means a pattern of noncompliance by a <span class=\"dictionary\">nursing home<\/span> or <span class=\"dictionary\">certified nursing facility<\/span> with one or more federal conditions of participation which indicates delivery of <span class=\"dictionary\">substandard quality of care<\/span> but does not necessarily create an <span class=\"dictionary\">immediate and serious threat<\/span> to patient health and safety.
