The cost\nof obtaining the criminal history record information shall be borne by the\nhospital.\n\t\t\tAny person applying to work in a hospital whose duties will provide access to\ncontrolled substances as defined in &#xA7; 54.1-3401 within the hospital\npharmacy, who is not licensed by the Board of Pharmacy, shall provide the hiring\nfacility with a sworn statement or affirmation disclosing any criminal\nconvictions or any pending criminal charges, whether within or without the\nCommonwealth. Any person making a materially false statement when providing such\nsworn statement or affirmation shall be guilty upon conviction of a Class 1\nmisdemeanor. Further dissemination of the information provided pursuant to this\nsection is prohibited other than to a federal or state authority or court as may\nbe required to comply with an express requirement of law for such further\ndissemination.\n\t\t\tThe provisions of this section shall be enforced by the Commissioner. If an\nindividual is denied or terminated from employment because of convictions\nappearing on his criminal history record, the hospital shall provide, upon the\nwritten request of the individual, a copy of the information obtained from the\nCentral Criminal Records Exchange to the individual.\n\nB.
