emergency medical services<\/span> agency<\/span> or other entity found to be in violation of any of the provisions of this article or any regulation promulgated under this article. All amounts paid as civil penalties for violations of this article or regulations promulgated pursuant thereto shall be paid into the state treasury and shall be deposited in the <span class=\"dictionary\">emergency medical services<\/span> special fund established pursuant to &#xA7; <a class=\"law\" title=\"(Contingent effective date) Fees for vehicles designed and used for transportation of passengers; weights used for computing fees; burden of proof\" href=\"\/46.2-694\/\">46.2-694<\/a>, to be used only for <span class=\"dictionary\">emergency medical services<\/span> purposes; and <a id=\"paragraph-249985\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-111.4\/#A9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> Procedures for when <span class=\"dictionary\">emergency medical services<\/span> agencies in medically underserved areas as defined by the Board may transport patients to 24-hour urgent care facilities or appropriate medical care facilities other than hospitals. The regulations shall include provisions for what constitutes a medically underserved area, cases appropriate for transferring a patient to a medical facility other than a hospital, and other information deemed relevant by the Board. <a id=\"paragraph-249986\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-111.4\/#A10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> The Board shall classify <span class=\"dictionary\">emergency medical services<\/span> agencies and <span class=\"dictionary\"><span class=\"dictionary\">emergency medical services<\/span> vehicles<\/span> by type of service rendered and shall specify the medical equipment, the supplies, the vehicle specifications, and the <span class=\"dictionary\"><span class=\"dictionary\">emergency medical services<\/span> personnel<\/span> required for each classification. <a id=\"paragraph-249987\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-111.4\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> In formulating its regulations, the Board shall consider the current Minimal Equipment List for Ambulances adopted by the Committee on Trauma of the American College of Surgeons. <a id=\"paragraph-249988\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-111.4\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nREGULATIONS; EMERGENCY MEDICAL SERVICES PERSONNEL AND VEHICLES; RESPONSE TIMES;\nENFORCEMENT PROVISIONS; CIVIL PENALTIES (\u00a7 32.1-111.4)\n\nA. Authorization procedures, developed in consultation with the Advisory\n   Board, that allow the possession and administration of epinephrine or a\n   medically accepted equivalent for emergency cases of anaphylactic shock by\n   certain levels of certified emergency medical services personnel as authorized\n   by &#xA7; 54.1-3408 and authorization procedures that allow the possession and\n   administration of oxygen with the authority of the local operational medical\n   director and an emergency medical services agency that holds a valid license\n   issued by the Commissioner;\n\n   8. A uniform definition of &#8220;response time&#8221; and requirements,\n   developed in consultation with the Advisory Board, for each emergency medical\n   services agency to measure response times starting from the time a call for\n   emergency medical services is received until the time (i) appropriate\n   emergency medical services personnel are responding and (ii) appropriate\n   emergency medical services personnel arrive on the scene, and requirements for\n   emergency medical services agencies to collect and report such data to the\n   Director of the Office of Emergency Medical Services, who shall compile such\n   information and make it available to the public, upon request;\n\n   9. Enforcement provisions, including, but not limited to, civil penalties that\n   the Commissioner may assess against any emergency medical services agency or\n   other entity found to be in violation of any of the provisions of this article\n   or any regulation promulgated under this article.
